Special Calla! Meeting of the City Council of the City of Denton, Texas, Friday,
August 11, 1978 at 12:00 noon in the City Manager's office.

1, The Council considered appplying for the Community Development Block
Grant Program, City Planner John Lavretta briefed the Council on the proposed
Community Development Block Grant Program, Lavretta explained that the City has
been asked to apply for a 1;5 million grant for community development over the
next two years, Lavretta further explained that the application required a
Housing Assistance Plan and the Housing Assistance Plan calls for the rehabilitation
of Dreamland Apartments by HJD and the construction of ;2 new units of public
housing to be built by HUD,
Council Member Stewart stated that he would not vote for the application
with the 12 units of new construction, Stewart felt that this housing would
deteriorate and become a slum area,
There was a motion by Hughes, seconded by Gay to authorize the Staff
to prepare the necessary documents and submit the application to HUD. Council
{ Member Stewart stated that he would not vote for the application and it would-
therefore fail, Hughes and Gay withdrew their motion. I~
Mayor Mitchell came to the meeting and was briefed on the progrim, l
j Motion was made by Hughes, seconded by Gay to authorize the filing of
{ the application, including all understandings and assurances contained therein
f and directingg•and authorizing the Mayor to act in connection with the application
and to provide such additional information as may be required, -Motion carried

PRESENT: Mayor Mitchell, Mayor Pro Tem Gay, Members Nash, Stewart and Hu hes;

1, The Cotulcil considered the minutes of the Regular Meeting of August 1,
1978 and the Special Called Meeting of August 9, 1978.
Motion was made by Stewart, seconded by fbughos that the minutes be
approved with the following changes:
(A) That item 4 on the minutes of August 9, 1978 be deleted,
(B) That the following !notion be added to the minutes of the meeting j
(tr) of July 10, 1978: Motion was made by Stewart, seconded by

(A) A public hearing was held on Z-1341s the petition of Mr, Tom
{ Jester, requesting a change in zoning from tingle Family (SF-7) to General ,
Retail (GR) classification on a two acre tract located on the southern third of
the block bounded by Ave:wos E and D, Eagle, and the 1.35E service road,
J111 Tom Jester and Tom Fouts spoke in favor of the petition.

residents of the area.
John Steadman spoke in opposition, stating that the planned use
i offered no protection for price or liveability of adjacent property.
Mr. Jester, iu his rebuttal stated that property values should go
up instead of down and that protection landscaping would be offered,
John LaVretta, City planner, stated that more than 204 of the adjacent
property owners were in opposition, therefore, a 4/5 vote would be required.
Motion was made by Nash, seconded by Hughes that the petition be
tabled until further information could be e,:;.tied from someone representing NTSU,
Motion carried 3 to 2,
(B) A public hearing was held on 2.1339, the petition of Mr, R, W,
Efi gins, requesting a change In zoning from Single Family (SP-7) to Multi-Family
(M -1) classificat on on ,68 acre located on the south side of Greenlee Street
immediately west of the intersection of Greenlee and Neff Streets.
Mayor Pro Tem Gay told the Council that she was abstaining because
the petitioner works for hot.

R, W. Higgins spoke in favor of the petition,
Four citizens living,within clase proximity to the property spoke
in opposition, stating that they were unclear on the plans for use of the
property and that they felt ho was seeking the zoning purely for its speculative
value.
John Lavrotta, City Planner, stated that 12 letters were mailed with 8
returned in opposition and none in favor, which would require a 4/5 vote of the
Council for approval.
Motion was made by Nash, seconded by Stewart that the petition bi
denied, Motion carried 3 to 1, with Mrs, Gay abstaining,

An Emergency Medical Service Advisory Board is hereby created and is to be composed
of 12 members appointed by the City Council for three (3) year terms, The Board
Members shalt have staggered terms with four members being appointed during each
yyear, At its inception, the City Council shall appoint four (A) members to the
Board for a three (3) ar term, four (4) members to the Board for a two (2) year
term and four (4) members to the board for a one (1) year term, Vacancies
shall be'filled in the same Amer provided for regular appointments,
At the first meeting each year after new members have been sworn in the Boa
will select from its own membership a chairman, vice-chairman and secretary. Any
seven of the regularly appointed members shall constitute a quorum, The Board
shall determino Yts own rules and order of business, and shall meet as necessary,
it shall be the duty of the Board to act in an advisory capacity to the City
Council and to assist in the coordination of all emergency medical services with

