CITY OF DENTON CITY COUNCIL
June 5, 2006
After determining that a quorum is present, the City Council of the City of Denton, Texas will
convene in a Special Called Work Session on Monday, June 5, 2006 at 11:30 a.m. in the Council
Work Session Room, 215 E. McKinney, Denton, Texas at which the following items will be
considered:
NOTE: A Work Session is used to explore matters of interest to one or more City Council
Members or the City Manager for the purpose of giving staff direction into whether or not such
matters should be placed on a future regular or special meeting of the Council for citizen input,
City Council deliberation and formal City action. At a Work Session, the City Council generally
receives informal and preliminary reports and information from City staff, officials, members of
City committees, and the individual or organization proposing council action, if invited by City
Councilor City Manager to participate in the session. Participation by individuals and members
of organizations invited to speak ceases when the Mayor announces the session is being closed to
public input. Although Work Sessions are public meetings, and citizens have a legal right to
attend, they are not public hearings, so citizens are not allowed to participate in the session
unless invited to do so by the Mayor. Any citizen may supply to the City Council, prior to the
beginning of the session, a written report regarding the citizen's opinion on the matter being
explored. Should the Council direct the matter be placed on a regular meeting agenda, the staff
will generally prepare a final report defining the proposed action, which will be made available
to all citizens prior to the regular meeting at which citizen input is sought. The purpose of this
procedure is to allow citizens attending the regular meeting the opportunity to hear the views of
their fellow citizens without having to attend two meetings.

SUBJECT
Receive a report, hold a discussion, and give staff direction regarding the draft business master
plan for the proposed Public Safety Training Facility.
BACKGROUND
Previously, the City Council approved a professional services contract with James Kirkpatrick
Architecture Studio to develop and prepare a City of Denton Public Safety Training Facility
Master Plan. Mr. Kirkpatrick assembled a team of consultants including Tommy Abercrombie.
The City Council directed staff to prepare a business plan as the first step in completing the
overall master plan for a joint public safety training center. This work session gives staff the
opportunity to discuss the draft Public Safety Training Facility "Joint Business Plan" as prepared
by consultant Abercrombie as part of the overall Master Plan before proceeding with the next
step which would be a final version of the business plan and a draft of the overall master plan.
Several meetings between the City's public safety departments' staffs and the consultants along
with Dr. Lee Ann Nutt from North Central Texas College (NCTC) and her staff have resulted in
the "draft" of a Joint Business Plan. Both the Police Department and Fire Department have
assembled teams to review specific areas of concern and as discussed in previous meetings,
North Central Texas College (NCTC) continues to be a strong partner in the future use of this
training facility.
Mr. Abercrombie, Dr. Nutt, Police Chief Charles Wiley and I will present the business plan to
the City Council and answer questions in order to receive input and direction before preparing
the final version of the business plan and incorporating it into the master plan.

SUBJECT
Receive a report and discuss the City of Denton's emergency management program and planning
process.
BACKGROUND
The City of Denton has an outstanding Emergency Management Program. It meets all the
mandates of the Federal government and the State Government. State law specifically mandates
that the City prepare, adopt and keep current an emergency management plan for its area. The
City of Denton is one of the few cities in Texas to receive an "Advanced" planning status from
the State's Division of Emergency Management.
Chapter 418 of the Texas Government Code (The Texas Disaster Act) requires the City Council
to adopt an emergency management plan for its area that provides for disaster mitigation
preparedness, response, and recovery. The City's plan complies with the provisions of Chapter
418.
The Federal Department of Homeland Security, the Texas Disaster Act of 197 5 (Chapter 418 of
the Texas Government Code) and the Homeland Security Act of2003 (Chapter 421 of the Texas
Government Code) mandate certain requirements for local government in Texas as it pertains to
emergency management.
The City of Denton operates under the City's Emergency and Disaster Planning and Response
Ordinance in Chapter 9 of the City Code (Ordinance No. 2004-101, S 2, adopted April 6, 2004,
repealed Chapter 9, arts. I, II, SS 9-1--9-11, 9-36--9-42, in its entirety and enacted new
provisions) which does the following:
1. Creates an Office of Emergency and Disaster Management separate from the County
headed by the Mayor as the Director of Disaster and Emergency Service.
2. Creates the Office of the Emergency Management Coordinator who is responsible for
many disaster and homeland security grants and the securing of confidential information
such as information relating to critical infrastructure and assigns the Fire Chief to the
function.

