McKinney Street, Denton, Texas to consider specific items when these items are listed below under the Closed Meeting section of this agenda. The City Council reserves the right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent with Chapter 551 of the TEXAS GOVERNMENT CODE, as amended, as set forth below. 1. Closed Meeting: A. Consultation with Attorney - Under Texas Government Code Section 551.071. 1. Receive a report from the City's attorneys, hold a discussion and give staff direction regarding legal issues associated with annexation of real property in the City's northern ETJ, under annexation case no. A05-0002, along with other legal issues related to the annexation, including zoning, land use and subdivision controls, annexation plans, development agreements, annexation agreements, service plans, utility service, and legal issues implicated by alternative proposals advanced by individuals owning property within the proposed annexation area. The City Council reserves the right to convene into closed session to consult with its attorneys under Texas Government Code Section 551.071 regarding any legal issues related to this matter where a public discussion would conflict with the duty of the City's attorneys to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas or would jeopardize the City's legal position in any administrative proceedings or potential litigation. Following the completion of the Closed Session, the City Council will convene in a 2nd Tuesday Session at which the following items will be considered: NOTE: A 2nd Tuesday Session is used to explore matters of interest to one or more City Council Members or the City Manager for the purpose of giving staff direction into whether or not such City of Denton City Council Agenda October 11, 2005 Page 2 matters should be placed on a future regular or special meeting of the Council for citizen input, City Council deliberation and formal City action. At a 2nd Tuesday Session, the City Council generally receives informal and preliminary reports and information from City staff, officials, members of City committees, and the individual or organization proposing council action, if invited by City Council or City Manager to participate in the session. Participation by individuals and members of organizations invited to speak ceases when the Mayor announces the session is being closed to public input. Although 2nd Tuesday Sessions are public meetings, and citizens have a legal right to attend, they are not public hearings, so citizens are not allowed to participate in the session unless invited to do so by the Mayor. Any citizen may supply to the City Council, prior to the beginning of the session, a written report regarding the citizen's opinion on the matter being explored. Should the Council direct the matter be placed on a regular meeting agenda, the staff will generally prepare a final report defining the proposed action, which will be made available to all citizens prior to the regular meeting at which citizen input is sought. The purpose of this procedure is to allow citizens attending the regular meeting the opportunity to hear the views of their fellow citizens without having to attend two meetings. 1. BACKGROUND During the budget process, the City Manager recommended that the Council authorize a compensation study, which would be funded over two fiscal years. Phase I of the study would include the positions in Utilities, Solid Waste, Police and Fire. Phase II would include the remainder of the positions in the organization. The approved budget for FY 05/06 includes $100,000 for the General Fund portion of Phase I. Utilities and Solid Waste has also included money in their budget to fund the study. The Human Resources department will be coordinating this study and will be working closely with the chosen consultant(s) to facilitate the process. Employee compensation is an important factor when recruiting and retaining quality employees. In a service organization, compensation typically represents the largest portion of the budget, which is true in our case for the General Fund. Therefore, before drafting and submitting an RFSP, staff would like to receive City Council input regarding the compensation study. PRIOR ACTIONIREVIEW (Council, Boards, Commissions) There has been no prior action. FISCAL INFORMATION One hundred thousand dollars ($100,000) has been included in the budget for FY 05/06 to cover the cost of Police and Fire. Another $100,000 has been included in the five-year financial forecast for Phase II of the study in FY 06/07. Utilities and Solid Waste will cover the cost for their positions from their budget. , , 1 Carla Romine Director of Human Resources 2 AGENDA INFORMATION SHEET AGENDA DATE: October 11, 2005 DEPARTMENT: Police ACM: Jon Fortune It SUBJECT Receive a report, hold a discussion, and give staff direction regarding proposed ordinance revisions related to Code Enforcement and property appearance. BACKGROUND Matrix of Code Enforcement Issues In October and November 2004, staff presented a comprehensive review of the ordinances, procedures, and programs related to property appearance and Code Enforcement. Staff presented these issues in a matrix that outlined the proposed changes and identified the likely positive and negative aspects of the changes. Where applicable, staff included draft ordinances. This matrix addressed many issues that have been the subject of growing concern and interest within the community. Additionally, some of the issues, such as the enforcement process, were identified by staff as a hindrance to the efficient and effective achievement of compliance with current property appearance standards. Council subsequently approved revisions concerning grass and weeds, trash and debris, junk vehicles, graffiti abatement, administrative fees, and changes to the enforcement procedures. Citing the number of ordinance and procedural changes, Council postponed action on the remaining items on the matrix. Council did direct staff to bring back any proposed ordinances that dealt specifically with health and safety issues. In May 2005, Council adopted the proposed ordinance on stagnant water. In September 2005, Council directed staff to bring back the other items remaining on the matrix. Appendix 1 provides a color-coded matrix of the issues. Items in yellow are ready for consideration, items in gray have been completed, and items in blue need Council direction. The items needing Council direction include changes concerning garage sales (permits and signage), the creation of a mowing/litter/Right-of-way crew, and the creation of a special "livability" court. There are two draft ordinances ready for Council consideration: fence maintenance and parking regulations. The following information provides greater detail about each of these issues, including any potential negative impacts of the proposed changes. Photographs have been included where appropriate to illustrate the property condition that the proposed ordinance is designed to address. A draft copy of the two ordinances is included in the back-up packet for reference. 1 Fence Maintenance Requirements Currently, there is no ordinance requmng a property owner to maintain a fence. The only avenue of redress is to wait for the fence to fall down and then treat it as trash and debris. The proposed ordinance would require owners or occupants to maintain a fence such that it is structurally sound and has no broken, loose, damaged, removed, or missing parts. It also requires that the fence be repaired using material comparable to the original fence that is being repaired. (Section 20-171) Parking Regulations The proposed revisions to the parking regulations include three separate issues: parking on unimproved surfaces, parking of certain recreational vehicles on public streets, and the parking of cars for sale. 1. Prohibit Parking on Unimproved Surfaces Currently, there is no ordinance that prohibits vehicles from being parked on unimproved surfaces, such as front and side yards. This is a source of a number of complaints regarding the appearance of private properties. The proposed ordinance would prohibit individuals from parking vehicles on unimproved surfaces in the front yard of a residence. It would further require any vehicle parked on a side or back yard of a residence on an unimproved surface to be screened from public view by a fence or wall of at least six feet in height. Finally, the ordinance would limit individuals from improving the surface of more than fifty percent (50%) of the front yard of a residential lot. (Section 20-184) This ordinance would address many of the current complaints from neighborhoods concerning property appearance. However, one significant consequence of this ordinance will be a sharp increase in the number of vehicles parked on the street. In many neighborhoods, because of factors such as the width of the roadway and the presence of existing vehicles on the roadways, the addition of more cars will likely create traffic congestion, view obstructions, and additional parking complaints. 2. Prohibit On-Street Parking of Recreational Vehicles There is no ordinance that prohibits recreational vehicles, including RV's, travel trailers, boats and campers, from parking on the street. These vehicles are the source of complaints in residential neighborhoods. They detract from the overall appearance of a street, create traffic congestion, and obstruct the view of passing motorists. The 2 proposed ordinance would prohibit individuals from parking such recreational vehicles on public streets. It further prohibits parking vehicles in excess of eight feet six inches in width or forty feet in length in any residential district/neighborhood. (Section 20-184) Similar ordinances in several surrounding cities are currently being challenged. Specifically, the restriction of parking certain recreational vehicles on private lots has generated significant OpposItIOn. The restriction of parking these vehicles on the street has not generated as much concern. 