NOW, THEREFORE, in consideration of the above and foregoing and the mutual covenants and agreements contained thi:rein, and other good and valuable considerations, the sufficiency and receipt of which are hereby expressly acknowledged, the parties hereto enter into this ?agreement and agree as follows: 1. The City agrees to allow owner to ir.stall one ten (1011) inch line from the city's main line up to the necel-sary building and to install a combination fire line and water service line from the ten (10") inch line to the building. 2. That the three (3") inch water meter and meter loop may be it •talled adiacent to the building being served. 3. That the maintenance of the three (3") inch meter and meter .oop shall be the responsibility of the City and that owner shall give City right to traverse Owner's property in order to maintain such water meter, and to read the meter. 4. That the maintenance of such ten (10") inch line and the combination fire and service lines shall be the responsibility of the Owner. 5. That no other party may tie on to the ten (10") inch water line. 6. That the City has the right to shut off the water at the connection of the ten (10") inch line with the twelve (1211) inch line on Mayhill Road if there is a leak in the ten (1011) inch line or the water and fire line extending from the ten (10") inch line. T}.e water service uhall be restored as soon as is feasible after the leaks have been repaired by the Owner. 7. Construction of the private lines shr,ll 'ie done by Owner in a good and workmanlike manner. 8. Owner shall allow City employees, agents or representatives to go upon tho property, inspect and work upon any portion of the private lines which connect or tie to the public lines at all rea- sonable times, and to repair or replace the water meters on said d private lines as needed. -2- MEMMEMMEW 9. This Agreement and all rights hereunder shall run with the land and be binding upon and inure to the benefit of the partie6 hereto, their succeosors and assigns. This Agreerent shall be recorded in the Deed Records of Denton County, Texas. 10. All modifications of this Agreement must be made in writ- ing and signed by all of the then current owner's of the land re- ferred to herein. This Agreement shall lie constructed and governed in accordance with the Laws of the State of Texas. WHEREAS, the City of Denton heretofore purchased a parcel of land bounded by West Prairie on the South and Carroll Blvd. on the West consisting of 7,794.24 sq. ft. more or leas, for street right-of-way purposes; and WHEREAS, the said property is not now suitable for street purposes and the Community Development Department of the City of Denton has recommended that such propeit.y not be used for street purposes because the same is not now useable or suitable; and WHEREAS, the City Council of the City of Denton desires to go on record as abandoning any intention of ever using such property for street purposes, and to evidence the fact that such property has not heretofore been used for street purposes and is not a part of the street system of the City of Denton, and that such property should be sold in order that the proceeds from the same might be used by the City of Denton for street purposes; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS: SECTION I. That the following described property, to wit: All that pertain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and tieing part of the Wm. Loving Survey, Abstract #759, and being part of two tracts of land, hereinafter referred tc as "tract two" being conveyed to City of Denton by Deed dated October 29, 1969 and recorded in volume 598, Page 27 of the Dead Records of Denton County, Texas and "tract two" being conveyed to City of Denton by Deed dated August 19, 1969 and recorded in volume 590, page 108 of the Deed Records of Denton County, Texas and more particularly described as follows: BEGINNING at the southwest corner of said "tract :,:e" said point of beginning lying in the north right-of-way line of Prairie Street; THENCE west along south boundary line of "tract one", same being the north right-of-way line of Prairie Street, a dis- tance of 61 feet to a point for a corner; THENCE north 1.018143" east passing at 56.01 feet the north boundary line of said "tract one" same being the south boundary line of said "tract two' and continuing north 10 18143" east a total distance of 1:•1.03 feet to a point for a corner in the north boundary line of said "tract two"; THENCE east, along the north boundary line of said "tract two", a distance of 58 feet to a point for a corner, be- ing the northeast corner of said "tract two"; THENCE south along the east boundary line of said "tract two", passing at 75.0 feet the southeast corner of said "tract twc", same being the northeast corner of said "tract one", a total distance of 131.0 feet to the place of beginning and containing 7,794.24 square feet of ',and, more or less. be, and the same is, hereby abandons-d insofar as said property may be used for street purposes by the city of Denton. That the above described property, not being suit- able or useable for street purposes, and nut having been used for street purposes, be, and the same is hereby declared to be, surplus property of the Ci;y of