WHEREAS, the County has leased 15 parking spaces on the Williams Trade Square ("Square") from the City for the past eight years; and WHEREAS, the Lease Agreement between the City and the County also provides five "anytime" Square parking permits to the Commissioner's Court and one "anytime" permit for the County's Director of Facilities; and WHEREAS, the Lease Agreement additionally includes 21 Square parking permits for various County staff members during the Commissioners Court meetings, which are only good on Tuesdays; and WHEREAS, the City of Denton desires to continue to lease 15 parking spaces, as well as six "anytime" permits and 21 parking permits in the Williams Trade Square to Denton County; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Manager of the City of Denton, Texas, is hereby authorized to ex- ecute a lease agreement between the City of Denton and Denton County to lease 15 parking spaces, six "anytime" permits and 21 parking permits in the "Williams Trade Square," a copy of which Lease Agreement is attached hereto and incorporated by reference herein. SECTION 2. This Ordinance shall become effective immediately upon its passage and approval. WITNESSETH: 1. Lessor leases to Lessee and Lessee leases from Lessor fifteen (15) parking spaces at the Williams Trade Square for a period of twelve (12) months commencing on 1st day of October 2011 and ending on September 30, 2012, at a monthly rate not to exceed Seventeen Dollars and Fifty Cents ($17.50) each to be occupied as a parking lot only. 2. Lessee will pay the rent monthly on the 1st day of the month. 3. Lessee agrees to allow Lessor to hive free access to the premises; to leave the premises, 1 on termination of the lease, in good repair; not to assign nor sublet the premises or any part there of; and to hold Lessor harmless and indemnify Lessor from any claim, damages or loss resulting from the use of the parking lot as to any use of said premises by Lessee. 4. Lessor will provide the five (5) members of the Commissioners Court with a sticker permit authorizing parking in the Courthouse Square area without time limit, to be in effect during the term of this Agreement. 5. Lessor will provide the Facilities Director of Denton County with a sticker permit authorizing parking in the Courthouse Square area without time limit, to be in effect during the term of this Agreement. 6. Lessor will provide twenty-one Tuesdays -only sticker permits authorizing parking in the Courthouse Square area. These permits shall be in effect during the term of this Agreement. 7. Lessee shall have the option to extend this Lease for seven (7) successive terms of twelve (12) months each at such rental that the City Manager shall establish. To exercise the option to extend, Lessee shall give Lessor sixty (60) days written notice of its intent to renew the Lease. Upon receipt of such notice, the City Manager shall give Lessee written notice of the increase, if any, in rental. Increases in rental shall be based upon economic conditions. McKinney Denton, TX 76201 RE: Williams Square Parking Lot spaces CORRECTED Please consider this letter as Denton County's notice to renew the lease agreement between the City of Denton and Denton County for 15 parking spaces at Williams Trade Square. The renewal period will become effective as of 10/01/2013 to 09/30/2014. It is my understanding that the parking spaces will be leased to Denton County at the same rate as the original contract; a monthly rate of seventeen dollars and fifty cents ($17.50) each. The sticker permits for on -street parking are maintained by Denton County and a current issue list of permits handed out will be provided to Mrs. Julie Glover, Economic Development Program Administrator for the City of Denton, when we receive the new permits. Last year's permits will be collected and returned to Mrs. Glover along with the listing for 2013-2014. Thank you for your time in this matter.