3. Limitation of the Number of Cars for Sale There is currently no ordinance that prohibits individuals from parking used cars for sale on privately owned parking lots or open spaces. These vehicles are often parked on the property without the property owner's knowledge. Additionally, most cars for sale are parked along major thoroughfares, considered gateways to the city, and significantly detract from the appearance of those areas. The proposed ordinance would limit to one, the number of used cars that could be placed for sale on private property. While we do not believe that private property owners can be totally prohibited from parking cars for sale on their private parking lots, such activities have been limited through similar restrictions that apply to itinerant merchants; specifically that such vehicles must be parked at least one hundred feet from the edge of the right-of-way or easement. In many locations, this requirement would place the vehicle so far from the adjacent thoroughfare that it would defeat the purpose of placing the vehicle there. The ordinance does not apply to legitimate new or used car sales businesses. (Section 20-182) Staffing Analysis Currently, the Code Enforcement Unit consists of one first-line supervisor, five field officers, and one secretary. Four of the field officers are assigned to specific districts in the city. The fifth field officer is assigned to address graffiti, stagnant water, and sign complaints citywide. Appendix 2 provides a map depicting the four Code Enforcement Districts. The supervisor fills in for field officers when absent or where there are complex complaints at specific properties. These officers are currently housed in remote community offices to provide better accessibility to their assigned districts. Code Enforcement has handled 3,795 cases since January 1, 2005. Because of the way the Code Enforcement software program tracks cases, a single case number is assigned to a specific property, regardless of the number of violations that may occur on that property 3 in a given year. Therefore, the reported number of cases is far less than the number of actual violations that are addressed by the unit. The community generates the majority of the code complaints that are addressed. During inspections, the field officers target individual properties for reported violations. They also conduct inspections of other properties along the street of the original complaint to ensure equitable enforcement. Due to the number of complaints and the level of staffing, there is little time for proactive enforcement efforts. Given the current and projected growth, the staffing concerns will continue to mount. Appendix 3 provides a comparison of Code Enforcement staffing levels versus square miles for twelve metroplex cities. This information was included in the North Central Texas Council of Governments Code Enforcement Benchmarking Analysis Report released January 2005. For reference, the annual cost for adding a single Code Enforcement FTE is approximately $82,500 for the initial year. Subsequent years average $65,000 annually for salary, benefits, and equipment. Initial year costs include the purchase of a vehicle, start-up equipment, and training. Citation Resolution The Code Enforcement Unit has issued 416 citations for violations to date this year. These citations are issued after a property owner or occupant has still failed to abate the violation seven days after receiving notification. Appendix 4 shows the resolution of the citations issued by Code Officers from January through the end of September 2005. Generally, the issuance of Code Enforcement citations has been very effective in addressing the violations. Since November 2004, the Municipal Court Prosecutor has been authorized to place first-time code violators on deferred probation. This change was introduced at the same time as the new enforcement timeline, where citations are issued on all violations that are not abated within seven days of notice. Where there is a second code violation on the same property within a six-month period, the violator can be charged for the initial violation as well as the subsequent violation. The intent of the enforcement process is to gain voluntary compliance. Studies have shown that educating and gaining compliance is the most effective method for improving and maintaining property appearance standards. When voluntary compliance cannot be obtained, staff must resort to a combination of punitive measures. Court citations can be somewhat effective on local property owners. However, the issuance of citations does not necessarily equate to the abatement of the property condition. Many cases require staff to bring in a contractor to perform the necessary work. The cost for the work is charged to the property owner, and if not paid, a lien is placed on the property. The primary problem with contracting the work is the cost to the City. There is a limited amount of money budgeted for contract work. This includes clean up of trash and debris, as well as mowing properties with tall grass and weeds. When there is no money left in the contract account, Code Officers attempt to bring in volunteer groups and/or do the work themselves. This further limits the amount of time the Code Officers have to take proactive enforcement of the ordinances. 4 Property Maintenance Issues Over the past two years, in addition to those concerns addressed through the matrix of code ordinance revisions, there has been a marked increase in citizen complaints concerning property appearance. Many of these complaints can be tied to single-family residences being used as rental properties or subleased to a number of college students. Other complaints concern violations of a variety of City ordinances or where there are no existing provisions to enforce. Citizens have expressed a heightened expectation for enforcement of existing ordinances. As these citizens bring their complaints and expectations forward, staff members from a number of City departments work to find solutions. In trying to sort out the issues, City staff members have the ability to address single issues, but the larger picture typically involves several departments. In an effort to bridge the real and perceived gaps between the individual department approaches, representatives from a host of City departments have been meeting to take a comprehensive approach to these property maintenance issues. Internal Workgroup The internal workgroup includes representatives from Code Enforcement, Police, Building Inspections, Planning, Parks, Community Development, Keep Denton Beautiful, Solid Waste, Legal, Utilities Customer Service, and Public Information. This group began by trying to identify the most pressing issues and researching some potential solutions. The primary concern identified by this workgroup was the need to bring about a "cultural change" in the appearance of properties throughout the city. While many of the citizen complaints target rental-type properties, the workgroup found that the issues include rental and owner-occupied properties. In order to bring about this "cultural change," the group discussed several potential programs. 1. External Property Survey Several cities in the DFW Metroplex are utilizing a property condition survey as a means to establish a global analysis of their cities in terms of code compliance and general property condition. These surveys are performed by trained City employees who visually inspect the external conditions of individual properties and grade them using a structured score sheet. The grade sheets can be tailored to target any number of code ordinance violations, depending on the individual community expectations. The scores of the individual properties are used to color- code a GIS-based map of the city. This results in a visual representation of the property conditions of the city. Using this map, the City can develop prevention, intervention, and resolution strategies. These strategies can target the city as a whole, or they can be focused for a "blitz" approach in problematic neighborhoods. The surveys also serve to establish a benchmark for the City to use as a comparative model to assess the effectiveness of these strategies in subsequent years. 2. International Property Maintenance Code One of the concerns identified by the workgroup is the lack of a centralized grouping of property maintenance codes. Many of the applicable codes are spread out in several chapters of the Code of Ordinances, while others are found in the 5 Denton Development Code. The International Property Maintenance Code (IPMC) provides a single, amendable compilation of applicable building and property maintenance codes. It is intended to provide a modern, up-to-date property maintenance code using code regulations that contain clear and specific property maintenance requirements. The code is founded on principles intended to establish provisions consistent with the scope of a property maintenance code that adequately protects public health, safety, and welfare; provisions that do not unnecessarily increase construction costs; provisions that do not restrict the use of new materials, productions or methods of construction; and provisions that do not give preferential treatment to particular types or classes of materials, products or methods of construction. The IPMC provides citizens, builders, and developers with a single location to research building and property maintenance requirements. Because the IPMC is amendable, the City has the ability to establish requirements specific to community standards. Further, because the IPMC is a nationally published document, it is kept up to date through a review process that includes code officials, industry representatives, design professionals, and other parties. 3. Rental Property Inspections Rental property inspections are a somewhat controversial concept. The intent is to provide some protection for renters and ensure that the properties they are renting meet applicable building and fire codes. These inspections can either be mandatory or voluntary. Both types bring with them a unique set of concerns for the City. Mandatory inspections of rental properties ensure that all rental properties meet City codes intended to protect the renter and the general public. These inspections can be tied to a change in occupants or based on specific timeframes. There are some communities that have enacted legislation requiring mandatory inspections. In checking on these programs, many of them appear to be run differently from the written enabling legislation. Mandatory inspections demand a number of City resources. Maintaining sufficient staffing levels to provide timely inspections is paramount. Currently, each building inspector averages 4,500 building inspections a year. A mandatory inspection program could add up to 18,000 inspections each year. Without an adequate number of inspectors, there will be a negative impact on both the renters and the property owners. Depending on whether or not the inspections are based on timeframes or on occupant changes, there may be additional problems with determining the need for inspections and gaining the necessary access to the property. A voluntary inspection program would appear to mitigate some of the problems created by mandatory inspections. Because they are requested by the owner/occupant, there are few concerns with property access or meeting timelines. However, the issue of providing a sufficient level of inspectors remains a significant concern. Even if these inspections were voluntary, the City does not have sufficient staff to adequately service the potential number of inspections. 6 The major issue with installing a voluntary inspection program, outside of the staffing issue, is making the inspection worthwhile to the property owner. Maintaining or improving property to meet existing City requirements can require a significant financial investment. The inspection is voluntary, however any violations of City ordinance found during the inspection would require the owner to bring them into compliance. While there are a number of rental properties that meet or even exceed City standards, there remain many rental properties that are below current standards. As it stands, property owners have little incentive to incur the added costs. Provided they are locating tenants for their properties, they have no real need to make improvements. Only when there is a competition for tenants will there be a reason for all property owners to improve the condition of their rental properties. Because of this, it is necessary to entice the property owner to invite City inspectors on to the property. To accomplish this, the City would need to provide a tangible benefit to the participating property owner. The workgroup is researching some form of City-sponsored rental property certification program. Rental property owners would be able to apply for this certification, which would require the property to pass a voluntary City inspection and could possibly include additional property requirements/amenities. The properties would be able to use this certification as a useful marketing tool to attract potential tenants. Determining and attaching an additional valuable incentive(s) for participating property owners is paramount to creating an effective voluntary inspection program. 