That the Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinance:, of the City of Denton, Texas, under provisions of Ordinance No. 69-1, be, and the same is hereby amended as follows: All the hereinafter described property is hereby removed from the General Retail "GR" and Single Family "SF-7" Districts as shown on said Zoning Map, and all provisions of Ordinance No. 69-1y adopted the 14th day of January, 1969, as *amended, shall hereafter apply to said property as Light Industrial "Lr" District in the same manner as other property located in the Light Industrial "Liu District and more particularly described as follows; All that certain lot, tract or parcel of land out of the William Teague S•irvey, Abstract No. 1266 and the Jonathan Brock Survey, Abstract No. 55, Denton County, Texas, r_nd being that tract of land described in two parts as conveyed by G. E. Baker, et ux to A. B. Baker, et al and recorded in Volume 306; Page 4280 Deed Records of said County and being more particularly described as follows: BEGINNING at the northwest corner of said Baker tract, said point being the southwest corner of a tract of land conveyed to J. That the City Council of the City of Denton, Texas hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with seasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens. SECTION III. That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the Planning and zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof. TAYLOR, JR., CITY ATTORNEY CITY OF DENTON, TEXAS a PAGE TWO - Z-1423 - TOM JESTER 74, yl u V .arid AIRPORT MANAJEMENT CONTRACT THE STATE Of TEXAS 1 COUNTY OF DENTON } This agreement is swadu and entered into this day of D,4,_0, 1979, between the CITY OF DENTON, TEXAS, hereinafter referred to as Dentor., and AVIATION 6 TRANSPORTATION CONSULTANTS, INC., hereinafter referred to as ATC. WHEREAS, Denton maintains and operates a Municipal Airport, Il and; WHEREAS, Denton is in need of the services of a i! qualified group to manage and operate such airport and provide assistance and future planning and expansion of said airport, and, WHEREAS, ATC is in the business of planning, deve'.oping and lli managing airport facilities, ands WHEREAS, it is deemed to be of m-itual advantage to Denton and to ATC to enter into this Airport Management Contract under the terms and conditions hereinafter set forth. Now, therefore, for and in consideration of the mutual covenants and prorlrises herein contained, it is mutually agreed as follows: I. Denton does hereby engage ATC for the development and management of the Municipal Airport for the City of Denton, Texas, and ATC does hereby accept and agree to perform such services. II. DUTI91 01 ATCs ATC agrees that its duties in develcping and managing the airport shall consist of the followings 1/ Providing a full time airport managet to be stationed at Denton Municipal Airport including 24 hour emergency coverage of airport operations. 2, Providing for the safe, efficient, and continuous operation of the airport and airport facilities. 3, seeking and negotiating leases on all property within the confines of the airport, including agricultural ground leased, I I A i`' subject 'tti the approVal W. the City Council/ i 4. Collecting and remitting to the City all fees from leas- ing services and operation of the airport, its lands and facilities. 5. Enfcrcing th;. provisions of any lease on airport property. 6. Establishing and enforcing safety and security procedures r rind operational procedures and rules for the airport. ~i 8. Studying and making recommendations to the airport advi- sor,- board plans for optimum and maximum use of airport properties. I, 9. Supervising and coordinating maintenance of all airport properties. 10. Seeking ar,d recommending federal and state airport grants. 11. Making recommendations to the airport board regarding needed changes and operational guidelines and fqe schedules. 12. Preparing an annual budget for submiissian to the City Manager and implementing such controls as are necessary in attempting to confine spending on airport operations to the budget approved by the City Council. 13. Enforcing and regulating the use of the grounds and facilities of the airport. 14. Acting as host and representative of the City of Denton for users of the airport. 15. Providing an information service for transient pilots. 161 Coordinating the airport Safety Committee. 17. Planning, coordinating and executing or approving any air shows or other activities at the airport. 18. Formulating policies and plans governing operational and maintenance functions at thb airport, 19. Providing supervision for the comprehensive maintenance services for all facilities operatiA by the airport, including pl.aneing and directing all engineering work relating to such maintenance. 20. Supervising and coordinating the removal of aircraft I{ )obstructing runways so as to keel, the airport operational. 