TO THE CITY COUNCIL:
In accurdance with the authority vested in the Public Utilities Board by
Section 12:08 (f)• of the Charter of the City of Denton, the Public.
Utilities Board submits the following statement:
Denton's Municipal Electric Utility has served the community well for
55 years, aid today is one of this city's most valuable assets, providing
abundant electric power at reasonable costo. The Municipal Electric Utility
is an important industry in Denton, and the investment return `o the people
from the operation of the Utility--in accordance with Section 12:03 (b)(1)••
of the City Charter--makes an important contribution to the City and is a
mayor factor in maintaining the present low tax rate.
On February 24, 1959, the residents of Denton overwhelmingly endorsed the
new City Charter which creat.d the Public Utilities Board and otherwise
provided for the continued operation and growth of Oenton's municipally
owned utilities. Lest January, the voters of Denton approved the $5,200,000
electric revenue bond issue by a margin of over 2 to 1. Plans are well
advanced for the expansion of Denton's Municipal Electric Plant under this
program.
An exhaustive management survey of the Municipal Utility System is planned,
as specifically required by the City Charter under Section 12:08 M.
Studies of this scope must be carried out in an orderly manner with advance
planning, and it is expected that the results of the forthcoming study,
made in accordance with the Charter provisions, will produce valuable re
recommendations concerning the operation of Denton's municipal utilities.
Any proposal for an additional study, other than this, would be inronsistent
with the orderly procedures provided by our City Charter, and would require,
in our opinion, an unwarranted expenditure of public funds.
Full information concerning your Municipal Electric System and the city's
other municipal utilities are, of cuuras, available at all times to all
Citizens of Denton. The Denton Municipal Utilities have a vital stake in
the orderly growth of our community. Hare in Texas, the record of industrial
growth of such cities as Austin and San Antonio--and elsewhere over the nation
such cities ns Los AnDeles, Coaha, Snattle, Jacksonville (fie.) and Chattanooga
(Tenn.)--to name only a few--demonstrates that municipal lectric service is
no deterrent to InJuatri9l dowelopm3rit.
Although utility sorvices are only one of a large, diverse group of facture
influencing the location of new industry, Oenton's municipal utilities stand
ready to work with any and all other groups in tha community in promoting the
future development of Denton.
The Public Utilities Board always is zsceptive to const.ictive ideas and
suggestions from any unselfishly motivated group Q Denton. We welcome the
interest and participation of all our citizens in the conduct of our
Municipal Utilities. With ol: of us working together, we cannot fail to
accomplish our goal of making Oenta;i a better city in which to live.

• Section 12:08(f) It shall be the duty of the Board to act in an
advisory caprcity to the Council, with authority to hold public hearings
and to study and racommefid policies relation to the operation, promotion,
enlargement, future planning and such other ma':ters involving City--awned
utilities ~s may be referred ti it by the Coun.;il. At intervals, nit ex-
ceeding 10 years the Council shall ut the expense of the utilities involved,
cause a general management survey to be made of all utilities under the
jurisdiction of thi Board by a competent management'consulting or industrial
engineering firm, the report and recommendations of which shall be made
public; provide:d, that the first such survey shall be made within three
yeare of the urfective date of this charter.
Section 12:03(b)(1) After all the requirements of the various funds
have been met, there shall be computed a return on the net investement in
the utility system. The "Ne`t Investment" figure used in these computations
shall be Laken from the independent audit of the utility systems for the last
fiscal period. The City shall be entitled to receive annually an the not
investment from excess revenues, if any, not more than six percent of the net
investment.

Notice is hereby givan that in the County Court of Denton
County, Texas there is pending a certain Proceeding in Eminent
Domain, entitled City of Denton vs. Guillelmine Vir,;inia Coston,
et al and rr.mbored ,j b , wher,in t-hu City of Denton, Texas
is Plaintiff, and GLM1elrrin.3 Virginia Coston, and husband,
Aulino Joston are Dafandants; that such proceeding is in
minent Domain for thi condemnation of the fee titleto all
that certain real ostato situated in Denton County, Texas,
known and described as follows;
All that curtain tract or parcel of land, situated
in the County of Denton, State cf Texas, and being
a portion of that certain tract or parcel of land
in the F. Puehalski Survey, Abstract No. 996 conveyed
by Guillelmine itanady, a widow, to Guillelmine Vir-
ginia Coston, by Warranty Deed recordo4 in Volume
337, Page 160 of the Deed Records of Denton County,
Texas, and being more particularly described as
follows!
BEGINNING at a point in tho north line of Wust Hickory
Street and the south line of the said Coston tract
of land, said boginning point being 75 feet west of
the southeast corner of the said tract;
THENCE north parallel with and 75 feat west of the
east line of said Coston tract 320 feet to a point
for earner in the south line of West Odic Street and
the north line of the said tract;
'.M',NCE west with the south line of West Oak Street 97
feet to a point for corner, sane being the northwest
corner of the Coston Tract;
