The City of Denton City Council will hold a Spemal Called Meeting on Friday, February
9, 2001 at 9 00 am ~n the Council Work Sessmn Room at C~ty Hall, 215 E McK~nney

RE Key issues, findings and recommendations
As you know, a sub-committee made up of local architects, commeraal and residential
budders, real estate professionals, bankers, and other practitioners has been meeting
regularly with the Planning Department staff s~nce last August to seek clarification and
~dentlfy major concerns We appreciate the opportunity to offer ~nput on behalf of the
~ndlwduals that will be required to Implement the new code
Please find attached a condensed hst of the key issues ~dent~fied by the sub-committee,
and recognized on .lanuary 25 by the Denton Chamber board of d~rectors as needing
further clarlficaUon or requested revisions
Although we st311 have several more Issues to address w~th the Planning staff, we do
appreciate your consideration of these Initial points, and we wdl make our resources
available to help you understand our needs and concerns

Denton Development Code
Key Issues Identified by the Chamber's Development Code Sub-Committee
1 For property tax purposes, property not presently located within the city limits,
but included in the new Land Use Plan, should be assessed according to actual
usage and not its "pre-zoned" category
2 ' The Code should provide an administrative approval process, which will hmIt the
amount of discretionary appearances before public bodies [Sub-Chapter 35 4]
3 The Development Code should allow for a clear, specific and practical variety of
design standards and construction materials, differentiating between Residential
and Commercial/Industrial uses [35 12]
4~ The appheabthty thresholds for the expansion of existing structures where a re-
plat is not required (eurrantly 1,000 square feet or 10%) are difficult to apply to
existing development and should be increased We recommend 1,000 square feet
or 25% wtuchever ~City staff has created a spreadsheet to address the
appheablhty thresho~a,r~ous property types and parking lots ) [35 12 2]
5 With regard to the expansion of existing structures, the site Design Standards
should apply only to the expansion if the expansion is less than 50% The entire
site should comply only if the expansion is greater than 50% [35 12 2]
6, The requirement to implement specific site design standards for residential lots of
10,000 square feet or less could hmIt affordable housmg [35 127B]
7 The City should not expand the site design standards that are proposed for
residential lots of 10,000 square feet or less to all residential lots
8 The requirement to exclude adjacent homes from having the same design and
floor plan is cost prohibitive The requirement should be changed to "front
elevation" and floor plan should be taken out [35 12 7 B 2 e]
9 The~nt that ten percent (10%) of gross building floor area (for braidings

necessarily essantml for health and safety preservation and management, and
should be separated from the Environmentally Sansit~ve Areas (Suggest mowng

12 A tree replacement policy should be considered instead of a tree preservation
requirement
13 Implementation of the new zomng categones across the entire City and ETJ could
result in legal, non-conforming uses for some property owners Property owners
may not be aware of the ramlfieatmns of having legal, non-conforming property

14 Evaluate the extent to which existing, non-confonmng structures will be subject
to the new code ~n the event that they are totally destroyed and replaced at the

15 Bicycle parking racks should not be requtred for eommercml and industrial

16 The Code should encourage and reward development of commercial and
industrial improvements with the intent of balancing the res~dentml to non-
res~dential property tax base ratio
