D. 1970. R E S O L U T I O N WHEREAS, to install certain equipment and to adequately carry out business functions there must be in-- stalled an air line crossing under East Sycamore Street; and WHEREAS, such crossing will in no manner interfere with the use of such street by the City of Denton, or by any public utility; therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DENTON, TEXAS: that Trinity Industries of Denton, Texas, is hereby granted permission to cross under East Sycamore Street at a minimum depth of two and one- half feet (2 1/2), with a four (4) inch steel pipe line, coated and wrapped, to be operated at a maxi- mum 100 PSI, and to be encased in a six (6) inch welded steel pipe sleeve, said crossing to be with- in the area of East Sycamore Street described as follows, to-wit; BEGINNING at a point in the south line of Lot 2, Block 256 of the City of Denton, Texas, 302.0 feet west of the centerline of Exposition Street; THENCE south perpendicular to centerline of East Sycamore Street a distance of 60.0 feet to a point in the south right of way line of East Sycamore Street. Provided that, this permission is conditioned upon the compliance with all the Rules and Regulations of the City of Denton regarding the use of public pro- perty, and the pipe so crossing shall be installed under the supervision of the City Street Department and shall be approved by the City Engineer prior to installation, and shall meet and satisfy all in- spection requirements. Provided further, that any relocation of said cross- ing, whether moved by City initiative or Company option, said relocation will be at the expense of Trinity Industries, and such relocation shall be sub- ject to the approval of the City Council. That the Code of Ordinances of the City of Denton, Texas, is hereby amended by adding new Article V to Chapter Nine of said Code which shall hereafter read as follows: ARTICLE V. ELECTRICAL CODE BOARD. Section 9-50. Electrical Code Board-Creation. There is hereby created an Electrical Code Board consist- ing of five (5) members, each to be appointed by the City Council for a term of two (2) years, and removable for cause by said Council after public hearing. Initially, however, all five (5) members shall be appointed for a term to expire coincidently with other City Boards, to serve until their successors are appointed. The City Council may appoint Ex Officio members to this board, to have a voice in all matters before it, but who shall have no vote. Section 9-51. Same - Procedure and Powers. The Board shall adopt rules to govern its proceedings provid- ed that same are consistent with the Code of the City of Denton and Statutes of the State of Texas. The Electrical Code Board shall have the same powers and duties on matters concerning chapter Nine of the Code of ordinances as the Building Code Board has on matters concerninq, and aris4.ng from, the Building Code, including the following: (1) elect a Chairman, who may administer oaths, and compel the attendance of witnesses; • (2) hear and determine, by 4/5 vote of the members, appeals from any decision of the Electrical in- spector made pursuant to Chapter Nine, after pro- per notice has been givens (3) by a 4/5 vote of the members, grant variances to any provision of chapter Nine, subject to appro- priate conditions and safeguards, and after a determination by the Board that a hardship exists which would be cured by the particular variance sought. Section 9-52. Same - Additional Duties. The Board shall with the assistance of the Electrical In- spector, Director of Public Utilities, and City Attorney, review the existing electrical codes, pertinent standard or model codes, and present to the City Council its recommendation on the adoption pf'a new, more comprehensive, Electrical Code. r t SECTION II. This ordinance shall be and it is hereby declared to be cumulative of all other ordinances of the City of Denton, Texas, and shall not operate to repeal any such ordinance or ordinances except insofar as the provisions of such other ordinance or ord- inances are inconsistent or in conflict with the provisions of this ordinance, in which instance or instances those provisions shall be hereby repealed. SECTION III. If any section, word, clause, phrase or provision of this ordinance is declared unconstitutional or invalid, then, in that event, it is expressly provided, and it is the intention of the City Council in passing this ordinance, that all other parts of this ordinance shall hot be affected hereby and shall remain in full force and effect. SECTION IV. That this ordinance shall become effective immediately upon its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published in the Denton Re- cord-Chronicle within ten (10) days of the date of its passage. AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, 1969, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO. 69-11 AND AS SAID MAP APPLIES TO CERTAIN PROPERTY KNOWN AS PART OF CITY LOTS 7 AND 81 BLOCK 276A AS SHOWN ON THE OFFI- CIAL TAX MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTI- CULARLY DESCRIBED HEREIN; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS: SECTION I. That the Zoning Map of the City of Denton, Texas, adopted January 14, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas, under provisions of Ordinance No. 69-1, be, and the same is hereby amended as follows: All the hereinafter described property is hereby re- moved from the "SF-7" Single Family District as shown on said Zoning Map, and all provisions of Ordinance No. 69-1 adopted the 14th day of Ja.,uary, 1969, as amended, shall hereafter apply to said property as General Retail District in the same manner as other property located in the General Retail