This is the petition of Pr, Grant Jacobson requesting a change in
zoning from Agricultural (A) to Single Family (SF-7) classification
on approximately 23 acres in two tracts:
1 - Addition= re tract is located immediately north of the Park West
an 18 acre tract is located west of Stuart, in the vicinity of

the Planning and Zoning Commission recommends approval of this
petition.
The northern 18 acre tract in this request is located immediately I
south of a tract recently approved for Single `Family OFT) classifl- {
cation, ;This portion of the zoning9 petition, as well as tf~e five I
Acre area lots ed north of the Park aest Addition, continues the
logical extension of single family development--something the Com-
misslun feels is an appropriate land use in this area. These tracts
ar`e well 'sited in relation to the developed city, utilities are
available for serving the areas, and the current and proposed street
system will accomodate anticipated development, in'addition, the
critical need for developable residential lots in Denton encourages
approval of this petition,
The Planning Staff recommended approval of this petition, Of notices R
availed to property owners for the Planning Commission hearing, four
(4) were returned in favor and more (4) in opposition. No opposition
was expressed at the Planning Commission meeting.

sited on the tot with one building wall on a side lot line, leaving
ten feet for usable side yard on the other side, The unit density
proposed for this single familyy development is between' that permitted
in a standard single family (SF-7) and a duplex (2-F) zone.
Utilities are available for extension to the two sites to this peti•
tlon,and current ana proposed street systems can accomodate anticipated
traffic needs.
This appears to be a reasonable land use request with consideration
8iven to transition from existing single family SF-7) development on
riftwood, We would recommend the following conditions for the planned
development:
1) The proposal for detached single family homes on 45' x 100' lots

this petition The Planning Commission felt retail zoning at this

residents' south of 1.35 as this area c6ntinues to develop. It was
the feeling of the Commission that a limited amount of additional
retail zoned property at this location would not be stgnificently
out of charactter with the Comprehensive Plan land use map and, there

With the thoroughfare improvements completed in this vicinity, it is
clear that Single Family (SF-7) zoning classification is inappropriate
on this tract Carroll Boulevard bisected a single faintly zoned area
creating this lot, but most surrounding properties are zoned Commercial f
(C), The Punningg Commission, feels it is in the public interest that
this tract, at,this five-way intersection, be develo,oed for less inten-
tive land uses than retail {GR) or Commercial (C). The requested Office
(0) zone is reasonable and we recommend approval of this petition.
The Staff,and the Planning Commission have recommended disposition of
excess city right-of-way remnants along Carroll, suggggesting to the
Council that the City retain approximately 20' in this area for land
scaping.and no curb cuts be granted to'pproperties which did not on inally
have access to Carroll, as s the case in this petition. This petition
would tone the city parcel lot 9) Office (Q) also. If the City Council
chooses to dispose of a portion of this excess right-of-way to the adja-
cent property owner, the petitioner could then replat his tract and
the unwanted city parcel into a single lot creating'a better building
site,
The Planning Staff recommended this as a reasonable petition. Of the

The petitioner seeks a single family zoning classification (SF-7) which
would permit development of this tract into two residential lots, SF-10
residential zoningq and development exist generally to the south of this
tract in the Headlee Addition, Aggricultural (A) zoning is in place on
the tract in this request, as well as on all properties north of Sanger
Road and west of Riney Road. In the vicinity of this property, there
are several large tracts, some having homes fronting unpaved Sanger
Road, Riney-fronting properties are basically undeveloped. The Plan-
ning Commission feels it is in the public interest that this .66 acre
tract be developed as single family lots, continuing the residential
pattern established in the Headlee Addition.
This case is somewhat unique in that the tract is a few feet short.of
providing the minimum lot depth required for SF-7 (SF-10 classifica-
tion tiou d be impossible to comply with since 120' of depth 1s required),
For SF-y, 100' of depth is ret red and the tract is nearly 98 feet
deep. The propposed construction of Windsor Drive will take another
two feet from the west sides 'Increasing to five feet on the east side
of this tract, the petitioner on finally proposed a three lot sub-
division but has now spread to divide the property into two lots if