3. Provides definitions including definitions of disaster, utility emergency, and homeland
security activity.
4. Provides for the development and maintenance of an up-to-date and comprehensive
emergency management plan.
5. Lists the Mayor's powers during the declaration of a disaster including the power to
protect the public health, safety and welfare through declaring curfews, establishing
wage, rent, and price controls, and taking other necessary action through emergency
proclamations and regulations.
6. Prohibits certain activities during the disaster period.
7. Establishes criminal and civil penalties for violation of disaster regulations, rules or
orders.
8. Provides limitation on liability and immunity for City officers, employees and volunteers
performing disaster, emergency or homeland security during a disaster.
GOVERNOR'S EXECUTIVE ORDER RP57 (see attached)
Much has happened recently on the Homeland Security front that is of central importance to
County Judges and City Mayors. Most notable is the issuance by Governor Rick Perry of an
executive order (Governor's Executive Order RP57, issued March 21, 2006) implementing
certain recommendations of his Task Force on Evacuation and Transportation and Logistics. In
this order, the Governor has further defined his commitment to a regional approach for achieving
emergency preparedness throughout the state.
Specifically, Governor Perry's order includes this requirement:
"To improve command, control, and communications during mass evacuations, the
Emergency Management Directors (County Judges and Mayors) within each of the
state's 24 Councils of Government shall establish a Regional Unified Command
Structure (RUCS), and appoint a single Incident Commander for the Regional Unified
Command Structure ".
The North Central Texas Regional Emergency Managers Committee met on March 30,2006, to
comprehensively discuss the issue. The Regional Emergency Managers reached consensus for a
response to this order, which meets the intent of the directive, is consistent with our current
regional emergency planning efforts and is in-line with well established disaster management
processes. It also leaves elected officials as the responsible agents in their respective
jurisdictions.
The Chief Elected Officials for the North Central Texas Region met on April 12, 2006 at the
Arlington Convention Center to vote on a Regional Unified Command Structure. Mayors and
county judges for the north central Texas region agreed to designate the Disaster District
Committee (DDC) Chair (currently Captain Joseph McKinney with the TX Department of Public
Safety in Garland) as the Regional Incident Commander (IC) during catastrophic events. During

