WHEREAS, Koleta G. Hunt is requesting the Planning and Zoning Commission
of Denton, Texas, to change the zoning classification of 1619 Underwood
Street (On the southeast corner of Avenue C and Underwood Street or'I-35E)
from Single Family (SF-7) To General Retail (GR) 1 and,
WHEREAS, this property is located in a residential section of the city; and,
WHEREAS, traffic flow to the lot is restricted by I-35E and would require
customers to approach through residential strnetsi and,
WHEREAS, said streets are lined by residences occupied by numerous children
and elderly citizens as shown by thka petition; and,
WHEREAS, General Retail is the classification most likely to be used `
for sale of liquor in pending'laws, and this could allow persons under
the influence of alcohol on our residential streets with these children
and elderly citizensl and,
WHEREAS, the subject lot is covered with beautiful, large trees which
now serve as a sound buffer and beautify the area for residents and
those on I-35E; these trees would most likely be removed to build a
retail establishment;
THEREFO:IE, we the undersigned property owners are opposed to this
request for rezoning and ask that you deny the requested zoning change.

AN ORDINANCE by the. City Council of the City of
Denton relating to the relationship of the City of
Denton with the Texas Municipal Power Agency;
approving the construction of an electric generating
facility by the Agency, to be known as Bryan
Lignite Number One, as well as certain System
Development and Reliability Expenditures and
Development Projects and the issuance of bonds by
the said Agency for such purposes; approving a
Power Sales Contract and providing for its -xecution
on behalf of this City; enacting other provisions
incident and related to the purpose of the ordinance,
and declaring an emergency.
WHEREAS, this: governing body has received the request
of the Board of Directors of the Texas Municipal Power
Agency that this governing body approve (1) the construction'
of an electric generating facility by the Agency, to be
known as Bryan Lignite Number One, and (2) certain System
Development and Reliability Expenditures, and (3) certain
Development Projects, a?.Zd (4) a Power Sales Contract; and
WHEREAS, this governing body has and does hereby determine
that it is in the best interest for the City and its inhabitants
to approve the same and the issuance of bonds by the Agency
to provide a portion of the funds which will be required;
` NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON,
TEXAS, HEREBY ORDAINS:
SECTION 1: That Bryan Lignite Number One is hereby
approve3 ass project of the Texas Municipal Power Agency,
such project being described as follows:
An electric generating plant (including land), steam
boiler; steam turbines electric generator; cooling
facilities; asscniated transmission, transformation and
switching facilities so as to connect the plant to
existing or proposed facilities; a lignite mine;
railroad siding; shops; warehouses; construction camp;
office; dwellin s and other structures, fixtures,
equipment, supplies or, other items which the Board of
Directors of the Agency finds are needed or useful in
connection with the construction, maintenance, any'
operation of the plant (and providing fuel for the
same) so the electric generating plant shall be placed
in service as an operating utility.
It is anticipated that such initial generating plant
will include a steam turbine actin, as the prime mover of an
electric generator of approximately 400,000 kilowatts (net).
The steam boiler, steam turbine and electric generator will
be of the outdoor type with all other equipment relating to
plant services and control enclosed in appropriate buildings.
It is planned that plant cooling facilities are to be
in the form of a pond supplied from underground water or the
water purchased from an existing water-storing entity in the
area for make-up water or by impounding water.
The strip mining operation includes equipment for
excavation and transpor`ation. The Project includes communication
equipment; all necessary permits, licenses; developmental
rights; easements, right of way; approvals, certificates of
state and federal agencies where applicable; real estate and
interest in properties where necessary.
SECTION 2: That the issuance of bonds of the agency in
the pr n3-amount of $50,000,000 is hereby approved, it
being understood that the bond proceeds are to be expended
for the purposes shown below;

That the estimated expenditures are subject to adjustment
and finalization as preliminary estimates at such time as
the bonds of the Agency are sold and definitive construction
bids are received.
SECTION 3: That the System Development and Reliability
Expen tines Tnc'.ude:
(a) Olinger - Greenville Transmission Line - the
estimated balance required to provide survey, right of way,
line construction, interconnection and engineering for a new
20 mile 138 KV transmission line form Greenville to Olinger,
(b) Bryan Capacitors Bank - to prevent Bryan from
experiencing severe voltage drop during certain pooling
contingencl.es, 21.6 WAR of 69 KV capacitor banks are to be
placed in service,
(c) Bryan interconnection - a 20 mile 138 KV line from
Hearne to Bryan to provide transmission interconnection and
reliable back up for the new 100 MW Dansby unit scheduled
for comple ton in 1978,
(d) Garland 345 MVA line (right of way) - to deliver
power from Comanche Peak and Bryan Lignite Number One to
Garland and Greenville a 345 KV line, two double circuit
138 KV lines, and a 506 MVA 345/138 KV autotransformer will
be required. A 345 KV substation is to be located in Northeast
Garland. Right of way is to be acquired at this time since
the completion date is now scheduled as June, 1980.
(e) Denton interconnection - improvement program to
provide firm transmission supply to over 231 MW of load in
Denton and Roanoke area, including the conversion of portions
of an existing 69 KV transmission system to 138 K1' operation
and two new 138 KV interconnections. Rights of way and
substation site purchases are to proceed immediately,