4. Centralized Hotline Currently, there is no centralized location for a citizen with a complaint or a renter with questions about existing building codes to contact for answers. Because of the organizational structure in the City, there are a number of departments that handle specific portions of the applicable codes. One solution to clarifying the issue for the citizens and helping to coordinate a comprehensive city approach is to create a centralized hotline for complaints. Staff is still researching the ability to accomplish this, but the general concept appears to offer some positive help. External Citizen Task Force In order to accomplish the desired "cultural change" in property appearance, the internal workgroup determined that there was a need to include input from the community. Many of the proposed changes have the potential for a negative impact on any number of stakeholders. Any change to existing codes can create confusion (and potential frustration) for everyone. Because of the potential for significant conflicts of interest between stakeholders, the workgroup did not believe the external community group should be involved in the specific development of the strategies. However, the workgroup did believe that a community task force would be essential to developing a marketing strategy designed to explain the concepts to the groups they represent. This marketing strategy should be designed to relieve potential fears among those affected by the changes. Finally, the task force should be able to offer insight into potential conflicts of the changes. Representatives on the task force should be drawn from those community groups most likely to be impacted by these changes. Further, they should be able to help 7 facilitate this "cultural change." While the selection process for determining the individual representatives is best determined by Council, the workgroup felt that it should include representatives from the following groups: Property Management Companies, Rental Property Association, Denton Apartment Association, NAACP, LULAC, University of North Texas, Texas Woman's University, REACH, Chamber of Commerce, Realtor's Association, Denton Housing Authority. OPTIONS Ordinance Revisions 1. Council can direct staff to bring the proposed ordinances back for approval. 2. Council can direct staff to conduct further research and bring back amended ordinances for approval. Property Maintenance Issues 1. Council can direct staff to continue with research on any or all of the proposed programs. 2. Council can direct staff to not pursue the identified programs and look for other potential solutions. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. Article V titled "Fences" of Chapter 20 of the Code of Ordinances of the City of Denton is hereby created and it shall read as follows: ARTICLE IV. FENCES Sec. 20-171. Definitions. Designee means the city manager or his duly appointed representative. Owner means any person or entity shown as the property owner on the latest property tax assessment rolls or any person having or claiming to have any legal or equitable interest in the property, including any agent who is responsible for managing, leasing or operating the property and including any tenant. Sec. 20-171. Maintenance of fences. (a) The owner of any property shall replace broken, damaged, removed or missing parts of a fence within ten (10) days of, the day the owner received notice from the designee, with the same material, or material with comparable composition, color, size, shape and quality of the original fence to which the repair is being made. The designee may, upon written notice from the owner that unusual circumstances prevent the timely repair of a fence, extend the replacement time as required. The designee shall not extend the replacement time longer than reasonable necessary. The owner requesting a replacement time extension shall provide the designee a written scope and schedule detailing materials and estimated time period of the completed replacement for approval. No person shall use materials not specifically manufactured as fencing materials such as plywood, corrugated steel panels, or fiberglass panels as fencing materials. (b) An owner shall maintain all fences in sound structural condition. (c) All owners shall maintain fences, including those existing prior to the adoption of this chapter, at all times in a state of good repair, safe and secure condition with all braces, bolts, nails, supporting frame and fastenings free from deterioration, termite infestation, rot, rust or loosening, and able to withstand at all times the wind pressure for which they were designed. Sec. 20-172. Abatement and notice procedures. The abatement and notice procedures provided for in Sections 20-131 through 20-134 shall apply to violations of this section and this article. Sec. 20-173. Proof requirements. Neither allegation nor evidence of a culpable mental state is required for the proof of an offense defined by this article. SECTION 2. If any section, subsection, paragraph, sentence, clause, phrase, or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not effect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas here by declares it would have enacted such remaining portions despite any invalidity. SECTION 3. Save and except as amended hereby, all the proVISIOns, sections, subsections paragraphs, sentences, clauses, and phrases of the Code of Ordinances shall remain in full force and effect. No person shall park a vehicle upon any street in the city for the purpose of: (1) Displaying such vehicle for sale; (2) Washing, greasing or repairing such vehicle, except repairs necessitated by an emergency; (3) Advertising or soliciting business; or (4) Selling merchandise from such vehicle. Sec. 20-182 Vehicles for Sale. (a) No person may have or allow more than one used vehicle for sale on private property. (b) No vehicle for sale may be on any right-of-way or easement nor may any vehicle for sale be within 100 feet of the right-of-way or easement. (c) Subsection (b) shall not apply if the vehicle for sale is parked on the improved portion of the residential property. (d) This section shall not apply to any new or used car dealerships provided that the car dealership is in compliance with all state laws and city ordinances. Sec. 20-183. Parking not to obstruct traffic. (a) No person shall park any vehicle upon a street, other than an alley, in such a manner or under such conditions as to leave available less than ten (10) feet of the width of the roadway free for the movement of vehicular traffic. Sec. 20-184. Parking nuisances. (a) Parking regulations. It is a nuisance and shall be deemed illegal for any person to park in violation of the following provisions: (1) It shall be unlawful for a person to park or store or allow another to park or store any vehicle in excess of eight feet six inches in width or 40 feet in length, including recreational vehicles, travel trailers, boats or boat trailers, in any residential zoned district. (2) It shall be unlawful for a person to park or store or allow another to park or store a recreational vehicle, travel trailer, boat or boat trailer on a public thoroughfare in any residential zoned district. (3) It shall be unlawful for a person to park or store or allow another to park or store a vehicle in the front yard of any property, upon any surface other than an improved surface. (4) It shall be unlawful for any person to park or store or allow another to park or store a vehicle in the side yard or in the rear yard of any lot, upon any surface other than an improved surface unless such vehicle is concealed from view from all points along public street and alleys by a solid, opaque fence or wall providing full screening from the ground to a minimum height of six feet; or (5) It shall be unlawful for any owner of a residential lot to allow a driveway, improved parking surface or combination of the two to cover more than 50 percent of the front yard of the lot. (6) It shall be unlawful for any person to park or store or allow another park or store a vehicle on any unimproved lot, easement, or right-of-way. (7) It shall be unlawful to use a vehicle for living or sleeping quarters, or for the storage of trash, debris or personal property not normally associated with the vehicle. (b) Maintenance of improved parking surface. It shall be unlawful for any person to fail to maintain all improved parking surfaces in good and safe condition, and free of any defects affecting the use, safety, appearance or drainage of the surface or of the adjoining property. SECTION 2. BACKGROUND The City of Denton Fire Department realizes the importance of ensuring that the make-up of its members reflects the community it serves. The Fire Department values the benefits that a diverse workforce provides to the City's overall organization and especially to the community. This work session will allow the City Council to participate in a discussion on where the Fire Department has been, where it is today and where Staff recommends going in the future. Unfortunately, the Denton Fire Department has not garnered the results in diversity Staff would like. The City of Denton markets itself as an equal opportunity employer and the Fire Department along with the Human Resources Department have worked very hard in that end to recruit all classes of applicants, yet the Fire Department does not yet reflect the racial makeup of citizens of Denton. Therefore, Staff will recommend proceeding in a different direction than the one we have traveled over the past several years. Although our intentions have been good and our efforts extensive, our success has not achieved our goals! Following are various pieces of background information to give Council a good foundation for the discussion on hiring and recruitment in the Fire Department. Denton Fire Department Strate2ic Plan Goal 2-3 The Denton Fire Department should continue its aggressive recruitment program working closely with the City's Human Resource Department. Strategy 2-3-A: Strategy 2-3-B: Develop a new Denton Fire Department recruitment video. Develop an updated Denton Fire Department informational brochure to be used for marketing and recruitment in accordance with Diversity Task Force's Marketing Plan. Page 1 of 17 Denton Fire Department Strate2ic Plan Goal 2-4 The Denton Fire Department should make every effort to attract and hire protected classes. It should work closely with the City's Workforce Diversity Task Force for assistance and guidance. Strategy 2-4-A: Strategy 2-4-B: Continue and expand the Fire Explorer Program. Continue to pursue non-civil service job assignments in the Fire Department in support services. Make every effort to talk to local community groups to encourage minority participation in the Fire Recruit tests. Strategy 2-4-C: Fire Recruit Job Description The Fire Recruit will be appointed through competitive Civil Service examination as required by Chapter 143 of the Local Government Code. The fundamental reason this classification exists is to protect life and property through firefighting and EMS