RESOLUTION AUTHORIZING AND DIRECTING SUBMISSION OF APPLICATION FOR A LOW-RENT HOUSING PROGRAM WHEREAS, the United States Housing Act of 1937 provides that there shall be local determination of the need for low-rent hous- ing to meet needs not being adequately met by private enterprise; and WHEREAS, under the provisions of the United States Housing Act of 1937, the S(---retary of Housing and Urban Development is authorized to provide financial assistance to public housing agencies for low-rent housing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE PUBLIC HOUSING AUTHORITY OF THE CITY OF DENTON, TEXAS AS FOLLOWS: (1) That the Public Housing Authority of the City of Denton Texas hereby determines that within its area of operation there is a need for low-rent housing to meet needs not being adequately met by private enterprise. (2) That the Executive Director shall cause to be prepart.3 and the Chairman shall sign and send to the Secretary of Housing and Urban Development an application for financial assistance for one hundred sixty (160) dwelling units to be provided by leasing privately owned housing under Section 23 of the United States Housing Act of 1937. (3) In connection with the development and operation of any program or activity receiving Federal financial assistance under the United States Housing Act of 1937, regardless of when such pro= gram or activity or any portion thereof was or is initially covered by any contract, the Public Housing Authority of the City of Denton, Texas will comply with all requirements imposed by Title VI of the Civil Rights Act of 1964, Public Law 88-352, 78 Stat. 241; the regulations of the Department of Housing and Urban Development issued thereunder, 24 CFR, Subtitle A, Part 1; and the requirements of said Department thereunder. THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS: PART I. That the Code of Ordinances of the City of Denton, Texas is hereby amended by adding a new Article IV, Barri- cading of Construction and Public Rights-of-Way, Sections 21-55 through Section 21-60 to the said Code of Ordinances which shall hereafter read as follows: ARTICLE IV. BARRICADING OF CONSTRUCTION AND PUBLIC RIGHTS-OF-WAY Section 21-55. Submission of Plan Any contractor, subcontractor, corporation, firm, company, public utility or other individual who shall under- take to perform any work within the traveled portion 0 of any public right-of-way when such work, arrangement of equipment, condition of work area, or activities associated with the conduct of such work or traffic upon the street will create or potentially create a hazard to workmen, pedestrians or motor vehicle operators upon said right-of-way or within an shall area adjacent thereto within the said city,/as an express condition precedent to the issuance of a building or street use permit for such work, furnish to the Traffic Director and/or the City Engineer a scale plat or sketch showing the work area, the space within ti]e right-of-way required for the work and a proposed plan for the use of barricades, signals, signs, flags, flares and other traffic control and safety devices about the work area. Said plan will be re- ferred to as the "Barricade Plan" and shall conform to the requirements set forth in the "Barricade Manual" adopted by Section 21-56 and shall be deemed a part of the issued per- mit. EXCEPTION: Such requirements contained herein shall not apply as to permits or submission of plans when work is conducted under emergency conditions. However, all require- ments for proper barricading and channelization as required in the "Barricade Manual" shall be met and such requirements will be enforceable. "Emergency Conditions" for the purpose of this article means unforseen occurrences or conditions; a sudden unexpected happening. Section 21-56• Adoption of Barricade Manual The Traffic Control Division of the Community Develop- ment Department of the City has prepared a manual entitled "Barricade manual", and the regulations for barricading of con- struction areas contained in that manual are hereby adopted and made a part of this ordinance. Copies of such Barricade Manual shall be kept available for public inspection in the offices of the Traffic Director and the City Engineer. The City shall'require that the regulations contained in that manual be made a part of the "Barricade Plan". Section 21-57. Additional Requirements Where the City deems it necessary in order to avoid traffic congestion and in the interest of safety, it may re- quire that the work be done only at certain hours during the day or night, that materials or equipment used in such work or dirt and materials removed from any excavation be located other than adjacent to the work area, and that any excavation be covered with materials of sufficient strength and construction to permit vehicular traffic to pass over such excavation at f peak traffic hours. Section 21-58. Validity of Permit Prior to and during any construction for which a permit is required under this Article, the permittee shall conform to all specifications and regulations set forth in the permit, Barricade Plan, and/or Barricade Manual including, but not re- stricted to, proper maintenance of barricades, signals, signs or other traffic control or safety devices. The Traffic 4)irector, Building Inspector and/or City Engineer may cancel the permit issued under this Article for any violations of the regulations, and after such cancellation the permit will have no further force or effect. Section 21-59. Stop Order Any person who shall barricade a construction area and pub- lic right-of-way pursuant to the provisions of this Article and violate any provisions of this Article shall be subject to a "stop any police officer order" issued by the Traffic Director,/Building Inspector, or City Engineer. In the event a stop order is issued, the person holding the permit and engaging in the work shall restore the work area to its proper condition as called for in the Barricade Plan, Barri- cade Manual and/or permit. Where permittee does not restore the work area to its proper condition as called for in this Section within two (2) hours after receipt of the stop order, the City shall proceed to do the work, and the cost thereof shall be charged to the permittee. The City shall have the right of action against any bond running from the holder of the permit to the City con- ditioned upon compliance with the ordinances of the City in the performance of said work, and the City Attorney may proseceute an action against the permittee in a court of competent jurisdiction for the recovery of such expenses, damages or costs. Section 21-60. Penalties (1) Any person who shall violate a provision of this code, or fails to comply therewith or with any other requirements there- of, or of a permit or certificate issued thereunder, shall be guilty of a misdemeanor punishable by a fine not less than ten dollars nor more than two hundred dollars. Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisons of this code is committed, or continued, and upon conviction of any such violation such person shall be punished within the limits provided above. (2) The imposition of the penalties herein prescribed shall not preclude the City Attorney from instituting an appropriate action or proceeding to restrain, correct or abate a violation of said ordinance, or prevent any legal act, conduct, business or use in or about any premises. PART II. That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any per- son or circumstances is held invalid by any court of competent juris- diction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity. PART III. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby direc- ted to cause the caption of this ordinance to be published in the Denton Record-Chronicle within ten days of the date of its passage.