(f) Fuel exploration and acquisition program - the
search for fuel for Projects other than Bryan Lignite Number
One.
(g) Microwave Communication - continuation of the
development of a communication system begun with the initial
financing of the Agency.
(h) Economic Dispatch Studies - continuation of studies
(begun with proceeds of initial financing by the Agency)
operating the most efficient anti economical generating
units.
The System Development and Reliability Expenditures are
hereby approved.
SECTION 4: That the Development Projects hereinabove
lists ar3- - ereby approved.
SECTION 5: That the form of bond resolution (being
designated "Proof of 3-29-76") which embodies the suggested
terms and conditions under which $50,000,000 in principal
amount of the bonds of the Aggency shall be iosued (such
bonds to be dated September 1, 1976, with interest payable
semiannually thereafter an March 1 and September 1 of each
year) is hereby approved. It is understood that certain
final details of the bonds will be inserted in Article II
and other blanks completed, but no substantial change is to
be made in Article III through Article VI nor shall any
change be made which would cause the bond resolution to be
contrary to the Power Sales Contract.
SECTION 6: That the Power Sales Contract by and between
the Texas Municipal Power Agency and this City (the same
being identical contracts between said Agency and the Cities
of Bryan, Denton, Garland, and Greenville), being attached
hereto as Exhibit A, is hereby approved. The Mayor of this
City is hereby authorized to execute said contract as the
act and deed of this City and its governing body,

SECTION 7: That the public importance of this measure
and t e act t at it. is to the best interest of the City to
approve certain documt.its and the execution of a Power Sales
Contract with the Texas Municipal Power Agency at the
earliest possible time in order that the joint project of
the Cities of Bryan, Denton, Garland and Greenville (to be
accomplished through said Agency) may proceed, constitutes
and creates an emergency and urgent public necessity requiring
that any rule providing for ordinances to be read more than
one time or at more than one meeting of the City Council be
suspended, and requiring that this ordinance be passed and
take effect as an emergency measure, and any such rules or
provisions are accordingly suspended and this ordinance is
passed as an emergency measure, and shall take effect and be
in full force from and after its passage, and it is so
ordained.

AT A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF
DENTON, TEXAS, HELD IN THE MUNICIPAL BUILDING OF SAID CITY
ON THE 6TH DAY OF JULY, A. D. 1976.
R E S O L U T I O N
WHEREAS, a need exists within the City of Denton to re-
duce major crime through a close contact and cooperative
effort between the Denton Police Department and the citizens
of Denton; and
WHEREAS, funding is available from the Texas Criminal
Justice Council to assist the City of Denton in supporting
a Police Crime Prevention Unit; and
WHEREAS, the City of Denton has received funding for
such unit for one year, and is seeking funding for a second
year with the commitment to continue the project after the
second year if the same has been successful;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF DENTON, TEXAS, THAT:
Applications be made to the Texas Criminal Justice
Council to assist the City of Denton in financing a Crime
Preventicn Unit, and the City of Denton commits itself to
continuing the project at least at the same leiel as the
second year of funding if the same is successful and has
been funded by the Texas Criminal Justice Council for the
second year.