21. Advising the City and the FAA of any malfunction at the airport which would affect its safe and cfficietut use, such as broken beacons or failure of runway lights, etc. 22. Enforcing standards of construction ,md making recommendations regarding facilities to be erected by leaseholders with a view toward their residual value upon the expiration of the lease with the leaseholder. 27. Coordinating city and airport activities with the FAA and the TAC on various aspects of airport management. 28. Coordinating and managing grants to the Cify of Denton from th3 FAA and the TAC. 29. Preparing all required local, btate and federal reports relating to the operation of the airport. 30. Developing and administering a self inspection program in accordance with federal requirements for certification. 31. Maintaining a daily inventory of aircraft on Denton Municipal Airport. 32. Establishing work procedures and conduct nec;otiations with agents of utility and other companies. 39. Developing a master tariff plan which would ;,'.eld I appropriate economic returns from airport properties. III. COMPENSATIONt In return for the services lrrformo~d by ATC, Denton agrees to pay to ATC as compensation for such services the sum of $16,500.00 per year proratQd monthly, or 358 of the gross annual revenues, whichever it greater. The percentage of gross revenue shall be calculated monthly as it accrues And paid monthly at such time as the said 358 exceeds $10375.00 in any month for that month, in determining gross revenue, all rbvnnue generated by the airport shall be included, with the exclusion of sales tax and ad valorem property tax on aircraft. Upon termination of this agreement, Aw shall not remove M any files, maps, books, pub.iications, records, or other city property from the airpo c other than the personal property of ATC or its employees. The rights of ATC to any compensation which ~laccrued r:cior to any termination under Paragraph A or B above shall not be divested by such termination. V. REPORTINGs F ATC snall regularly attend Airport Board meetings and advise ~I the Airport Board on matters of concern to the Airport Board. On all matters relevant to the use and operation of the airpcrt, its land and facilities, ATC, through its Airport Manager, shall report directly to the City Manager. No less often than annually, the Airport Advisory hoard shall 4 , prepare a formal evaluation of the services being provided by ATC and make any recommendations for changes or improvements in such services and deliver such evaluations and recommendations to ATC by and through its designated Airport Manager. M V1. CITY TO PROVIDEt To enable Ai'C to properly carry out its duties under this contract, the City of Denton agrees to provide the followings 1. A suitable office and office eyt+ipr,tent for the Airport Manager to administer the airport. 2, office supplies for the Airport Manager's office. I ~ 1 a 71 fj r fE 3. Storaqe space for necessary maintenance equipmert and I supplies. 4. City maintenance employees as necessary, with a minimum 11 of one full time employee, to report directly to the Airport Manager. Should such employee not be needed for maintenance i r.perations then the activities of such employea may be redirected by the City Manager. 5. Necessary maintenance equipment end supplies, including a {vehicle for use by the airport staff. i ~ 6. Necessary auxiliary management services, such as manage- ment reports, Finance and accounting assistance, data processing assistance, and other services deemed necessary. i~ 7. Reimbursement of travel expenses to the Airport Manager for trips deemed necessary by the city staff or airport board and approved by the City Manager. VII, MISCELLANEOUSt A, ATC shall have no authority to bind, obligate, or commit Denton by any promise or representation, unless specifically authorized by Denton in writing in a particular transaction. This agreement constitutes the entire agreement between ATC and Denton, and there are no agreements or understandings i concerning such agreement which are not set forth hezrein. R E S O L U T I O N The City Manager, be, and he is hereby authorized and directed to give notice to the Secretary of Health, Education, and Welfare and the State of Texas of the intent of the City of Denton to withdraw social security coverage authorized by modification in 589 for: 4'r (a) Services by individuals in policemen's positions only as employees of the City of Denton as members of a coveragge ggroup (as defined in Section 218 (d) (4) of the Act) of the Texas Municipal Retirement System. (b) Services by individuals in firemen's positions only as employees of the City of Denton as members of a coverage group (as defined in Section 218 (d) (4) of the Act) of the Firemen's Relief and Retirement Fund. THE STATE OF TEXAS SERVICES AGREEMENT COUNTY OF DENTON ) This agreement, made -0 entered !nto thin let d?y of December, 1979, by and between the City of Denton, Texas, a Municipal