made a study of the zoning reuulations and enisting land use of
the City of Dentcn over a period of several months and recomn.ended
certain revisions to the zoning revulations of Ordinance 69-1 pass-
ed and approved on the 14th dal' of Jant:ary, 1969; and
MUMS,, the Cite Council pursuant to a request of the Plannina
and Zoning Coir.miSslon did call a public hearing on October 26, 19719
after giving notice as required by law; and
WHEREAS, the City Council is of the opinion that the passage of
the amendnents to th*a ?•oni.n Ordin-.cnec its recorrnended by the Plann-
ing and Zoning C:i;t_.ti_Gsion is: in the public intcresL and den.ned neccs-

(23) Howe Occupations - A horre occupation is an occupationr

without offering any coninodi ty for sale on the Further,

of a repair garage, pluribing shop or similar activity in a resi-
dential area. For purposes of this ordinance, retail sales are per-
mitted through activities which are commonly termed "narage sales"
when such sales do not extend in duration in excess of three conse-
cutive calendar- days, and all other provisions of the home occupation
requirements as listed above are followed. And, sales from such
premises are deemed not to comply with the "garage sale" exception to
the home occupation rule if such "aaraoe sales" reoccur within six
(6) months after termination of the last sale held at the same ore-
mists,, or, if commodities sold are those other than those items cus-
tomarily found in a household.

(a) Iniere the frontage on one side of a street between two
intersecting streets is dividr.d by two or more 70ninq districts,
the front yard shall coriply with the requirercrntr. of the most
restrictive district for the entire fruntage. (See Appendix
Illustration 7)
(h) Where a buildino line has been established by plat or
Ordinance approved by the City Planning and Zotinq Commission or
enacted by the City Council and Such 11ne requires a greater or
lesser front yard setback than is prescribed by this Ordinance
for the district in which the buildincl line is located, the re-
quired front yard shall comply with the building line so establish-
ed by such ordinance or plat.
(c) The front yard shall be measured fron the property line
to the front face of the buildinn, covered porch, covered terrace
or attached accessory building. Eaves and roof extensions may
project into the required front yard for a distance not to exceed
four (4) feet and subsurface structures may not project into the
front yard to a height greater than forty (40) inches. (See
Appendix Illustration 5)
(d) Where lots have double frontage, running through from one
street to another, a required front yard shall be provided on both
streets unless a building line for accessory buildings has been
established along one frontarie on the plat or by Ordinance, in which
event only one required front: yard need be observed. (See Appendix
Illustration 6)
(e) If buildings alone, the froritarie of any street in a single
block have observed an averane setback -,hich is oreater or lesser it
dimension than the ninimum front yard establisl.cwd in the district,
then the average front yard of all buildings in the block shall
establish the minimun front yard, however. this regulation shall not
be interpreted as requiring a front yc.rd of more than fifty (50) feet
or any building to observe a set back exceeding ten (10) feet greater
than that observed on any adjacent lot. (See Appendix Illustration 8)
(f) In the MF-2 District, a minimum front yard of twenty-five
(25) feet shall be required provided, however, that in no case shall
the distance from 0e centerline of the street on which a buildinn
fronts to the front face of the buildinn be less than one-half (1/2)
the height of the building. (See Appendix Illustration 11)

shall be provided between such wall and the side lot line. (See
Appendix Illustration 9)
(c) Where apartment buildings or structures. are constructed to
exceed three (3) stories in height, a side yard equal to one (1) foot
for each two (2) feet of building height for all buildings faces or
walls having opening for light, air or access shall be orovided, ex-
cept that such side yard need not exceed fifty (50) feet. In all
districts pernitting the construction of apartment buildings exceed-
ir5 three (3) stories in height, a minimum side yard of ten (10) feet
shall be required for any bui ld;nq face or ,.fall which contains no
openings for windows, liunt or air. (See Appendix Illustration 11)
(d) On a corner lot a side yard adjacent to a street for a
multiple-family dwelling not exceeding three (3) stories in heiolit
shall not be less than fifteen (15) feet and no balcony or porch, or
any portion of the building may extend into such required side yard,
except that a roof may overhang such side yard not to exceed four
(4) feet.
(e) On a corner lot used for one-family or two-family dwell-
ings, both stre^t exrosures shall be, treated as front yards on all
lots flatted after the effective date of this Ordinance, except -that