THIS AGREEMENT, made and entered into this 6th day of July, A.D. 1976, by
and between the City o~ Denton, Texas, acting through its Mayor, Elinor Hughes,
thereunto duly authorized so to do, Party of the First Part, hereinafter termed
OWNER, and the Institute of Applied Science at North Texas State University of
the City of Denton, County of Denton and State of Texas, Party of the Second Part,
herinafter termed CONTRACTOR.
WITNESSETHt That for and in consideration of the payments and agreements
hereinafter mentioned, to be made and performed by the OWNER, the CONTRACTOR
hereby agrees with the OWNER to commence and complete the Environmental Assess-
menc for six (6) parks and Archeological Assessment for the two (2) parks that
are included in the Paris Development Project under the terms stated in the Pro-
posed Work Statement, attached hereto as Exhibit "A" and incorporated into and
made a part of this contract as if the same had been included in the body of this
instrument, and at the CONTRACTOR'S own proper cost and ex-tense to furnish all
materials, supplies, machinery, equipmr.nt, tools, superintendence, labor, insur-
ance, and other accessories and services necessary to complete the said Environ-
mental and Archeological Assessment, in accordance with the conditions and prices
stated in Exhibit "A" attached hereto; all of whit', .ee made a part hereof and
collectively evidence and constitute the entire cer,~"rprt.
The CONTRACTOR hereby agrees to commence work within ten (10) days after
the date written notice to do so shall have been given to him, and to substanti-
ally complete the same within 60 days after the date of the written notice to
commence work.
The OWNER agrees to pay the CONTRACTOR in current funds the price or prices
shown in the proposal, which forms a part of this contract.

ENVIRONMENTAL ASSESSMENT
I
ENVIRONMENTAL ASSESSMENT*
An interdisciplinary team of environmental ar.d social scientists
and archaeologists from the Insititute of Applied Sciences mill
conduct a cause/effect analysis of the "Proposed Community Parks
Project" by the City of Denton, Texas. Our approach will involve
extensive on-site examination of each park (Southridge, Denia,
Mack, Fred Moore, Evers and North Lake) and its surroundings.
Field work will be design;d to identify and locate all environ-
mental components (e.g., biological/ecological, cultural, demo-
graphic, sociological, physical) that may he siginificantly
altered by the proposed project. A literature survey including
all pertinent records and data maintained by the City of Denton
will be made to augment field work.
Essentially we will assess the existing environmental
conditions of the parks and their surroundings and attempt to
predict and compute the consequences of (1) the proposed action
and (2) no action on t(ro temporal frames (short-term and
long-term) and two spatial frames (on site and the appropriate
surrounding areas). The assessment will address each item
contained in Enviroranental Assessments (July 1975 supplenLC&IL,
U.S. Department of the Interior, Bureau of Outdoor Recreation,
South Central Region). The assessment will follow the specific
Archaeological survey follows.

guidelines in this document and the report will follow the "standard"
format of Environmental Assessment and Environmental Impact Maps
containing findings of field work will be included.
Personnel in the Institute of Applied Sciences have worked
on and prepared numerous environmental impact assessments and
statements. We will draw on this experience to prepare a docu-
ment that will enable the Bureau of Outdoor Recreation to decide
whether or not an Environmental Impact Statement is required under
Section 102(C) of NEPA for this project.
In addition to identifying potential impacts on the environ-
ment, we will offer suggestions to mitigate these impacts where
possible.
If work can begin by 21 June, we should have a completed
EAS report by August 16. The archaeological report should be
completed by 1 August. We plan to submit the archaeological
report separately at the earlier date, but will also include
it in the final EAS to make it a complete document.

ARCHAEOLOGICAL ASSESSMENT

INTRODUCTION
The following proposal is for a comprehensive archaeological
survey of areas to be affected by the expansion of North Lakes
and Fred Moore Park facilities proposed by the City of Denton,
Texas. The research will include an intensive walking reconnais-
sance of the approximately 356 acres included in the two parks.
Upon completion of the survey, an accurate and detailed
assessment of the prehistoric and historic archaeological resources
which will be affected by the proposed construction operations
will be provided the City of Denton. Included in this manu-
script will be specific recommcidations for mitigating .-ny
anticipated adverse effects of the proposed park improvements.
DESCRIPTION OF PROPOSED RESEARCH
1. Background:
Prior to the initiation of field investigations, a literature
search will be conducted in order to locate all published reports
and manuscripts which deal vrith the archaeology of this section
of Denton County. In addition to published literature, infor-
mation on file at institutions such as the State Historical
Survey Committee and the University of Texas at Austin will be
carefully checked for additional data. During this phase of
investigation, private, local collections of archaeological
materials will be studied and information collected on putsible
site locations.

2. Survey:
Field investigations will consist of a walking survey of
both park areas. The lack of heavy ground cover should facilitate
the location of any sites which are not deeply buried beneath
the present ground surface. Two teams of archaeologists will
walk over the entire area to be affected by construction. All
personnel have been trained in archaeological site survey and
locational techniques. After a site has been located, the
following data will be recorded in order to give as full an
evaluation as possible:
a. Location - This information will be recorded
on both 7-1/2 minute United States Geological
Survey maps as well as those provided by the
City of Denton. In addition, a verbal descrip-
tion of how one would go about relocating the
site will be made.
b. Extent - The size of the site is primarily deter-
mined by the scatter of artifacts visible on
the ground. This estimate becomes difficult
when a portion of the site is buried and not
visible, or when the originial limits of a site
have been disturbed by flooding or plowing.
c. Nature - The nature of a given site is deter-
mined on a number of factors such as surrounding
vegetation, location with respect to the natural
environment and other sites, and the distribution
and nature of noted artifacts.

