Following is a statement of the Local Authority's plan fur selection of
applicants and assignment of dwelling units, in sufficient detail. to indi-
cate consistency of the plan with HUD requirements in paragraph Id of
Exhibit 2 to Law-Rent Housing Manual Section 102.1. (Insofar as provisions
of the Local Authority's adopted admission regulations are relied upon
in this statement, a copy may be attached,)

ARTICLE: II - OFFICERS
Section 1. Officers. The Officers of the Authority shall be a Chairman,
a Vice Chairman and a Secretary (who shall be Executive Director),
Section 2. Chaivm mn, The Chairman shall preside at all meetings of the
Authority. Except as otherwise authorized by resolution of' the Authority, the
Chairman Shall. Sign all, contracts, deeds And other instruments mado by thn
Authority. At each meeting, the Chairman shall submit such recommendations and
information as he may consider proper concerning the business, affairs and
ty.
policies of the Authority.
Section 3. Vice Chai.rrnan, The Vice Chairman shall perform the duties of

and shall pay out and disburse such moneys under the direction of the Authority.

Sect1cur j. Executive Director. T),e Secretary ehall be; the Executive Director
of the Authority and shall. have frenoral.rrupervision over the •R3-ministration of the
business and ttffatrs of the Authority, subject to the direction of the Authority.
He shall. be charged with the management of the housing, projects of the Authority.
Section G. Additional Duties, The officers of the Authority shall perform
such other duties and fuunctions as! may from time to time be required by the Authority
or the Bylaws or rules and regulati..rns of the Authority.
Section 7. Pllection or A ointment. The Cttaizmran and Vice Chairman stall he
elected at the annual. meeting of the Authority from among Commissioners of the
Authority, and shall hold office for one year or until their Successors are elected
and qualified, In case of the absence or incapacity of both the Chairman and Vice
Chairman, the other Commisaloners of the Authority msy elect an Acting Chairman to
serve during the period of absence or incapacity of the Chairman and Vice Chairman.
The Secretary shall be appointed by the Authority. Any person appointed to

fill the office of Secretary, or any vacancy therein, shall have such term as the
Authority fixes, but no Commianioner of the Authority shall be eligible to this office,

Section fi. Vacancies. Should the offices of Chairman or Vice Chairman become
vacant, tho Authority shall, elect a successor from its membership at th0 next regular
j meeting, and such election shall be for the unexpired torn of said office, When the

office of Secretary becomes vacant, the Authority shall appoint a successor, as
aforesaid,
Section 9, Additional Personnel. Tho Authority may from time, to time employ
such personnel as it deems neeensary to oxeroine its powers, duties and functions as
prescribed by the Housing Authorities Law of the State of Texas and all, other laws
of the State of Texan applicable thereto. The selection and compensation of such
t personnel (including the Secretary), shall be determined by the Authority subject
to the laws of the State of Texas,

Section 3. S)eclal Moctin s, The Chairman of the. Authority cony, tihen he

Authority, ca]]. a special meeting of the Authority for the purpose of transacting
any business designated in the call. The call for a special meeting may be delivered
to each member of the Authority or may be mailed to the buLsincss or home add2ess of
each member of the Authority at least two days prior to the date of such special
meeting; provided, thnt formal. notice of the calling of a special meeting may be
walved if all members of the Authority sign a written walvcr of notice and consent
to meeting in which shall be set out the purposes, for which the meeting is to be
hold, At such special ;acoting no business shall be considered other than as desig-
nated in the call or waivorp but if all. of the members of the Authority are present
at a special meeting any cuid all business may be transacted at such special meeting.
Section lf, uorAt all meetings of the Authority a Majority of the
members of the Authority shall. conrstituto a quorum for the purpose of transacting ,
business; provided that a smaller number may moot and adjourn to some other time or I
until a quorum,is obtained.

section 6. Manner of Voting. The voting on all questions coming before the
Authority shall be by roll call., and the "yeae" and "nays" shall be entered upon the
minutes of such meeting.

