14 Motion was made by Stewart, seconded by Hughes that the minutes of the
Regular Meeting of November 7, 1978 -ind the Special Called Meeting of November 14,
1978 be approved. Motion carried.
21 PUBLIC HEARINGS:
(A) A public hearing was held on Z-1361, the ppetition of Mr. Jack
Barton, requesting a change in zoning from Single Family {SF-7) to Multi-Family
(NF-1) classification on one acre located at the northwest corner of Sherman and
M North Elm.
M After hearing 24 speak in favor and none in opposition, the hearing
was closed.
W John Lavretta stated that the Planning and Zoning Commission voted 3
Q to 3 but approved the petition, and that 14 letters were mailed with 4 returned
Q in favor and 3 against.
Motion was made by Nash, seconded by Hughes to approve the petition.
Motion carried 3 to 1.

Ryylander, requesting a change in zoning from Agricultural (A) to Light Industrial

City Attorney Isham advised that Mr. Rylander that there must be 4
Affirmative votes by the Council to approve his petition, but that only 4 members
were present.

Mr, Rylander answered that he would rather wait until 5 members were

Motion was made by Nash, seconded by Hughes to table the request until ?

3, The Council considered instituting annexation rroceedings on 10,6 acres
{ of land owned by First Texas Savings.
Motion was made by Stewart, seconded by Nash to institute annexation
j proceedings by publishing the proposed annexation ordinance, Motion carried.

the quit claim of a utility easement located east of existing development in
Kingston Trace Addition,
Following a briefing by the City Planner, motion was made by Stewart,
seconded by Nash that the request of First Texas Savings be approved. Motion
carried,
50 The Council considered a participation agreement between the City of
Denton and Martino Realty for oversize sewer facilities at the Golden Triangle
Industrial Park,
Bob Nelson, Utilities Director, briefed the Council,
Council Member Nash asked if bidding of sewer facilities was done in
the regular manner,

Nelson answered that the bid was in accordance with Charter requirements"
Three bids were taken by Martino Realty,
00" Motion was made by Stewart, seconded by Hughes that'the Participation
Agreement with Martino Realty be approved at a cost to the City of $23,463,00,
Motion carried,
b, The Council considered a Participation Agreement between the City of
Denton and Denton Mail Company for offsite water and/or sewer facilities at the
Golden Triangle Mall.
Bob Nelson, Utilities Director, stated that the participation was with
Denton Mall Company for a 30" water line along loop 288 and installation of a 30"
water line under I-35E at Loop 288, He added that Luke Turner Construction
Company of Fort Worth was the low bidder and that the City's cost is ;218,987.00.
Motion was made by Gay, seconded by Hughes to approve the Participation
Agreement between the City of Oenton end Denton Mall Company. Motion carried,

8. The Council considered the recommendation of the Citizens Traffic Safety
Support Commission to remove parking on the east side of Locust from Peach to
FM 2164,
Motion was made by Hughes, seconded by Nash that parking be removed on
the east side of Locust from Peach to FM 2164, Motion carried.
9. The Council considered the recommendation of the Citizens Traffic
Safety Support Commission to remove parking on Avenue E and Bonnie Brae and the
related construction area, on a temporary basis, to facilitate construction,
Rick Svehla of Community Development, stated that during certain phases
of construction, particularly storm sewers and underground utilities may need to
be removed to facilitate traffic movements,

SERVICE RATE TO BE CHARGED FOR SALES OF ELECTRICITY TO RESIDENTIAL, COMMERCIAL
AND SECURING LIGHT CONSUMERS WITHIN THE CITY LIMITS OF DENTON, DENTON COUNTY, {
r TEXAS, AND PROVIDING FOR THE MANNER IN WHICH SUCH RATE MAY BE CHANGED, ADJUSTED
AND AMENDED, AND DECLARING AN EMERGENCY.
The City Manager stated that the matter was tabled at the lest meet-
ing to see if a public hearing should be held before adoption,
City Attorney Isham stated that the requested change in rates of the
Denton County Electric Cooperative, Inc, does not constitute a major change as
defined by the Publid Utility Regulatory Actl and, therefore, does not require
a public hearing before adoption.
Motion was made by Hughes, seconded by Gay that the Ordinance be