A scale map of each site will be made in addition to a mim-
ber of both black and white and color photographs. The collected
data, maps and photographs will become part of the permanent
record for each site.
It is generally accepted that the distribution of surface
archaeological remains reflects, in varying degrees, the sub-
surface distribution. Such being the case, artifacts will be
collected only at sites where it has been determined that no
further work is necessary or possible.
3. Analysis:
Collected materials and data will be returned to the arch-
aeology laboratories for analysis and preservation. A manuscript
will be prepared which will present the recovered information,
supporting data and recommendations. Specifically, the report
will contain the following information:
a. A literature review including a bibliography
and written summary (where applicable).
b. The data collected on the prehistoric and
historic archaeological remains noted during
survey.
c. An interpretation of the collected data
including each site's location, extent
and significance.
d. Specific recommendations for the mitigation
of any adverse effects of the proposed con-
struction.

It is anticipated that the total project will take approxi-
mately 10 days from start to completion. The following is a
breakdown of the time allocations:
a. Background and Literature Research: 2 days
b. Survey: 3 days
c. Analysis and Report Preparation: 5 days

Ordinance No. 75-46 ordering the improvements of the
hereinafter named streets and levying the assessments was pass-
ed on the 4th day of November , 19 75 A. D., and
the work of improving the streets described on Exhibit A, which
is made a part hereof and attached hereto, has been completed,
the Director of Community Development of the City of Denton
having measured, examined and caused to be tested the finisl;ed
improvements by the means and in the manner provided by the
terms of such contract and of plans and specifications therein
contained, and the Director of Community Development having
found that such improvements have been constructed and completed
in full compliance with the terms of said contract and ti-.e plans
and specifications therein contained, and having approved and
accepted said improvements, and having recommended that the City
Council accept said work and improvements, it is, accordingly,

The City of Denton bought the electric and water plant from the
Denton Water & Light Company June 10, 1905 and it was transferred to
the City July 5, 1905 for $65,000; $15,000 was to be paid in five annual
payments of $3,000 each and the City assumed the payment of $50,000
bonded indebtedness, bearing 6% interest payable semi-annually, the
gold bonds being payable in 1922. The City was to pay this out of
revenues of the plant. The City issued $25,000 of forty year bonds and
made extension of the system to 13 miles of mains. The sewer system was
added and many other extensions made.
In the year 1908 the unsanitary condition of the City and the
typhoid fever epidemic in July and August produced a strenuous effort to
build a sanitary sewer for the City. The City estimated it would take
$25,000 to build the system, but the City's bonding capacity at that
time was only $12,500. The cry quickly went out to the citizens and
businesses to pledge the remainder. Thankfully the Citizens of Denton
a
responded and the City received a first class sewer system consisting of
8 7110 miles of mainseand a septic tank. (The septic tank cost $5,100.
At todays prices the mains would cost approximately $359,040.00.) for a
total price of $26,791.70. The City added this to the water works
department and made its service free to all as an inducement for all to
make connection with it, making the City sanitary.
The City of Denton now has an installed capacity of 12,635 KW at
the Diesel Plant and 163,000 KW at the Steam Plant (net capability).
The Diesel Plant is used only in emergencies as the cost to maintain and
operate these units is prohibited. Units 1 and 2 were installed in 1948,

unit 3 in 1950, unit 4 in 1953 and unit 5 in 1954. At the Spencer Steam
Plant units 1 and 2 were installed in 1955, unit 3 in 1962, unit 4 in
1966 and unit 5 in 1973. According to our latest predictions these units
will meet our needs through 1979, at which time we will be able to meet
our obligations through our association with TMPP.
Historically the electric rates have gone down in the City of Denton.
The rates that went in effect in 1932 showed a decrease in charges as
did all subsequent rate changes thereafter. These rates either lowered
the bottom step or changed the first steps of our rates to benefit the
customer. The rate change in 1975 reflected the first true rate increase
in the City of Denton's History, and contrary to a lot of talk, Denton's
rates are still very competitive in the State of Texas.

