June 13, 2006
After determining that a quorum is present, the City Council of the City of Denton, Texas will convene in
a 2nd Tuesday Session on Tuesday, June 13, 2006 at 4:00 p.m. in the Council Work Session Room at City
Hall, 215 E. McKinney Street, Denton, Texas at which the following items will be considered:
NOTE: A 2d Tuesday Session is used to explore matters of interest to one or more City Council
Members or the City Manager for the purpose of giving staff direction into whether or not such matters
should be placed on a future regular or special meeting of the Council for citizen input, City Council
deliberation and formal City action. At a 2d Tuesday Session, the City Council generally receives
informal and lYeliminary reports and information from City staff, officials, members of City committees,
and the individual or organization proposing council action, if invited by City Councilor City Manager to
participate in the session. Participation by individuals and members of organizations invited to speak
ceases when the Mayor announces the session is being closed to public input. Although 2d Tuesday
Sessions are public meetings, and citizens have a legal right to attend, they are not public hearings, so
citizens are not allowed to participate in the session unless invited to do so by the Mayor. Any citizen
may supply to the City Council, prior to the beginning of the session, a written report regarding the
citizen's opinion on the matter being explored. Should the Council direct the matter be placed on a
regular meeting agenda, the staff will generally prepare a final report defining the proposed action, which
will be made available to all citizens prior to the regular meeting at which citizen input is sought. The
purpose of this procedure is to allow citizens attending the regular meeting the opportunity to hear the
views of their fellow citizens without having to attend two meetings.

3. Receive a report, hold a discussion and give staff direction regarding Ibrary fees for non-

NOTE: The City Council reserves the right to adjourn into a Closed Meeting on any item on its Open
Meeting agenda consistent with Chapter 551 of the Texas Government Code, as amended, including
without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

residents.
BACKGROUND
On October 1, 2005, the Denton Public Library made full service library cards available to nonresidents
of the City of Denton for a fee of $50.00 per year per household. This decision was made after the
Denton County Commissioners voted to fund library services at only 80 cents per person and then only if
the library agreed to filter the Internet.
If the Denton Public Library had accepted this drastic reduction in funding, it would have only been able
to purchase 5,913 new items with County funding when in FY 2004-2005, nonresidents checked out
approximately 181,232 items.
The Denton Public Library would also have had to block constitutionally protected information to the
majority of our library users who use the Internet responsibly. In 1997 when the library first began to
offer Internet access, the Denton Library Board agreed to not install filters on the library computers. As
filters sweep too broadly, block only some sites with indecent materials while restricting access to
thousands of legal and useful resources, and fail to block communications sent through other popular
channels for distributing pornography like peer-to-peer file sharing, the current Denton Library Board
unanimously agreed to again not filter the Internet.
After further study of both edicts from the Denton County Commissioners, the Denton Library Board
recommended to the Denton City Council to not accept County funding. City Council members agreed
and approved Ordinance 2005-157 on June 7, 2005.
Since the county funding allocation would not be accepted, it was determined that the library would make
up the revenue by charging non-residents a fee of $50.00 to purchase a library card. With no historical
data on which to base a determination on how many nonresidents would actually purchase a library card,
the Director of Libraries decided to base the projected revenue on the County allocation the Denton
Public Library would have received if it had accepted the County funding allocation of $118,250. The
FY 2005-2006 revenue projection was therefore based on the assumption that approximately 2,365
nonresidents would purchase a library card at a fee of $50.00. As of April 30, 2006, only 531
nonresidents had purchased a card with $26,550 in revenue collected to date. (See Exhibit A).
In an effort to increase the number of out-of-city users purchasing a library card, the library
administrative staff is proposing to amend the ordinance to provide discounted annual fees for
nonresidents enrolled full time in an independent school district or home-schooled; and to
provide limited access punch cards.
OPTIONS
1. Approve changes recommended by library administrative staff.
2. Suggest alternative changes to the existing Ordinance.
3. Leave existing Ordinance in place.
RECOMMENDATION
Library administrative staff recommends that the City Council approve the proposed changes.

The Denton Library Board voted unanimously to approve the amended Ordinance at their
meeting held on April 6, 2006.
FISCAL INFORMATION
With additional payment options, the Denton Public Library has revised its revenue projection for the
fiscal year to approximately $40,000 for a total of 800 nonresident cards paid for and issued by September
2006.

AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE NO~
2005-157, PROVIDING FOR AN AMENDMENT TO CHAPTER 2, ARTICLE V LIBRARY,
SECTION 2-157 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS,
TO REQUIRE THE PAYMENT OF A ANNUAL FEE FOR A LIBRARY CARD FOR
NONRESIDENTS AND DISCOUNTED ANNUAL FEES FOR NONRESIDENTS
ENROLLED FULL TIME IN AN INDEPENDENT SCHOOL DISTRICT OR HOME
SCHOOLED, AND SENIOR CITIZENS; PROVIDING LIMITED ACCESS PUNCH CARDS
FOR NONRESIDENTS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A
SAVING CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Library provides an essential function to the citizens of the City of
Denton; and
WHEREAS, it is recommended by the Library Board that a annual fee for a library card
should be required for those persons who do not reside within the city limits of Denton, Texas,
except for those persons who own property within the city limits or unless they are city
employees, and a discounted annual fee should be required for those nonresidents who are
enrolled full-time in a formally recognized independent school district or being home schooled,
and for senior citizens over the age of 65; and
WHEREAS, the City Council finds that it is in the public interest to establish an annual
fee for a library card to nonresidents and to provide discounted fees in certain circumstances;
NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION l~ Chapter 2, Article V Library, Section 2-157 of the Code of Ordinances of
the City and Ordinance No ~ 2005-157 is hereby amended in its entirety to read as follows:
Sec. 2.157. Library cards.
a. An adult applicant is eligible for a library card free of charge upon making proper
application if they reside within the city limits -of the City of Denton, Texas. City employees and
non-residents who own property within the city limits will also be eligible to obtain a library card
free of charge.. An annual non-resident fee of $50~OO shall be charged for those living outside of
the city limits of Denton, Texas.. The non-resident fee will be charged per household and not per
person, and. household membership will be determined by proof of residency. The annual fee
may be amended and changed by the City Council as is deemed necessary~
b. A nonresident individual who is currently enrolled full-time in any formally
recognized independent school district or who is being home schooled may pay a fee of $30.00
per year to obtain full access to library services~

Teresa Starrett called the meeting to order at 5:05 p.m.
The minutes from the March 2, 2006 meeting were reviewed and approved by a motion from
Dorothy Adkins to accept and a second by Sherri McDade.
y Eva Poole related that Open Government Training for two (2) hours was required to be
attended with one (1) year to complete. Training can either be done by DVD or online.
y Eva Poole reviewed Denton's proposed Non-Resident Circulation Policy. The policy
states $50.00 for unlimited items per year or specific costs per item. There is a senior
discount - $30.00 for unlimited, and students - $30.00 for unlimited items (which does
not include university students). At the end of March, 500 people have bought a $50.00
card, still far short from what was projected. Lori Wolfe made a motion to accept,
Turner Kobler seconded the motion and all were in favor of the policy.
y Eva Poole is working with the Police Department to filter only pornographic sites on the
public computers. These sites will be filtered before they come into the library. The
library itself is not filtering.
y Eva Poole will draft a resolution on filtering for the Board to review next month.
Judy Deek-Giese made a motion to adjourn, Pat Langa seconded, and the meeting adjourned at
5 :30 p.m.

Receive a report, hold a discussion and give staff guidance on the development of solid waste
storage facilities and design standards.
BACKGROUND
The Denton Development Code requires new construction and certain other projects such as
redevelopment and building expansions to locate solid waste storage containers (dumpsters)
behind the front building line. One of the goals of the City Council is to improve the appearance
of the community, not only by relocating existing containers out of the City's rights-of-way, but
also by working to facilitate their vision through updated ordinances, design standards, revised
operating procedures and code enforcement. In order to provide clear general guidance for
developers on the City's requirements for municipal solid waste and recyclables storage
enclosures city staff has prepared amendments to Chapter 13 of the Development Code and
developed site criteria for solid waste and recyclables storage facilities and associated their
enclosures.
The nationwide average waste generation rates, by waste producer category, were used in
establishing storage enclosure space requirements. The space requirement on the ground
("footprint") for storage is generally based on providing the most economical dumpster size with
the minimum collection frequency allow by the State of Texas Department on Health, once per
week collection. The space requirements, footprint, are the same whether a four or eight cubic
yard container is used.
In 2004, representatives of several City departments (Planning and Development, City
Attorney's Office, Solid Waste, Code Enforcement, Police) began discussing the problems
associated with a lack of guidelines for the requirements, locations and quantities of dumpsters to
support commercial activities in the city. A draft (dated October, 2004) of a Solid Waste Site
Criteria document was developed. The PUB received a presentation on the goal and key issues
of the document during their meeting held on November 14,2004 and provided input. The P & Z
received a similar presentation and provided input to amend the draft.
The draft including suggested amendments to the site design standards were presented to the
attendees at the Developer's Luncheon on November 9, 2005 and revised based on input from
attendees and others in the community. The working draft document was further revised
following the Planning and Zoning Commission work session comments on December 9, 2005.
The Site Plan Criteria was again presented to the Planning & Zoning Commission at their
meeting of January 11, 2005, where both commission and public comments were received.
Provided below is a general overview of the recent Site Plan Criteria document received and
document comments.
. Wood materials were requested for use as an acceptable enclosure construction material.
The City Council and City Fire Marshal have recommended that architecturally
compatible and non-combustible materials be utilized as acceptable enclosure
construction materials.
. Refuse and recycling storage areas necessary for future or alternate uses shall be
available for development, but need not be developed initially, nor enclosures constructed
initially, until the future growth occurs.
. Developments that initially are projected to produce waste and recyclable volumes that
are less than waste generation rates for their respective industries, may construct a
smaller solid waste and recyclables enclosure area through submittal of an Alternate
Development Plan (ADP).
. Refuse carts may be appropriate for some businesses. For small businesses utilizing less
than 500 square feet of area, refuse cart service may adequately meet the refuse service
needs, thereby eliminating the need for construction of an enclosure.
. No solid waste or recyclable enclosure shall be located within the required front yard or
protrude in front of any buildings along the designated lot frontage.
. No utility wires shall extend over the enclosure approach and service area.

