A five acre tract is located immediately north of the Park West Additions and an 18 acre tract is located West of Stuart in the vicinity of Sierra r and Manhattan. B. 2-1346. This is the petition of First Texas Savings request- ing a change in zoning from Single Family (SF-10) to Single Family (SF-7) classification on eight (8) acres beginning approximately 600' east of existing Kingston Trace develop- ment and extending 400' east to the city limit line. City council ~ septarbor 26, 1978 Special Called Joint Meeting of the City Council of the City of Denton, Texas, j Tuesday, September 26, 1978 at 7100 p.m, in the Civil Defense Rom of the Municipal Building, PRESENf3 Mayor Mitcholl, Mayor Pro Ten Gay, Members Nash, Stewart and liughesi o• ~I City Manager Chris llArtung, Assistant City Manager Jack Owen, City Attorney Paul Isham and City Secretary Brooks Holt, 1, A public hearing was held on the 1978-79 Budget, 1 Deborah Shelton of the lhrnano Society asked that construction of the Animal Control Center not be postponed, She added that the present building is a disgrace and is unsuitable for keeping animals and that the City was liable ! for cruelty suits. She also asked for a separate department for the Animal j Control Shelter. Mayor Yi±chell stated that the Animal Shelter will be constructed, but will be a smaller size than originally planned, but it can be added to. City Man4er Chris Hartung--Wo are in the process of planning an Animal Shelter Building but funds are limited. We hope that we can build they entire building, We have only $600000 in the budget, however, The public tearing was closed, the City Manager stated that the Staff had worked hard in compiling I the new budget system with no tax increase, Many roquests wore made that could not be fitted in. Citizens have told us what they want. This is good. The 1978-79 Budget will continue to provide many services for our citizens. 2. The Council considered plans and specifications on Avenue E and Bonnie Brae, a I Following a briefing by Rick Svehla, the Council concurred that changes 1 t be made in the plans as follows: J j 1 (A) Delete portion of Avenue E from I-35 to Eagle Drive. + (B) Leave angle parking and valley curb on wrest side of Avenue E from Highland to Eagle Drive, (C) Build 300 angle parking in front of The Texas Pickup. (D) Build Eagle Drive from Avenue D to Avenue E, j 3. The Council oonsidored a joint meeting with the Research and Eoonanio Development Board to consider a contract with the institute of Applied Sciences at N`= to continue planning and research on a Univorsity-Falatod Research Park l for Denton. Council Member Hughes abstained from voting, Roy Busby of the Research and Fconado Development Board stated that ! the Board had reoannerded a transfer of carry over funds in the amount of $10,000 to begin Phase II for planning and research for a University Related Research r Park in canton, Dr. Bill Glaze of NTSU pointed out advantages of oerirnninity and univ- I ! ersity involvement and presented details, purposes and advantages of a Research # + j Park for Denton, and adding that Om $10,000 from the Research and Economic 1 Development Board is a beginning for such a project, Following Dr. Glaza's presentation, Utilities Director, Bob Nelson, stated that the Utilities Board made the following recommendation on Septa i)or 26, 1978 at their regular meeting regarding this roquosti "Without prejudice to tho M) Board request, we recommend that the Council not change accounting principles or policies in regard to carry over funds. The Council considered purchase of ambulance from, Denton County. j Motion was made by Stewart# seconded by Hughes to parchaso the ambulance from Denton County and to pay the County by deducting payment for current ambulance service billing to Denton County, Motion carried, 7. 2ho Counci•1 considered authorizing the law firm of Gray, mitten and j Loveless to act as legal Counsel for City of Denton on certain lawsuits. At its inception, the City Council shall appoint five (5) mrnbers to the C=nittea for a two (2) year term and I four (4) mo*ers to the ocmnittee for a one (1) year term. Following a briefing by nick Svehlri, motion was made by Stawart, seconded >Yy Hughes to accept the reoonrnendations of the Citizens Traffic Safety support Cannission to ramove parking from the north lido of Mulberry, from j Locust to Elm, Motion carried. 7. The Casncil considered roo mmvIations from the Parks 6 Pecroation Doard and the Greater Denton Arts Council to build an Art Center. I Tha Parks and Recreation Board recommended calling a $2,000,000 bond issue election. ~ Dick Huck introduced Dr. Stephen Farish, Dr., 13irold Perry and Mrs, Enna Ruth Russell of the Greater Denton Arts Council. Parish stated he hoped the J Council would call a $2,000,000 bored election fr,r construction of center with tentative silo at North Uikos Park, ' r Septarber 19, 1978 Continued Council Member Hughes stated that there are goal nrdl bad times for calliix3 an election. Notion was made by Nash, seconded by Irughes to instruct the staff to look into the possibilities of calling a bond election aril advise the Council as to tho earliest date it can be held. Motion carried. 