CITY OF DENTON CITY COUNCIL
April 2, 2007
After determining that a quorum is present, the City Council of the City of Denton, Texas will
convene in a Special Called Work Session on Monday, April 2, 2007 at 11:30 a.m. in the
Council Work Session Room, 215 E. McKinney, Denton, Texas at which the following items
will be considered:
NOTE: A Work Session is used to explore matters of interest to one or more City Council
Members or the City Manager for the purpose of giving staff direction into whether or not such
matters should be placed on a future regular or special meeting of the Council for citizen input,
City Council deliberation and formal City action. At a Work Session, the City Council generally
receives informal and preliminary reports and information from City staff, officials, members of
City committees, and the individual or organization proposing council action, if invited by City
Council or City Manager to participate in the session. Participation by individuals and members
of organizations invited to speak ceases when the Mayor announces the session is being closed to
public input. Although Work Sessions are public meetings, and citizens have a legal right to
attend, they are not public hearings, so citizens are not allowed to participate in the session
unless invited to do so by the Mayor. Any citizen may supply to the City Council, prior to the
beginning of the session, a written report regarding the citizen’s opinion on the matter being
explored. Should the Council direct the matter be placed on a regular meeting agenda, the staff
will generally prepare a final report defining the proposed action, which will be made available
to all citizens prior to the regular meeting at which citizen input is sought. The purpose of this
procedure is to allow citizens attending the regular meeting the opportunity to hear the views of
their fellow citizens without having to attend two meetings.
1. Receive a report and hold a discussion on a proposed Comprehensive Plan Amendment,
rezoning and an overlay district classification, potentially applicable to approximately
410 acres of land, generally located on both sides of West University Drive / U.S.
Highway 380, and being generally located between IH-35 and Bonnie Brae Street.

Following the completion of the Work Session, the City Council will convene in a Closed
Meeting to consider specific items when these items are listed below under the Closed Meeting
section of this agenda. When items for consideration are not listed under the Closed Meeting
section of the agenda, the City Council will not conduct a Closed Meeting and will convene at
the time listed below for its regular or special called meeting. The City Council reserves the
right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent with
Chapter 551 of the TEXAS GOVERNMENT CODE, as amended, as set forth below.
1. Closed Meeting:
A. Deliberations regarding consultation with the City Attorney – Under TEXAS
GOVERNMENT CODE Section 551.071 and Section 551.087 – Deliberations
regarding Economic Development Negotiations.
1. Receive a report and hold a discussion regarding granting economic
development incentives to Allegiance Development with respects to
development at Rayzor Ranch on a matter in which the duty of the
attorney to the governmental body under the Texas Disciplinary Rules of
Professional Conduct of the State Bar of Texas clearly conflicts with the
City of Denton City Council Agenda

provisions of the Texas Open Meetings Act, Chapter 551 of the Texas
Government Code; and regarding commercial or financial information that
the governmental body has received from a business prospect that the
governmental body seeks to have locate, stay, or expand in or near the
territory of the governmental body and with which the governmental body
is conducting economic development negotiations; and the offer of a
financial or other incentive to a business prospect.
ANY FINAL ACTION, DECISION, OR VOTE ON A MATTER DELIBERATED IN A
CLOSED MEETING WILL ONLY BE TAKEN IN AN OPEN MEETING THAT IS HELD IN
COMPLIANCE WITH TEXAS GOVERNMENT CODE, CHAPTER 551, EXCEPT TO THE
EXTENT SUCH FINAL ACTION, DECISION, OR VOTE IS TAKEN IN THE CLOSED
MEETING IN ACCORDANCE WITH THE PROVISIONS OF §551.086 OF THE TEXAS
GOVERNMENT CODE (THE ‘PUBLIC POWER EXCEPTION’). THE CITY COUNCIL
RESERVES THE RIGHT TO ADJOURN INTO A CLOSED MEETING OR EXECUTIVE
SESSION AS AUTHORIZED BY TEX. GOV’T. CODE, §551.001, ET SEQ. (THE TEXAS
OPEN MEETINGS ACT) ON ANY ITEM ON ITS OPEN MEETING AGENDA OR TO
RECONVENE IN A CONTINUATION OF THE CLOSED MEETING ON THE CLOSED
MEETING ITEMS NOTED ABOVE, IN ACCORDANCE WITH THE TEXAS OPEN
MEETINGS ACT, INCLUDING, WITHOUT LIMITATION §551.071-551.086 OF THE
TEXAS OPEN MEETINGS ACT.

