THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS: SECTION I. That the maximum speed limit on the described portions of highway entrances within the City of Denton are hereby changed as follows: SPEED LIMIT ON DALLAS DRIVE SHALL HEREAFTER BE: 60 MPH from center line of Interstate 35E Service Road to 200 feet southeast of Piping Rock; 50 MPH from 200 fee: southeast of Piping Rock to 400 feet southeast of Willow Springs; 45 MPH from 400 feet southeast of Willow Springs to 300 feet southeast of Smith Street; 40 MPH from 300 feet southeast of Smith Street to the center line of Johnson Street. SPEED LIMIT ON SHERMAN DRIVE SHALL HEREAFTER BE: 50 MPH from north City Limits to center line of Buckingham Drive; 45 MPH from center line of Buckingham Drive to center line of Edinburgh Drive; 40 MPH from center line of Edinburgh Drive to 300 feet north of Stuart Road; 35 MPH from 300 feet north of Stuart Road to 300 feo:t north of Bell Avenue; 30 MPH from 300 feet north of Bell Avenue to center line of Locust Street. SECTION II. That anyone exceeding this speed limit when posted, without legal excuse, shall be guilty of a misdemeanor, and a violation of any provision of this ordinance shall be punished by a fine upon conviction of any amount not exceeding Two Hundred ($200.00) Dollars. SECTION III. That all ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are inconsistent or in conflict with the terms or provisions of this ordinance are hereby repealed to the extent of any such conflict. SECTION IV. That if any section, subsection, paragraph, sentence, clause, word or phrase of this ordinance, or application thereof to any person or circumstances, are held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the re- maining portions of this ordinance, end the City Council of the City of Denton, Texas, hereby declares it would have enacted such remain- ing portions in spite of any such invalidity. SECTION V. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published in the Denton Record-Chronicle with ten (10) days of the date of its passage. La -3r AN ORDINANCE AXENDING CHAPTER FIVE OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY REPEALING PORTIONS OF THE ADOPTED UNIFORM BUILDING CODE, 19?0 EDITION, VOLUME ONE; EFFECTING CER- TAIN CHANGES THERETO; CREATING A BUILDING CODh BOARD; ESTABLISH- ING PROu=::URES AND POWERS THEREFORE;REPEALING CONFLICTING ORDIN- ANCES; PROVE DING A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS: PART I. A. That the Code of Ordinances of the City of Denton, Texas, is hereby amended and changed in the following particulars: B. Chapter Five, Article II, Section 5-14 is hereby amended by adding new subsections(e) and (f) to Section 5-14 of said article and chapter, which shall hereafter read as follows: 'Ye). Volume I. Section 1709 (a) GENERAL, is deleted and amended to read as follows: (a) General: Parapets shall be provided on all exterior walls of buildings, except as follows: 1. Walls not required to be of fire-resistivQ construction. 2. Roofs with more than 20 degree slope unless said build- ing is against another building. 3. Walls where unprotected openings are permitted. 4. Exterior walls of a building which is 20 feet or more distant In all directions from the nearest line to which the other buildings are, or may be built, and from other buildings on the same lot. 5• Walls which terminate tt roofs of sot less than two-hour fire-resistive construction or roof£ constructed entirely of`non- combustible materials. (b) Required parapets shall have fire resistance ratings not less than required for the wall on which they are erected. (c) Required parapets on exterior walls required to have a fire resistance rating of two-hours shall extend not less than two feet above the roof; parapets-:on exterior walls required to have a firq resistance rating of three or four-hours shall extend not less than three feet above the roof; parapets shall extend at least to the same height as any portion of the roof within fifteen feet." "(f) Volume 1, Section 204 is deleted and amended to read as follows: (a) Building Code Board - Creation There is herby created a Building Code Board consisting of five (5) members, each to be appointed by the City Council for a term of two (2) years, and removable fo" cause by said Council after public hearing. Initially, however, all five (5) members shall be appointed for a term to expire coincidently with other City Boards, to serve until their successors are appointed. To the extent that persons are available within this City, the said Board shall consist of one (1) general contractor, and One=(l) architect, one i) engineer, and two (2)Amembers who shall all reside within the City. The City Council may appoint ex officio members to this Board, to have a voice in all matters before it, but who shall have no vote. The Chief Building Official shall be an ex officio member of the board. b. Procedu:•e and Powers. The Board shall adopt rules to govern its proceedings pro- vided that same are consistent with the Code of the City of Denton and Statutes of the State of Texas. The Building Code Board shall have the saine powers and duties on matters concerning Chapter Five of the Code of Ordinances as the Board of Adjustment has on matters concerning, and arising from, the Zoning Ordinance, including the following: (a) Elect a chairman, who may administer oaths, and comp3l the attendance of witnesses; (b) Hear and determine, by a four-fifths (4/5) vote of the members, appeals from any decision of the Chief Building Official made pursuant to Chapter Five other than Article IV after proper notice has been given; (c) By a four-fifths (4/5) vote of the members, grant variances to any provision of Chapter Five, other than Article IV, s*ibject to appropriate conditions and safeguards, and after a determination by the Board that a hardship exists which would be cured by the particular variance sought. Maintain (d) /jurisdiction of questions involving Article IV of said Chapter as authorized therein." C. Chapter Five, Article IV, Section 5-47 (5) - Definition of "Board" is hereby repealed and replaced by the following: "Board": 'Board' shall mean the Building Code Board of the City of Denton, Texas." D. Chapter Five, Article IV, Sections 5-55, 5-56, 5-57 are hereby expressly amended to become consistent with the above changes, by replacing the term "Board of Adjustment" with the term "Building Code Board" wherever used in said sections. PART II. That if any section, subsection: paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the re- maining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby derslares it would have enacted such remain- ing portions despite any such invalidity. PART III. That this ordinance shall become effective immediately upon its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published in the Denton Record- Chronicle within ten (10) days of the date of its passage.