Corporation ("City") and Donald Glynn Erwin ("Consultant"). WHEREAS, the City desires to retain the services of the ConsulCant to assist in the training of firemen in the area of emergency health care and to utilize Consultant's skills, experience and abilities as a qualified Emergency Medical Technician Ind paramedic in implementing ambulance service programs with the City's Fire Department; NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained the parties hereto agrees as follows: 1. City agrees to rontract with and pay Consultant for personal services rendered for a period of ten (10) months commencing December 10 1979, on a part-time basis at a total salary of $7.50 per hour. Consultant hereby agrees that such part-time basis shall consist of working an average of forty-two (42) houra every two (2) calendar weeks with payment to be made to said Consultant every two (2) weeks. 2. Consultant's services shall be performed under the general direction ,)f the City's fire department chief, but Cc-e- ultant shall have final supervisory authority with regard to all training of emergency medical service personnel. 3. City agrees to provide Consultant with general liability and malpractice insurance; and, provide life insurance t,nd workmen's compensation Insurance equivalent to that of City's employees. Furthermore, at said Consultant's request and for his benefit, social security deductions will not be subtracted from Consultant's salary although other applicable withholdin~,~ deductions shall be subtracted. i 4. Consultant shall submit a monthly progress report in such form as' may be required by the City's fire department chief sl )wing the status of the work. If progress is delayed, the report shall stale the reasons fnr such delav. 5. Either Fzrty may at any time, and for any reason, terminate this contract by written notice specifying the termination date, which shall not be less that two (2) weeks from the date such notice is given. in the event of such termination, the Consultant shall be paid such amount as shall compensate him for the portion of the work satisfactorily performed prior to the termination date. Termination under this section shall not give use to any claim against the City for damages or compensation in addition to that provided hereunder. 6. City agrees to indemnify and hoed harmless the Consultant from all claims, demands, or loss damage resulting from, or arising out of, the operation of the ambulance service program, but will not under any circl:mstances indemnify the Consultant for any willful, intentional or malicious acts on his part. 7. It is the express intention of both parties to this contract that Donald Glynn Erwin is being employed by the City as an independent contractor for personal consultant services and that said Donald Glvnn Erwin is in no ways to be considered an employee of the City. That laid amendments to the Home Rule Charter to be submitted to the qualified voters are as follows: AMENDMENT NUMBER 1 That Section 2.01 be amended so as to hereafter provide as follows, to-wit: "Section 2.01. Number, Selection and Terra. (a) The City Council shall have seven D--members, six (6) councilpersons and a Mayor. The manner of cheir election is prescribed herein. Each councilperson shall be elected to and occupy a place on the Council, such places being numbered one, two, three, four, five and six. The Mayor's position on the Council shall be place seven. (b) Four (4) members of the Council whose positions shall be places one, two, three and four, shall be residents of and elected by the qualified voters of single-meraber geo- graphical)districts of the ('ity, known as districts one, two, three and four, as such districts may froru time to time be determined by the City Council in accordance with Section 2.01(d), and created and described by ordinance. Two (2) members of the Council and the Mayor shall be (elected by the qualified voters of the entire city, conunonly) known as at large. One (1) at large member, place five shall be a resident of district one or two, and one (1) at large nember, place six, shall be a resident of district *hree or four. 4 < (c) :11 members of the Council and the Mayor shall be elect..d for cwo (2) year terms and shall not be eligible for election to more than three (3) consecutive two (2) year terms, such terms to commence with the first two (2) year term to which such member or Mayor is elected after the adoption of this section. (d) The Council shall from time to time create and descriLe by ordinance election districts known as districts one, two, three and four. Such district, shall be created so that each will contain, as nearly as possible, a population equivalent to the others, according to the latest available census data." a That Section 3.01(b) shall be amended and Sections 3.01(c), (d) and (e) shall be added, so as to thereafter provide as follows, to-wit: "Section 3.01. lunicipal Elections. (b) On the first