NO* AN ORDINANCE ANNEXING A TRACT OF LAND CONTIGUOUS AND ADJACENT TO THE CITY OF DENTON, TEXAS; BEING ALL THAT LOT, TRACT OR PARCEL OF LAND CONSISTING OF APPROXIMATELY 10.6 ACRES OF LAND LYING AND BE- ING SITUATED IN THE COUNTY OF DENTON, STATE OF TEXAS AND BEING IN THE D,D, CULP SURVEY, ABSTRACT NO, 287, DENTON COUNTY, TEXAS; CLASSIFYING THE SANE AS SINGLE-FAMILY %F-7" DISTRICT PROPERTY; AND DECLARING AN EFFECTIVE DATE, WHEREAS, the request for annexation was introduced at a re- gular meeting of the City Council of the City of Denton, Texas, on the petition of First Texas Savings Assooiation; and WHEREAS, an opportunity was afforded, at a public hearing held for that purpose on November 70 1978 for all interested per- sons to state their views and present evidence bearing upon the annexation provided by this ordinance; and 1 WHEREAS, this ordinance has been published in full at least { one time in the official newspaper of the City of Denton, Texas, prior to its effective date, and after the public hearings; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, AERRBY ORDAINSt SECTION I. That the hereinafter d_.,oribed tract of land be, and the same I, is hereby, annexed to the City of Denton, Texas, and the same is 1 made hereby a part of said City and the land and the present and , future inhabitants thr.reof shall be entitled to all the rights and privileges of other oiti2ens of said City and shall be bound by the acts and ordinances of said :ity now in effect or which may I hereafter be enaetgd and the property situated therein shall be j subject to and shall bear its pro-rata part of the taxes levied by the City. The tract: of land hereby annexed is described as follows, to-wits f ~ All that certain lot, tract or parcel of land situated in the D,D. Culp Surrey, Abstract No, 287, City and County of Denton, Texas, being part of that trace described in deed from Jane Houston Sewell I to Kingston Tract Joint Venture as recorded in Volvme 656, Page 645 ? of the Denton County Deed Records; said tract being more particularly described by motes and bounds as follows% BEGINNING at a 2 inch iron pipe for the southeast corner of this tract and the Kingston Trace Joint Venture Tract; THENCE north 870 30' west 620 feet, more or leas, with the south 'line of the Kingston Trace Joint Venture Tract to the southeast corner of that tract described in Ctty of Denton Annexation Ordin= y ance 73-1, l" THENCE north 009 08' east 970 feet, more or less, with city limits line to a point in the centerline of Kings Rowf THENCE south 870 26' east 155 feet, more or less, with said center line to a point) THENCE in a southerly direction 50 feet, more or less, to a point in the south right of way line of proposed Loop 288 THENCE in a southeasterly direction with a curve to the right in said proposed south right of way line a chord distance of 245 feet, more or leas, to a point of tangency of said curvet THENCE southeasterly 418 feet, more or leas, to a point in the west line of said Kingston Tract Joint Venture Tract= { THENCE south 110 34' west 565 feet, more or lose, with said west line to the place of beginning, containing approximately 10,6 acres i of land, more or less. i f SECTION II. k, The above described property is hereby classified as Single- I Family "SP-7" District and steall so appear on the official zoning r map of the City of Denton, which map is hereby amended accordingly. This petition has com,leted the public hearing process before the Planning Commission and City Council and all state re- quirements regarding annexation have been met, The Planningg Commission unanimously recommended approval of this annexation and zoning request at its meeting on October 4, 1978. ACTION REQUIRED: To complete action on this petition, the City Council should adopt the zoning and annexation ordinance prepared by the City Attorney. t c I F I J j ;ark. 1 6 Planning and Zoning Commission Recommendation to the City Council Z-1358 November 7, 1978 y Identity and Location: Z-1358 This is the petition of First Texas Savings requesting annexation and 4 Single Family (SF-7) zoning classification on 10.6 acres beginning 1000' east of existing Kingston Trace development at the city limit line and extending approximately 650' eastward. 0 Re comae nda t i on The Planning and Zoning Commission recommends approval of this request. Annexation and sr-7 zoning on this tract would add an additional ten acres for single family residential development in the Kingston Trace Addition. Minimum tot sizes would total 7000 square feet on this tract. j The Planning Commission feels this is an appropriate request, one that continues the single family residential development in this area. Proposed utilities and street systems are adequate to accomodate this addition to Kingston Trace. The Planning staff recommended approval of this petition. Of notices I sent to property owners for the Planning Commission hearing, none were returned either in favor or in opposition. No opposition was expressed at the Planning Commission hearing.