rezoning and an overlay district classification, potentially applicable to approximately
410 acres of land, generally located on both sides of West University Drive / U.S.
Highway 380, and being generally located between IH-35 and Bonnie Brae Street.
BACKGROUND
Applicant: Allegiance Development Dallas, TX
Allegiance Development has submitted a request for a Comprehensive Plan Amendment,
Special Purpose Overlay District and rezoning for the Rayzor Ranch Development. The
entire subject property encompasses approximately 410 acres of land located generally on
both sides of U.S. Highway 380 (West University Drive), between Interstate Highway 35
and Bonnie Brae Street (See Exhibit 1).
The parcel north of U.S. 380 contains approximately 153 acres (Northern Tract) and is
currently undeveloped except for an existing self-storage facility (to be demolished) (See
Exhibit 1). The applicant proposes to construct a combination of retail and single family
residential uses on the Northern Tract (See Exhibit 2). The parcel south of U.S. 380
contains approximately 257 acres (Southern Tract) and is undeveloped (a single family
structure was recently removed) (Exhibit 1). The applicant is proposing to develop a
combination of retail (pad sites and an outdoor mall), residential (single family and
multifamily), two hotels, offices and park uses on the Southern Tract (See Exhibit 3).
On March 27, 2007, the City Council approved a Comprehensive Plan amendment for the
Northern Tract from “Neighborhood Centers”, “Existing Land Use” and “Community
Mixed Use Centers” land use designations to “Regional Mixed Use Centers” and
“Neighborhood Centers” land use designations. The Council also approved the first
phase of the Special Purpose Overlay District for the entire 410 acre Rayzor Ranch site
and a rezoning of 53.65 acres of the Northern Tract from Neighborhood Residential
Mixed Use 12 (NRMU-12), Neighborhood Residential Mixed Use (NRMU) and
Community Mixed Use General (CM-G) zoning districts to a base zoning district of
Regional Center Commercial Downtown (RCC-D) as modified by the Overlay District.
The remainder of the applicant’s request is as follows:
1. Comprehensive Plan Amendment for the Southern Tract (257 acres) from
“Neighborhood Centers” and “Community Mixed Use Centers” land use
designations to “Downtown University Core” and “Neighborhood Centers” land
use designations.
2. Complete the remainder of the Special Purpose Overlay District regulations for
the entire 410-acre site. These regulations will include development, landscaping
and design standards for the area outside of the 53.65 acres already rezoned on
March 27, 2007.
3. Rezone the remainder of the Northern Tract (approximately 100 acres) from
Neighborhood Residential 3 (NR-3), Neighborhood Residential Mixed Use 12
(NRMU-12), Neighborhood Residential Mixed Use (NRMU) and Community
Mixed Use General (CM-G) zoning districts to base zoning districts of Regional
Center Commercial Downtown (RCC-D) and Neighborhood Residential 3 (NR-3)
as modified by the Overlay District.
4. Rezone the Southern Tract from Neighborhood Residential 6 (NR-6) and
Neighborhood Residential Mixed Use (NRMU) zoning districts to base zoning
districts of Regional Center Commercial Downtown (RCC-D) and Neighborhood
Residential Mixed Use (NRMU) as modified by the Overlay District.
5. Creation of a Special Purpose Sign District for the entire 410-acre site that will
allow less restrictive sign regulations for the proposed development than the
current Development Code requirements.
The request for rezoning and modifying the Special Purpose Overlay District for the
remainder of the Northern Tract as well as the entire Southern Tract are being considered
at later public hearings from the 53.65 acres portion of the Northern Tract approved on
March 27, 2007 primarily for the following reasons:
1. The applicant has proposed street sections for much of the Southern Tract that are
not adopted standards defined in the City Transportation Criteria Manual. Many
of the street widths are narrower than what the Criteria Manual requires. The
applicant and staff are working together to resolve the City’s concerns over
parking and access brought about by these alternative street sections (defined as
Context Sensitive).
2. City and TxDOT staff are in the process of reviewing the applicant’s proposed
modifications to U.S. Highway 380. These modifications have been described in
a Traffic Impact Analysis (TIA) submitted by the applicant’s engineers; once the
City and TxDOT are in support of the TIA, road improvements will be required to
be constructed in order to serve the proposed development.
3. City staff is working with the applicant to ensure adequate infrastructure will be
in place to serve the proposed development in the southern Tract. This
infrastructure includes water, wastewater, storm water and electricity.
4. The layout of the proposed single-family developments in both the Northern and
Southern Tracts needs to be clarified by the applicant in order for staff to
accurately access the infrastructure (streets, driveways, utilities) requirements of
the development.
