Anderson § § DENTON COUNTY, TEXAS Deceased § PROBATE DIVISION r WAIVER, RELEASE AND AUTHORIZATION The City of Denton is a residuary devisee of the estate of Ruth 1. Anderson, deceased, under a will filed for probate in the County Court at Law No. 3 of Denton County, Texas, in Cause No. PR•93-451. Included in this estate was a Baldwin organ that Ms. Anderson attempted to give to Gethsemane Presbyterian Church prior to her death. Legal questions have arisen regarding the effectiveness of this gift. If the gift were not effective, the City of Demon, r' as a residuary devisee, might have an interest in the organ. F~. k ti The City of Denton, in order to avoid any legal dispute over the effectiveness of the gift r` and to honor Ms. Anderson's stated desire, hereby waives any interest it might have in i the organ and authorizes its transfer to the Gethsemane Presbyterian Church. j The City of Denton further releases Fairchild H. Carter, named as executor in the will, and the estate of Ruth 1. Anderson, from any liability either might have as a result of such transfer. Notwithstanding the foregoing, this waiver, release and authorization shall be effective only if all residuary devisees ex-cute a similar document. Dated , 199. Harrell, City Manager SUBJECTS Transportation Improvement Plan (TIP) for Public Transportation in Fiscal Year 1995 DATE. January 6, 1994 The City of Denton is submitting two programs for consideration in the Transportation Improvement Plan to be evaluated by the Regional Transportation Commission (RTC) of the North Central Texas Council of Governments (NCTCOG). c The first is for the Section 9 transit program and he The second is City for Congestion Mitigation Air Quality (CMAQ) funds. Council will review a detailed Section 9 grant application in March 1 before the funding request This is sthe submitted to the funding application for Transit Administration (FTA). funds and these will be evaluated and allocated by the NCTCOG. Section 9 Program The City of Denton is eligible to receive Section 9 ETA funding for r our p,.blic transit system operated by Services Program for Aging r Needs (SPAN). The amount of Section 9 federal funding available to be programmed is $417,037. The City of Denton will develop a grant application and bring that d to the City Council for review in March. However, in order for the City of Denton to be able to receive any FTA funds, planning, y operating, and capital funds must be programmed into the TIP. Therefore, it is ay for the year 11995. submit This TIto the NCTCOG P submission this plan for the TIP for fiscal does not commit the City financially at this time. The City's local match financial commitment will be made with the submission of the grant application. The Section 9 TIP submission of ;417,037 of federal funding includes $40,187 planning, $215,250 operating, and$161,100 capital funds. Capital plans include lift-equipped replacement signs for the trolley routes. Congestion Mitigation Air ualit Program Additionally, the City of Denton is submitting a request for CMAQ funds for partial reimbursement for the Ozone Alert day program for fiscal years 1994-1996. As the City Council will recall, the summer of 1993 was the first l i i ,4 14 y' j I y , < 'Y year that the City offered free rides on the trolley syste on each. Ozone Alert Day. DART, the "T" in Fort Worth and Denton's trolley system are all submitting CMAQ requests for partial reimbursement for lost fare revenues on Ozone Alert days. The NCTCOG coordinated meetings with the three transit providers in the region and recommended that 25c fares be charged on ozone Alert days In all three cities. The City of Denton concurs with this recommendation and this program has been submitted with a 251; fare. By having the same reduced fare in all three cities, this program will be marketed in a coordinated manner. Denton will benefit greatly from this combined marketing since it will likely be covered in the Dallas and Fort Worth media. This program would allow the City to recoup 54% of the lost fare revenues on Ozone Alert days in 1994, 19950 and 1996. The lost fare revenues for Ozone Alert days in the summer of 1993 were completely absorbed by the City. Harroll, City Manager FROM: Rick Svehla, Deputy City Manager DATE: January 5, 1994 SUBJECT: Call for Projects for the Congestion Mitigation/Air Quality Program from TxDOT and COG { ' We were advised several of weeks ago that there would be a new call for projects for 1995 for Congestion Mitigation/Air Quality kinds i of improvements (CMAQ). Our staff has been working on putting d# together some suggested projects. Jerry Clark and his staff have included those for your information along with estimated cost of those projects. Council may recall that we have been very successful in the past getting approval for a number of our projects. These federal dollars require a local match. t f J What we are asking for is permission to submit these projects. As in past years, the most logical source of funding for these projects is the existing bonds or interest from existing bonds. We have checked with Finance and have verified existing interest from the bonds that were