Harrell, City Manager t DATE: August 50 1994 SUBJECT: Request For An Exception From the Noise Ordinance For the North Texas State Fair and Rodeo Au North Texas Fairgrounds ' gust 19-28, At the ! Bob PowersMr, , representing the North Texas State Fair Association, has requested that the City Council grant an exception to the noise ordinance for use of loudspeakers, amplifiers, and 4 musical instruments for the purpose of holding the 66th North Texas ,r State Fair and Rodeo at the North Texas Fairgrounds during the E period August 19-28. The noise ordinance declares loud s Bakers, ,cry amplifiers, and musical instruments a noise nuisance p f3 attar the hour of 10:00 p,m. (please see co particularly the .:e attached). However, the ordinance states that the City councilamay make exceptions when the public interest is served. During the regular meeting of August 2, Council considered and s}. denied a request to grant an exception for this event. I has worked with the Board of Directors to bring an amended request , f,~'j to the Council for reconsideration. r The specific dates and times of the exce tions follows: p requested are S ¢ August 22-25 (Monday-Thursday) Augyst 19, 20, 26, 27 10230 p.m. (Fridays, Saturdays) 12:00 midnight August 21 (Sunday) ,•r4 August 28 (Sunday) 10100 p,m. 1:00 p.m,-4:00 p,m. The dates reflect changes in threa areas, denied by Council sought an exception for MondThe ay throughsThursday until 11:00 p. m.1 on tiundaY, August 21, until 11:00 p.m.; and to begin on Sunday, August 28, at 8 a.m. Mr. Powers believes that { t• "Dedicated to Quality Service" t , I t~laNo~" L - pan z2-- 1 this amended request represents a good faith effort at mitigating the disruption to the adjacent neighborhood. Council will remember that Staff prepared a temporary no parking ordinance for the area surrounding the Fairgrounds. That ordinance was recommended for approval by the Traffic Safety commission and subsequently approved by the Council last Tuesday. The affected streets are as follows= Both sides of Carroll, from Fain to Headlee; West side of Denison, from University to Sherman] East side of Denison, from Sherman to Headleef West side of Bolivar, from Sherman to Fain; South side of Ross, from Carroll to Bolivar; North side of Fain, from Carroll to Bolivar; North side of Strata, from Carroll to Mesquite. The pur;ose of the temporary no parking ordinance is to allow Y' better traffic flow and reduce congestion on Carroll Boulevard during the festivities at the Fairgrounds. PROGRAIMS. DEPARTMENTS. Odor. ~ (a) It shall be unlawful for any person to create or cause any unreasonably noxious, unpleasant or strong odor which causes material distress, discomfort or injury to persons of ordinary sensibilities in the immediate vicinity thereof. (b) It shall be unlawful for any person to create or cause any odor, character, strbngth or continued duration u to substantially interfere with thor smoll e comfortable bsuch le enjoyment of private homes by persons of ordinary sensibilities.