THE HOUSING AUTHORITY OF THE CITY OF
DENTON, TEXAS
HELD ON MAY 27, 1370
For the purpose of organizing a meeting of the housing Authority of
the City of Denton, 'T'exas, was held on the 27th day of May, 1970, at
2;30 o'clack p.m„ at the Municipal Building in the Gity of Denton, Texas.
Members of the Authority were present as follows:
Bruce Davis, Bill Irwin, Herman Herod and Paul Young.
Tho following were absent: Jack Brown.
There wore also present the f, swing: Assistant City Manager,
Barry Ilu.mphrics, City Attorney, Jack Barton, and Jerry Golden of the
Denton Record Chronicle,
Oath of Office was administered by City Attorney, Jack Barton.
Commissioner Bruce Davis, the duly ac~polr:' d Chairman, presided,
and Barry Humphries was appointed Secretary of the meeting and kept the
minutes.

That the following Bylaws stall be and they are hereby approvod and
adopted as anti for the Bylaws of the Housing Authority of tha City of
Denton, Texas.
BYLAWS OF THE HOUSING AUTHORITY OF THE CITY OF t~

AR'PIGLr. THE AUTHORITY
Section 1, Name of Authority. The name of the Authority shall be the
'HOUSING AUTHORITY OF THE' CITY OF DENTON, TEXAS."
Section 2. Seal of Authority. The coal of the Authority shall be in the
form of a circle and shall bear the name of the Authority.
Section 3. Offlc of Author lty_. The offices of the Authority shall be. at
such place or places in the City of Denton, Texas, as the Authority may from ~
time to time designate by resolution,

The Secretary shall be appointed by the Authority. Any person appointed
to full the office of Secretary, or any vacancy theroln, shall have such term as
the Authority fixes, but no Commissioner of the Authority shall be eligible to
this office,
Section B, Vacancles, Should the offices of Chairman or Vice Chairman
become vacant, the Authority shall ele successor from its membership at the
next regular mooting, and su,)h election snail be for the unexpired tarm of said
office. When the office of Secretary becomes vacant, the Authority shall appoint
a successor, as aforesaid.

Section 9. Additional Personnel. The Authority may from time to time
enploy such personnel as it deems necessary to exercise its powers, duties
and functions as prescribed 'ay the Housing Autt.orities Law of the State of
Texas and all other laws of tho State of Texas applicable thereto. The selec-
tion and compensation of such personnel (fncludind the Secretary), shall be
determined by the Authority subject to the laws o`. the State of Texas ,
ARTICLE 111 -_MEETING'Section 1. Annual Meetin( The annual meeting of the Authority shall
he held on the 4th W--dnesday of May, at 2;30 o'clock p,m„ at the regular
meeting place of the Authority. In the event such elate should fall on a legal
holiday, the annual meeting shall be held on the next succeeding secular day,
Sc^tion 2, Regular Nieotinc~s._ Regular meetings may r)e hold without
notice at such times and places as may from time to timo be determined by
resolution of the Authority,
Section 3, Special Mec tinrts. They Chairman of the Authority may, when
he dooms it expedient, and shall, upon the written request of two members of
the Authority, call a special moetinrj of the Authority for the purpose of trans-
acting any business designated In the call, The call for a special meeting may
be delivered to each member of the Authority or may be mailed to the business or
home address of each member of the Authority at least two days prior to the date
of such special meeting; provided, that formal notice of the calling of a special
j meeting may be waived if all members of the Authority sign a written waiver of
notice and consent to rneeting in which shall be set out the purposes for which
the meeting is to be held, At such special meeting no business shall he considered

other than as designated in the call or walvor, but if all of the members of the
Authority are present at a npeclal meeting any and all business may be trans-
acted at such special meeting.

