January 28, 2002 at 5 00 pm m the Council Work Session Room at City Hall, 215 E McKllmey Street, Denton, Texas at which the following items will be considered 1 Receive a report, hold a discussion, and give staff direction regarding the draft Development Code, including without limitation zoning map and text changes 2 The City Council reserves the right to adjourn into a Closed Meeting on any staffdtrect~on regarding the draft Development Code BACKGROUND Tbas ts the fifth work session to dmcuss the outstanding pohey tssues related to the Development Code At the completion of the last work session held on January 15, 2002 only one outstanding issue remained, the mapping of Bell Avenue Specffically, several property owners have requested that thetr property wrath m currently zoned L~ght Industrml (LI) and Heavy Industrml (HI) be changed fi.om the proposed Downtown Commercml General (DC-G) designation (Attachment 1) Since the mcetmg, staff has held two meetings with property owners to dtseuss tbas tssue At these meetings staff was able to convey the intent and provts~ons of the Special Exception contained m the draft document The dtscuss~on centered on how tbas provts~on would allow the continuation of emstmg uses and even their expansion under certain c~rcumstances Staff beheves that the mdlwduals that attended the meetings have a better understandmg of the issues surrounding the land use designation of tbas area Further, staff heheves that those mdlwduals have a better understanding of protection the Specml Exception prov~das them However, these property owners would still prefer to have the zoning map changed to show the employment center designation for those properties currently used as such Some of the property owners will be at the meeting and have asked to speak to Council on th~ msue Finally, changing the proposed zoning of tbas area to employment center may necessitate changing the Comprehensive Plan Amending the Comprehensive Plan would mqmre a pubhc hearing hefom the Planning and Zoning Commission prior to action by the City Cotmcfl Council has prewously determined that other zoning changes that reqmre a Comprebenslve Plan amendment be held until after the adoption of the Development Code OPTIONS C~ty Councd ~s not scheduled to take formal action on the draft Code until February 5, 2002 Dlseuss~on on the following top~es would enable staffto help the project move forward 1 Gave d~rect~on regarding the Bell Avenue mapping tssue, 2 Gave &rect~on to address any ad&t~onal issues RECOMMENDATION Staff recommends that Councd provide &rect~on regarding any changes to thc draft code and map As stated, staffls aware of only the single outstanding ~ssue Staffmtends to mmumze the amount of rune devoted to presentations and techracal questions to allow Councd Members to use the work sessions to dehberate and determine proper pohcy direction To ttus end, Council Members are encouraged to meet w~th staff m advance ffadd~ttonal reformation is needed ESTIMATED PROJECT SCHEDULE Thc new regulations are scheduled to be voted on at the February $, 2002 meeting and become effective on February 20, 2002 A fcc schedule related to thc new code wdl also be on the agenda for adoption PRIOR ACTION/REVIEW To date, over 130 officml meetmgs have been held to d~scuss the Development Code FISCAL INFORMATION The dratl Development Code ~s intended to set the regulatory framework for unplementat~on of the comprehensive plan (the Denton Plan) The unpact of the Interun Resdent~al and Nonresidential Development Regulations has, m the optmon of staff, retarded tax base growth for the last year, particularly with respect to nonresidential development The dral~ Code ~s intended to reduce the rezonmg rexaew cases heard by the Planning & Zoning Cornmass~on and C~ty Councd, and wall also ehmmate almost all site plan rewew actlwtles conducted by the Council These object,yes should make the development revaew process more predictable and consistent, and should shorten the review process considerably for most projects The fiscal unpact of the draft Code, anticipated to regulate development for the next 20 to 25 years, wtll be very slgmficant If development proposals are consistent wath the Denton Plan, the unpact on developers should be positive due to decreased rewew tune and project adnumstratlon costs The draft Code wdl also have positive effects on the commumty's econonuc health and quahty of life, both of which are xmportant conslderat~ons contained m the Denton Plan The abthiy to protect environmentally sensitive areas, espeemlly floodplains, wall have a very posmve impact on drainage and water quahty costs prod by property owners The creation of land use zomng classifications that are consistent to Denton Plan recommendations will allow better coordination of transportatmn and utdlt~es infrastructure systems, and other services, such as pohce, fire,
