SUBJECT
Hold a joint meetmg with the Development Code Committee to discuss, determine, and give staff
direction regarding potential revisions to the process and review schedule for completion of the
Development Code Rewrite
BACKGROUND
During the June 13th work session, Council Members discussed a revised Development Code Rewrite
schedule drafted by city staff (see Attachment #1) The proposed schedule revisions were recommended
in response to a Friday, June 9th Couricll meeting with consultant John Fregonese, during which Council
members were advised that project delays were anticipated On the previous day, June 8th, a Code
Committee meeting was cancelled due to lack of a quorum
The Code Committee is a 15-member ad hoc committee, appointed by City Council, and chaired by Mr
David Neal A roster of the Code Committee is attached (Attachment #2)
The current Council-approved scope of work for the Code Rewrite indicated that the Design and
Environmental Standards would be drafted by February 2000 and ready for Council consideration for
interim adoption by March 2000 To date, Code Committee review of these standards has not yet been
completed John Fregonese is now prepared to dehver a draft of the entire development code on July 24th
Staff indicated to Council on June 13th that it doesn't make sense to adopt the Design and Environmental
Standards on an interim basis with delivery of the entire code set to take place in two months It is also
staff's understanding that the Code Committee would prefer to have the entire code for review rather than
section by section
After extensive discussion, City Council decided to hold a special called meeting with the Code
Committee to chseuss the completion of the Code Rewrite review process The discussion will review the
Code Comunttee's role m the process The desenptlon of the Code Committee as contained in the scope
of work is attached for reference purposes (see Attachment #3)
Another citation that may be helpful during the discussions on June 22nd is the following mandate found
in the Texas Local Government Code
Section 211.004 Comphance With Comprehensive Plan
(a) Zoning regulations must be adopted tn accordance with a comprehensive plan and must be
designed to
(1) lessen congestion in streets,
(2) secure safety from fire, pantc, and other dangers,

(3) promote health and the general welfare,
(4) provide adequate hght and air,
(5) prevent the overcrowdtng of land,
(6) avoid undue concentratton of populatton, or
(7) facdltate the adequate provtston of transportation, water, sewers, schools, parks,
and other pubhc requirements
A suggestion~ made dunng recent discussions was to reduce the quorum of the 15-member Committee
from eight members to six Approval of this option by City Council would be required to allow the
Committee to function with less than 8 members A draft copy of the ordinance that would enable
committee actions with a lower quorum requirement is attached (Attachment #4)
OPTIONS
Several options are available to City Council If the Code Committee needs more time to accomplish its
work, the schedule should be revised to reflect the delays that will result If the project schedule should
be maintained as proposed (as shown in Attachment #1), the Code Committee may have to meet
frequently within a short period of time, hut will finish its work more quickly Council's expectations of
the Code Committee, in terms of the format of advisory opinions (both majority and minority) and
deadline for completion should be clearly communicated The role of the Code Committee both before
and during the pubhc review process should be discussed and decided The consultant contract and
scope of work should be modified to reflect any changes decided by Council
RECOMMENDATION
The schedule' for the Development Code Rewrite project should be revised to begin public review of the
draft code soon after the July 24th consultant delivery date The role of the Code Committee should be
clarified to avoid potential mlscommtuncatlons, and a specific process for completion of committee
review of the draft code should be developed If the Code Committee can complete its review of the code
prior to release for public review within the July 24th - August 13th t~meframe, the schedule will not be
delayed Staff is willing to coordinate intensive review sessions with John Fregonese and the Code
Committee as necessary to facilitate committee completion As has been the intent since the creation of
the committee, the diversity of committee opinions will be reported to the Planning & Zoning
Commission and the City Council
Once the draft code is released for public review, the role of the Code Committee should be defined The
committee could continue to meet on its own to evaluate public review comments, or could be dissolved
Staff recommends that the committee be dissolved once the formal Planning & Zoning Commission
review process begins
ESTIMATED PROJECT SCHEDULE
The proposed project schedule is attached (Attachmem # 1)
PRIOR ACTION/REVIEW
The Code Rewrite project, and establishment of the Code Committee, began in August 1999

The consultant contract w~th Fregonese - Calthorpe Associates identified professional services to be
performed for an amount not to exceed $252,575