periods of catastrophic disasters the Regional IC will stand-up a Regional Coordination Center
(RCC) to assist in coordinating resource requests and public information. The location of the
RCC will vary depending on where the incident is taking place. Emergency Operations Centers
(EOCs) in Collin, Dallas, Denton, Tarrant counties as well as the City of Denton EOC are all
possible sites from which the RCC may operate. The RCC will be staffed with emergency
managers from the unimpacted areas of the region. The RCC concept was recently tested as part
of a statewide Hurricane Exercise held on May 2-4, 2006.
HURRICANE SHELTERING PREPARATIONS
The City of Denton Emergency Manager has been working closely with the American Red Cross
in preparation of the 2006 hurricane season. Camp Copass, which was utilized during the 2005
hurricane season as a shelter for Hurricane Katrina evacuees, has agreed to once again serve as a
shelter location. The City of Denton and Camp Copass are formalizing this agreement by
coordinating a Memorandum of Understanding (MOU) in which the Camp will agree to serve as
a shelter site and the City will agree to support those operations with fire/EMS, law enforcement,
solid waste and other support services. In addition, the Red Cross and City are coordinating
sheltering efforts with the University of North Texas in hopes of utilizing campus facilities as
refuge locations. In order to prepare shelter managers and operations personnel, the Red Cross
is holding a series of training classes in the county, including one at Central Fire Station on
Saturday, June 3, 2006. Disaster support volunteer organizations such as the Denton County
Medical Reserve Corps and City of Denton Community Emergency Response Teams (CERTs)
are being contacted to staff and provide assistance in Denton shelters.
NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS)
In early 2003, President Bush signed Homeland Security Presidential Directive (HSPD) #5
creating the National Incident Management System (NIMS). NIMS provides a consistent
nationwide approach at the federal, state and local levels to prepare, prevent, respond and
recover from domestic incidents. The directive requires adoption of NIMS by state and local
jurisdictions a condition for receiving federal grants/funds.
There are several components to NIMS implementation:
1. Authoritv: Requirement to adopt NIMS at the local, county and state level. Denton City
Council adopted NIMS as the standard for incident management for the City of Denton
on June 21,2005.
2. Plans: Local Emergency Management Plans must be updated during FY2006 to include
NIMS components. The City of Denton EMP is in the process of revision. A copy will
be available for review on the City Intranet once updates are complete.
3. Exercises: Community disaster drills and exercises must include NIMS structure.
4. Resources: Community resources are in the process of being added to a statewide
resource database through the TX Forest Service, following NIMS Resource Typing
Requirements.

5. Training: NIMS training compliance activities have been greatly expanded for FY2006.
The previous focus was on first responders in leadership positions. The FY2006, the
initial training requirement has been broadened to include all entry level first responders
and disaster workers, first line supervisors, middle management and command staff. All
personnel with a role in the City Emergency Management Plan are in the process of
taking the required NIMS training.
PANDEMIC FLU
Much has been written and discussed about the possibility of Avian (Bird) Flu mutating to
person-to-person transmission creating a worldwide pandemic similar to the Spanish Flu of
1918, which killed an estimated 20-50 million people. The bird flu is a much deadlier strain of
the regular influenza that occurs each year. Approximately 35,000 Americans die of influenza
annually. No one knows for sure if the bird flu will spread person-to-person, but the impact on
the health care system and workforce could be significant as an estimated 30-50% of employed
Americans could be out ill for various lengths of time. If it does go person-to-person, the WHO
and CDC would be immediately involved to quarantine the outbreak, contain the spread and
hopefully develop a vaccine (which does not currently exist) before a pandemic occurs. Thus
far, the Avian Flu transmission has been from bird-to-person, primarily impacting those
individuals living in close proximity to poultry. The virus has killed nearly 57 percent of the 217
confirmed cases. On the positive side, the United Nations' chief pandemic flu coordinator
confirmed that the flu virus known as H5Nl largely has been contained in the Asian countries
where it first hit.
Since this is a public health issue, the Denton County Health Department has taken the lead on
local pandemic flu preparations. They have developed a countywide pandemic flu plan and
support website: http://www.pandemic.dentoncounty.com/. Information regarding this website
has recently been added to DTV Cable Channel 26. The City of Denton Emergency
Management Program Manager has been working closely with the Denton County Health
Department and UNT Pandemic Flu Working Group on pandemic flu plans and preparations.
In addition, a Pandemic Flu Tabletop Exercise was conducted at the City of Denton Emergency
Operations Center (EOC) on January 20, 2006. The purpose of the exercise was to raise
awareness about the possible impact of pandemic influenza on the City of Denton and Denton
County. A City of Denton Pandemic Flu EOC Standard Operating Guideline (attached) has been
developed in the event human-to-human transmission of the virus occurs in the world, in the
United States or in our region of the state.
DISASTER DRILLS.. TRAINING PROGRAMS AND PUBLIC EDUCATION
The City of Denton Office of Emergency Management sponsors, hosts, conducts and/or
participates in a wide variety of disaster drills, training programs and public education activities.