activities often performed under conditions that require strenuous physical exertion. This is an entry-level firefighting trainee position and is under the close supervision of a Fire Captain. Upon successful completion of probation, the Fire Recruit moves into a civil service Firefighter position. Texas Local Government Code, Chapter 143 Overview The City of Denton became a Civil Service City on August 10, 1948 under what eventually became Chapter 143 of the Texas Government Code. To be classified as a Civil Service city, the city's population must be 10,000 or more, the city must have a paid fire and police department, and the citizens must have voted to adopt Chapter 143 of the Texas Local Government Code or the laws codified by the Chapter. The purpose of Chapter 143 is "to secure efficient fire and police departments composed of capable personnel who are free from political influence and who have permanent employment tenure as public servants." To help ensure this, Chapter 143 outlines the procedures associated with the following: · classification and appointments including, but not limited to, eligibility requirements, examination notices and procedures for filling positions, · compensation, · disciplinary actions, · leaves, and · miscellaneous provisions including, but not limited to, personnel files, strike prohibition, determination of physical and mental fitness, efficiency reports, etc. Civil Service Commission A three-member Civil Service Commission is appointed by the Chief Executive Officer (City Manager) to oversee and ensure compliance with this chapter. The governing body (City Council) confirms the Chief Executive Officer's appointment. As outlined by Chapter 143, to be eligible to serve on the Commission, a member must: Page 2 of 17 · be of good moral character; · be a United States citizen; · be a resident of Denton, Texas, and must have resided in Denton for more than three years; · be over 25 years of age; and · not have held public office within the preceding three years. Commission members are appointed to serve staggered, three-year terms, with the term of one commissioner expiring each year. The City of Denton strives to ensure the Commission best reflects the demographics of the community and has been successful in this goal over the past several years. Commission meetings typically are held the third Thursday of each month. Civil Service Director Chapter 143 also includes a provision for a Civil Service Director. Section 143.012(a) states, "upon adoption of this chapter, the office of Director of Fire Fighters' and Police Officers' Civil Service is established in the municipality. The Commission shall appoint the director. The director shall serve as secretary to the Commission and perform work incidental to the civil service system as required by the Commission...". The Director of Human Resources has traditionally served and currently serves as the Civil Service Director for the City of Denton. Entry- Level Positions Under Chapter 143, applicants for the Fire and Police Departments can only be hired from the eligibility list produced from a competitive written examination. Since Chapter 143 specifies that an entrance examination must be given, in order to be in compliance, the City of Denton has elected to use an outside agency to develop the written examinations for Fire and Police entry-level positions. 143.025. Entrance Examinations (a) The commission shall provide for open, competitive, and free entrance examinations to provide eligibility lists for beginning positions in the Fire and Police Departments. The examinations are open to each person who makes a proper application and meets the requirements prescribed by this chapter. (b) An eligibility list for a beginning position III the Fire or Police Department may be created only as a result of a competitive examination held in the presence of each applicant for the position. . . Pursuant to section 143.025(i), "...each applicant's grade on the written examination is based on a maximum grade of 1 00 percent and is determined entirely by the correctness of the applicant's answers to the questions. The minimum passing grade on the examination is 70 percent. An applicant must pass the examination to be placed on an eligibility list." Page 3 of 17 Examination Notice Section 143.024(a) states, "before the 10th day before the date an entrance examination is held, the Commission shall cause a notice of the examination to be posted in plain view on a bulletin board located in the main lobby of the city hall and in the Commission's office. The notice must show the position to be filled or for which the examination is to be held, and the date, time, and place of the examination." The City of Denton makes every effort to ensure this notice is posted at least 30-60 days before the exam date. The notice is posted at the main City Hall and City Hall East. The Commission does not have an office, but the Civil Service Director who supports the Commission is located in City Hall East. Additionally, the "notice of examination" is posted in the lobby of the Police Department and at the fire stations. Notifications of examinations are also posted on the City's website and newspapers along with fliers that are distributed through fire academies and military bases. Civil Service Testin2 and Hirin2 Process The Human Resources Department has used approximately three different tests for Fire entry-level examinations over the last fourteen years. The Wollack and Associates' examination has been used for Fire Recruit exams since 1988. In 1997, however, the Fire Department switched to a different examination offered by W ollack that included a study guide for test candidates. It was the intent of the City to provide the study guide as a tool to enhance the test taking skills of the candidates by providing sample questions and preparing them for the examination format. The City purchased the Wollack "Alpha" test in 2003 to use in its Fire Recruit entrance examinations. Based on validity and certification studies, this examination has reportedly met with success in the testing and the hiring of protected classes. On the day of the test, all applicants must display valid picture identification at check-in at the testing site. Failure to display valid picture identification disqualifies the applicant from testing. All applicants must be on time. Failure to check-in prior to the posted start time will disqualify the applicant from testing. The Civil Service exam is scored on-site immediately after completion by a candidate and the list of raw scores posted within 24- hours. The Fire Department, with assistance from the Human Resources Department establishes an eligibility list that is presented to the Civil Service Commission for approval at the next scheduled Civil Service Commission meeting. In the event that candidates are tied with identical scores, the Fire Department currently uses the following tiebreakers (which can be changed in the Local Rules to reflect the desires of the community) to determine the final rank of applicants on the certified list: 1. Firefighter certification 2. Paramedic certification 3. EMT certification 4. Highest raw score 5. Bachelor's degree 6. Associates degree Page 4 of 17 7. Bilingual 8. Earliest registration date Taking the Civil Service test is just the first step in the hiring process. These steps follow the entrance examination for candidates scoring high enough to continue in the process: background check; oral review board; psychological evaluation; a polygraph examination (if necessary); physical ability examination; criminal and driving history checks; a complete doctor's physical; a Chief s interview; and, finally a conditional job offer by the City of Denton. The number of applicants that sign up for the exam is often deceiving. A large number never have a chance to be employed because they will not meet the minimum requirements of our hiring standards and will not make it through the entire process without being disqualified. In the past several years, the Fire Department goes through approximately eight (8) candidates to hire one (1) new employee. The biggest eliminator is the background check that reveals things in the candidates' past that disqualifies them. The disqualifiers are made known prior to the test and are clearly listed in the Department's hiring criteria; however, many candidates who score high enough to continue in the process are eliminated later. DENTON FIRE DEPARTMENT RECRUITING/HIRING HISTORY The Fire Department has tried many strategies to include greater numbers of minority applicants without success in hiring an adequate number. The Fire Department uses every opportunity to recruit individuals. Programs such as the Citizen's Fire Academy, the FireCATS and the Fire Explorer Youth Program provide individuals with knowledge about the overall operation of the departments. Though participants may not be interested in employment with the Department, they may have friends or relatives who they could refer for employment. The Fire Department still attends all career fairs that cover all of our objectives as far as target groups, which includes African Americans, Hispanics, females, and certified firefighters and paramedics. The Department attempts to attend at least two career fairs that promote each group as the budget allows. Recruiters attend the EMS Conference in San Antonio each year as well as at least two military job fairs. In addition, it always attends local career fairs that become available. Over the years many recruiting attempts have been aimed specifically at diversifying the Fire Department as indicated by Table 1. The Fire Fighters Association won the suit and the two candidates who were not certified were hired. Page 6 of 17 Between 1995 and 1996, the City only tested certified or certifiable firefighters for the position of recruit firefighters. This testing philosophy met the City's immediate need to place firefighters on fire engines in the fire stations as quickly as possible. Hiring only certified/certifiable firefighters reduced the time to have qualified firefighters on duty, which ultimately saved the City substantial money and expedited the reopening of a needed fire station (Central Fire Station in April of 1996). Three tests were administered and averaged only 47 applicants per test with less than 5% representation of protected classes. Based on a report prepared by the Human Resources Department, prior to the certified/certifiable rule, the City averaged 162 applicants per test with an average of24% of the participants being protected classes. In 1997, based on the recommendation of the Fire Chief, the City Council and Civil Service Commission changed the eligibility requirements for Recruit Firefighter to 18 years old and a high school graduate. The recommendation was made based on the fact that, in a civil service system, the first step to getting protected class individuals hired is to assure a strong representation at the test. The City determined that hiring non-certified candidates would attract more protected class applicants in ratios mirroring the community. While the number of minority test takers increased, unfortunately, no minority candidate scored high enough to receive a job offer. As part of the 1998 City budget, the Fire Chief proposed a Non-Emergency Ambulance Transport Program, which recommended using civilian positions. This non-Civil Service program was a strategy to diversify the sworn workforce with the increase