Special Called Meeting of the City Council of the City of Denton, Texas, Tuesday,
t e~) November 28, 1978 at 7100 p.m, in the Civil Defense Room of the Municipal Building.
PRESENT: or Pro Tem Gay, Council Members Hughes, Nash and Stewart, City
Manager Chris Hartung, Assistant City Managers Jack Gwen and King Cole,
1 City Attorney Paul Isham and City Secretary Brooks Holt.
ABSENTS Mayor Mitchell,
11 The Council considered annual contribution to Flow Memorial Hospital.
The City Attorney advised that County Attorney Cobb, in the matter of
who pays for indigent care, has received a letter from the Attorney General
s tating that he would not provide any more opinions. Isham added that Cobb
stated that the new Attorney General, Mark White, would be contacted after the
first of the year for his opinion,
The City Manager recommended that the amount of funding for Flow
M remain at the budgeted amount of $114,500, which is one half the amount requested,
that final amount would depend on opinion rendered by the Attorney General,
Leonard Watson, Flow Manager, requested full amount of $229,000 but
that they would accept $114,500 and wait for the Attorney General's opinion,
Q Motion was made by Stewart, seconded by Hughes that $114,500 be paid
as the City share to Flow budget, (See below after discussion for vote.)

Discussion,
Stewart--I made an original motion for reducing the City's share
because of inequities involved,
l Nash--I concur, We fully support Flow and have tried to work with
the County, Denton does not get a fair shake,
Ii c
Hughes--We have high quality care at Flow and want to pay our share,
1 if the County picks up indigent care, Flow should be in good shape.
Gay--We are trying to the the responsibility where it belongs. Flow
1 has good management and Board, Action we take is for, not against Flow.
I Following the discussion, the above motion by Stewart carried unanimously. I
2, The Council received a report on a questionnaire of Cable TV Operators,
I Assistant City Manager King Cole presented a report relative to a survey
t of cities served by cable television companies Cox and Storer. He distributed
copies of tht, survey to each Council Member, along with other data,
Motion was made by Hughes, seconded by Gay to receive the report on a
questionnaire of Cable TV Operators, Motion carried,
3, The Council received landfill report.
The City Manager requested that Assistant City Manager Jack Owen
present the report.
Owen gave the following information;
Out of 45 landfill sites considered, it now has boiled down to 4. The
sites are as follows
JAI Site f43 near the Municipal Airport
B Site 136--Approximately 84 acres
C Site 144--384 acres off Highway 156 North of Ponder
Owen advi:~ that site 045 located near Roselawn Cemetery, would be
lease property, but that he has been advised that it is no longer available,
Motion was made by Stewart, seconded by Hughes to receive the report
and to contact Freese and Nichols for necessary engineering, Motion carried.

for ramps in sidewalks,
Rick Svehla advised that the cost of ramps has increased and that i
recalculations of costs for all ramps, including the extension of Glenwood, x
would cost an additional $55,000, j

Director of Finance, Bill McNary, briefed the Council on the status
of financing of Capital Improvements Program.

This is the petition of Oak Ridge Company requestingg a change in zoning j
from Agricultural (A) and Planned Development (PD) to Commercial (C)
zoning classification on 18.5 acres.

This tract is located on the west side of 1,-35E, P (inning 550 feet
east of Denton State School Road. The property + ds along the
Interstate generally 1600 feet and is 600 feet dec
Recommendation;
The Planning and Zoning Commission recommends approval of this petition.

This tract has several existing zoning classifications. A small per
tion of the Interstate frontage, where the mobile home sales office
I was located, is zoned Commercial (C), The remainder of the mobile
home park site, in the center of this tract, is zoned Agricultural (A).
The north and south ends of this tract are part of a larger area
zoned Planned Development (PD) in 1972 for commercial uses.
This petition seeks Commercial zoning on a combined parcel totalling
twenty acres. It is the Commission's opinion that since commercial
uses are permitted in this location of the PD, this change to commercial
(C) zoning classification is a reasonable request. Utilization of
the remaining planned Development would not be impaired by this change.
Utilities are available for extension to this site and streets are
considered adequate by the Traffic Safety Engineer,
The Planning staff recommended approval of this request. Of notices
sent to property owners for the Planning Commission meeting, one was
returned in favor and none in opposition, No opposition was expressed
at the Planning Commission hearing.
The Planning and Zoning Commission unanimously recommended the City
Council approve zoning petition Z-13631

THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:

SECTION I.
1
(1) That parking on the east side of Locust Street from Peach
Street to FM 2164 shall not be used for the parking of vehicles or
in any manner obstructed at any time, and the same shall be so
posted by the proper authorities of the City of Denton, Texas.
(2) That the west side of Bell Avenue from Sherman Drive to i
University Drive shall not be used for the parking of vehicles or

j in any manner obstructed at any time between the hours of 7:00 A.M. j
to 7:00 P.M., and the same shall be so posted by the proper auth-
orities of the City of Denton, Texas.
SECTION II.
That if any section, subsection, paragraph, sentence, clause,
i phrase or word in this ordinance, or application thereof to any
person or circumstances is held invalid by any court of competent
1 jurisdiction, such holding shall not affect the validity of the
remaining portions of this ordinance, and the City Council of the
City of Denton, Texas, hereby declares it would have enacted such
remaining portions despite any such invalidity.
SECTION III.

