After ~letermmmg that a quorum is present and convening in an Open Meeting, the City
Council of the City of Denton, Texas will convene in a Closed Meeting on Monday,
Marcl~ 19, 2001 at 9 00 a m in the City of Denton Council Work Session Room, Denton
City Hall, at 215 East McKmney, Denton, Texas to consider specific items when these
items Ore listed below under the Closed Meeting section of this agenda When items for
conslc~i~ratlon are not listed under the Closed Meeting section of the agenda, the City
Counqll will not conduct a Closed Meeting at 9 00 a m, and will convene at the time
listed below for its regular or special called meeting The City Council reserves the right

How does the adoption of the Denton Development Code affect the pre-existing use of property?
Zomng ordinances sometimes prohibit certatn uses of property that were in existence before the zomng
regulatmns or amendments to ex~stmg regulattens arc adopted Uses estabhshed before zomng
regulations or thetr amendments apphed to a tract are called "nonconforming uses"
What ~s a Legal or Innocent Nonconforming Use?
An "innocent" nonconforming use of land or buildings ~s a use that existed legally when the
zoning regulataon became effective and has continued to exmt even though no longer comphant
with currently apphcable zomng regulations Courts will generally only protect "innocent"
nonconforming uses Nonconforming uses are not considered innocent if they are commenced
w~th knowledge that zonmg regulations will soon apply or are in the process of being enacted
When will a Nonconforming Use be abandoned?
There ~s a two-part test ~n deterrmnmg whether a property owner has abandoned a
nonconforming right The test requires an intent to abandon and an overt act or fmlure to act that
tames the ~mpheaUon of abandonment
When does a Nonconforming Use become abandoned under the Denton Development
Code?
The Development Code cont0ans a rebutable prcsumptmn of abandonment ~f a use is
discontinued for a period ofs~x months or more Since the courts have held that mere passage of
time during Much a nonconforming use ~s &scont~nued does not prove abandonment, the owner
may rebut the presumption of abandonment by prove&ne there was no intent to abandon
Discontinued means that a property or structure ~s vacant and no attempt to market the property
is observable or that the property ~s vacant and city taxes are dehnquent The code specifically
~dentffies vlolatmns that will cause the termination of the nonconforming use The Board of
AdJustment may terminate a nonconforming use or the Building Official may serve notme of the
termination of a nonconforming use
When does a Nonconforming Use terminate due to subsequent illegahty?
The Denton Development Code provides that that a violation of any ordinance shall cause thc
termination of nonconforming rights This prowsmn ts based upon the understan&ng that
nonconforming uses are by their nature g~ven a protected status Accor&ngly, their speeml
posmon In the commumty reqmres that nonconfornnng uses continue to operate lawfully
Nonconforming uses that operate unlawfully become illegal and are therefore no longer entitled
to protected status

The proposed amendments do not create a new treatment of nonconforming rights Rather, they
clanfy that it is only the violation of certain specific ordinances that will cause the loss of
nonconforrmng rights Ttns is a more conservative position that ~nsures that the ordinances
being vloll~ted are significantly related to the nonconforming use
Can Noneonforming Uses be Amortized?
The amortazataon of nonconforming uses is the process of reqmnng the owner to discontinue the
nonconforming use by allowing the owner a reasonable time to recover their investment fi.om the
use Amortization is a valid exercise of municipal police power Ntunerous cases have htagated
various issues regarchng the method of determunng the proper amortization penod but none have
found the basic process to be illegitimate
The Development Code contmns general references to the method and factors that are to be used
by the Board in determlmng the appropriate amortization period These factors help assure that
the period of t~me the nonconforming use is allowed to remain is long enough so that the income
from the use allows the owner to fully recover [ns or her capital investment

AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A CHANGE FROM
AGRICULTURAL (A) TO PLANNED DEVELOPMENT (PD) ZONING DI~TRICT
CLASSIFICATION AND USE DESIGNATION FOR 245.8 ACRES OF LAND L 2ATED
ON THE EAST SIDE OF U.S INTERSTATE HIGHWAY 35W AND NORTH AND SOUTH
OF LOOP 288; APPROVING A DEVELOPMENT PLAN FOR THE DISTRICT; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Rancho Vista Development Company has applied for a
change in zoning for 245.8 acres of land from agricultural (A) to
planned development (PD) zoning district classification and use
designation and for approval of a development plan for the dls-
tract; and
WHEREAS, on June 12, 1991, the Planning and Zoning Commission
recommended approval of the requested change in zoning and approval
of the development plan; and
WHEREAS, the City Council finds that the change in zoning and
approval of the development plan will be in compliance with the
Denton Development Plan; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
S_~. That the zoning district classification and use
designation of the 245.8 acres of land described in Exhibit A,
attached to and incorporated ~nto th~s ordinance by reference, 1s
change~ from agriculture to planned development (PD) zoning dis-
trict classification and use designation under the comprehenslve
zonlngl ordinance of the City of Denton, Texas.
~Y~. That Exhibit B, attached to and Incorporated into
this ordinance by reference, is approved as the Development Plan
for the district in accordance with article IV of Chapter 35 of the
Code of Ordinances.