in civilian staffing of non-emergency positions. Recruiting qualified, protected class individuals to fill these positions would have provided them more exposure to the Civil Service positions in the Fire Department. The Police Department's Jailer program was used as an example of the success possible in bringing in civilians in support positions and then actively recruiting them to take Civil Service tests. After considerable debate, the City Council did not approve the program. In 1999, the Denton Fire Department mapped out a comprehensive strategy for improving the recruitment of protected class individuals for the Recruit Firefighter examination. Staff identified this year's entrance test as a great opportunity to hire protected classes due to the fact that many new positions would be filled with this list (28 new employees actually ended up being hired off this list). It was decided to have examinations in Denton and Marshall, Texas that would be given at the same exact time in accordance with State Civil Service laws. The place for the examination in Marshall was Wiley College, a historical African American college. The college agreed to facilitate the exam at their facility. A recruiter from the Fire Department was on the Wiley College campus in October and December 1998 organizing the test. A recruiter also spent two days on the campuses at TWU and Wiley College just to hand out brochures; speak with young Page 7 of 17 people about becoming a firefighter; obtain information from potential candidates so Human Resources could mail applications and study guides to them for the examination; and, give out information concerning the number of career opportunities, salaries, work schedules and benefits of being an employee of the City of Denton. Recruiting efforts also included trips to the Corpus Christi, Kingsville Campus of Texas A & AM. The Texas A & M at Commerce was visited along with Prairie View A & M, Southeastern Oklahoma at Durant, Oklahoma, and Southern Arkansas in Magnolia, Arkansas. Recruiters also went to the Texas EMS conference in Austin, SACUP A (San Antonio area recruiting event), and other local area recruiting seminars. The University of North Texas campus diversity group gave the Fire Department a list of predominantly African American schools that included Texas College in Tyler, Jarvis Christian College in Hawkins, Grambling in Ruston, Louisiana, and Southern University in Shreveport, Louisiana. Fire Department staff recruited at all these institutions. The results of all these efforts were not rewarded at the test site in Marshall as only 53 people showed up to take the test. The number of African Americans that responded was 37. In a sense, the recruiting effort was successful because 581 people were present at the exam in Denton. In Marshall, no African American applicant made above a score of 89 and, therefore, had no impact on the list. In October 1999, sixteen people were hired off the list. In February 2000, still using the February 1999 list, twelve more candidates from this large list were hired, including one female. All 28 candidates who were successful in being hired scored a 93 or higher. One Caucasian applicant from the Marshall list was hired. Because Fire staff had not been satisfied with the results of the intensive and extensive efforts to hire protected class individuals, in 2001 the Fire Chief requested that the City Council approve a Fire Department Diversity Task Force to review the recruitment and hiring procedures. The task force was chaired by Davina Tomlinson (African-American) of the Human Resources Department and consisted of three African-Americans and three Hispanics from the community who were appointed by former City Manager, Michael Jez, and confirmed by the City Council. The task force met three times. The focus of the task force was to make recommendations to assist with attracting, recruiting, and hiring protected class individuals. The task force made several recommendations. Their key recommendation was that the focus of recruitment should shift from outside the community to the local level. The Fire Department almost exclusively recruited in the Denton area to prepare for the 2001 Recruit Firefighter test. Based on the input from the Diversity Task Force, the Fire Department met with local church groups, recruited at local retail outlets to get the word out to these target groups; worked with the local universities; and recruited at all the City's neighborhood recreation centers. The test produced the first Hispanic firefighter for the Denton Fire Department. Page 8 of 17 In July 2003, the Fire Chief proposed that a new Diversity Task Force be assembled to further address the problem of enlisting qualified minority applicants to take the entrance examination. City Manager, Mike Conduff appointed ten African American community leaders to serve on the new Diversity Task Force, three of whom also served on the Department's first task force. Pastor Kenneth Davis of the St. Andrew Church of God in Christ in Southeast Denton volunteered to chair this committee. The Chief also enlisted the Denton Fire Fighter Association President as well as the Fire Department's recruiting officer and representatives of the Human Resources Department, including the Civil Service Director. The Diversity Task Force met several times with Fire and City Staff to discuss the Fire Department's hiring and testing procedures for Civil Service employees. They identified several major concerns that they wanted addressed: · Invite in outside consultants. · Develop a Youth emphasis. · Determine what is the best way to effectively reach out to minority communities. · Perform a self-assessment of the Department. · Focus on 18-36 year olds. · Look at advertising and marketing opportunities. · Focus locally on study groups. · Look at civilian positions such as a fire protection intern. · Develop a marketing plan, a youth emphasis and a study program. In 2005, the Diversity Task Force continued to meet with Fire and City Staff to discuss the Fire Department's hiring and testing procedures for Civil Service employees, especially related to the June 11, 2005 entrance exam due to the possibility that the fifteen new firefighters for Station #7 might be hired off the list. Fire Department Staff attended the opening fundraiser for the Quakertown House at the United Methodist Church on May 15, 2005. 300 flyers were handed out asking the question "Do You Want to be a Firefighter?" and inviting interested candidates to attend one of two study sessions on taking civil service tests as well as an orientation on the Denton Fire Department. The Master of Ceremonies of the event, Cassandra Berry, who is also a member of the Department's Diversity Task Force made a strong point to invite participates to attend study sessions for the upcoming Civil Service test on June 11,2005. Fire Department Staff distributed another 500 "Do You Want to be a Firefighter?" flyers to be handed out to all predominantly black churches prior to the test, inviting interested candidates to register to take the Civil Service test and attend one of two study sessions on taking civil service tests as well as an orientation on the Denton Fire Department. Fire Department Staff conducted two study sessions on May 26 and June 4 to prospective candidates. One was on a weekday evening and the other on a Saturday afternoon. Both were conducted at St. Andrews Church of God in Christ. Of the total 135 attendees of the study sessions, eight African Americans attended. Only twenty-five, or 3.9%, of all 644-test takers were African Americans. Of those taking the test, 616 passed with a 70% or better. All Diversity Task Force members were invited to attend the test and view the procedures as well as take the test. Fire Department Staff handed out personal information forms to be filled out by all candidates who scored a 97 or above to continue in the process. There were a total of 70 applicants who were in this category with no African Americans. Following is the racial breakdown of those who scored a 97 or above. Many social and economic issues affect the problem of qualified candidates, including physical tests of strength and endurance, receiving expensive advanced training (EMS and fire academies), and cultural attitudes. 2. Word of mouth brings in a high number of candidates for testing. There are very few minorities currently employed, which limits the potential minority employees at testing facilities. In addition, word of mouth throughout the fire service community will normally increase the number of test takers at any given site. The lack of minorities already on the Denton Fire Department leads people to believe that they will not be hired by the Department. 3. There is no local mentoring program in place to bring applicants along and support them through the process of getting into the fire service. Page 11 of 17 4. There are very few actual jobs for a large number of qualified applicants. 5. The problem may not be the recruiting program itself, but in other areas. The City's pay structure for the Fire Department has not kept pace with the market. The Denton Fire Fighters Association has argued that the Police Department has fewer troubles recruiting minorities because their pay is higher with more steps to increase their future compensation. There's a perception that if the pay were higher, minorities might be more encouraged to pursue employment in the Department. Our recruiters are often told that minority recruits would rather go to work in Dallas where the pay is higher, minorities are in larger numbers and they can promote faster. 6. The Denton Fire Department cannot attract sufficient numbers of minority applicants to the take the entrance exams to ensure equal distribution on the entry- I evelli st. 7. The small number of minorities who are already firefighters in Denton offer little opportunity for a support system. There is no minority union, such as the Black Firefighters Association in Dallas, to help them along the way. Without a support system or at least some members of the same race to act as mentors, many minorities are reluctant to pursue the Denton Fire Department as a serious career choice. 8. The small number of firefighters hired off of each list also reduces the chances of minorities being hired. Since the turnover rate is almost nonexistent, vacancies usually occur due to retirements rather than transfers to other departments. Promotions also playa part in the vacancies for hiring. Promotions occur at about the same rate of attrition, therefore limiting the chances to go lower on the list, thus deepening the pool of applicants. 9. The civil service selection process removes virtually all hiring discretion. Thus, efforts to achieve diversity are frustrated primarily by the existence of civil service. 