Revised Land Use Code

INTRODUCTION
CaW of Denton is m the process of adopting a rewsed comprehensive plan Many of the pohcies In
the plan call for re~qslons in the way land use is regulated m City of Denton In order to rmplement the
rewsed Comprehensive Plan, extensive rewsions to the current Code of the City of Denton will be
reqmred This revision wll be guided by the Denton Comprehensive Plan
Goals of the Prolect
The City of Denton Comprehensive Plan, including the Recommended Land Use Plan and
Implementation Strategy will be mstrumental m developing the new code The goals of the prolect will be
further defined bythe Consultant and the "Code Committee" as identified m Task 2
Code Committee
A CaW of De~aton Development Code Committee vnll be appointed by the C,ty of Denton CouncA
and wdl pamcapate w~th the Consultant and City staff m the development of the code They will meet
approxanately monthly to rexaew progress and adxase the City Councal and Planning & Zomng
Commimon!on the development of the code in accordance w~th the Comprehensive Plan The City of
Denton Planning and Development Department will pro,nde pnnopal staff support to the "Code
Cornn~ttee"
The Code Comrmttee will consxst of 15 members, a Committee chaarperson nominated and
selected by simple majonty of the City Councal, and two members to be selected by each Council Member
Caty Council will make every effort to make appointments that are balanced w~th respect to ctuzen,
neighborhood, busmess, and development interests The purpose of the Committee is to pro,nde
feedback forlthe Planning & Zoning Commission and City CouncA review m response to Consultant
recommendauons regarding the revtsed development code The Committee wdl attempt to work by
consensus In the event that there are unresolved issues, the vanety of opnuon wdl be presented to the
Council In the Consultant's report to the Council, any major issue wluch needed to be resolved, or wi'ach
remains unresolved, shall be clearly commumcated, mcluchng altemauves evaluated, and the Code
Committee's rauonale and recommendauon, and any mmonty reports from the Comnuttee

Department shall be responsible for scheduling and coordinating the meetings

· A pubhc design preference survey, conducted m part through the Denton City Web Site,
· Two open houses,
· A four page color newsletter of general c~rculatlon in the commumty,
· Four page newsletters for reading to interested pames,
· Attending and making presentations at adopuon hearings

Once the Code Committee Olerelnaf'cer referred to as the "Committee") has been estabhshed, the
Consultant ~ meet with the Cornnuttee and orient the Cornnmttee voth the basics of development codes,
including thelopnons available and the chfferent approaches avmlable under Texas and Umted States Law

The Codsulmnt will draft the use zones that are necessary to ~mplement the Land Use Concept

specific usaslsuch as setbacks, development standards, and landscaping reqmrements The Consultant
will review this w~th the Committee, and modify the standards as necessary The Consultant will
modify the work products as necessary
In conjtmct~on w~th the Land Use Modehng Task, there will be a comparison between ex~st~ng
and proposed zomng elass, ficat,ons, and an analys~s of the relative loss or gmn of development rights
as a result o~the change to a new zoning designation The staffreport for this task will d~st~ngmsh

Task 11. Deyelop New Zomng Map
The Consultant will develop a GIS based version of a zoning map that will maplement the new
development code, based on the newly adopted land use plan and the current zomng of parcels The
zoning map will be dehvered m Arcwew compatible format, and be parcel-specific In ad&non, the
Consultant wdl dehver 1" to 2,000' and 1' to 5,000' maps of the proposed zomng map, and an analysis of
the zoning map m area by zone, developable land by area, and development capacity by zone
In addmon, in conjunction w~th the Land Use Modehng Task, a capacity analys~s will be
conducted of the existing and proposed zomng maps, and the effects of permitted development on
development and redevelopment of land
Deliverable: GIS zoning map, parcel specific, hardcopy maps as described above, and zoning
map analysis

Task 12 Adoption Process
The Consultant will participate m two adoption heartngs, workshops, and other activmes in
support of the City Council adopnon process, and mo&fy the draft development code as necessary based
on feedback during the process

The following tasks are mduded m order to unprove the quahty of the final code, the City's understanding
of mapacts of the new code, the abthty of the pubhc to prowde meaningful input to the prolect at an
appropnate tune, and the acceptance of the new code by the pubhc and the development commumty
Communication Strate_uy and Materials
Ths opnon would develop a commumcauon strategy for reforming and revolving the general publ,c m the
Development Code project It would mclude a memo on the goals and methods of the commumcatton
strategy, as well as the following products
One general circulanon newsletter, full color, four page tabloid, pnnted on web press on newspnnt,
&stnbuted m local newspapers There will be a provision for a reply area The cost includes an estunate
of $5,000 for the printing and &str,bunon m the Denton area by a local newspaper
Four marled newsletters, 4 page, 8 ~,f' by 11", black and wbate Th~s is intended to be marled to a hst of
interested pames, stakeholders, and others to keep them reformed of progress, and prowde opportumty
for input TLs does not include the costs of reproducuon and marling
Two open houses These are informal sess, ons for input There wdl be vanous stations w~th &splays (for
example, one stauon for design standards, another for enwronmental buffers, another for land &'nslon)
Each station would be manned by one or more knowledgeable staff, Consultants, or Commattee members,
who could address questions and explam materials in a one on one session Somemne during the open
house, there would be a presentation, and various feedback tools would be employed, msunng that the
partmpants issues would be recorded and addressed
Deliverable. Commumcauon Strategy memo, one pnnted and delivered tabloid newsletter, four
marled newsletters, two open houses
Task Cost: $20,400
Preference Survey_
Tins techmque is to show tmages of vanous urban, rural, and open space scenes, and asking a large group
of participants to rate the Lrnage, posmvely or negatively Tbas has been useful m fin&ng what kinds of
urban designs are wewed positively m the local area, and which are wewed negatively In ad&non, the
effect of landscaping and open space can be iudged, by adding these elements to the same maage The
reaction to a streetscape with and w~thout street trees, for example, can then be assessed
We are subcontracting w~th LRK Design, who intends to employ an lnternet based preference survey,
which wdl be hosted on the City's web ute, and available at computer stations throughout the City at local
hbranes and City offices The options presented will allow parncapants to interact with the v~sual anages,
as well as respond to survey quesnons