8. The Council considered a contract with Denton Firohouse Theatre for space in the old City Will, the contract to run through ,Tune, 1980. After a briefing by the City Manager, in which he pointed out the approximate cost of a new roof for old City Hall, motion was made by Stewart, seconded by Gay to approve the contract with the Denton Comr unity Theatre. o Motion carried, t 9. The Council considered a contract with Architectural Collective, Ina, for architect services for the new Fire and Police station. E The City Manager recam mlod that the architectural selection oomaittoe work with the architect an the site selection. The Council concurred. PD zoning permitting' a regional mall on a 70 acre tract located northwest of the loop 288 - I-35E intersection was approved in 1969. The next step in-the PD process requires the developer to submit a de- tailed site plan for consideration by the Planning Commission and City F 11 Council. These amerwlments accomplish the following& 4 16 Service Deposits - removes mandatory deposit requirement provided customer has a good credit rating or a co-signer. Discontinuance of Service - establishes formalized service discontinuance ` I policy that provides for two notices being sent to a customer if payment I j has not been made and that service will be mandatorily discontinued if j payment has not been made within 30 days after due date. 4. Interest on deposits shall be paid at an annual rate at least equal to six percent (6t), if refund of deposit is made within thirty (30) days of receipt of deposit, no interest will be paid. If the deposit is retained more than thirty (30) days, payment of in- torest shall be retroactive to the data of deposit. The deposit shall cease to draw interest on the date it is returned or credited to the customer's account, payment of the interest to the customer shall be annually, or at the time tho deposit is returned or credited to the customer's account. (c) After making application for service, the customer service department may have to pursue a credit ro- forenco check, The customer will be given service promptly after application, but if the credit check y proves negative, the customer will be required to I produce a co-signor or place of deposit. Failure to do so will result in the discontinuance of ser- vice with no less than two days of notification to the prospective customer by the customer service department. (d) A connection fee of $10.00 will be charged to new customers requesting water and/or electric service and a transfer fee of $10.00 will be charged exist- ing customers for transferring from one location to another. (e) If water and/or electric utility service is discon- nected for non-payment, then the customer will be required to pay a $20.00 reconnect fee and maintain a deposit sum equal to 1/6 of the last 12 months billing at the location where service is requested." (2) discon- nected customer if his with account is rating not paidbinfull by the due date. (e) Notice of Termination for Customers With a "B" Rating. A customer with a "8" rating will be notified on his f current utility statement that his service will be disconnected the day after the present due date if payment for the past and proeont statements is r.ot received by the due date. The notice will inform the customer that he/she should contact the customer service department of the City of Denton within the fifteen (15) day period and prior to disconnection of utility service to present any evidence or argu- ment concerning the statement or amount of utility service provided by the City, if full payment has ti not boon made approximately five (5) days prior to j the duo dato the customor will again be notified by $ mail of possible termination and his alternatives. (d) Alternatives to Termination of. Utility service. A customer with a "ll" rating may avoid termination of utility service by doing one of tho followings -2- 'I i (1) Paying the total amount due. (2) Arranging with the customer sevicDepart- ment for a deferred payment agreement would require payment of at least fifty (50%) percent of the outstanding bill and payment of the remaining amount in not more than six (6) equal monthly payments. Multiple dwellings containing five (5) or more units which do not have separate motoring and service facilities shall be classified as commercial buildings for utility purposes and shall be billed under the applicable commercial rates, , j (g) Notice on Moving Required,.
