CITY OF DENTON CITY COUNCIL
November 9, 2004
After determining that a quorum is presem, the City Council will convene in a Closed Session of
the City of DeNon City Council on Tuesday, November 9, 2004 at 4:00 p.m. in the City Council
Work Session Room at City Hall, 215 E. McKinney, Denton, Texas at which the following item
will be considered:
1. Closed Session:
DELIBERATIONS REGARDING CERTAIN PUBLIC POWER UTILITIES:
COMPETITIVE MATTERS - Under Texas Governmem Code §551.086.
Receive a competitive public power presentation from Gary Parsons,
General Manager of Texas Municipal Power Agency ("TMPA"); from
both City of DeNon TMPA Board Members; and/or from City Staff
pertaining to certain competitive electric issues regarding the surface
transportation of coal, coal delivery costs to TMPA and its members, the
concept of "captive shipping," the status of the appeal of the TMPA rate
case of the Surface Transportation Board, alternatives available for the
transportation of coal, and other issues related to the expense of
transportation of coal to the TMPA Plant near Carlos, Texas; and discuss,
deliberate, consider, and provide the TMPA Board Members and City
Staff with direction regarding such matters.
NOTE: The City Council reserves the right to adjourn imo a Closed Meeting on any item on its
Open Meeting agenda consistent with Chapter 551 of the Texas Government Code, as amended,
including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.
Following the completion of the Closed Session, the Council will convene in a Planning Work
Session to consider the following:
NOTE: A Planning Work Session is used to explore matters of interest to one or more City
Council Members or the City Manager for the purpose of giving staff direction imo whether or
not such matters should be placed on a future regular or special meeting of the Council for
citizen input, City Council deliberation and formal City action. At a Planning Work Session, the
City Council generally receives informal and preliminary reports and information from City
staff, officials, members of City committees, and the individual or organization proposing
council action, if invited by City Council or City Manager to participate in the session.
Participation by individuals and members of organizations invited to speak ceases when the
Mayor announces the session is being closed to public input. Although Planning Work Sessions
are public meetings, and citizens have a legal right to attend, they are not public hearings, so
citizens are not allowed to participate in the session unless invited to do so by the Mayor. Any
citizen may supply to the City Council, prior to the beginning of the session, a written report
regarding the citizen's opinion on the matter being explored. Should the Council direct the
matter be placed on a regular meeting agenda, the staff will generally prepare a final report
defining the proposed action, which will be made available to all citizens prior to the regular
meeting at which citizen input is sought. The purpose of this procedure is to allow citizens
attending the regular meeting the opportunity to hear the views of their fellow citizens without
having to attend two meetings.

SUBJECT
Receive a report, hold a discussion, and give staff direction regarding the structuring of the
proposed Capital Improvement Program and ballot.
BACKGROUND
At the July 20, 2004, Council Work Session Meeting, the City Council held a discussion
concerning a February 5, 2005, Capital Improvement Bond Election. The Council instructed
staff to proceed with the process necessary to create a special 50-member Citizens Advisory
Committee. At the August 3, 2004 Council Meeting, each Council Member was asked to
appoint seven (7) citizens to the Advisory Committee. The Committee list is attached
(Attachment A). The entire Council selected Mark Burroughs to chair the Committee. Mr.
Burroughs chose Randy Robinson as co-chair.
The Committee held its first meeting on August 30, 2004. They organized into seven groups to
begin gathering data. The groups appointed their own chairs and met with the following entities:
City Council, Planning and Zoning Commission, Chambers of Commerce, Universities and
DISD, the County Commissioners, citizens, and City staff.
After this information-gathering phase was completed, the Committee reorganized into three
project teams: Community Development, Parks and Recreation, and Transportation. Each Team
presented their teams' recommended projects to the whole Committee. After considering all of
the information, the Committee voted to recommend projects for a capital improvement bond
election for February 5, 2005.
The Committee presented their recommendation at the Joint City Council/Planning and Zoning
Commission Public Hearing on October 20, 2004. The Planning and Zoning Commission then
voted to recommend the Committee recommendation to the City Council.
The City Council discussed the recommendations and held a public hearing at the November 2,
2004 Council meeting. The Council decided to discuss the structuring of the proposed Capital
Improvement Program and ballot at the November 9, 2004 Council Work Session.

Recommendation from the City of Denton CIP Committee
We are recommending three main categories of improvements, ideally spread over five
years. In order to provide flexibility for timing and to maximize leverage of local dollars,
we are listing our top priorities in each category, and we encourage the Council to use its
best judgment over the life of the CIP.
The Committee acknowledges that based on the timing of these improvements, inflation,
and the growth of the local tax base, up to a four-cent tax rate increase may be necessary.
Still, we consider these projects absolute imperatives for the quality of life of our citizens.
