Home My WebLink AboutR2012-001RESOLUTIONNO. �012-�01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXA5 REGARDING ESTABLISHMENT OF THE ROUTE OF THE DENTON MUNICIPAL ELECTRIC NORTHEAST DENTON TRANSMISSION L1NE RE-BUILD PROJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Denton Municipal Electric ("DME"), the City's electric department, has previously announced that the necessity exists for the re-build of the Northeast Denton Transmission Line (the "Project") in order to properly serve future load and the needs of its customers; �and WHEREAS, in connection with this Project, over time DME staff has carefully examined a number of different routes in the northeast part of the City in order to determine an appropriate route, considering the impact on homeowners, avoiding the displacement of Denton residents, the cost of easements, the cost of worlc in existing subdivisions, transmission line construction costs, engineering factors, and also considering other relevant factors to the extent reasonably possible; and WHEREAS, although not required by applicable law to do so, DME conducted four public meetings in the months of July through December, 2011 with advance notices made to its residents, in order to gauge the sentiment of the residents of the City, as well as to receive input from the residents; which meetings spurred dialog which has assisted DME in arriving at its preferred recommendation; DME Staff also placed information, including numerous possible alternate locations for the route, for public viewing on the City's website; and WHEREAS, the City Council has on three occasions had an opportunity to hear the input of its residents at three public hearings, conducted on October 18, 2011, November 15, 2011, and on January 10, 2012; and the Council has considered the information and the preferred route recommendations provided to it by DME Staff; and has also considered the public comments regarding the location of the preferred route; and WHEREAS, on November 15, 2011 the Council unanimously approved Resolution No. 2011-043 approving the "purple" route for the southern segment of the Proj ect running from Spencer Substation to the proposed new Kings Row Substation; and WHEREAS, the Council, after considering all of the facts and circumstances, is of the opinion, and the Council accordingly finds, that Route "C," designated below for the northern segment of the route for the Project, is a feasible and cost-effective route for the Project; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION l. The City Council hereby approves the northern segment of route for the Denton Municipal Electric Northeast Denton Transmission Line Re-Build Project, heretofore referred to as Route "C," as depicted on the Map attached hereto as Exhibit "A," which Map is incorporated by reference herewith for all purposes. The City Council further directs staff to route that portion of such Line, in substantial accordance with Exhibit "A". SECTION 2. The recitals set forth in the preamble to this resolution are hereby incorporated in, and are made a part of this resolution for all purposes. SECTION 3. This Resolution shall talce effect immediately from and after its adoption. PASSED AND APPROVED this the lOth day of January, 2012.