Saturday in April immediately following adoption of Section l.ul, and the drawing of election district boundaries by the Council, the voters shall elect: (1) The Mayor, place 1, for a term of two (2) years. (2) Two councilmembers, places 5 and 6, for terms of two (2) years each, (3) one councilmember for an interim term of one (1) year. This position shall be dencni- nated for such interim term as place 4 and such councilmember shall be elected from the • City at large and may be a resident of any district. At the next following regular annual municipal election after the one referred to above in this section, the dis- trict and at large system provided in Section 2.01 shall take full effect. (c) Councilmembers holding office at the time the charter amendments to Section 2.01 are adopted (places 1, 2 and 3) shall serve the remainder of their unexpired terms as at large members of the Council. (d) If any councilmember whose term would not otherwise expire at the time of the canvass of the results of the election specified in Section 3.01(b) shall enter said election, such councilhnember!s term shall be deemed to have been vacated at the time of the canvass of said election results, whether the candidacy of said council- member is successful or not. (e) Neither the Mayor nor any member of the Council shall become a candidate for election to any position on the Council, other than for re-election to the same seat, unless such candidate shall first submit to the City Secretary his written resignation from the Council to be effective at the time eit the canvass of the results of the next regularly scheduled election. If such candidate's unexpired term would otherwise extend beyond the date of such canvass. the City Secre- tety shall notify the Council and an election shall be held on the date of the next regularly scheduled election to fill the unexpired term of said resigning councii- member." That section 2.06(a) be amended so as to hereafter provide as follows, to-wit: "(a) A majority of the members of the Council shall constitute a quorum for the transaction of business, and the affirmative vote of a majority of the Council shall be necessary to repeal any ordinance or take any official acti:.)n in the name of the City, except ae othewise provided in this Charter or by the general laws of the State of Texas." FOR AGAINST i • AMENDMENT NUMBER 2 That Section 9.01 be amended so as to add subsection (d) • to read as follows, to-wit: "(d) No revenue bond issue in excess of One Million Dollars shall be ordered by the City Council;until a non-binding referendum election has been hold to determine approval or disapproval of such issue by a majority of the quali- fied voters voting at such election." FOR AGAINST AUNUMENT NUMBER 3 That Section 2.02(a)(5) be amended so as to hereafter pro- vide as follows, to-wit: "(a)(5) Shall not be interested in the emoluments of any contract, job, work or service of or with the ci-.~y, or interested in the sale to or by the city of any articles, materials, supplies or equipment; and" FOR AGAINST AMENDMENT NUMBER 4 That Section 2.03 be amended so as to hereafter provide as follows, to-wit: "Section 2.03. Presidan; officer: Mayor and Mayor Pro Tem. - The Mayor shall preside at the meetings of the Council and shall be recognized as head of the City government fnr all ceremonial purposes and by the Governor for purposes of martial law, but shall not interfere with the managerial duties and responsi- bilities of the City Manager. The Mayor shall have all the same powers and privileges as any other councilmember, including entitlement to vote upon all matters considered by the Council, but shall have no veto power. The Council shall, as soon as possible after the annual election, elect from its membership a Mayor Pro Tem. The Mayor Pro Tom shall act as Mayor during the absence or disability of the Mayor and if a vacancy occurs shall become mayor for the completion of the unexpired term." Within seven (7) days after a petition is filed, the City Secretary shall determine whether each paper bears the names of five (5) electors who constitute a committee of the petitioners, and the required affidavit of the circulator thereof, and whether the petition is signed by qualified voters of the constituency- of the councilmember whose removal is sought equal in number to at least twenty-five percent (258) of the number of the votes cast for that councilmember and all of his opponents in the last preceding general municipal election in which he was a candidate. As used herein 'constituency' shall mean the qualified voters eligible to vote for the council- member whose removal is sought, either by geographical district or at large, as the case may'be." D. 1979, hereinafter called the "City", Party of the Second Part, made to become effective when fully executed by both parties. I WITNESSETH: I WHEREAS, the City has authorized thg installation of high- way traffic signals by resolution, passed on the 4th day of December, A. D. 7979, at the intrsrsections of Interstate 35E and Fort Worth Drive and Interstate 35E ane Teasley Lane shown on Exhibit 1, attached hereto and made a part hereof. AGREEMENT: NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter set forth, it is agreed as follows: 1. The State will furnish the necessary funds for the actual construction, prepare plans and specifications, install said highway traffic signals, and supervise construction. 