At their regular meeting Sherman July 12, 19781 the Citizens Traffic Safety ConAistion
recommended that all of Sherman Drive with,the exception of a strip from 225'
north of Stuart Road to 300' south of Monterey be signed no parking. The reason
j for this exception was that the homes on this stretch of Sherman front on She yrn
and before Sherman drive was rebuilt, parking was available to these homes. when
the Council approved the plans for Sherman Drive this was taken into acmit.i In
this area Sherman Drive is 60' wide allowing for two parallel parking %nes and
four traffic lanes,
The Traffic Commission also recommended one change for the intersection designs
which the Council ep;roved in the design 'sta a of Shermtii. The Commission recom.
mended that a left turn bays at the Windsor Drive intersection be omitted at this
time. They felt that the left turn movement off Sherman at this intersection did 1
not present enough of a.r ~,r}ict to warrant the.left turn bays at this time. They
felt that Incorpporating`to%, bays now would hamper IN perking for the residents ~
in the area, They did recommemd that this intersection be reviewed when Windsor
is extended. The cost of installing the bays will be about $500. 1

To make this new thoroughfare and its major intersections work properly, parking
on some of the side streets must be removed. I believe the'Council was made aware
of this when the plans were approved, The first area that needs to be considered
is the ramp area at Locust and Woodland, As you can see on sketch d11 with the I
addition of the Ifft turn bays at Locust and the merge ramp a' Locust and the exit
on to Woodland, it was necessary to remove the parking on the south side of Sherman.
in order to make the exit on Woodland work propperly, it would be necessary to
remove parking on Woodlanc for appro,:imately )50',
also, the Staff would recommend removal of parking on Windsor on the east side of
Sherman for 3001, as shown on drawing 42. Removal of this parking will facilitate
#.he traffic separation and make the movements from Windsor on to or across Sherman
safer aad more orderly. The interse.tion at Stuart and Bell should be signed as
shown on drawing 03. The intersections at Kings Row, Bell Avenue, Locust and Elm
should have parking removed from the sidr streets for a minimum distance of 100'
or as shown on drawings 14, to 6, respectively.

Allocation of the Contingency Fund from the 1977
Community Development Grant
September 5, 1978
This report concerns the status of the 1977 Community Development Grant and
recommends allocation of the grant's contingency fund. The original grant
program contained the following projects:

TOTAL $250,000
As you recall, we requested that HUD permit an amendment to this program I,
to allow the funds allocated for acquisition of sites for public housing
to be used in the housing rehabilitation program. HUD has approved this
amendment. The ma ority of the remaining funds have been expended with
two exceptions-- al the drainage project; and b) contingency. We have
m completed the engineering plans and acquired the necessary easements to
improve the channel that extends east from Bradshaw Street. This drainage
project is currently out for bids for the second time, however, no con-
tractor has expressed interest and it does not appear that we will receive
an bids. In this case; the drainage funds will be carried over to next'
year and the project rebid at a more favorable time.
There is a ;20,000 contingency fund that remains. We would recommend that
10% of the estimated cost of the drainage improvements ($6,000) be reserved
in the contingency fund, Also, it appears likely we may need about $2,000
to pay personnel costs associated with the housing program in the interim I
batween the time when our new grant application is approved and when the
required environmental studies are complete permitting us to draw down funds,
there is, then, at least ;12,000 that is not needed,•for'any contingency
purpose. We are recommending that this amount', and ady other contingency
funds that later prove to be unnecessary, be allocated to the demolition
program.
To date, the demolition program has resulted in the removal of 59 vacant,
dilapidated structures. Of these, 37 were demolished by the owner, 16 were