10. The community at large has loudly voiced their opinions of why the Denton Fire Department has not hired more minorities, specifically African Americans. An article in the Denton Record Chronicle on August 15, 2005 entitled "Residents criticize lack of black firefighters" with the sub title of "Fire officials say diversifying department not easy," contained the following quotes from African American community leaders: Some residents led by Willie Hudspeth, a civil rights activist, criticize the city's lack of a black firefighter. He says the city's hiring rules place too much emphasis on the results of a test with questions "skewed" against minorities. "We've got this racist method of keeping a certain race out of the fire department, and other city departments." Hudspeth said "It's pretty obvious that the city Page 12 of 17 wants to keep blacks out of the top echelon of the city, and for sure, the fire department. " Carolyn Phillips, head of the Southeast Denton Neighborhood Association and a task force member, said the lack of a black firefighter "doesn't speak well of the city." But she's not sure why the department lacks diversity. She said it might be a cultural issue, or that blacks don't feel welcomed by the city. The Rev. Kenneth Davis, head of the task force and minister at St. Andrew Church of God in Christ in Southeast Denton, said minorities may not believe they have a fair shake with city employment. "There's a perception out there that there's no upward mobility or opportunities for minorities," Davis said at a recent City Council meeting. CURRENT HIRING SCENARIO OPTIONS Essentially we have two scenarios to consider in regards to hiring off the June 11, 2005 Civil Service list. Since the eligibility list from the June 11th test is only for six months, a strategy for the next regularly scheduled Civil Service test on December 17, 2005 also needs to be addressed in the scenario options. Keep in mind that this current list is for non-certified candidates which requires a ten- month lead in time before becoming a fully functioning crewmember permanently assigned to a fire engine or ambulance company. Staff recommends using the data from the results of the June 11th test along with the historical figures to fully evaluate which scenario works best for the City of Denton and the community. Hirin2 Scenario Option #1 Using the eligibility list from the June 11th test, the Fire Department would fill the current vacant positions (4 currently) and any vacancies that may occur before the list expires in accordance with State law. The Fire Department's original goal was to seriously consider hiring the 15 new firefighters with a hiring date of December 2005 for Station #7 from this list due to an anticipated opening date for Station #7 of October or November 2006. However, the schedule to open Station #7 has been extended to December 2006. Thus, this schedule will require administering a civil service test on December 17, 2005 with the same existing requirements for non-certified candidates with an anticipated hiring date of January 2006 for the 15 new firefighters off this December 2005 list. Hirin2 Scenario Option #2 Just as in option #1, the Fire Department would fill the current vacant positions and any vacancies that occur before the list expires using the eligibility list from the June 11th test. Page 13 of 17 However, using scenario #2, the City would give its next Civil Service Fire Recruit test on December 17, 2005 to certified firefighters and/or paramedics only. This Civil Service list would be used to fill the firefighter positions for Fire Station #7 with a hire date of October 2006 rather than the January date in scenario option #1. STAFF RECOMMENDATIONS 1. Test and Hire Certified Firefighters and/or Paramedics from the December 17, 2005 Fire Recruit test with a one-year eligibility list. (Probable reduced costs due to the fact there will be less candidates taking the test.) Since we currently anticipate an opening date for Station #7 of December 2006, Staff's recommendation is to use the hiring scenario #2 option and test for certified firefighters and/or paramedics on the December 1 ih test. The Department would hire only certified firefighters or certified paramedics with the best solution being someone who was both a certified firefighter and paramedic. Staff believes that this action would allow the Fire Department to recruit certified minority firefighters currently working in other fire departments or graduates from fire academies not yet employed and minority paramedics who currently work in low paying jobs for private ambulance companies. Staff believes that they can actually increase the minority representation percentage at the entry tests due to having a more focused audience for recruitment efforts. There are many advantages of hiring new firefighters who are already certified. This is the preferred method of hiring firefighters throughout Texas. Denton remains one of the few municipalities that does not hire certified only firefighters. · A list of certified firefighters allows the Department to fill vacancies immediately as they occur, rather than wait until there are enough vacancies to justify sending several employees to a fire academy and paramedic school. Having this capability means that the Department always works at full strength and does not have to fill vacancies with overtime positions. Currently, the Department has four vacanCIes. · Firefighters serve a one-year probationary period from date of hire. Non-certified firefighters take up to ten months for training away from the Fire Department's supervisors, which means when those firefighters finally get assigned to a company, they have a much shorter time to be evaluated while on probation. A certified firefighter will have the full one-year for evaluation. · The cost to train new employees who are not certified continues to increase. Certified firefighters save the City considerable amount of training funds. · Candidates who have taken the initiative and gone to the expense to put themselves through a fire academy and/or paramedic school show they are serious about being in the fire service profession. They will have experienced the Page 14 of 17 occupational hazards such as extreme conditions and sick and injured patients before coming to work for Denton. It eliminates some of the applicants that will otherwise come to work and then find this is not the job for them. This recommendation would allow the City to hire 15 trained firefighters in the fall of 2006 resulting in savings to the FY200512006 budget for the costs currently allocated for hiring and training non-certified firefighters beginning in January 2006. 2. Redevelop and implement a comprehensive Explorer/Cadet program. ($20,000 annually) We believe this will allow the Fire Department to recruit local African American and Hispanic youth as well as other youths to be firefighters. This program would target youth - boys and girls - in the 16 to 21 year range. As part of the program, the Fire Department would offer scholarships to a certified fire academy for members 18 years or older of age based on a minimum of one year performance, attendance and attitude in which they have met all requirements as well as maintained good citizenship and grades in high school (if in high school). This would enable them to apply for our firefighter positions as well as other certified firefighter positions in the State of Texas. The annual cost represents the estimated expenses for uniforms, printing and incentives for the program as well as scholarships. 3. Advance the funding of the Fire Captain's (Civil Service) position identified in the Five-Year Financial Forecast for the Public Safety Training Facility in FY2006/2007. ($120,000 one time) This position would be the Assistant Training Officer and be responsible for assisting the Training Chief with a primary duty of overseeing the explorer/cadet program. The position would also be in charge of our fitness/wellness/safety program. Since this position will interact with shift personnel, it is very important that the position be Civil Service. We have allowed for this new position as part of the Training Facility's 2006/2007 O&M costs so this would not be an ongoing new cost. This position would report to the Training Battalion Chief. 4. Fund a new civilian (non-Civil Service) position as Fire Training/ Recruitment Manager. ($110,000 annually) This position would be a new civilian (non-Civil Service) management position responsible for managing an explorer/cadet program with the purpose of attracting young minorities to develop into certified firefighters. This position would also be the Civil Service liaison and a recruitment specialist to assist in the recruitment, testing and hiring process for new recruits as well as a community Page 15 of 17 liaison available to assist the Battalion Chief over hiring. Possible projects would include developing more comprehensive study groups for civil service tests. The position would have close interaction with DISD as well as both universities. This position would also assist the Assistant Training Officer in specialized training programs. This position would be assigned directly to the Fire Chief. 5. Assemble a Recruiting Task Force for response to the Gulf Coast area. ($10,000 one time) This task force would be made up of two Diversity Task Force members, two Denton Fire Fighters Association (DFF A) members and two Fire Department Management Staff along with the new Assistant Training Officer and the Fire TrainingIRecruitment Manager. The task force would respond to the Gulf Coast area in Texas, Louisiana and Mississippi to recruit and meet with minority firefighters, especially African American firefighters. The Fire Association has received several calls from the Gulf Coast by firefighters wanting to relocate out of the area, especially New Orleans. The unfortunate tragedies of Hurricane Katrina and Rita may open up opportunities to recruit African American firefighters to take the Denton Fire Department test on December 17, 2005. 6. Conduct an off-site Civil Service Fire Recruit test in the Houston area in conjunction with the Denton test on December 17th. ($5,000 one time) The off-site testing location in the Houston area would allow all those firefighters recruited in the Gulf Coast area to take the test in an area closer to their homes saving them time, effort and money. In addition, the City could advertise this test throughout the Houston region to the large contingent of minority firefighters in that locale. 7. Complete the Marketing Plan as proposed by the Diversity Task Force. ($10,000 one time costs) John Baines of the Diversity Task Force proposed a Marketing Plan as a tool to assist in recruiting more minority applicants for the Fire Department. Part of that plan should be the development of a recruitment video and a new informational brochure to be used on recruiting trips. 