After detarmmmg that a quorum is present, the City Council will convene in a Special Called
Session of the City of Denton City Council on Tuesday, February 12, 2002 at 4 30 p m in the
Council Work Session Room in City Hall, 215 E McKlnney Street, Denton, Texas at which the
following item will be considered
1 Consider approval of a resolution of the City Council of the City of Denton, Texas,
authonzmg the City Manager, as Denton's authorized representative, to file a project
application with the North Central Texas Council of Governments ("NCTCOG") for a
regional solid waste program local project, authorizing the City Manager, or his designee,
to act on behalf of the City of Denton in all matters related to the application, and
pledging that if a project is received, the City of Denton will comply w~th the project
reqmrements of the NCTCOG, the Texas Natural Resource Conservation Commission
and the State of Texas, and providing an effective date
Following the completion of the Special Called Session, the Council will convene into a
Planning Session at which the following items will be considered
NOTE A Planning Work Session is used to explore matters of interest to one or more City Council
Members or the City Manager for the purpose of giving staff direction into whether or not such matters
should be placed on a future regular or special meeting of the Council for citizen input, City Council
deliberation and formal City action At a Planning Work Session, the City Council generally receives
informal and preliminary reports and information from City staff, officials, members of City commgtees,
and the individual or organization proposing council action, ~f invited by City Council or City Manager to
participate in the session Participation by individuals and members of organizations invited to speak
ceases when the Mayor announces the session is being closed to public input Although Planning Work
Sessions are pubh¢ meetings, and citizens have a legal right to attend, they are not public hearings, so
emzens are not allowed to participate in the session unless invited to do so by the Mayor Any citizen
may supply to the City Council, prior to the beginning of the session, a written report regarding the
citizen's opinion on the matter being explored Should the Council direct the matter be placed on a
regular meeting agenda, the staff will generally prepare a final report defining the proposed action, which
will be made available to all citizens prior to the regular meeting at whmh citizen input is sought The
purpose of this procedure is to allow citizens attending the regular meeting the opportunity to hear the
wews of their fellow citizens without having to attend two meetings
1 Receive a report, hold a discussion, and give staff direction regarding a multi-year
financial forecast

SUBJECT
A resolution of the City Council of the City of Denton, Texas, authorizing the City Manager, as

BACKGROUND
On September 1, 2000 the City of Denton created an Environmental Crimes Unit staffed by a
hcensed Police Officer, funded by a North Central Texas Council of Governments Illegal
Dumpmg/Lltter Abatement Program grant This program has been a success w~th over 83
citations Issued, over 6 arrests made (4 class B, 2 class A), and more than 8 arrest warrants filed
Through this program "No Littering" and "No Dumping" s~gns have been placed throughout the
city of Denton and training has been provided to pohce officers Educational materials have been
provided to the pubhc, both in English and Spanish, and The Envlronmemal Crimes Unit has
been featured m several news stories by local and regional media The Environmental Crimes
Investigator, Officer Sweet also provides valuable representation as vice-chair on the NCTCOG
Regional Solid Waste (SID) Stop Illegal Dumping Ad-Hoc subcommittee
The City of Denton Police Department is requesting authorization to file an apphcatlon for
project fuadmg The project to be funded is a Community Clean-Up and Education Program
This project will enhance the Illegal Dumping and Litter Abatement Program already in place
Funding for this project is needed for several reasons To clean-up dlegal dumpsltes where
suspects can not be determined, to clean up transient htter on city streets and storm drains, and to
offset the cost of proper disposal of materials collected at clean-up sites There is currently
inadequate funding budgeted for these tasks that must be done Funding is needed for the
educational materials and an advertising campmgn To have any long-term affect on this problem
the attitude and mmdset toward htter and illegal dumping must be changed The educational
component of this program will be geared to do that

FISCAL IMPACT
The C~ty of Denton Police Department ss requesting grant funding m the amount of $47,150 for a
Community Clean-Up and Education program This project w~ll be funded by a North Central
Texas Council of Governments grant Funds for these grants come from envtronmental fees
collected by the Texas Natural Resource Conservatmn Commtsslon (TNRCC) and d~stnbuted to
the regional Council of Governments throughout the State The commitment on the part of the
City of Denton wdl be made totally by m-k~nd contnbutmns totaling $64,631 conslmng of
personnel, office space and eqmpment There will be no need for a cash contribution from the
C~ty of Denton

A RESOLUTION OF THB CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
AUTHORIZING THE CITY MANAGER, AS DENTON'S AUTHORIZED
REPRESENTATIVE, TO FILE A PROJECT APPLICATION WITH THE NORTH CENTRAL

PROGRAM LOCAL PROJECT, AUTHORIZING THE CITY MANAGER, OR HIS
DESIGNEE, TO ACT ON BEHALF OF THE CITY OF DENTON IN ALL MATTERS
RELATED TO THE APPLICATION, AND PLEDGING THAT IF A PROJECT IS
RECEIVED, THE CITY OF DENTON WILL COMPLY WITH THE PROJECT
REQUIREMENTS OF THE NCTCOG, THE TEXAS NATURAL RESOURCE
CONSERVATION COMMISSION AND THE STATE OF TEXAS, AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the North Central Texas Council of Governments (hereinafter referred to as
NCTCOG) Is directed by the Texas Natural Resource Conservation Commission to admImster
solid waste project funds for Implementation of the Council of Government's adopted regional
solid waste management plan, and
WHEREAS, the City of Denton in the State of Texas is qualified to apply for project
funds under the Request for Projects, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES
SECTION I The City Manager, or Ins designated representative, of the City of Denton,
Texas, ~s authorized to request project funding under the NCTCOG's Request for ProJects of the
Regional Solid Waste Local Project Funding Program and act on behalf of the City of Denton ~n
all matters related to the project application and any subsequent project contract and project that
may result
SECTION 2 If the project IS funded, the City of Denton will comply with the project
reqmrements of the NCTCOG, the Texas Natural Resource Conservation Commission, and the
State of Texas
SI~CTION 3 The project funds and any project-funded equipment or faclhtleS will be
used only,for the purposes for wluch they are intended under the project
SI~CTION 4 Activities w~ll comply w~th and support the adopted regional and local
solid waste management plans adopted for the geograpincal area in winch the activiUes are
performed
SECTION 5 Tins resolution shall become effective ~mmedlately upon its passage and
approval