Planning Commission Recommendation for
the 1978-1983 Capital Improvement Plan
Each year the Planning Commission is required to submit a recom*oendation
on a revised five year capital improvment program. The Planning Commission
began study on this issue with a hearing on July 19 to solicit public in-
put City department heads were also asked to submit recommendations for
their individual treas. The Commission considered this issue again at a
study session on Iuly 26, August 2 and 16; and their recommendation for
the five year plan follows this memo.
This capital improvement plan is basically made up of the four year capital j
improvement plan adopted January 1978, and approved in the bond issue,with
the addition of one year's projects. The finance department estimates that
the city will be able to support the debt service, without tax increase,
required for . $1,000,000 of capital improvements in the fifth year (1982-
1983). We have assumed an average annual inflation rate of 8% andall cost
estimates include inflation, as well as engineering costs. In making their
I recommendation, the Planning Commission chose to emphasize projects that
j involve basic services--street paving, fire protection, and drainage. A
f. description of Bath of the recommended projects in the fifth year 1s included
with this memo,
j The Utility Staff is in the process of developing a five year utility capital
i improvement plan through the Utility Board. These projects will be coor-
dinated with the capital improvements built through the general fund--
particularly, street and drainage projects. We will then change the capital
improvement plan book so that it includes both utility and general fund
capital plans. The format of the book will'also be changed to improve 1
project descriptions and to better illustrate the relationship between pro-
jects. Sample sheets that will be used in'this new capital improvement
plan book are included with this memo. The Engineering and Utility Staff
expect this revised capital improvement plan will be submitted for your j
consideration in October.

RE: Human Resources Committee's Recommendation for an Information
and Referral Service
At a meeting in April, Homer Reese of the Denton County Community Council
appeared before the City Council to request ti,at they grant him partial
funding to operate an Information and Referral Service in Denton. The
Council, in turn, asked that this request be referred to the Human Resources
Committee who could sufficiently study the need for such a service and make
a recommendation,
On May 4, Mr. Reese presented his request to the Human Resources Committee.
At this meeting, the Committee moved to direct a. staff study which would
i i seek to discover the extent to which such a service would be utilized,
The results of the study pointed out that there was some confusion among
I I agencies about wha~ constitutes an information and Referral Service. For
this reason, at the June 1 meeting, the Human Resources Committee' moved to
sponsor an Information and Referral workshop and invite all agency repre-
sentatives in town to attend. The workshop was held on June 19 with some
30 agency representatives in attendance. Professor Alvin Sallee of New
Mexico State University, an 13 R expert, conducted the workshop.
At the July 6 meeting, the Human R(` nurces Committee was presented with a
revised budget for fiscal 1979 rskiw; the City for a5 000. This request
k was considered by the Committee and o:, August 1 0, aquorum of six (6) mem-
bers unanimously approved Lhe following motion:
"The Human Resources Committee has reviewed the proposal and
budget presented by the Denton County Community Council for
ppartial funding of a centralized Information and Referral
Service, The Committee has determined the Community Council's
request to be a reasonable one.
Because of the urgent need for such a professional service as
spelled out in the Comprehensive Plan for Human Services, this
Committee recommends that the City Council approve this $5,000
request. The Committee also recommends that Denton County and
United Way of Denton County support this service as well.
The proposed 1979 R+idget for the Information and Referral Service of the
{ Denton County Community Council is attached.

Consultant Selection for the Housing Study
September 5, 1978
The Housing and Development Committee, appointed to serve as the steering
committee for the housing study, has begun their work. The staff has a
suggested outline for the housing study (included with this memo) and the
Committee is reviewing this outline and our available housing data. It
is anticipated that they will develop a recommendation for you in September
or early October on the specific elements the housing study should address.
The 1978 Community Development Grant does contain an allocation to fund the
f housing study,and we anticipate that this application will be approved on
October 1. There is $20,000 for community development planning. As the
budget is proposed, $5,500 would be used to fund staff and $14,500 would
be used for consultant services.

The staff is aware of the urgent need for the study and we are requesting
authorization to begin work on selection of a consultant. We would do the
preliminary selection work so that we would have three or four competent
firms that are interested, When the specific parameters of the study are
established, the final selection process could begin quickly, We would
also recommend that a smaller group be appointed to interview the consul- .
tant firms. This group might consist of council persons, some staff, and
members of the committee.

Central Question
It is an important policy of the City to encourage industrial
development in Denton in order to maintain fiscal stability.
j However, there is also concern about maintaining quality of life
and in particular, ensuring that there are adequate housing oppor-
tunities for our citizens. It is anticipated that Denton will
experience significant in-migration over the next five years as a
11I result of new retail and industrial employment bpportunities.

For the past two years the City of Denton and the Denton Independent
School District have contracted with professional Appraisal Company,
Inc. of Arlington on a maintenance contract for property appraisals
in the City of Denton and in the DI$D.
The purpose of this contract is for the company to appraise all new t
or altered construction within the City of Denton to get the proper
values placed on the tax roll.
! A partial listing of the duties of the Appraisal CoWjany is as followst ¢
i. To treasure all newly constructed or altered buildings and make
an appraisal of those properties.
2. To appraise all new commerical and industrial structuv*x.
f 3. To review all personal property renditions and assessments and to
i appraise all newer and large firms for personal property values.