8. Present the City Council's Direction to a Town Hall Meeting in November 2005. Because the lack of diversity in the Denton Fire Department has become such a heated community issue, Staff recommends a Town Hall type meeting where the community can come and hear exactly what's going on. In addition, the Town Hall meeting should be televised. Since the City Council's work sessions limit Page 16 of 17 input from citizens, this would present a forum to allow their input and reaction to whatever direction the City Council gives to Staff. A highly recognized African American leader from outside our community - perhaps someone from the NAACP, a university, the media, or a judge, etc. - should facilitate this meeting. A knowledgeable panel could discuss these issues as well as answer questions from the community. The setting could possibly be: "Here is where the City Council thinks the Denton Fire Department's hiring should go but we would like to hear from the community first before we implement that direction." The property to be annexed is generally located in the northeastern area of the City of Denton's Extraterritorial Jurisdiction (ETJ). BACKGROUND Applicant: City of Denton Denton, TX An involuntary annexation proceeding is being considered by the City of Denton for the Craver Ranch development site, city water treatment plant, and intervening properties. In accordance with the City's annexation policy plan, approved in June 1993, the City will "assess on a case by case basis" the annexation of areas in the ETJ when significant developments are proposed. The subject area to be annexed contains 146 separate parcels owned by 61 property owners, portions of FM 428 (Sherman Drive), FM 2153, Elm Bottom Circle, Green Valley Circle, Warschun Road, PR 2718, Shepard Road, and Burger Road. FM 428 and FM 2153 are state roads under the jurisdiction of the Texas Department of Transportation (TxDOT). A 54-inch city waterline runs along Burger Road, FM 2153, and FM 428. The property where the proposed city wastewater treatment plant will be located (along Hartlee Field Road) is also included in the proposed annexation. '" August 30, 2005, staff received direction from the City Council to pursue involuntary annexation proceedings. '" The City of Denton issued a letter of intent to annex to property owners on September 2, 2005. '" The entire area proposed for annexation is located in the extra territorial jurisdiction and is not zoned. Currently, there are approximately 60 residential units, a convenience store, a horse arena, a church, and a city water treatment plant. '" Due to outdated parcel information three property owners, encompassing approximately 94 acres, were not notified about the proposed annexation. The State law requires that all property owners included in an annexation be notified 30 days prior to the first public hearing. Due to the improper notification staff removed the three properties from the proposed annexation. '" The Comprehensive Plan identifies this area to be within Rural Area, Existing Neighborhood/Infill Compatibility Area, and Neighborhood Center land use designations. '" Property owners were notified of the involuntary with an "intent to annex" letter and official public hearing notification. To date, staff has received two letters in support, one letter neutral, 1 and 23 letters in opposition from property owners within the proposed annexation area. (Refer to Attachments 2 and 3.) Refer to map below. Size. 5,800 acres Location. Between the City's current northern city limits and Lake Ray Roberts along both sides of FM 2153 and FM 428 north of Hartlee Field Road in the northeastern area of the City of Denton Extraterritorial Jurisdiction (ET J). Proposed uses. 1. A proposed master-planned community with homes, retail and possibly a golf course on 1,900 acres near Lake Ray Roberts. The extension of City's utility facilities or the creation of a water district are under consideration by the developers. 2. The construction of a City wastewater treatment facility that would service the Clear Creek and Milam Creek watersheds. The purpose of the service area analysis is to determine how the city would provide services to the area should it be annexed into the city. A service area analysis form is attached. Please provide the requested information and any other pertinent information you deem necessary. To determine the city's ability to provide services to the proposed area it is necessary to document: . Each department's existing capacity to provide an adequate level of service to the proposed area; . Additional personnel and capital equipment/facilities necessary to provide an adequate level of service to the proposed area; and . Cost of providing additional service. Existing Conditions: Proximity to existinq arterial and collector roads. The Mobility Plan designates FM 428 as a Primary Major Arterial, FM 2153 as a Secondary Major Arterial, and Hartlee Field Road as a Collector. Forty-two (42) tracts have actual frontage along FM 428; forty-one (41) tracts have frontage on FM 2153; and thirteen (13) tracts have actual frontage along Hartlee Field Road. Future Land Uses. The proposed annexation area contains three future land use designations: Rural Areas, Existing Neighborhoodllnfill Compatibility Areas, and Neighborhood Centers. The vast majority of the area is within Rural Areas. The area to be annexed includes the Milam Creek and Clear Creek basins. Environmental Sensitive Areas (ESAs), including floodplain, stream buffers, water-related habitats, and upland habitats, are spread through out the proposed annexation area. See map attached map. Proximity to other service providers. The annexation area is along the northeastern border of the City of Denton. Based on current data, there is a 54-inch waterline along FM 2153 and FM 428. The annexation property is located within Denton's wastewater Certificate of Convenience and Necessity (CCN), which is a utility service area permit authorizing a specified utility to be the retail service provider. The water CCN holders for the annexation property include the City of Denton, Bolivar Water Supply Corporation and Green Springs Water Supply Corporation. For failure to specifically dedicate officers to this area would mean a dilution of existing resources committed to other areas of the city and an proportionate increase in response times in those areas. My reason is checked on your NOTICE OF PUBLIC HEARING AOS-0002, and for the additional following reasons: 1. If this proposed annexation is allowed to pass, it won't currently impact one iota of your quality of life, but without any equivocation it will certainly impact the quality of our lives, and the lives of all the residents in the depicted area, thru the burden of increased taxes, regulations, and ordinances. The City Of Denton cannot contribute anything that this community does not currently have at its' disposal, such as utilities and a quiet private, and peaceful life style. The regulations and ordinances that may be applicable in an urban area would be totally inappropriate for this suburban Green Valley Community. 2. My wife and I will have been married 55 years in December, We are both retired, and living off our retirement investments, I am just two months shy ~ Page 20f3 of my 85th birthday, and am no longer able to put in a full days' work to supplement our income. I am a WW II Veteran B-24 pilot who survived 46 missions in the China Burma Campaign in 1945. I feel like I have already paid my dues. Increased taxes will put a big dent in our discmtionary spending. 3.. Since I am no longer able to put in a full.days' work, I have let a portion of this property return to nature and it has become a wildlife sanctuary for deer~ coyotes, raccoons, possums, bobcats, skunks, armadillos, beavers and many species of wild birds and waterfowl. We built this home in 1964.1 believe it was the first brick home built on Hwy iO-Now FM 428- northeast of Clear Creek. It helped establish the trend for nicer homes in the area. In order to continue this trend we subsequently d,?veloped High Meadow Subdivision, a subdivision of 2000+ square foot homes situated on,2.5 to 3.0 acre tracts approximately 1/2 mile north of our homestead. This enhanced, and accelerated the trend for more high-end residences in the Green Valley Community. If I remember correctly, it has been less than six months since the City Council was advocating bringing more high-end housing to Denton. This is already happening in our community, and incidentally without having to burden its' citizens with increased taxes and regulations. 5. We have two Boliver Water Meters, CoServ COOP Power, Verizon Telephone, IESI Trash pickup, and have had excellent and courteous Sheriff Department .r~s.ponse.' .to... .......s..~~~~~!> .i~~~~.~i,{llllS;,;>~Il(j..~~Y"~~~l\inadvertent triggerings of our alarm system over the years, plus their close surveillanoe of our property when we are out of town. All of these amenities are available to the JNC Partners of the proposed Craver Ranch Development without additional City of Denton taxes to the citizens of this community. 6. I haven't a clue concerning what plans JNC Partners envisions, but' the Craver Ranch Development is approved there is probably a good chance that there will be a sea of identically colored roof-tops on similar shaped houses and apartments with little, or no individuality, such as the houses and apartments one can observe in numerous areas of Denton, and in Flower Mound east of the intersection of Interstate Highways 35 E and Highway 3040 at VISTA RIDGE MALL. If your perception of quality Uving Page:3 of3 embraces, these types of developments, It would seem to be reasonable for you to examine the issues that constitute QUALITY LIVING, and our quality of life that you-in conjunction with JNC Partners-are proposing to destroy. 7. FM 428 is a two lane county road crowded with heavy traffic during rush hours, as well as during the day -one cannot safely walk across the road to get the mail and back again-without taking a chance of getting run over. Furthermore, it is the only reasonable direct route between the Craver Ranch Development and Denton, and to the Dallas and Fort Worth accesses to I 35 via Loop 288. FM 428 will ultimately need to be 'widened in order to accommodate the increased traffic. Who is going to pay for this construction cost? I am saddened and surprised that you would even consider this proposed annexation and urge you to do some serious, soul-searching. thinking about what you are proposing to do to our way of life. 8. In the seventies, Denton's Chamber of Commerce Industrial Development slogan was: "A HALF HOUR FROM THE HUB AND A LIFETIME FROM THE HUBBUB." Well, The "HUBBUB" is here now in the form of frustrating traffic jams, and trying to get from one end of the city to the other, due in part to incomplete thru ways and what appears to be poor planning to alleviate this problem. Now, all of that having been said, I'm making an educated guess that the real reason for this proposed annexation is to raise taxes to make up for the financial deficit of the WATERWORKS, and its' projected losses. The NATATORIUM and the C.H. COLLINS ATHLETIC COMPLEX are quality pieces of planning and development and a real credit to the community. AREA ANNEXED The Planning and Development Department is processing an involuntary annexation for approximately 5,800 acres of land generally located between the City's current northern city limits and Lake Ray Roberts along both sides of FM 2153 and FM 428 north of Hartlee Field Road in the northeastern area of the City of Denton Extraterritorial Jurisdiction (ETJ). II. INTRODUCTION This service plan has been prepared in accordance with the Texas Local Government Code, Sections 43.021, 43.065, and 43.065(b)-(0) (Vernon 1999, as amended). Municipal facilities and services to the annexed area described above will be provided or made available on behalf of the City in accordance with the following plan. The City shall provide the annexed tract the levels of service, infrastructure, and infrastructure maintenance that are comparable to the levels of service, infrastructure, and infrastructure maintenance available in other parts of the city with similar topography, land use, and population density. III. AD VALOREM (PROPERTY OWNER) TAX SERVICES A. Police Protection, Code Enforcement, and Animal Control Police service, including patrolling, response to calls, and other routine functions, will be provided to the property upon the effective date of the annexation using existing personnel and equipment. Code enforcement and animal control services will also be provided to the property upon the effective date of the annexation. B. Fire Protection Fire