ORDINANCE NO 99-254 Amended
AMEND ORDINANCE NO 99-254 WHICH AUTHORIZED THE CITY MANAGER TO ENTER
INTO A PROFESSIONAL SERVICES AGREEMENT FOR PLANNING SERVICES TO ASSIST
THE CITY WITH THE REWITE OF THE DEVELOPMENT CODE WITH FREGONESE
CALTHORPE & ASSOCIATES AND WHICH CREATES A 15 MEMBER CITY COUNCIL
APPOINTED DEVELOPMENT CODE COMMITTEE, AMEND THIS ORDINANCE TO
CHANGE THE REQUIREMENT ESTABLISHING A QUORUM FOR THE CITY OF DENTON
DEVELOPMENT CODE COMMITTEE, PROVIDING AN EFFECTIVE DATE, SAVE AND
ACCEPT AS AMENDED THAT ALL OTHER SECTIONS OF ORDINANCE NO 99-254 SHALL
REMAIN IN FULL FORCE AND EFFECT
WHEREAS, the City of Denton Code Committee is a fifteen member committee appointed
by the City of Denton City Council pursuant to the City of Denton Code of Ordinances under
DIVISION 2, QUALIFICATIONS FOR MEMBERS, including Section 2-61 to 2-65, and,
WHEREAS, the City of Denton Code Committee is required to conduct City of Denton
business under DIVISION 3, RULES AND PROCEDURES, and including Section 2-81 to 2-84,
and specifically under Section 2-83 General Rules, (a) Quorum, which requires a quorum for the
transaction of business ora board shall be a majority of the members appointed to the board, and,
WHEREAS, the City Council of the City of Denton has established that a quorum of
members will consist of SlX members of the C~ty of Denton Development Code Committee for the
transaction of all business of the City, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That he City Manager is hereby authorized to amend the Professional Services
Agreement with Fregonese Calthorpe & Associates, substantially in the form of the Agreement
attached to and made a part of Ordmanee No 99-254 previously passed and approved on the 3~ day
of August, 1999 for all purposes, for the purpose of acqmnng professional planning services to assist
the City in preparing a Development Code, and which estabhshed a City of Denton Development
Code Committee, establishing the Committees advisory purpose, and authorizing appointments to
its membership
SECTION 2 That the City of Denton Development Code Committee shall have a quorum
of its membership which will consist of six members of the Committee for the transaction of all
business of the City
SECTION 3 If any provision oftlus ordinance or the application thereof to any person or
circumstance is held lnvahd by any court, such invalidity shall not affect the validity of other
provisions, and to this end the provisions of this ordinance are severable

SECTION 4 That the Ctty Council has found and determined that the meeting at which this
ordinance is considered is open to the pubhc and that notice thereof was given in accordance w~th
provisions of the Texas open meeting law, Tex Gov't Code ch 551, as amended, and that a quorum

passage and approval

In order to usc our Ume well, I have made a summary of key msues as I see them as Chair of the
committee These concerns reflect a summary ofdlscnss~ons I have had w~th some code
committee members and staff
1) The committee wants to provide input and change, not just be a rubber stamp
Th~s msue goes d~reet to the ~nmal charge to the conumttee In my &scuss~ons w~th the
committee, members want to provide effective input to change the document where
necessary I do not think that most of us want to write all the code or do the consultant's job
Rather we want to help tune it to reflect the needs and amtudes of Denton, Texas, and the
eommumty's many stakeholders
2) Will our suggestions to the code become part of the document~
For example, the consultant has made changes m the document based on our comments It Is
our understand~ug that our recommended changes will become part of the workmg document
The committee needs assurances that these changes are part of the document In short, when
vail we as a committee sec the final document that vail be taken out to the pubhe (In order to
save trees, 1 tlm~ an electromc version available would be fine)~
3) We as a commatee are stall strugghng with what we mean by consensus or ugreement
TO a degree, tfus ~s a function of what council wants out of our comments (see pomts I & 2)
To another degree, ~t is a reflection of the w~de d~vers~ty of stakeholders that we have on the
conlm~ttee
4) A Final Note,
I have been ~mpressed with the Councd's and S~ff's wfihugness to help us Whenever
there have been impotent concerns brought to the attention of staff and the chair. (e g,
note taking, a process for minority reports, conc. va~ ~wth council), Councd and Staff
have responded well to our concerns In short, we now have a court reporter, we now
have a process for minority reports, and we even have th~s cvemug's meeting wah C~ty
Council I hope that when future concerns arise, committee members conUnue to
approach the comm~ee chmr, appropna~ stuff and their ~ouncfl representatave so we
can solve any other problems together and qmckly