SITE PLAN CRITERIA
FOR
MUNICIPAL SOLID WASTE & RECYCLABLES
STORAGE & ENCLOSURE REQUIREMENTS

General Solid Waste and Recycling Service Responsibilities:
The City of Denton is the exclusive provider for the collection, transportation and
disposal of municipal solid waste (MSW) and some non-hazardous wastes within the city
limits of Denton. Both the generator of municipal solid waste and the property owner
have the responsibility for the proper management, storage, collection, transportation and
disposal of solid waste in accordance with federal, state, and city regulations.
Commercial solid waste and recycling storage facilities (container enclosures) shall be
located on each platted tract of commercial property, except as otherwise provided within
these criteria, and shall be constructed by the commercial property owner or developer,
and made available for use by the City of Denton Solid Waste Department and/or
commercial recycling service provider. For purposes of these solid waste requirements,
commercial property represents any attached residential arrangement of 4 or more living
units and all non-residential property. Proper construction of the container enclosures
shall be completed prior to final acceptance of the development or property by the City's
Planning and Inspection Departments.
Commercial property on-site waste and recycling storage facilities (container enclosures)
shall be available for the storage of all municipal solid waste and recyclables generated
for each platted property. Some specific areas of the City of Denton (Downtown Square,
strip centers, etc) may be recommended for shared container service. Container
enclosures shall be of adequate size to contain all solid and liquid wastes and recyclables
generated on the property, which may include, but are not limited to municipal solid
waste, recyclables, grease and oils, process by-products and wastes, hazardous waste,
medical waste, and any special wastes. The container enclosure shall be constructed to
such capacity as to contain the aforementioned wastes and recyclable materials generated
between scheduled collection service days.
Commercial Business Categories:
Commercial, industrial, and institutional establishments will be provided municipal solid
waste and recycling collection services by the City of Denton Solid Waste Services
Department using front load and/or roll-off container(s).
The general types of business services or land use establish the business categories.

Solid Waste and Recyclables Storage Enclosure Requirements:
The Solid Waste and Recyclables enclosure information shall be contained within
engineering drawings and specifications, and other written documentation submitted to
the City of Denton. The submittal of the required materials shall be concurrently with the
building permit application. Construction of enclosures(s) shall be completed prior to the
issuance of a certificate of occupancy. Submittals to the City of Denton should include
the following.
. Drawings of container enclosure location(s) per scale on a site drawing.
. Drawings delineating the ingress / egress service pathway sufficient for
the safe movement and travel of Class 7 collection vehicles.
. Drawings containing enclosure construction specifications.
Proposed future growth and phased development shall be considered in the site design
with regard to sizing, location( s), and access of future solid waste and recyclables storage
enclosures. Refuse and recycling areas necessary for future growth shall be available for
development, but need not be developed, nor enclosures constructed, until the future
growth occurs.
Storage Space and Enclosure Accommodation Requirements:
The site plan must contain adequate enclosure space for solid waste and recyclables
storage containers. The following list provides the typical container storage area
requirements, based on industry waste generation rates for the listed business categories,
by which solid waste and recyclables storage containers shall be required.