EMERGENCY OPERATIONS CENTER (EOC) RELOCATION AND ACTIVATIONS
The City of Denton Emergency Management Office has completed Phase I (Operations Room)
of the relocation of the Emergency Operations Center (EOC) to Central Fire Station. Phase II
(PIO/Joint Information Center) is currently underway and a grant for Phase III (Executive
Briefing Room) has been submitted to NCTCOG for review/consideration. The City of Denton
EOC has been activated five times in the last year. Full EOC activations occurred for Hurricanes
Katrina and Rita and partial activations occurred for wildfire outbreaks in the city and twice for
severe weather events (including the severe weather event of Friday, April 28, 2006 when the
outdoor warning sirens were sounded for a tornado indicated on radar by the NWS).

FISCAL INFORMATION
The fiscal impact of meeting Federal and State Emergency Management requirements is a part of
the Fire Department's annual operating budget.

Relating to implementing recommendations from the Governor's Task
Force on Evacuation, Transportation, and Logistics.

WHEREAS, the Governor's Task Force on Evacuation, Transportation and Logistics was
appointed to document the lessons learned from the Hurricane Rita evacuation, identify
key challenges of urban area mass evacuations in Texas, and recommend improvements
to state, regional, and local evacuation planning and execution; and
WHEREAS, the Task Force conducted public hearings across Texas to gather and
document input from stakeholders to develop recommendations; and
WHEREAS, on February 14, 2006, the Task Force issued a final report containing
recommendations to improve the State's ability to plan and execute mass evacuations in
the five key areas: command, control, and communications; evacuation of people with
special needs; fuel availability; traffic flow; and public awareness;
NOW THEREFORE, I, Rick Perry, Governor of Texas, by virtue of the power and
authority vested in me by the Constitution and laws of the State of Texas, do hereby order
the following
1. Direction and oversight. The State Director of Homeland Security shall
ensure this executive order is carried out in a manner consistent with the
report and recommendations of the Task Force.
2. CODlDland, control, and cODlDlunications. To improve command,
control, and communications during mass evacuations, the Emergency
Management Directors (County Judges and Mayors) within each of the state's
24 Councils of Government shall establish a Regional Unified Command
Structure (RUCS), and appoint a single Incident Commander for the Regional
Unified Command Structure. Each Regional Unified Command Structure will
be responsible for preparing for and responding to catastrophic events within
the region. Each Incident Commander will be the operational commander
within the region during a disaster response, including a mass evacuation. An
Incident Commander will serve a term of not less than one year. The
Governor's Division of Emergency Management shall oversee the
implementation of the Regional Unified Command Structure throughout the
state. Each Regional Unified Command Structure shall be established no later
than April 18, 2006, and the composition of regional unified command, to
include the name and qualifications of the Incident Commander, shall be
provided to the Governor's Division of Emergency Management no later than
April 20, 2006.
The Texas Department of Public Safety shall provide to each Regional Unified
Command Structure a senior-level commissioned officer with appropriate
staff to represent the State as each Regional Unified Command Structure