That Section 1-5 of the Code of Ordinances of the City of
Denton is incorporated into the ordinance as if set out in full
r herein, and the penalty by fine not to exceed Two Hundred Dollars
is applicable hereto, and it is hereby declared unlawful to park
F any vehicle on any portion of the above described streef.d as is
posted or marked as a "No Parking gone".
SECTION IV. I
That this ordinance shall become effective fourteen days from
the data of its passage, and the City Secretary is hereby directed
to cause the caption of this ordinance to be published twice in the

That Chapter 15 "Parks and Recreation" is hereby amended by
adding a new Section 15-10 "Possession and Consumption of Alcohol

(1) Within the limits of any public park within the City
of Denton, it shall be unlawful for any person or persona to possess
or consume any alcoholic beverage within 100 feet of any portion of
any playing field except if such possession or consumption is inside

a motor vehicle locatel rpon a designated parking area. Playing
{I field is hereby defined as a marked field area or the enclosure
! surrounding or setting apart a designated field area, including but
not limited to a fence, for the purpose of conducting or engaging
in an athletic game or activity, Such activities would include but
not be limited to football, baseball, softball, soccer$ rugby,
;J lacrosse, field hookey, tennis and basketball, f
(2)6 The Director of Parke and Recreation shall cause signs

to be erected at the playing fields within the various public parks
notifying the public of the provisions of this ordinance, i
(3) The Director of Parks and Recreation, Parks Attendants
designated by the Director, and the Police Department, shall, in
connection with their duties imposed by law# diligently enforce the
provisions of this ordinance, and they shall have the authority to
eject from the
park any person acting in violation of this ordinance. {

Any person who violates any provision of this ordinance shall
be deemed guilty of a misdemeanor, and, upon conviction, shall be

RE: Recommendation of the Traffic Safety Commission to install new
meters at Hickory, Avenue A and Fry Street
At their meeting on November 8, the Traffic Safety Commission reviewed further
data that the Staff was able to give them concerning installation of meters.
After a lengthy discussiono the.Traffie Commission recommended that new meters
be installed on Fry from Pak to Hickory, on Hickory from Avenue D to 200' feet
ppast Avenue A, on Avenue A from Hickory to Mulberry and on Mulberry from Avenue
A to approximately 160' feet east of Avenue A, The meters that were requested
by the area merchants would have a one-hour time limit.
After receiving `a limited amount of infonnation from the Staff, the Commission
felt that leasing the meters would be the bust alternative, However, the Staff
advised them that we would like to gget more information for the Council before
they make their decision, We will be working with the finance department and
bring tho Council our. results as soon as possible.

SUBJECTi Resource Recovery Grant Application'
The City Council in requested to authorise the submission of a pro-
applica-tion to the U. B, Environmental Protection Agency for grant assistance to con-
duct a feasibility analysis of resource recovery in Denton. As we have discussed
previously, the City has identified four potential customers for such a system -
{ The City of Denton Electric Utilities, Texas Woman's University, North Texas
state University "A Aoma Brice Colgwy.
The purpose of this study is to conduct a detailed analysis of the solid
waste being generate irk the City of Denton to determine its volume and composi-
tion and then to analyse the four potential markets to determine their energy re-
quirements and possible resource recovery technologies which might most tboas
energy requiromasnts. The final product of the proposed study would be a eost/bens-
I fit analysis comparing the cost of these resource recovery systems with the long-
tangs. cost of continuing to dispose of solid waste in a sanitary landfill.
The pre-application has not been completed at this point, but I hope to have
a preliminary draft available for the Council at Tuesday's meeting. I would point
out to the members of the Council that this grant program is competitive and that
I think that we can expect many more applications than will be funded. I do foal
wry good about our chances,however, and feel that there is a good possibility
that Denton will be selected to receive one of the g:ant awards.