Dimension Format:
Refuse and Recyclables enclosure area requirements are provided, by width and depth,
and represent outside wall dimensions (OD).
Example: 13.0 feet wide by 10.5 feet deep.
Standard drawings with construction specifications are included In Appendix A.

o Multi-Family Residential Units: Applicable to multi-family residential facilities
with four or more living units. Multi-family residential facilities with buildings
greater than two stories, and with greater than 5,000 gross square feet on any
floor, shall have at least one refuse collection chute for each floor above the
ground floor, which will deliver refuse to a central refuse storage room. Adequate
solid waste storage area is required if common or other public areas are provided,
i.e. pools, sports areas, recreation and meeting rooms, maintenance facilities, etc.

Commercial and business establishments, institutions, and other businesses, which are
not specifically listed in the above storage space and enclosure requirements, will be
reviewed for adequate solid waste and recyclables enclosures based on site-specific
information and Solid Waste and Recycling Design Factors.
Developments which initially are projected to produce waste and recyclable volumes that
are less than waste generation rates for their respective industries, may construct a
smaller solid waste and recyclables enclosure area through submittal of an Alternate
Development Plan (ADP). Approved ADP's providing for the initial design of a smaller
enclosure area, shall have a minimum of one enclosure's additional area designed into the
project to accommodate additional growth, and/or a change in site use. This additional
area, planned within the development, shall be available for development when needed,
but need not be developed, nor enclosures constructed, until the future growth occurs or
the site use requires the additional area.
General Container Enclosure Information:
o Enclosures may contain other storage containers such as grease and oil
receptacles, and other items, as long as the enclosure is enlarged to accommodate
the additional items.
o Gates shall be required if when viewed from the street, the interior of the
enclosure is visible.
o Personal access side gates are recommended as a feature of all gated enclosures.
o In some industrial applications, where industrial businesses are located in
perimeter areas of the city, and where the container locations are not visible from
the public roads, then container enclosures are not required.
o The property owner is responsible for maintenance of the enclosure.
o Businesses of 500 square feet or less will be evaluated by city staff to determine
the applicability of constructing an enclosure. Refuse carts may be appropriate,
thereby eliminating the need for construction of an enclosure.
Enclosure Construction Information:
o Front load enclosures shall have walls constructed to a minimum 6- foot height, or
as tall as required to conceal the container. Compactor enclosure walls require
construction a minimum of 8 feet in height in order to conceal the compactor and
mechanical equipment.
o Materials used for container enclosure construction shall be constructed of 100%
noncombustible materials, masonry or metal materials, compatible with the main
building architecture and appearance and may include:

Enclosure Access, Placement, Ingress and Egress Requirements:
o Property owners shall design and construct enclosures, and enclosure access
requirements, which are in compliance with the requirements of Chapter 469 of
the Texas Government Code and the Texas Accessibility Standards.
o The solid waste enclosure shall not be located in a fire lane, public right-of-way,
public utility easements, or sidewalk area.
o No solid waste or recyclable enclosure shall be located within the required front
yard or protrude in front of any buildings along the designated lot frontage.
o The location of solid waste enclosures may not cause the obstruction of traffic for
excessive lengths of time while being serviced.
o The solid service truck shall be on the property owner's property during service
operations, if the site design permits.
o Ingress and egress routes shall be designed to facilitate exiting the property in a
forward driving direction for all interstate and state roads, arterial streets, and
collector streets with four lanes.
o Utility wires and structure overhangs should have a minimum height clearance of
20 feet along the ingress and egress route. No utility wires shall extend over the
enclosure approach and service area.
o Dead end streets, which are planned for extension in future development phases,
will have sufficient all weather turn around areas for Class 7 trucks constructed of
a suitable road base material.
Compactor Requirements:
o The customer is responsible for providing a %" hose bib within 20 feet of the
compactor enclosure. The hose bib shall meet all City of Denton plumbing code
requirements.
o In specific wet waste situations the compactor site shall contain a minimum 12"
by 12" screened sand or grit trap catch basin connected to a minimum 4"
wastewater drain, which shall be connected to the City's sanitary sewer system.

Wastewater drain construction specifications shall comply with all City of Denton
code requirements.
Exceptions / Alternate Development Plan:
Alternative solid waste and recyclables services options meeting or exceeding the
Solid Waste and Recyclables storage and enclosure requirements may be
submitted to the City of Denton for consideration on a case by case basis. All
exceptions are subject to approval by the City of Denton using the Alternative
Development Plan process outlined in Section 35.13.5.