Denton, and upon recommendation of the Com- munity Development Department of the City of Denton should be disposed of as surplus and unuseable property in accordance with the Charter of the City of Denton and the laws of the State of Texas. SECTION 711. That the City of Denton has officially advertised seid property for sale and received sealed bids, an3 that such prop- erty be, and the same is hereby authorized to be, sold to the highest bidder, for the highest cash consideration. SECTION IV. That the funds received from the sale of such prop- erty, after deducting necessary expenses, may be used for street pur- poses only. SECTION V. The fact that the above described property .,6s not needed or useable for street purposes and the Community Development Department of the City of Denton has recommended that it not be used for street purposes, because it is unsuitable for such purposes, and that such property should be sold in order to permit the proceeds from the sale to be used for street purposes, creates an urgency and an emergency in the preservation of the public health, safety and welfare, and it requires that this ordinance shall take effect im- mediately from and after its passage, as the law in such cases pro- vides. Administrative Directive should be adopted for Denton; and WHEREAS, it appears that a request to be included within such Administrative Directive must be submitted on behalf of an entire county; NOW, THEREFORE, BE IT RESOLVED BY TPE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, THAT: Section I. The City Council hereby determines that the corporate limits of the City of Denton, Denton County, Texas, should be included within the provisions of the Governor's Administrative Directive providing for Odd/Even Gasoline Sales beginning June 2P, 1979, for portions of Texas. Section II. The City Manager or the Assistant City Manager is hereby authorized to advise The Commissioner's Court of Denton County and the office of the Governor of the determination of the City Council as set out above, and r . to request that the City of Denton and Denton County be in- cluded within the provisions of the Governor's Administrative Directive. Section III. The Governor is hereby urged to include all portions of the City of Denton and/or Denton County, which are brought under the provisions of his Administrative Dir©ctive within the reallocation of gasoline available as a result of the State's emergency set Pside. WHEREAS, the CITY desires to retain the services of the CON- SULTANT to assist in the training of firemen in the area of emer- gency health care and to utilize CONSULTANT'S skills, experience and abilities as a qualified Emergency Medical Technician and para- medic in implementing amrulance service programs with the CITY'S Fire Department; NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained the parties hereto agree as follows: 1. CITY agrees to contract with and pay CONSULTANT for personal services rendered for a period of six (6) months commencing June 1st, 1979, on a part-time basis at a total salary of $6.29 per hour. CON- SULTANT hereby agrees that such part-time basis shall consist of work- ing an average of fifty (50) hours every two (2) calendar weeks with payment to be made to said CONSULTANT every two (2) weeks. 2. CONSULTANT'S services shall be performed under the general direction of the CITY'S fire department chief, but CONSULTANT shall have fival supervisory authority with regard to all training of emer- gency medical service personnel.. 3. CITY agrees to provide CONSULTANT with general liability and malpractice insurance; and, provide life insurance and workmen's com- pensation insurance equlvale n to that of CITY'S employees. Further- more at said CONSULTANT'S request and for his benefit, social security deductions will not be subtracted from CONSULTANT'S salary although other apFlicable withholding deductions shall be substracted. 4. CONSULTANT shall submit a monthly progress report in such form as may be required by the CITY'S fire department chief showing the status of the work. IE progress is delayed, the report shall Ftate the reasons for such delay. M 5. Either party may at any time, and for any reason, terminate this contract by written notice specifing the termination date, which shall not be less than two (2) weeks from the date such notice i.! given. In the event of such termination, the CONSULTANT shall be paid such amount as shall compensate him for the portion of the work satisfactorily performed prior to the termination date. Termination under th.ls section shall not give use to any claim against the CITY for d:mac,es or compensation in addition to that provided hereunder. 6. CITY acrees to indemnify and hold harmless the CONSULTANT from all :laims, demands, or loss damage resulting from, or arising out of, the operai:iun of the ambulance service program, but will not under any circumstances indemnify the CONSULTANT for any willful, in- tentional ~r malicious acts on his part. 7. It: is the express intention of both parties to this contract that DONALD GLYNN ERWIN is being employed by the CITY as an independent contractor Eor personal consultant services and that said Donald Glynn Erwin is in no ways to be considered ar, employee of the CITY.
