I THE STATE OF TEXAS ) COUNTY OF DENTON ) CITY OF DENTON ) TO THE HONORABLE BOARD OF ADJUSTMENT OF THE CITY OF DENTON, TEXAS: WHEREAS, the undersigned have been notified of a Meeting to be held by your Body (which meeting has been adjourned until Wednesday, September 27, 1961, at the City Hall in Denton, Texas at 4:00 P.M.); such Hearing to be conducted under and pursuant to the provisions of Article 13.33 E.2 of the Zoning Code of the City of Denton, Texas, to consider an application for the extension of an existing nonconforming use in a Cla6;s "R" dwelling district; such application being that of Mr. R. W. Minnis, and covering the pro- perty at 1417 Anna Street; and, WHEREAS, the undersigned are of the opinion that such non- conform3ng use should not be extended farther, and are strongly opposed to such extension; NOW THEREYORE, the undersigned hereby Respectfully petition your Honorable Body, that the application of the said R. W. Minnis for such nonconforming extension be denied for the following reasons: 1. Such expansion would detract from the appearance and enjoyment of the neighborhood, which is intended to be, and duly zoned, Residential, for single family dwellings. 2. The granting of any such permit will create a precedent, and will lend encouragement to others, to file similar applications, to the detriment of the neighborhood. It is the observation of the undersigned that once the'boor" is opened to encroachments by non- „ conforming uses, or violations, it is extremely difficult there- after to prevent others of like character. 4. Property values will be damaged by this expanded use in t the area; particularly, the value of the immediately adjacent pro- perties. 5. It is believed by the undersigned that the real purpose of such "conditional use permits" or "permit for e..xpansion of non- conforming uses", is only to prevent the working c!f an actual hard- ship or inequity on a person already enjoying a nonconforming use. In the present instance, it is clearly not a question of preventing any hardship or inequity to the applicant. Rather, the hardship would result to the undersigned, were the permit granted. R E S 0 L U T 1 0 N WHEREAS, Trinity Valley Helicopter Service of Fort Worth, Texas, has • applied to the City Council of the City of Denton, Texas, for a temporary establishment of a helicopter landing area on certain property belonging to Central Baptist Church at 2300 Beaumont Street in the City of Denton, Texas, under provisions of Article 2.08 of the Code of Ordinances of the City of Denton; and WHEREAS, such landing area is requested for the purpose of offering helicopter rides to the public for hire for the duration of the 1961 North Texas State Fair only; and WHEREAS, such proposal has the approval of the Central Baptist Church and the North Texas State Fair Association; and WHEREAS, it appears that Trinity Valley Helicopter Service has secured liability insurance coverage with $50,000/$500,000 limits for the protection of the public; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEE , that the vacant property adjacent to and belonging to Central Baptist Church at 2300 Beaumont Street in the City of Denton, Texas, be, and the same is hereby, designated as a regular helicopter landing area under the provisions of Article 2.08 of the Code of Ordinances of the City of Denton, Texas, for a temporary period not exceeding the duration of the 1961 North Texas State Fair; and be it further RZSO1.VgD, that the said Trinity Valley Helicopter Service be, and it it hereby, granted permission to offer helicopter rides for hire to the public at said location during the hours that the 1961 North Texas State Pair is open to tM public; and be it further RESOLVED, that the permission to operate helicopter rides for hire within the City of Denton, Texas, as aforesaid, be all upon the condition that Trinity Valley Helicopter Service executes a proper indemnity agreement with the City of Denton, Texas, agreeing to save and hold harmless the City of Denton from any and all liability for damages of any kind which may arise out of, or be in any way connected with, the conduct of helicopter rides for hire at the location mentioned above in this resolution.