prepares for and responds to a catastrophic event within the region.
The Texas Department of Public Safety shall assume responsibility for
command, control, and communications, as well as other operational tasks as
directed by the Governor, during evacuations and other disaster response
operations that involve multiple Regional Unified Command Structures.
The Governor's Division of Emergency Management shall create eight
Regional Response Teams (RRT) to support multi-jurisdictional operations
during catastrophic events.
The Governor's Division of Emergency Management shall develop a statewide
hurricane evacuation and shelter plan to save lives and reduce the
vulnerability of Texans in the event of disasters.
The Governor's Division of Emergency Management shall oversee the
implementation of regional response and evacuation plans throughout the
state.
The Governor's Division of Emergency Management shall coordinate with
independent school districts and public colleges, universities and university
systems to provide transportation assets and facilities to enable the execution
of state and local evacuation and shelter plans.
The Governor's Division of Emergency Management shall develop policies
and procedures to reimburse school districts and public colleges, universities
and university systems for evacuation, shelter, or transportation-related
expenses in the event that the Texas Legislature or United States Congress
designates funding for this purpose.
The Governor's Division of Emergency Management shall direct an annual
hurricane evacuation exercise to test the readiness of state and local
evacuation and sheltering plans in the event of a disaster.
3. Evacuation of people with special needs. To ensure the safe and
efficient evacuation of Texans with special needs in the event of a disaster, I
hereby direct the Governor's Division of Emergency Management to
coordinate with the Department of State Health Services, the Department of
Aging and Disability Services, the Governor's Committee on Persons with
Disabilities, and other appropriate state agencies to define the term "special
needs," and develop a statewide evacuation and shelter plan for persons with
special needs.
The Governor's Division of Emergency Management shall coordinate with the
Department of State Health Services, the Department of Aging and Disability
Services, the Governor's Committee on Persons with Disabilities, other
appropriate state agencies, local governments, and appropriate stakeholder
groups to develop criteria for evacuation plans for all special needs facilities,
to include both licensed and unlicensed facilities.
The Governor's Division of Emergency Management shall ensure local
jurisdictions and Regional Unified Command Structures approve evacuation
plans maintained by special needs facilities.
The Governor's Division of Emergency Management shall develop and
implement a statewide database to assist in the evacuation of the special

needs population, with coastal jurisdictions as a priority. RUCS shall be
responsible for collecting and providing information for the statewide
database.
The Governor's Division of Emergency Management shall develop and
implement a plan to address the evacuation and sheltering needs of
individuals with companion animals.
4. Fuel availability and distribution. To improve fuel availability and
distribution during a mass evacuation, I do hereby direct the Texas
Department of Transportation to coordinate with the Texas Oil and Gas
Association and other industry partners to develop a plan to address fuel
availability along major evacuation routes and establish a fuel operations
function in the State Operations Center to coordinate the distribution of fuel
prior to and during evacuations.
The Governor's Division of Emergency Management shall work with local
officials to ensure locally developed evacuation plans address fuel availability
during an evacuation.
The Governor's Division of Emergency Management shall establish
procedures to distribute fuel in a prioritized manner during an emergency.
The Governor's Division of Emergency Management shall develop policies
and procedures to reimburse local governments and other support entities for
evacuation-related fuel costs in the event that the Texas Legislature or United
States Congress designates funding for this purpose.
5. Traffic control and DlanageDlent. To improve traffic control and
management during a mass evacuation, I do hereby direct the Texas
Department of Public Safety to assume traffic management authority over
designated evacuation routes during multi-jurisdictional evacuations in order
to move large populations and heavy traffic in a highly-coordinated manner.
The Texas Department of Transportation shall coordinate with the Texas
Department of Public Safety to develop contra-flow plans for major hurricane
evacuation routes as identified by the Task Force on Evacuation,
Transportation and Logistics.
The Texas Department of Transportation shall implement short and long-
term solutions to reduce congestion on the one-lane section of U.S. Highway
290 at Brenham, Texas, during an evacuation.
The Texas Department of Transportation shall prioritize for implementation
the infrastructure projects recommended in the March 2005 Report to the
Governor on Texas Hurricane Preparedness, which address obstructions on
evacuation routes during mass evacuations.
The Texas Department of Public Safety shall coordinate with the Department
of Homeland Security and the United States Customs and Border Patrol to
expedite the flow of traffic through checkpoints on major hurricane
evacuation routes and assist in developing traffic management plans to
accommodate increased volume at checkpoints during evacuations.
6. Public awareness. To increase public awareness, I do hereby direct the
Public Utility Commission to work with utility companies that are regulated

include hurricane preparedness and evacuation-related public awareness
information in monthly billing statements prior to and during the hurricane
season each year.
This executive order supersedes all previous orders in conflict or inconsistent with its
terms and shall remain in effect and in full force until it expires by statute or it is
modified, amended, rescinded, or superseded by me or by a succeeding governor.