District; All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, being a part of the Wm. Teague Survey, Abstract No. 1266 and Leing a part of the tract of land conveyed by A. B. Baker, Jr., and Elvin Baker to Archie R. That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purposes of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things, for the character of the district and for its peculiar suitability or particular uses, and with a view to con- serving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton and its citizens. SECTION III. That this ordinance shall be in full force and effect im- mediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof. No buildings or other structure shall be constructed on any portion of the land described and shown on the attached plat until such portion has been finally platted according to the requirements of the Subdivision Regulations of the City of Denton, known as Appendix A to the Code of Ordinances, Articles 13.01 through 13.090 inclusive; and the plat attached hereto shall not be considered a subdivision plat under the terms of such subdivision regulations. 2. The boundary lines shown on the attached plat designate land use areas only, and shall not be changed by any subdivision plat or replat unless this ordinance shall be amended accordingly. 3. When a tract or parcel of the land described herein is finally platted or replotted, any and all additional rights of way and easements which are deemed necessary by the Planning and Zoning Commission shall be dedicated by the owners of the land ;he same as if the tract or parcel were being originally subdivided. 4. Each lot or tract shown on the attached plat shall be zoned to permit only the use or use4 designated to apply within the delineated areas shorn on the attached plat and such uses shall be as intended by said ordinance No. 69-01 under the same stated classifications, but same shall be conditioned and limited as stated on the attached plat, and the attached plat shall not be filed of record in the Plat or Deed Records of Denton County, Texas, except as a land use map along with this ordinance. No building permits will be issued until a future subdivision or development plat has been properly approved and filed of record. 5. All provisions of Ordinance No. 69-01 (Zoning ordinance) of the City of Denton shall apply to the property within the attached plat to permit the zoning uses indicated thereon, by lot and block reference, or otherwise, stated thereon, or provided herein. No other use than those permitted hereby shall be permitted within the areas designated on the attached plat, and the zoning district areas so defined shall not be changed except by amendment of this ordinance. A platting or replatting of any area shall not affect the uses permitted within the respective areas shown on the attached plat. 6. All structures other than residential structures shall be built in conformance with the requirements of the second fire district as established and defined in Section 5-1 of the Code of ordinances and such structures shall be subject to the regulations pertaining to such second fire district. The owners of the land described in this ordinance, for and in consideration of the granting by the City Council of this soiling classification on the said property, do hereby b{nd them- selves, their successors, heirs, executors, administrators and assigns to fully comply with all of the above described terms and conditions for the use of said land as long as this ordinance shall remain in effect, and the said owners understand that without full and complete compliance on their part with the said terms and conditions the uses permitted herein and hereby would otherwise be prohibited under the Zoning Ordinance of the City of Denton, and in order to secure this amendment to the Zoning Map to make such use of the aforesaid land, said owners do hereby covenant that they will fully and completely comply with the terms and conditions herein mentioned, that this covenant shall run with the land, and shall be binding upon them, their hairs, successors, executors, administrators and assigns; that upon breach of this covenant this Planned Development District may, at the City Councils discretion, be made null and void and thereupon said property shall once more and immediately become subject to the regulations applicable to property in the "SF-7" Single Family District under tha terms of the Zoning Ordinance of the City of Denton without any right on the part of the said owners, their heirs, successors, executors, administrators or assigns, to continue the development of said premises as planned. SECTION II. That the City Council o:.- the City of Denton, Texas, hereby finds that such Planned Development District is in aceordanco with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things, for the character of the land and for its peculiar suitability and uses. Bleed-thru to the underside of the tile shall be apparent in less than two (2) minutes. 3.5 Resistance to Stripping - from both wet and dry clean limestone Aggregate determined by ASTM Pro- cedure D1664-59T shall show over 9516 of the coating retained after 18 hours immersion in distilled water at 256C. 3.6 Insolubles In CS2 - determined by ASTM Procedure 0165-42 ehall be less than 2%. 3.7 Flash Point - determined by ASTM Procedure D56-61 shall not be lower than 1106F. 4.0 APPLICATION 4. 1 Material shall be applied by suitable pressure spray equipment made with hose, gaskets, washers, etc, th;,t are resistant to aromatic (coal tar) solvents, and at preszures low enough to avoid over-spray and fogging. It is recommended that the material he stirred to even consistency in Its container as received, and strained through a fine mesh screen ae it is poured into the spray equipment tank. A hood over the spray nozzle for con- trolled placement is also recommended. 