sold for University Drive in 1977. Also included with Jerry's information is a table which shows the number of points that are given in the ranking of the CMAQ projects for city participation. With most of the projects, we will have to I match a minimum of 20% of the construction costs. However, if we match more, we have a better chance to get projects. This is part of an overall ranking system that gives a maximum of 100 points to a each project. This is what the COG staff uses to help rank the project that it ultimately recommends to the RTC and that are ultimately passed on to the Executive Board of COO and TxDOT. Jerry has indicated to you the eight projects that we think are appropriate to be submitted. They are listed In rank order. As you can see, the top four or five are signals and turn lanes. The reason these are ranked the highest is generally they effect more Ap+ of our congestion and therefore would rank higher. Harrell Date January 5, 1994 Page 2 e U V participation, staff would recommend that we try to match these first four projects with a minimum of 41t-46%. That would enable us to get the most points. As indicated earlier, we have approximately $150,000 worth of interest money from the U.S. 360 bonds. We would suggest to the Council that we be allowed to participate at these levels in order to get the maximum points in j the participation categories. There may be other projects that the Council would like to include, or we could change the participation levels per their direction, in any event, if the Council feels comfortable with this application or other projects, we would confirm these funding suggestions with the 191 Committee and bring back formal recommendations to the Council prior to actual acceptance of these grants. Those submittals are due to NTCOG on Friday, January 14, 1994. The most effective projects were traffic signals and similar that show real congestion and € delay reduction. Capacity is to be handled through other programs. The enclosed project submittal form shows our preliminary list to be submitted for city Council approval on January 11, 1994. These i projects are Engineering and Transportation Department staff recommendations that are based on public input and consultation with Buzz Elsom, area Engineer TxDOT. We checked the prices on the traffic signals with District 18 who recommended some basic figures. Harrell, City Manager SUBJECT: RECEIVE CITY COUNCIL APPOINTMENTS TO THE SOLID WASTE MASTER PLAN ADVISORY COMMITTEE (SWMPAC) RECOMMENDATION: No recommendation required, received City Council appointments to the Solid Waste Master Plan Advisory Committee. BACKGROUND/SUMMARY: The Denton City Council reviewed the Public Utilities Board's recommendations for the Solid Waste Master Plan Advisory Committee membership, goals and proposed activities. The Council accepted the Board's recommendations with the following changes{ j 1. The City Council would not actively participate as a tl committee member but would attend committee meetings as needed. 2. Residential representation appointed by each district council person does not have to be from their district. 3. A high school student would be added as an advisory committee member. SWMPAC appointments for the residential and the business members are to be provided by the City Council. The membership on the committee from the other entities will be provided by those entities. It is anticipated that the committee membership can be finalized before the end of January and that the first meeting of the committee could be planned for the first part of February. ` I i I { 1 t.. The SWMP is to be developed utilizing a community advisory committee, chaired by City staff, with reporting responsibilities to the Public Utilities Board and City Council. The advisory committee will consist of approximately 25 members representing a cross section of the Denton community (See Exhibit I). It is anticipated that the main advisory committee will assemble in smaller groups, as needed, to address various issues in the solid waste plan. These subcommittees may further involve special community groups to investigate and develop the appropriate course ' of action for specific Issues. All committees and subcommittees j will be provided with administrative and consultant support as needed to facilitate the master planning process. . r In general, the Denton Solid Waste Management Plan will identify demographic and waste stream estimates assess adequacy of 1 existing waste management practices, programs and facilitiesi identify and address short and long-range management alternatives: coordinate the local solid waste activities with regional and state initiatives; and recommend a plan of action to encourage and achieve a greater degree of waste minimization, recycling and resource recovery. The SWMP will address solid waste management activities over a period of 20 years. Specific details and implementation activities will be identified and presented in a short-range planning period, one to five years, with less detailed information for the intermediate planning period (6-10 yrs) and general information for long range (11-20 yrs) planning period.