1. Motion was made by Young, seconded by Irwin that the
minutes of the meeting of May 27, 1970, ho approved, Motion
carried.
2. Chairman Davis announced that the Roundtable Discussion
was open, welcomed and introduced the guest speakers.
Mr, Joe Bowers of the State Welfare Agency began with his
views as to the needs for housing for the Elderly In Denton. lie stated
that there were approximately 1000 in Denton County that were 65 or
over, handicapped and blind requiring assistance. He offored to ob-
tain figures for the immediate Denton area and other relative statistic,
for the Authority to review.
' Mr. Gursch with The Foster Parents Program, pointed out
r i that 6779 were drawing Social Security In Denton County, (526,000
{ in County) Many of these people can earn more than the maximum
amount provided by Social Security. ($2,400 per couple / $1,800 per
Individual) 5252 of the 6779 group are over agc 60 and would be
eligible for a housing program, The Foster Parents Program had appli-
cations for 191 people with incomes at or below $2,500 annually, Some
were living on $300 - $500 per year with an avorage monthly payment
of $80, 70. Average annual income was $1, 254. Out of ) 06 In this
program, 66 owned their own home, but most were substandard. Two-
thirds lived alone. Although many homes are substandard the Elderly
are proud lien most are unwilling to move, Mr, Gursch felt there is a
definite r..ed for housing assistance in the city.
Mr, Gursch felt that the following points should be considered;
I.Aderly in Denton is approximately 11.7%,
There will be 1/3 more lAdorly rn 1900 than today.
56% are women and widowed; 75% of the males are married.
290 disabled In Denton County,
Housing needs to he close to shopping centers etc.
The proposed staff study for the local needs for the l,lderly
Housing was discussed In detail and Barry Humphries reported that
the study would lie ready by July 1, 191,70.
Motion was made by Irwin, seconded by Herod for a special
meeting on July 1, 1970, at 2;30 o,m, Motion carried,

After considerable discussion, iwtion was made by Irwin,
seconded by Herod that the Board apply for 250 public Elousing
tunits for the elderly, disabled and handicapped. Motion
carried.
Motion was nude by livin, seconded by Brown that the report,
` reconvnendiny, 250 public housing units for the elderly,
disabled and handicapped be approved with the clarification
that the elderly in the Posl.er Parent. Progra!n do not
represent those on old age assistance. 'S'hat it be pointed
out that the elderly participating in the Old Age Assistance
Prograo are far below those participating in the Poster
Parent Prograri in income, housing and the other necessities
of Life. Motion carried.
3. \lotion was male by Brown, seconded by Iferod that a special
meeting be held on July 8, 1970, tit 2 p.m. to discuss the
various methods of construction with the representative of
Hous9.rg Urban Development. Motion carried.
4. Motion was made by Brow, seconded by Irndn that the Pubitc
Housing Authority leave the City liall at 12 p.m, on 'T'hursday,
July 9, 1970, to go to Dallas and moot with the Nblic

The Chairman read the resolution for submission which

RESOLUTION AUTHORIZING AND DIRECTING SUBMISSION
OF APPLICATION FOR A LOW-RENT HOUSING PROGRPM
WHEREAS, the Housing Authority of the City of Denton, Texas, has fond
and hereby determine-=s that there is a need for low-runt housing for the
elderly, disabled, and handicapped, to meet needs not being adequately
mot by private enterprise within its area of operation;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
j OF THE HOUSING AUTHORITY OF THE CITY OF DENTON, TEXAS, AS
FOLLOWS:
The Secretary shall cause to be prepared and the Chairman shall sign and
send to the Housing Assistance Administration, Department of Houri,ng
and Urban Development, an application for financial assistance for:
(1) Two hundred and fifty dwelling units of low-rent
public housing for the elderly, disabled, and
handicapped, to be provided by new construction,
or by acquisition, or by acquisition and rehablli-
tation of existing housing and for a preliminary
loan in the amount of $100, 000.00,

1. The Cooperation Agreement between the City of
Denton, Texas and the Housing Authority of the
City of Denton, Texas is hereby approved,

The following methods of administration, a copy of which will be conspicuously 1
posted in all Authority facilities which are open to the public, are hereby adopted
for use by the Denton LIousing Authority pursuant to Title VI of the Civil Rights
Act of 1964:
1, This Authority does rid: discriminiate on the grounds of race, color, creed,
or national origin In any phase of Its operation. Further, there shall he no in-
tUddatory or retaliatory action by this Authority or its staff agafnst any applicant
or tenant because, of participotian in civil rights activities or for having asserted
any of his rights under the Civil Rights Act, and the regulation:; and requirements
pursuant thereto.
2. Applications for housing will be acrcptcd hetwecn the houru of 8:00 a.m.
and 5:00 p.in., the following days: Monday through Friday, at thc% following
address:

3. Such location of facilities for filing of applications for tenancy <ind such
circumstances for acceptance of applications will afford the applicant tho greatest
opportunity of his rights under the tenant selection and assignment plan adopted
by tho Local Authority. Applications filed shall 1)e dated, time-stamped, and
(when appilcations are accepted at more than on of.fico) referred to a central tenant
selection and assignmont office.
4. Each applicant shall be assigned his appropriate place on a community-wide
basis In sequence basr.d upon date; and time his application Is received, suitable
typo or size of unit, and factors affecting perforence or priority ostablished by the
Local Authority's regulations, which are not inconsistent with the objectlve:s of
Title VI of the Civil Rights Act of 1964 and the Department of Housing and Urban
Development regulations and requirements pursuant thereto. Offers shall be made
first lnlocations having the most vacancies, Suitable vacancies arising at a given
tuna at any location shall be offered to the cllgible applicant first in sequence at
such time.
5. Our plan for the selection of tenants and theft- assigment to dwelling units is
as follows:
PLAN A The eligible applicant must accept tho vacancy offered or be moved to
the bottom of. the list.
6, Applicanls, may reject offers of vacancies without being moved from their

lated to considerations of race, color, or national origin, as follows:

his inability to move to the Local Authority's satisfaction, refusal
of the offer shall not count as one, of the number of allowable ro-•
fusels permitted the applicant before placing his name at the bottom

B, If an applicant presents to the satisfaction of the Local Authority
clear evidence that acceptance of a given offer of a suitable vacancy
will rosult in undue hardship or handicap not related to considerations ,
of race, color, or national origin, such as inaccessibility to source of
employrnnet, children's day care center, anti the like, refusal of such
offer shall not be counted as one of the number of allowable refusals
permitted an applicant before placing his name at the bottom of the
eligible list,
In scattered site developments the local Authority shall moke reasonable
determinations of "locations" based on specific Scatterlzation. Locations, or
groupings, for such scattered sites are defined as follows;
a. The Local Authority shell maintain a record of the vacancies offered, in•-
cluding location, date and circumstances of each offer and each rejection or
acceptance.
9. Reassignment or transfers to other dwelling units;
Reassignments or transfers to other dwelling units will be
mado without rogard to race, color, or national origin as
follows; Tenants will not be transferred to a dwelling unit
j of equal size either within a project or between projects,
except for alleviating hardships as delerminod by the No
CUtive ])hector or his designee. Transfers within projects
shall be made to correct occupancy standards. Transfers
between projects shall be made for families requiring lame
size units which do not exist within the project A which has
only ono-to-four bedroom unit and lives in Project A which has
only one - to - four - bedroom units, This tenant may, these-
fore, be, considered for a transfer to a project containing flve-
bedroom units.

10. This Authority will receive and process complaints from or on behalf
of tiny person who believes himself to be subject to discrimination by the
Authority or its staff, and will keep a record of each complaint, including
the date of the complaint, by when) made, investigation and hearing (if any) {
and evaluation. The complainant will bo furnished a written notice of action

A progress report on Dr. Cora Martin's survey was given by Larry Brinkley, T'he
survey is completed and the material is ready to be tabulated. Brinkley reported

that the respondents were cooperative and Dr. Martin feels that the survey will be
extremely beneficial in detorminJng the needs and desires of the elderly. No com-
pletion date for the survey analysis was given,
The selection of the architects for the Denton Housing Project was next to be
considered. Commissioner Young suggested that a criteria for selection be
r decided upon by the Authority, The criteria was recorded as follows:
Experience and capability
Location and/or type of transporLation
Firm not: too busy to have time to devote to Denton
Imlgination and creativity
Dependable reputation
Each member of the Authority and the Executive Director had proposals and
material from eighteen firms. After a few hours of screening, it was decided that
more time would be needed In order to narrow the field to 5 or 6 firms, Motion
was made by Young, seconded by Brown to have a Special Meeting on Wednes-
day, January 27, 1971, at 2:00 p.m. in the Municipal Building.