AT A REGULAR, MEETING OF THE CITY COUNCIL OF THE CITY OF DENTON
TEXAS, HELD ICI THE MUNICIPAL BUILDING OF SAID CITY ON TEE
DAY OF A. D. 1976.
R E S O L U T I O N
WHEREAS, the City of Denton presently operates a sanitary
landfill, and said sanitary landfill will be fully utilized with-
in approximately twelve (12) months; and
WHEREAS, the Cities of Denton, Sanger, Pilot Point and Aubrey,
all Denton County Cities, have expressed an interest in cooperating
in developing a regional sanitary landfill for joint use; and
WHEREAS, the City of Denton deems it appropriate for the County
of Denton to construct and develop such sanitary landfill, requests
that the Commissioner Court of Denton County issue the necessary
Revenue Bonds to purchase and develop said sanitary landfill site;
and
WHEREAS, the City of Denton agrees to execute a contract with
the County of Denton to guarantee annual payments in an amount re-
quired to retire the principal and interest on the bonded Indebted-
ness in proportion to the percentage of the site used by the City
of Denton; and
WHEREAS, the City of Denton further agrees that it will sign
a contract to operate the proposed sanitary landfill in accordance
with all ordinance, state statutes, and rules and regulations of
promulgated by the Texas Department of Health Resources;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY Of DENTON, TEXAS,
RESOLVES:
That the staff should be directed to negotiate agreements with
the County of Denton to guarantee payment of a proportion of the
cost of a regional sanitary landfill and to operate the same, and
bring such agreements to the Council for approval; and that the
County should be encouraged to be the sponsor of the regional land.

Dear Mr. Jones:
I am enclosing the Easement which you recently submitted.
This is an easement which is granted to the City of Denton,
Texas for constructing, installing, repairing and perpetually
maintaining public utilities in and over a tract approximately
sixteen (16) feet in width along the front of my property which
is located at the southwest corner of the intersection of U.S.
Highway 380 and Loop 288 in the City of Denton, Texas.
The subject easement has been signed and acknowledged by
me, and is delivered to the City of Denton, Texas upon the
express condition that an eight (8) inch sanitary sewer line
will be installed, and available to me for service, in and across
the tract covered by the easement not later than October 151
1976, time being of the essence.

Rc: The Paving of Daughtery Street

Dear Members:
I am sorry that I missed the last Council meeting but I had
another meeting that same night. Of course i was disappointed in
the final voting you took in rejecting my petition to pave Daughtery.
I have again checked with Mr. Jones and I was informed that
our petition was legal according to the enclosed petition blank.
Tt~,? names on the petition did in, fact represent a combined ownership
of more than 60% of the assessable footage along the street. The
petition did not represent 60% of the property owners. However, as
stated in the requirements, either (1) or (2) would sufficel
The net of all this is that our petition is a valid one accord-*
ing to the petition form o the City. Therefore, it would seem
that there is another basic reason for rejecting the petition. I
would guess at this point, judging on what Bill Nash stated at the
last meeting where I attended, that the real cause for rejection
was due to a drainage problem at the corner of Johnson and Daughtery.
The question is: If this i~: the hold-up, will a study be m%.de
to determine the expense of a drainage unit that would carry wat,_c
toward Dallas Dr. into a cement canal running adjacent to the apart-
ment complex on Dallas Dr.?
I have contacted Glenn Justice Co. in Dallas and was told that
they would be glad to consider an easement request for such a drain-
age unit along the north boundry of their tract and i would certainly
agree to an easement along my property which is adjacent to the Jus-
tice tract. The second question then is: Does the City have the
funds to construct a drainage unit? If not, would the Council please
inform the petitioners accordingly and hopefully make some estimate
of the length of time (months, years, etc.) it would be before such
funds would become available. If doing nothing about the matter
except to reject the petition is the Council's final decision, I
would appreciate some definite statement from the Council giving
the basis of their rejection and some kind of suggestiins as to what
the people along Daughtery can do now to overcome the problems

involved. we would still like to see the street paved. One block
of Avenue F and West Prairie will soon be paved.. Daughtery Street
ie longer than both these projects, so the overall "size" of the
.job should not be a factor. In short, I would, as the petition
"chairman", like to have something to tell these people from their
.Council. We simply don't know where to turn now.
in the meantime the drainage problem existstoday even while
Daughtery and Johnson remain unpaved; that is, water stands for
several days following rain at the south end of Johnson because it
has nowhere to go (except through and around the end of my ware-
houses l). Therefore, this drainage problem is a current onc., not
a projected one from the proposed paving of Daughtery.
I will do what I can to attend the next meeting. I do feel
obligated to those people I signed up on Daughtery and I must con-
tinue to try and try again. Thanking you for your patience with