4. 2 The amount of material applied shall be egtilvalent to that required to make the given surfacn of the portland cement concrete or asphalt concrete a uniform chocolate brown color (not black) after the material is in place for ten (10) minutes. No excesses whatsoever shall be loft on the surface. The actual amount of material used will depend upon the porosity and texture of the surface, and usually ranges from 0.0075 to 0, 03 gallon per square yard. 4. 3 Exposure to heat, fiamr., or sparks, shall be avoided. All precautions for handling flammable materials shall be taken, 4. 4 Since this material may cause skin irritation, it is recommended that protective clothing and goggles be used during its application. (2) To provide the pavement with an easy-to-clean surface, free of hazardous loose stones, and a new- looking attractive appearance. 11. MATERIAL: Jc_nnite_J- 16 - shall be thoroughly stirred in its container as received, preferably by power mixer, or with mortar hoc, so that a creamy smooth consistency of all the, Jennite J-16 in file container is assured for ready application. Since prolonged contort may cause skin irritation, it is recommended that protective clothing be worn while ha,ulling this product. Jennite J-16 must be protected from freezing. III, PREPARATION OF PAVEMENT: Areas to be scaled shall be sound, surface-cured, and clean, To be sound, the pavement must be asphalt concrete properly designed and constructed for the temperature ranges and usage to which it is subjected. The asphalt concrete must be made with well-graded, hard, durable aggregates, and compacted to maximum density. The base shall be properly designed and constructed to provide adequate drainage, and also compacted to maximum density. Any oil-soaked pavement material shall be removed and replaced with new properly designed asphalt mix well compacted in place. To be surface-cured, the pavement shallbe weathered sufficienllyso lhatit Is free of light oils, and presents a water-break-free surface. The lime required for surface-curing depends mainly upon the penetration (or hard- ness) of the, asphalt cement in the mix, the amount of asphalt cement in the mix, and prevalent weather conditions. To be clean, the surface shall be free from sand, clay, dust, salt, greasa, and other foreign matter.. Any accumulations of oil or grease shall be scraped, burn, d, or cleaned off the pavnment with detergent solution, the residue of wl•ich shall be thoroughly flushed away with ciean fresh water before application of the Jennite J- 16. If oil is still deeply impregnated in the pavement mix, but the pavement Is phya Ically sound, such areas shall be scaled off with shellac to prevent oil bleeding. If water flushing is necessary for cleaning, or the pavement surface is absorptive, or it is over concrete, or over a poorly drained base, it is recurnmeuded that the pavement be allowed to :ompletely dry out before sealing, IV. APPI,R:ATION OF MA' ERIA1S: Two coals of Jennite J- 16 shall be applied over the pavement described in the foregoing Section Ill, so that the completed scalcoal is free of voids, holidays, and pinholes. The first coat shall be applied uniformly over a pavement surface tha', is fog-spray dampened with clean fresh water, but free from standing water. When the first coat has Net sufficiently so that It will take traffic without scuffing, tine second coat shall be applied uniformly and crosswise (if practical) to the first application, Total Jennite J-16 coverage for two coats shall be approximately two gallons per 100 square feet - or 0, 18 gallon per square yard. This may vary 15176 with the surface texture of the psv ment. v In critical areas where gasoline or oil spillage may he prevalent; It ht recommended that a third uniform coat of Jennite J- 10 be applied at an approxlmale coverage rate of one gallon per 100 square feet - or 0.09 gallon per square yard, Generally, application may be made by long-handled rnedium-soft rubber squccg,:e, long-handled plastic- 'brjstled brush. Where pavement surface is unusually rough or very smooth, brush application is recommended for best results. Application may also he made by mechanical equipment designed for this purpose. It is recommended that the completed Jennite J-16 sealcoat be allowed to cure at least 24 hours under good drying conditions, and then test&d for traffieahility before opening the treated pavement area to regular usage, V. WITNESSETH WHEREAS, the aforementioned City has requested the Consultant to propose a program for updating and coordinating the Planning in and around North Texas State University and Texas Woman's University; and, WHEREAS, the Consultants have recommended an appropriate program of plan- ning in outline form; and, WHEREAS, the City of Denton has taken action to enter into agreement with the Consultants; NOW, THEREFORE, in consideration of mutual covenants and agreements here- inafter set forth, the part;-3s do hereby covenant and agree as follows: ARTICLE 1 CONSULTANT'S SERVICES The Consultant agrees to undertake the planning program as outlined in Article 2, such work to be performed in accordance with the terms of this Contract and for the consider- ation herein stated. The Consultant will make various studies as provided for herein and will make recommendations to the City based upon the results of such studies, In the pre- paration of the various maps and data outlined, the Consultant will furnish under his direct supervision such personnel as is required to assemble data, do research and to prepare the required plans and proposals. In developing the various plans, the Consultants will work with the Mayor, City Council, City Manager, Planning and Zoning Comm;ssion, Officials and Planners for the two Universities and such other groups and persons as the City may, from time to time, designate. i t V ARTICLE 2 SCOPE OF WORK The scope of the work to be performed by the Consultant is outlined as follows: 1. A study of the existing street circulation system and land use within and adjacent to the campus expansion areas of both North Texas State University and Texas Woman's University. 