The minutes of the regular meeting of August 26, 1970, were presented for
! approval. Commissioner Irwin moved to dispense with the reading of the minutes
and that they be approved. The following vote was recorded:

1970; but now appears that It will be as late as
January 31st, 1971,

Chairman Davis then turned the meeting over to Dr. Martin e,id her students for a

k report on their activities with the Survey Questionaire, Dr. Martin gave a brief

summary of the basic outline used for the survey. A map was presented to the
r Authority indicating the areas that would be canvassed by her students. It was
decided that out of each designated block, 2 residents over the age of 62, would
be interviewed. With a total of 203 designated blocks, covering varied Income
brackets, ethnic groups and environmental backgrounds, a total of 406 respondents
is anticipated, Survey expected to begin in 2•-3 weeks, Questions and answers
wc:ro then exchanged between the Authority and the student group.

WHEREAS, it is the policy of this locality to eliminate

slums and blight, and to realize as soon as feasible the coal of a
decent home and a suitable living environment for all of its ci.tizensp

WHEREAS under the
provisions of the United States Housing

Act of 1937, as amended, the Department of Housing and Urban Deve-
lopment is authorized to provide financial assistance to local public
housing agencies for undertaking and carrying out preliminary plann-
ing of low rent turnkey housing projects that will assist in the goal;

WHEREAS, the Housing Authority of the City of Denton, Texas,
(herein called the "Local Authority") is a public housing agency and
is applying to the Department of Housing and Urban Development for a
premininary loan in connection with the development of ].ow rent turn- {
key housing for the elderly, disabled and handicapped, as that type
of construction is defined in the June, 1969 edition of Low Rent
[lousing Turnkey Handbook ablished by U. S. Department of Housing and
Urban Development (RHA 7920.1),
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSING AUTHORITY OF THE CITY
OF DENTON, TEXAS, THAT:
1. The Application of the Local Authority to the Depart-
ment of Housing and Urban Development for a preliminary
j loan connected with low rent turnkey housing projects
is hereby approved; ,
2. The Executive Director of the Local Authority is here-
by authorized to enter into and represent and act in ~
j behalf of said Local Authority concerning such appli-
cation and all negotiations therewith.

Motion was made by King, seconded by Herod, that they be approved,

that since Mr. Brinkley was moving out of the city and Mr. Net 1 Haman would ,
be assuming most of his duties that the Authority consider appointing Mr, Haman I1

After consideration, motion was made by Young, seconded by Herod that
Nell Haman be appointed as temporary executive director until such tirrne as the
Authority was funded,

From information gathered from HUD Headquarters in Ft. Worth/Dallas It is
apparent that immediate funding for conventional project is nil. T'ie second
choice would be "'turn-key", which was considered by the authorit},.
The ratings on the re-submitted application on the 9 points program shcwed Denton
with a low rating In area of housing for the indigent non-elderly. No provisions
for this classification were included In Denton's application. HUD suggested
that an application revision for 150 elderly and 100 non-elderly would qualify
Denton under HUD requirements. Would probably be 2 separate projects with

separate funding. HUD definition of elderly is fit and older,
Second endeavor would be a list of elderly who needed the project. ~NNf~ W/9 )
HUD office suggested to do away with conventional application and re-
submit. Gould apply under PROGRAM D-3 (falls under Rent Supplement program)
this program is applied for through private Individual (developer/builder) to get
Immediate needs taken care of. This could be done but is not desirable as the

Authority would have absolutely no control over the project before or after construction.

Since there appears to be some misunderstanding concerning the policy of the;
University to purchase proporty in the block bounded by Avenue D, Wast Mllbrrry, I ~
Avenue C, and Hickory Street, this statement is issued to explain and Clarify fU)

The University has offered to purchase any property in the above area from the

expense of the University. If the appraisal is unsatisfactory to the ol,mor, then

Report submitted by Tax Assessor Collector, Hugh Mixon, for the month of April.,

of the Sewai;e 't'reatment Plant contract with I31m Fork Construction Company, for