Commission containing a side yard of ten (10) feet or more the
buildinn provisions on the plat shall be observed. On lots vhich
were official lots or record prior- to the affective date of this
Ordinance, the minimum side yard adjacent Lo a side street shall be
ten (10) feet. (See Appendix Illustration 4)
(f) A one-family attached dwellino shall orovile a minimum
required side yard adjacent to a side street of ten t'.0) feet and no
complex of attached one-fznily dwellings shall exceed t,:o hundred
(200) feet in length. A minirauer required side yard of five (5) feet
shall be provided at the end of each one-family attached duelling
complex so 0 at the end of any trio adjacent building complexes shall
be at least ten (4) feet apart. (See Appendix Illustration 12)
(g) The minimum side yard requirements in a Planned Develop-
ment District shall be established on the site plan which shall be
made a part of the Amending Ordinance.
(h) No side yard is specified for nen-residential use in the
08 NS. GR, Co CB1 LI, and HI Districts except where a commercial,
retail or industrial or other non-residential use abuts upon a dis-
trict boundary line dividing such district's from a residential dis-
trice in which event a minimum ten (10) foot side yard shall be pro-
vided on the side adjacent to such residential district.
G. REAR YARD
NO BUILDING OR STRUCTURE SHALL HEREAFTER BE LOCATED, ERECTED
OR ALTERED TO HAVE A REAR YARD SMALLER THAA HEREIN REQUIRED.
(a) In the A. SF-16, SF-109 SF-7, 2F9 MF-1, MF-2, U, P, O,
HS, GR, C, CDs or Lt Districts, no rain residential buildinn reap
be constructed nearer than ten (10) feet to thb rear )roperty line.
The main residential buildino and all accessory buildings shall not
cover more than fifty (50) percent of that portion of the lot lying
to the rear of a line erected joining the nid-point on one side lot
line with the mid-point of the opposite side lot line. For accessory
building standards see Article 18.
(b) In the 01 NS9 GR, Co CB, Lt and III Districts, no rear yard
is specified for non- residential u.;° except where retail, commercial
or industrial uses back upon a cop^non district line, whether separated
by an elley or not, dividing the district freer any of the residential
districts listed herein, a minimum rear yard of ten (10) feet shall
be provided.

(c) Every part of a required rear yard shall be open and
unobstructed to the sky fron a point thirty (30) inches above
the general (rround level of the graded lot, extent for accessory

EXCEPT IN CONFORMANCE WITH THE FOLLOI.111IG STANDARDS:
For any use other than single family or two family dwelling
units, all structures shall be set back a mininum of fifty (50)'feet
from any right of way of the Federal or State Highway System (any
highway designated as a Federal or State Highway) including the front-
age roads thereof, but excluding those protions of U.S. 77 and U.S.
377 on Locust Street and Elm Street hetac en Laole Drive and F.R. 2164.
At the present tine this hiah..lay system includes I.H. 35E9 I.H. MI
I.H. 35, Loop 288, U.S. 77 (Dallas Drivel", U.S. 377 (fort Worth Drive),
U.S. 380 (Universit.v Drive), F.R. 426 (Cast McKinney), F.R. 428
(Sherman Drive). F.R. 2164 (North Locust), and F.R. 2181 (Teasley Lane).
The fifty foct area may be used for off-street parking, driveways,
signs, canopies, and pump islands. 3o sign, canopy, or pump island,
however, shall be located within 25 feet of such highway right of ray.

C. SPECIAL OFF-STREET PARKING RE GULATIGNS
(1) In computing the off-street parking requirements for any
developcent v:hich includos more than one distinct class of u;(_. (i.e.
retail centers with restaurants, multi-family developments %-J0 Public
convenience facilities, etc.) the total nari.inn requirenent sha11 be
the sun of the specific parking requirements for each class of use.
This provision shall apply only when the uses are separate and distinct
and shall not be construed to exclude store roon or offices from re-
tail requirements. In all cases where two or more uses co-exist to
perform a singular function within a structural unit, the parkino re-
quirement shall be based on the gross area using the highest minimum
parking requirement applicable.

B. PROCLDURE
(1) The City Council way, from time to tinor:, amend, supple-
nenL, or change by 'lydinrncr the boundaries (it LFin districts or the
regulations herein established as provided by the Statutes of the
State of Texas.
(2) Before taking action on any nronosed anendment, supplement,
or channe, the aoverninn body shall submit the sane to the Planning
and Zonia-l Conr>ission for its recom^iendation and report.
(3) The Planning and Zoning Cornission sh•)II hold a public
hearing on any application fir any anapndment or change orior to mak-
ing its recon-endation and report to the City Council. Vritten notice
of all public hearings before the Planning and Zoning Commission on
a proposed amendr ent or chjnne shall be sent to all oviners of real
property lying within two hundred (200) feet of nronerty on irhich the
change is requested. Such notice shall be givca not less than ten
(lo) days before the date set for hearing by posting such notice pro-
perly addressed and pr;tane-paid to each taxpayer as the ownership
appears on the last approved City Tax Roll.
(4) A public hearing shall be held by the governin~j body before
adopting any proposed amendment, supplement or change. Hatice of such
hearing steal) be given by publication in the offi;ial newspaper of the
City of Denton stating the time and place of such hearing, which time
shall not be earlier than fifteen 115) days from the date of publication.
(5) Unless a proposed amendment, supplement or, channe has been
approved by the Plr.nninn and Zoning Cor•imission, or if a protest anainst
sue;. proposed amendment, supplement or.channe has been filed with the
Cit Secretary, duly sipn~d and acknowledned by the o::ners of twenty
(20~ percent or more of the area of the lots included in such a proposed
change, or those within two hundred (200) feet therefrom, such amendment
shall not become effective except by a four-fifths (4/5) vote of the
City Council.

unconstitutional, the same shall not affect the validity of this
Ordinance as a whole or any part or provisions thereof other than

from the date of its passage, and the City Secretary is hereby