2. The City hereby consents to the construction of the highway traffic signals shown on Exhibit 1 by the approval of the location a,.d manner of construction as shown on the plans and described in the specifications. 3. The City will operate and maintain the high- way traffic signals upon completion of the installations by the State.'.,. 4. The City will pay all power costs for operating the signals. 5. The City will obtain written approval of the State Department of Highways and Public Transportation before making any changes in the design of operation and timing of the signals or before removing any part of the installations. 64 The City will return any and all parts of said highway traffic signal installations to the State should they be removed by the City for any reasons other than for installation on a State or Fedrrai numbered highway route at a location approved by the State. 7. The City will be responsible for the police enforcement required for seclri4hg obedience to the highway traffic signals. 8. In the event the terms of this Agreement are in conflict with the provisions of any other existing Agreements and/or Contracts between the City and the State, this Agreement shall take precedence over the other Agreements and/ot Contracts. ENERO DE 1980; DESIGNANDO LOS LUCARES . LAS HORAS DE VOTACION; NOMBRANDO LOS JUECES DE ELECCION Y ESTIPULANDO LA MANERA EN QUE SF DARA AVISO DE DICHA ELECCION. EL CONCEJO DE LA CIUDAD DE DENTON POR ESTE MEDiO DECRETA: SECCION 1. Que de acuerdo con Ins esttpulaclenes del Articulo 1170 del Estatuto Civil Revisado de Vernon del Estado de Texas, se presentara a los votantes de In Ciudad de Denton en una eleccion municipal eSpeLial quo tendra lugar el 19 de enero de 1980, Ins siguientea enmiendaa propuestas a Is Carta Constitutional de Gobterno Propio de la Ciudad de Denton. SECCION 2. El Alcalde presidira an las reuniones del Concejo y sera reconocido comc el principal del gobierno de la Ciudad pars todo proposito ceremonial y por el Gobernador para proposito de la ley martial, pero no intervendra an las obligaciones administrativas y responsrbilidades del Administrador Municipal. El Alcalde tendra codos los mismos podeves y privilegios como cualquier otro concejero, incluyendo el derecho de votar sobre todos los asuntos considerados por el Concejo, pero no tendra el poder de poner el veto. El Concejo debera, to mas pronto posible despues de la election Anual, elegir de sus miembtos un Alcalde Pro Tempore. Propiedad imponible a impuesto. Et Concejo municipal esta autoriiado a graver y recaudar dichos impuestos como sea permitido por Is Ley del Estado y de modo como sea estipulado por la Ley del Estado." A FAVOR EN CONTRA ENMIENDA NUMERO 13 Qae la Seccion 8.06 se enmiende para que aqui adelante se estipule como to siguiente, a saber: "Seccion 8.06. Presupuesto establece apropiacioncs Y gravamen de impuesto. l`ara aceptacion final, ml presupuesto sera vigente pars el ano de presupuesto. Aceptarion final del presupuesto por of Concejo constituira la aproprtacton oficial de las variao cantidades esteblecidas alli dentro :omo gastos propueatos pars el asio de Vresupuasto. Se registrars una copia del presupuesto finalmente nceptado con el secretario municipal, el eacribiente condal del Condado de Denton y el contralor estatal de cuentar publicae en Austin. Toda apropiaciin qua no ha lido gastada o legalmente sobrecargada transcurr:tra al fin del alo de presupuesto." A FAVOR iN CONTRA ENMIENDA NUMERO 14 Qua la Seccion 8.08 se enmiende para qua aqui adelante estipule co•ao to siguiente, a saber: "Seccion 8.08. £nmendar el presupuesto. En 91 caso de necesidad grave, gastos do emergencia para satisfacer condiciones extraordinarias a imprevistas qua ni por pensamiento ni ntencion diligente se habra podido -.incluido en el presupuesto original, as podri autorisar por el voto afirriativo a to menos de cinco (5) concejeros como una enmiend,% al presupuesto original. Ningun official o empleado de la Ciudad de Denton tendra el interes financial, directo o indirecto, en ningun contrato con la Ciudad, o ser lnteresado financialmente, directamente o indirectamente, en la venta a o por la Ciudad de cualquier terreno, material, abastecimlento o servicio, excepto de parse de la Ciudad come un oficial o empleado. Cualquier infraction intencionada de esta section constituirs un acto ilegal en su cargo de oficto y cualquier official o empleado culpable de eso perdera su puesto o poslcion.