2. In consultation with the officials and planners for North Texas State University and Texas Woman's Univetsi'.y, the current expansion plans and access requirements of each area will be determined . 3. The probable impact of each plan on the land use, street system and traffic generation of the areas involved will be determined. 4. A coordinated plan for the changes required in the street system, land use and other is physical features of the area within and near the Universities will be developed . The plan shall delineate the changes required to permit the full development of the University Campuses, as well as the probable timing of the changes along with responsibilities and coordinating procedure recommendations. 5. The results of the study and agreements will be incorporated in a report, which report will be designed as a guide to the gradual change, expansion and Improvement of the campus of each University and the area adjacent thereto. The relationship to the over- all land use pattern of the City of Denton and the future major thoroughfare system shall be a consideration in the final recommendations. i ARTICLE 3 GENERAL 1. All maps, plans, data and reports developed by the Consultant as part of the planning program, except file and record copies, shall become the property of the City upon completion of this Contract or any phase thereof. 2. The conclusions and recommendations resulting from the planning program will be prepared in the form of a report and submitted to the City. -2- r j i 3. The City will make available all existing maps, records and data which may pertain to the physical development of the planning area of concern or be important to the planning program, It is also understood that North Texas State University and Texas Woman's University will furnish appropriate data and consultation. 4. It is intended that the work outlined herein be accomplished and submitted to the City within six (6) months of the City's authorizing the Consultant to proceed by executing 1 this Contract. 5. The Consultant shall not assign any interest in this Contract without prior written consent of the City. ARTICLE 4 COMPENSATION TO CONSULTANT For the services to be performed under the provisions of this Contract, the City agrees to the Consultant the sum of $4,750.00 upon completion and delivery of the Report. I It is understood that should conditions develop which require significantly more work than outlined in Article 2 , compensation for the extra work shal I be subject to negotiation prior to undertaking such extra work. The payments for each item shall be made within thirty (30) days after submission of the Report. The fee paid the Consultant shall include cost of salaries, insurance, travel expense, taxes, but the actual cost of printing the Report in such number of copies as the City may desire, shall be at the expense of the City. The Consultant will furnish all drawings and text material and will supervise the printing of the Report. The City shall also be furnished one original or reproducible copy of all maps and plans prepared as part of Oils Contract. ARTICLE 5 TERMINATION OF CONTRACT It Is contemplated by the parties that the services to be performed under this Contract shall require six (6) months. Payments for services shall be as provided in Article 4 herein. It is agreed that the City may cancel or terminate the Contract upon thirty (30) days written I notice with the provision and understanding that Immediately upon receipt of notice of termina- tion, all work and labor shall cease pending final cancellatior. In event this Contract is ,.3. terminated as set forth or by agreement of the parties prior to completion of the work provided for herein, Vie City agrees to pay the Consultant on a prorated basis for work actually per- formed and accomplished in accordance with the terms of this agreement. In determining the prorated compensation to be paid, the Consultants shall be paid an amount which bears the same ratio to the total compensation as the work accomplished bears to the total services to be performed by the Consultant under this Contract, less payment of any compensation previously made. AN ORDINANCE AMENDING THE CODE OF THE CITY OF DENTON, TEXAS, DELETING THE MA,.IMUM FEE FOR ELECTRICAL WORK PERMITS; PROVID- ING FOR SEPARATE PERMITS FOR EACH SEPARATE UNIT; PROVIDING AN EXCEPTION; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON,, TEXAS, HEREBY ORDAINS: PART ONE. That Chapter Nine, Article IV, Section 9-47, of the Code of the City of Denton is hereby amended by deleting the following three lines from Section 9-47 including the catchline: MAXIMUM AND MINIMUM FEES Minimum fee for any one permit $ 1.25 Maximum fee for any one permit ..................$50.00 and substituting therefore the following two paragraphs: MINIMUM FEE: Minimum fee for any one permit $ 1.25 SEPARATE PERMITS: A separate permit shall be required for each separate building, store space, or apartment, whether such unit is metered separately or conjunctively, and a service permit shall be taken on all ;3uch units whether suppli- ed from a central metering st&tion or directly from an electricity supply agency, except that in trailer courts, the individual trailer disconnect switches shall not be deemed services.