protection (within the limits of existing hydrants) and emergency medical services will be provided to the property upon the effective date of the annexation. The estimated emergency response time in this area is 10 minutes, which is similar to responses for surrounding properties within the city limits. The City of Denton will provide emergency medical services ("EMS"). C. Roads and Streets Roads and streets, which have been properly platted, duly dedicated, and accepted by the City of Denton andlor Denton County shall be maintained by the City of Denton on the effective date of the annexation. Parks and Recreation Facilities Parks and recreational facilities in the area to be annexed will begin upon the effective date of the annexation according to the 2000 Parks and Recreation Master Plan. No parks are currently located within the proposed annexation area. Denton neighborhood park facilities are located within reasonably close distance of the proposed annexation area. Residents of the proposed annexation area will be able to use existing City of Denton park and recreation facilities and programs. E. Library Services Library services will be made available on the effective date of the annexation on the same basis and at the same level as similar library facilities are maintained throughout the city. F. Building Inspections and Consumer Health Services Building inspections and consumer health services will be made available on the effective date of the annexation on the same basis and at the same level as similar facilities are maintained throughout the City. Both services are provided on a "cost recovery" basis, and permit fees offset the costs of services delivered. Incomplete construction must obtain building permits from the Building Inspections Department of the City of Denton. G. Planning and Development Services Planning and development services will be made available on the effective date of the annexation. The Planning and Development Department currently services this property by way of administration of the Development Code, concerning subdivision and land development regulations. City Council adopted The Denton Plan, the city's 1999-2020 comprehensive plan, by Ordinance 99-439 on December 7, 1999. The Future Land Use Plan addresses both land in the city and its ETJ, and the subject tracts contain Rural Areas, Existing NeighborhoodlInfill Compatibility Areas, and Neighborhood Centers. The Denton Plan designates future land uses to manage the quality and quantity of growth by organizing the land use patterns, by matching land use intensity with available infrastructure, and by preserving floodplains as environmental and open space corridors. UTILITY (RATEPAYER) SERVICES A. Solid Waste Collection The City of Denton is the exclusive residential and commercial Solid Waste service provider within Denton's city limits. The City Ordinance requires Solid Waste services for all residences and commercial businesses located in the City. The City of Denton Solid Waste Department is fully funded through the service fees charged, and receives no funding from city tax revenues. Solid waste refuse collection services will be provided to the newly annexed property immediately upon the effective date of the annexation. All residential homeowners and commercial businesses should telephone the City of Denton Solid Waste Customer Service Department at 940-349- 8787 to initiate service. Commercial customers are required to complete and submit a Service Agreement to Solid Waste Customer Service prior to . . . receIvmg servIce. Residential Solid Waste Services Each residential address will be provided a 96-gallon wheeled refuse cart, which will be serviced one time per week. Residents are required to place their refuse cart(s) at the curb prior to 7:00 a.m. on their collection day. Carts should be placed at the curb for collection no earlier than 6:00 p.m. the evening prior to their collection day. Carts are to be removed from the curb no later than 6:00 a.m. on the day following their collection day. All refuse placed in the cart for collection must be bagged to eliminate wind blown debris and littering. Refuse that is not placed in the cart with the lid closed will not be collected. Additional carts may be provided for an additional monthly charge. Weekly yard waste service is provided. Weekly curbside recycling services are provided by Trinity Waste Services. Contact Trinity at 1-800-766-1758 to obtain curbside recycling information. Each residential customer's refuse cart service, curbside-recycling service, and yard waste service will occur on the same day each week. All refuse placed in the container for collection must be bagged to eliminate wind blown debris and littering. Refuse that is not placed in the container with the lid closed will not be collected. Refuse placed outside the container is subject to code enforcement regulations, including potential fines. Landfill Service The City of Denton Solid Waste Landfill hours of operation are 7:00 a.m. to 4:00 p.m. Monday through Friday; and 7:00 a.m. to 12:00 p.m. on Saturdays. For information regarding disposal charges, call the Landfill Office at 940-349-7510. B. Water/Wastewater Facilities The annexation area is along the northeastern border of the City of Denton. Based on current data, there is a 54-inch waterline along FM 2153 and FM 428. The annexation property is located within Denton's wastewater Certificate of Convenience and Necessity (CCN), which is a utility service area permit authorizing a specified utility to be the retail service provider. The water CCN holders for the annexation property include the City of Denton, Bolivar Water Supply Corporation and Green Springs Water Supply Corporation. Currently, the area to be annexed is provided water service by Bolivar Water Supply Corporation, Greens Springs Water Supply Corporation or private water wells. Wastewater service is provided by individual private onsite wastewater systems (septic tanks and aerobic spray irrigation systems). A major City of Denton waterline exists within the annexation area. Water service is available from this transmission pipeline at designated connection points that were designed into the pipeline. The City of Denton has current plans to construct a new wastewater treatment plant in the Clear Creek watershed to provide wastewater service to this portion of their wastewater CCN. The City has obtained a wastewater discharge permit from the TCEQ for this facility and has an engineering firm under contract to complete the construction plans and specifications for these planned facilities. The project has funding approval in the Water Utility Department's Capital Improvements Plan and the project will proceed foreword on a schedule to match the developments needs in this area as they occur. Water and sewer mains shall be extended as development occurs within the area in conformance with standard extension regulations and rules at the initial expense of the property owners, subject to and consistent with the City's participation policies, Tex. Loc. Gov't Code ch. 395, and the City's impact fee regulations. C. Drainage Services Drainage maintenance will be provided to the property upon the effective date of the annexation. The City shall provide a level of drainage services, infrastructure, and infrastructure maintenance that is comparable to the level of services, infrastructure, and infrastructure maintenance available in other parts of the city with topography, land use, and population density similar to those reasonably contemplated or projected in the area. D. Electrical Services Denton Municipal Electric is not certified by the State to provide electric utility service to the annexation area beyond Elm Bottom Circle should a request be made by a property owner. V. OTHER SERVICES Other services that may be provided by the City, such as municipal and general administration will be made available on the effective date of the annexation. The City shall provide a level of services, infrastructure, and infrastructure maintenance that is comparable to the level of services, infrastructure, and infrastructure maintenance available in other parts of the City with topography, land use, and population density similar to those reasonably contemplated or projected in the area. VI. CAPITAL IMPROVEMENTS PROGRAM (CIP) No new construction of additional water, sewer, street, and drainage facilities is contemplated within the annexed area as a result of this annexation because the annexed area on the date of annexation will have a level of full municipal services equal to other areas within the City having similar characteristics of topography, land use, and population density. Thus, no construction of public improvements is contemplated as a result of this annexation that would begin within two and a half (2 IIz) years after the effective date of the annexation. VIII. TERM This service plan shall be valid for a term of ten (10) years. Renewal of the service plan shall be at the discretion of City Council. IX. BACKGROUND On 9-26-05, the Texas Commission on Environmental Quality released a "Notice of Application and Preliminary Decision for Hazardous Waste Permit Renewal and Major Amendment" related to Permit No. 50163. Safety-Kleen Systems, Inc., Denton Recycling Center, initiated this permit renewal with amendments during March 2004. The "Notice of Application and Preliminary Decision" is simply a statement by the TCEQ acknowledging the permit renewal request, stating the results of TCEQ's technical review, and announcing the release of the draft permit. [Permit No. 50163] Dear Sir or Madam, On behalf of the City Council of the City of Denton, Texas and their constituents, I am requesting a "Public Meeting" in Denton, Texas concerning the Notice of Application and Preliminary Decision issued by the Texas Commission on Environmental Quality on September 23, 2005 and received via mail by the City of Denton on September 26, 2005. This notification is related to Safety-Kleen Systems, Inc., a facility located in Denton, Texas that is mainly involved in spent solvent recycling, solvent reclamation, fuels blending, and recoverable fuels marketing. Under this permit renewal request, Safety-Kleen Systems is pursuing the authorization to continue operations on seven existing container storage areas, thirty-eight existing tanks, and five container storage areas (permitted but not constructed) for the storage and processing of industrial and municipal hazardous wastes and Class I, Class 2, and Class 3 industrial solid wastes. Safety-Kleen is also requesting a major permit amendment which will allow the business to create a new container storage area, and to receive, store, and process additional categories of industrial and municipal hazardous and non-hazardous wastes by adding USEP A waste codes to the existing permit. Safety-Kleen submitted its application for permit renewal to the Texas Commission on Environmental Quality ("TCEQ") on March 9, 2004. The City of Denton, Texas first received notification concerning the permit renewal and amendment application from the TCEQ via a memo dated August 11, 2004. At the Denton City Council's regularly scheduled meeting of October II, 2005, the City Council unanimously authorized me to write this letter requesting that the TCEQ hold a Public Meeting in Denton, Texas regarding the Notice of Application and Preliminary Decision. Please note that the City Council is expressing neither support for nor opposition to this Notice.