4. To appraise all new subdivisions filed within the City.
5. To reappraise all properties on which the toning has been changed,
6, To reappraise all areas on which site plans are accepted by the City.
All of these items are duties that we must fulfill each year to insure
that the City's tax roll is kept up to data.
As I stated earlier, this contract will be a joint contract between the i
City of Denton, Denton rndependent School District and Professional Ap-
praisal Company. The total cost of the contract will be $18,000.00 to
be paid in monthly installments of $1#500.00 each. Of tlAt amount, the
f City's monthly installment will be $600.00 for a total annual cost of
$7#200.00. The Staff does recommend approval of this contract.

As you are aware, the state Legislature in their recent Special session,
passed a new law repealing the 4+1 State portion of the sales tax on resi-
dGntial gas and electric bills effective October let. The law also gave
cities several alternatives to consider pertaining to the it sales tax
that we currently have on residential gas and electric bills.
Two options twit cities have are toy (1) repeal the it saps tax or
(2) tee those specific actions necessary to insure the continued re-
ceipt of that 1% sales tax. It is the recosmindation of the City Staff
that the City Council zepeal the 1% "lee tax, eliminating any sales tax
in Denton on residential gas and electric bills. The Staff recosssandation
to rapsal the l% sales tax was incorporated into the propaied budget for
1978-79 and amounts to a loss in revenue in the coming year estimated to
be 0140,000.00.
if the Council wishes to accept the recommendation of the City Staff io
repeal the It sales tax, it requires action by a majority vote of the
Council at the meeting of September S, 1978.- Notice to the State Comptroller's
Office of the repeal of the it tax must be sent by certified mail postmarked

gas and electricity from the 4% State Sales Tax and providing a local option on the 1% City Sales
Tax.
The exemption covers "residential use", meaning use in a family dwelling, a multifamily
apartment, a housing complex or building or portion of a building occupled as a home or
residence.
The residential use exemption from the 4%State Sal9s Tax becomes effective on October 1, 1978.
The residential use exemption from 1% City Sales Tax becomes effective on October 1, 1979,
UNLESS THE CITY TAKES ACTION AS DESCRIBED BELOW:
• TO REPEAL THE TAX
BY SEPTt MW 10, 1978. A city, by majority vote of its governing body, may vote to
exempt residential use of gas and electricity from the 11.1r City Sales Tax effective
October 1, 1978•• the same date the State Tax exemption becomes effective.
Notification of the city's Intent to exempt gas and electricty from the 1% Tax effective
October 1, 1976, must be received by the Comptroller of Public Accounts by registered
or certified mail postmarked no later than September 10, 1978,
TO KEEP THE TAX
BY MAY 1,1979. A city, by majority vote of its governing body, may adopt an ordinance
continuing the Imposition of the 1% City Sales Tax on residential use of gas and
electricity, A copy of the ordinance must be recelved by the Comptroller of Public
Accounts by registered or certified mall no later than May 1, 1979. (The 1% City Sales
Tex on residential use of get and electricity will be automatically abolished effective
October It 1979, unless an ordinance is received from a city continuing the tax.)
• OTHER CITY OPTIONS
At any time prior to October 1, 1979, a city, by majority vote of Its governing body, may
exempt residential use of gas and electricity from the 1% City Tax. One full calendar
quartershall elapse prior to the effective date of the exemption following notification of

For Example; If notification Is received by the Comptroller between September 11, 1978
and September 30,1978, the exemption will become effective onJanuary
1, 1979.

