BACKGROUND th
Th~s staff report has been prepared to famhtate two Council work sessions, on November 12 and 13th,
to d~scuss outstanding pohcy ~ssues related to the Development Code At the first work session, four
of e~ght pollcy issues (determination of pubhc hemng date and legal notme, ESA Upland Habitat,
recogmt~on of selected Planned Developments, and appeals process) were resolved to allow
preparahon of the final draft of the code The remmn~ng four pohcy ~ssues are hsted below
1 ENVIRONMENTALLY SENSITIVE AREAS (ESAs)
Q. Should the ESA regulations be apphed to the ET J?
The C~ty can legally apply the ESA standards to property ~n the ETJ as they relate to water
quahty The benefits of protecting the ESAs will also accrue m the ETJ There are large
areas of ESA ~n the ETJ that may be protected ~f the regulatmns are extended (map
enclosed)
The draft can be modffied to ~nsure that the apphcatmn of the ESA m the ETJ ~s clarified
and has a sound legal basxs
2. pLANNING & ZONING COMMISSION RECOMMENDATIONS
Q: Does the Counctl want to address the outstanding Planning and Zontng Commtsston
recommendattons that are not reflected tn the draft code?
Attachment 1 ~s a rewsed summary of the tssues rinsed by the Planmng and Zoning
Comm~ssmn that have not been included into the current draft Staff has added
commentary for each issue
3 MULTI-FAMILY CONCENTRATIONS
Q Should a threshold be estabhshed tn the code thatplaces a "cap" on the number of
multt-famdy dwelhngs allowed wtthtn a stngle development project~
Q: If so, should there be a provision that allows apphcants to exceed the multt-famdy
"cap" through Planning & Zoning Commission and City Council review and
approval?
The Denton Plan calls for an overall density of 14 umts per acre as the target average for
the city The proposed mixed use zomng d~stncts all allow for densities h~gher than the
target average whale mamtalmng the overall c~ty average The code also prowdes design
standards that will change the development pattern for new apartment developments
Speeffically, the current pattern of creating ~nterconnected parkmg lots will be replaced
with connecting streets Design standards wall also place the bmldmgs up on the streets and
will allow a mixture of uses (Attachment 4)
Although variations m density are allowed m the draft code, the ~ssue has been rinsed
regarding the potential need for hmlts on concentration, or the maximum number of
dwelhng umts allowed within a single multi-family complex Staff has not found many
existing regulations that relate to this issue, most C~tles regulate apartments by forcing them
~nto single use d~stncts
Staff would propose that no additional regulations he adopted at th~s time

Q: Should the zoning map revisions made to the Downtown area remain as drafted~
Q: Should the zoning map revisions contemplated for the Ft ~Forth Drive area, but never
added to the draft zoning map, be reflected tn the final draft~
Q: How should Council resolve the issue of mdtvtdual zonmg map revision requests?
Staff attended the Ft Worth Drive neighborhood assocmt~on on Thursday, November 1st
The meeting resulted in several proposed changes to thc zonmg map (map enclosed)
Attachment 5 ~s a listing of outstanding mapping issues that are located by the two enclosed
maps
Staffwdl be prepared to discuss the map changes at the meeting
OPTIONS
City Council is not scheduled to take formal action on the draft Code D~scuss~on on the following
top~cs would enable staff to help the project move forward 1 Give direction regarding the policy issues,
2 Give dlrectmn to address any additional issues,
3 D~scuss expectations regarding the draft Code review and adoption schedule
RECOMMENDATION
Staff recommends that Council provide direction regarding the ~ssues outhned so that the final draft of
the code can be prepared Staff intends to minimize the amount of time devoted to presentations and
technical questions to allow Council Members to use the work sessions to deliberate and determine
proper pohey direction To this end, Council Members are encouraged to meet w~th staff in advance if
adtht~onal information ~s needed

To date, over 123 official meetings have been held to d~scuss the Development Code The first work
session was held on September 19, 2001
FISCAL INFORMATION
The draft Development Code ~s intended to set the regulatory framework for ~mplementat~on of the
comprehensive plan (the Denton Plan) The ~mpact of the ~tenm Residential and Nonresidential
Development Regulations has, m the op~mon of staff, retarded tax base growth for the last year,
partmularly w~th respect to nonresldentml development The draft Code ~s intended to reduce the
rezomng rewew eases heard by the Planmng & Zomng Commass~on and C~ty Counml, and will also
ehmmate almost all rote plan rewew act~wt~es conducted by the Council These object, yes should
make the development rewew process more predmtable and consistent, and should shorten the rewew
process considerably for most projects The fiscal ~mpact of the draft Code, antlmpated to regulate
development for the next 20 to 25 years, will be very s~gmficant If development proposals are
consistent w~th the Denton Plan, the impact on developers should be positive due to decreased rewew
t~me and project administration costs
The draft Code will also have positive effects on the commumty's economic health and quahty of hfe,
both of wluch are important considerations contmned ~n the Denton Plan The abd~ty to protect
enwronmentally sensitive areas, especially floodplmns, will have a very positive impact on drarnage
and water quahty costs prod by property owners The creatmn of land use zomng classfficat~ons that
are consistent to Denton Plan recommendations will allow better coordination of transportation and
ut~ht~es ~nfrastmcture systems, and other serwces, such as pohce, fire, emergency medical services,
hbranes, parks, and schools

23 low b~dder for the Lake Ray Roberts Water Treatment Plant, which is under construction, and
