Also enclosed is a copy of a letter from the Bureau of Public Floods granting conditional approval to this stility adjustment. Please be advised that the condition placed upon the approval of this adjustment has now been removed. This letter is your authority to begin work covered by this adjustment. i'lease notify in writing our Resident Engineer in charge of this project, Mrs Joe P. Maddox SPECIFICATIMM FOR BACKFILL The following is an excerpt from the 1962 Texas Highway Oepnrtment Stand- ard Specifications for backfill of pipe sewers. Where pipes are referred to heroin, it is intended that "any underground utility facility" be sub- stituted therefor, Trenches shall be backfilled with material selected from the sewer trench excavation, or obtained from other sources, which is free from stones of such site as to interfere with compaction and is free from large lumps which will not break down readily under compaction. The Engineer shall have the right to reject any material containing more than 20 percent by weight of material retained on a 3-inch sieve, or material excavated in such a manner as to produce large lumps not easily broken down or which cannot be spread in loose layers. In gen- eral, material excavated by means of a trenching machine will meet the requirements above provided large stones are not present. The following requirements "hall apply to the backfilling of sewers in addition to the pertinent portions of the general requirements given in the preceding paragraph. After the bedding has been prepared and the pipes installed as required by the pertinent specifications, selected materials from excavation or borrow shall be placed along both sides of the pipe equally, in uniform layers not exceeding 6 inches in depth (loose measurement), wetted if required, and thoroughly compacted so that on each side of the pipe there shall be a berm of thoroughly compacted material at least as wide as the external diameter of the pipe, except insofar as undisturbed material obtrudes into this area. Filling and/or backfilling shall be continued in this manner to the elevation of the top of the pipe. Special care shall be taken to secure thorough compaction of the materials placed under the haunches of the pipe. All fill or backfill below the top of pipe shall be compacted mechanically in the manner prescribed above, regardless of whether or not such material is placed within the limits of the embankment or roadbed. In the case of pipe placed in trenches, that portion of the backfill above the top of the pipe which supports the em- bankL*nt or roadbed shall receive mechanical compaction and shall be placed in 6 inch layers in depth (loose measurement). The portion which will not support any part of the embankment or roadbed shall be placed in layers not more than 10 inches in depth (loose measurement) and shall be compacted by what- ever means the Contractor chooses to a density comparable with the adjacent undisturbed material. Bend operated mechanical tampers may be used with approval of the Engineer for compacting backfill. U,f. No assessment shall be made until after the notice and hearing provided by law, and no assessment shall exceed the special benefits in enhanced value to the property and the owners thereof by reason of such improvements. SECTION V. Such assessment shall be p,iyable either by: (A) Placing an amount equal to the paving assessment in e,1qcrow for the City of Denton with the City Engineer- ing D%partment to be paid upon completion and accep- tance of the paving by the City of Denton, or, (B) Executing a note or notes, payelile to the City of Denton, in an amount equal to the paving assessment to be assessed against the abutting property, said notes to be payable in equal monthly installments not to exceed ~5 - years, Interest on the note or notes, payable in equal month- ly installments, shall be at a rate of 8% per annum. Any balance on any note that is due and owing and un- paid shall carry a straight interest rate of B% until paid. In the event that the total amount of paving season- ment against any one lot is less than two hundred dollars ($200.00), two notes shall be executed by the owner of the property, payable to the City of Denton, as folla4e: The first note equalling 50% of the paving assessment to be assessed against his property is to be paid upon completion and acceptance of the paving by the City of Denton. The second note equalling the remaining 50% of the paving assessment to be assessed against the property shall be payable in twelve equal monthly installments, the first installment being due and payable thirty days after the completion and acceptance of the paving by the City of Denton, and the balance shall be paid iu eleven equal monthly installments payable on the same date of each month thereafter, and shall bear in- orest at " per annum. Any such installment may be paid at any time before maturity by the payment of the principal and accrued interest thereon. Past due principal and interest shall bNr interest at the same rate from maturity un- til paid. If default is made in the payment of any -7- j } (y such installment or inteivat, th,i entire unpaid balance of the assessment ilus interest shall, with- out notice to the owners, and at the option of the holder of the Certificate of Special Assessment, if any, imit diately become due and payable together with expanses of collection and reasonable attorney's fees, if incurred. [n the event of such default, collection shall be enforced by suit in any court having jurisdiction. Upon the completion of the improvement and the accep- tance thereof by the City of rMnton. the assessment made against all abutting property owners who have not made arrangements for the payment of the assess- ment as above set forth, shall be immediately due and payable.
