AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS
CALLING AND ORDERING AN ELECTION TO BE HELD ON THE 4TH DAY OF
APRIL, A. D. 19723 THE SAME BEING THE FIRST TUESDAY IN SAID
MONTH, FOR THE PURPOSE OF ELECTING TWO (2) COUNCILMEN FOR THE
CITY OF DENTON, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF
ARTICLE 3, SECTION 3.01 (a) OF THE CHARTER OF THE CITY OF
DENTON, TEXAS; ESTABLISH14G THE HOURS AND PLACE FOR THE SAID
ELECTION; PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND POST-
ING IN THREE PUBLIC PLACES IN THE CITY OF DENTON AS NOTICE OF
SAID ELECTION; DIRECTING THE CITY SECRETARY TO MAKE UP THE
OFFICIAL BALLOTS, CAUSING THE SAME TO BE PRINTED AND DELIVERED
TO THE PRESIDING OP?ICER; PRCVIDING FOR THE MAKING OF OFFICIAL
RETURNS OF SAID ELECTION; PROVIDING FOR THE CANVASSING OF THE
RETURNS OF THE SAID ELECTION AND DECLARING THE RESULTS OF SAME
BY THE CITY COUNCIL; AND DECLARING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:
SECTION I.
That an election shall oe held in the Community Building,
in the Civic Center on McKinney Street, in the City of Denton,
Texas, between the hours of seven o'clock (7:00) A.M. and seven
o'clock (7:00) P.M., on the 4th day of April, A. D. 19720 the
same being the first Tuesday of said month, for the purpose of
electing two (2) Councilmen for the City of Denton, in accord-
ance with the provisions of Article 3, Section 3.01 (a) of the
Charter of the City of Denton, Texas.
SECTION II.
That the two candidates who receive the highest number of
votes shall be declared elected to the City Council of the City
of Denton.
SECTION III.
That notice of said election shall be given by the post-
ing of true copies of this ordinance, signed by the Mayor and
attested by the City Secretary, in three public places of the
said City, one of which places shall be at the Municipal Bufld-
ing, for thirty (30) consecutive days prior to the date of said
election and this ordinance shall be published in full one time
in the Denton Record-Chronicle at least thirty (30) days prior
to said election.
SECTION IV.
That J. L. Carric,o, is hereby appointed presiding judge of
said election, and (,1iet.~v~ l/, V. Is appointed as his
alternate, and the said presiding fudge shall appoint such assis-
tants as may be necessary to properly conduct said election, as
provided by the Election Code.
SECTION V.
That the City Secretary shall make up the official ballot
from the names presented to him by application or nominating
petitions as provided by Article 3. Section 3.02 and 3.03 of
the Charter of the City of Denton, Texas, and he is hereby
authorized and directed to have the ballots to be used in such
election printed and delivered to the said presiding judge.
SECTION VI.
That immediately after the counting of the votes the pre-
siding judge shall deliver the official returns of the election
to the City Secretary.
SECTION VII.
That on the Monday next following the election, the City
Council shall canvass the returns and declare the results which
shall be recorded in the Minutes of the Council.
SECTION VIII.
That the two candidates who receive the highest number of
votes shall be declared elected and the Mayor shall deliver certi-
ficates of election to the successful candidates. If two or more
candidates shall tie with the second highest number of votes, or
if three or more candidates shall tie for the highest number of
votes, the Council shall order a second election to be held on
the fourteenth day after the first election at which only the
names of the candidates who receive the same number of votes at
the first election shall be printed on the ballot. In the event
of a tie at the second election, the tied candidates shall cast
lots to determine which one shall be declared elected.

WHEREAS# JAMES THOMAS, d/b/a DELCAR CONSTRUCTION COMPANY,
is the owner of a certain subdivision known as Thomas Place, an Addition
to the City of Denton, Texas, which was previously known as Loma Del
Rey, an Addition to the City of Denton, Texas, as shown of record in
Volume 40 page 34, Deed Records of Denton County, Texas; and,
WHEREAS, it is necessary for the development of such
property to grant certain easements to the City of Dentor, for the
purpose of installation of certain utilities and the maintenance
and reconstruction of such facilities. Now, therefore,
KNOW ALL MEN BY THESE PRESENTS: ThAt I, James Thomas,
d/b/a Delcar Construction Company, do hereby grant and extend to the
City of Denton an easement for the purpose of installation of certain
utilities and for the maintenance and reconstruction of such utilities
over and across the following described property.

AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS
SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY
OF DENTON, TEXAS, BY ORDINANCE NO. 69-1, AND AS SAID MAP APPLIES TO
CITY LOT 5, BLOCK 355, AS SHOWN THIS DATE ON THE OFFICIAL TAX MAP OF
THE CITY OF DENTON, TEXAS, AND MORE PARTICULARLY DESCRIBED THEREIN;
AND DECLARING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:
SECTION I.
That the Zoning Map of the City of Denton, Texas, adopted January
14, 1969, as an Appendix to the Code of Ordinances of the City of Denton,
Texas, under provisions of Ordinance 69-1, be, and the same is hereby
amended as follows:
All the here±nafter described property is hereby removed from the
"SF-7" Single Family District as shown on said Zoning Map, and all pro-
visions of Ordinance No. 69-1, adopted the 14th day of January, 1969, as
amended, shall hereafter apply to said property as "MF-1" Multi-family
District in the same manner as other property located in the "MF-1" Multi-
family District;
All that certain lot, tract or parcel of land lying and being
situated in the City and County of Denton, State of Texas, and
being City Lot 5, Block 355, and being further described as be-
ing located dust south of Eagle Drive and west of Welch Street.
SECTION II.
That the City Council of the City of Denton, Texas, hereby finds
that such change is in accordance with a comprehensive plan for the pur-
pose of promoting the general welfare i-r the City of Denton, Texas, and
with reasonable consideration, among other things for the character of
the district and for its peculiar suitability or particular uses, and
with a view to conserving the value of the buildings, protecting human
lives, and encouraging the most appropriate uses of land for the maxi-
mum benefit to the City of Denton and its citizens.
SECTION III.
That this ordinance shall be in full force and effect immediately
after its passage and approval, the required public hearings having
heretofore been held by the Planning and Zoning Commission and the City
Council of the City of Denton, Texas, after giving due notice thereof.

Notice is hereby given that the City Council of the City
of Denton, Texas will hold a public hearing on Tuesday,
January 25, 1972, at 7:00 p.m. In the Council Chambers of
the Municipal Building to consider the request of
Mrs. Ella Lee Noore that the zoning classification of
914 Welch Street be changed from "SF-7" Single_ Family
Classification to the "`IF-1`_*Eul~ ti-
daily- Classification.
The property in question is further described as being
City Lot No. 5, Block 355. The property is further
described as being located just south of Eagle Drive and

across said premises, with the right and privilege at all times o
the granteee herein, his or its agents, employees, workmen and
representatives having ingress, egress, and regress in, along,
upon and across said premises for the purpose of making additions
to, improvements on and repairs to the said public utilities, or
any part thereof.