WHM..AS, the City Council of the City of Denton has
determined that there is a necessity for and that it will be to

the best intersst of the said City and the taxpayers generally
to employ experts skilled in the appraisal and evaluation of E
1 property so that all taxable real and personal property maybe
properly valued for taxation and the values thereof equalized)
and said City desires to obtain information, data, and assistance
to enable its Tax Assessor-Collector and Board of Equalization
better to i perform their respective duties and functions as
required by law) and

WHEREAS, the appraisal and evaluation of taxable real 11
and personal properties for ad valorem tax purposes is a speciAl-
load art requiring training, skill, experience, and expert '

WHEREAS, said City Council of the City of Denton
believes that the Professional Appraisal Company, Inc. and

S. Barney Baker, President thereof, possess special skill, l1
technical knowledge, and the experience required, essential,
desirable, and necessary for the appraisal of taxable real and
personal properties and the furnishing of expert advice and
assistance to its taxing officials and that it should contract
for the services of Professional Appraisal Company, Inc. and
B. Barney Baker in the amounts hereinafter statedo

IOW, THEREFORE, PREMISES CONSIDERED, the parties AGREE
as follower

City hereby employs the Professional Appraisal Company,

Inc. to make a survey of all properties, real, personal, and
nixed, situated within the boundaries of the City-and to
establish values so that a program of annual updating and
{ equalization of,property within the City may be instituted to,
the extent it is economical and feasible so that the value of
property will be realistic, fair, and equitable for all ensuing
years.

The respective duties of the parties as followsi
A. City AGREESi
1. To provide all building permit information
to Company.
2, To provide Company a list of all new sub-
divisions or additions recorded during the
year and a copy of the plat for each.
3. To provide Company with a list of properties
on which zoning has been changed so that
valuation records in the tax office can be
corrected to reflect the change in zoning,

4. To review all appraisals submitted by Company.
5. To prepare valuation notices as necessary for
all properties on which the value has been
changed.
6. To arrange a time and place for the Board
of Equalization meetings and notify Company
at least thirty days in advance in order
that Company may have a representative present.
B. Company AGREES, at its expenses
1. To measure all newly constructers or altered
buildings, obtain pertinent data on same,
and make an appraisal on these residential
properties within the city limits from build-
ing permit information.
2. To check the personal property route list by
driving or walking each street, road, or
highway in the city for the purpose of
obtaining pertinent information on changes,
additions, or deletions which should be made
i a part of the personal property route list.
E 3. To appraise all new commercial and industrial
structures.
4. To review all personal property renditions
i and assessments) and to appraise all ntw or
i enlarged firms for personal property values.
S. To appraise all new subdivisions filed within
the City.
j 6. To reappraise all properties on which the
zoning has been changed.
7. To reappraise all areas on which site plans
1 are accepted by the City.

8. To maintain a sales/analysis/ratio s*udy of
properties throughout the City.
9+ To reappraise any property, either real or
personal# deemed needful of adjustment, by
the Tax Assessor or the Company.
10. To provide consultation to the Tax Assessor
as needed.
11. Ta provide for a qualified representative of
the Company to be present at all meetings of
the Board of Equalization.

n A. That the Company shall be employed by the City to
provide services herein described. The term of such employment •

shall begin on the first day of , 1978, and shall
be for a period of one year.
Be Assuming the Denton Independent School District
j joins in the execution of this contract Company agrees that the
compensation for the joint services to be rendered by Company to
the City and the District shall be in the total sum of $160000.00
which total a= to be paid in monthly installments of $1,500.00
each, of which amount District will pay to company $900.00 thereof
' and City will pay to Company $600.00 thereof, with the first
I installment due on the first day of -1978 and
j j like payments on the first day of each succeeding month there-
after until the total sum of $18,000.00-shall have been paid.

C. Should in the conduct of those services for which
I Company is being employed, the personnel of Company conduct them-
selves in such a manner as, in the judgment of the City Council
I of the City and the Board of Trustees of the Districts assuming
District is a party to this contract, to be damaging or jeopardiz-
Ing the relationship which each has with the citizens of the
I District and City, notice in writing of such fact shall be given
to Company which shall then have a period of thirty days to
assure District and City that such conduct has been corrected and
if such assurances are deemed insufficient by District and City, ?
then and in such event this contract may be terminated by thirty
days notice to Company.

D. It further agreed that all information gathered
and assembled'in whatsoever form by Company for City on the up-
dating as set forth in this agreement, shall become the sole r; ,r
property of the City and in like manner, should District join
in this agreement, all information gathered and assembled in

f whatsoever form by Company for District on the updating as set ,
forth herein shall become the sold property of the District and
upon termination of this agreement Company agrees to deliver
custody of all such records and information to the City and
District respectively.
IN WITNESS WHEREOF, we execute this contract on this
