Regular Meeting of the City Council of the City of Denton, Texas, Tuesday,
December 19, 1975 at 7:00 p.m, in the Council Chamber of the Municipal Building,
t,.'. PRESENT: Mayor Mitchell, Mayor Pro Tem Gay, Members Nash, Hughes and Stewart;
City Manager Chris Hartung, Assistant City Managers Jack Owen and King
Cole, City Attorney Paul Isham and City Secretary Brooks Holt.
1. Motion was made by Gay, seconded by Mitchell that the minutes of the
Regular Meeting of December 5, the Special Called Joint Meeting of December 11,
the Special Called Meetingq of December 12 and the Special Called Joint Meeting
of December 12 with the CATV Advisory Board be approved. Motion carried.
2. PUBLIC HEARING:

(A) A public hearing was held on Z-1362, the petition of Mr. H. G.
j Rylander requesting a change in zoning from Agricultural (A) to Light Indust-
rial (Ld classification on 6,2 acres located on East McKinney Street; beginning
350 feet east of Foxworth Galbraith Company,
After hearing 2 speak to favor and none in opposition, the Mayor
closed the public hearing.
John Lavretta stated that 8 letters were mailed with 4 in favor
and 1 in opposition, and tha'. the Planning and Zoning Commission had recommended
j Q approval unanimously.

1 Motion was made by Gay, seconded by Stewart that, the petition be
approved, Motion carried, ,
3. The Council considered the Human Resource Committee's recommendation
concerning the need for a sheltered rehabilitation workshop in Denton,
John Lavretta advised that the HRC passed a motion as follows: "It
is the opinion of the Committee that a workshop is needed in this area with the
reservation, that if established, it be operated to benefit other than the
mentally retardad as defined by State law; adding that it is the opinion of the
Committee that a selection of the site of a sheltered workshop is not part of
I H RC's responsibility." yy
Homer Reesa, representing Denton County Community Council, appeared

{ to request use of the old Post Office Building for rehabilitation service and
sheltered workshop for disabled and handicapped, Mr, Reese made the following, l
among other statements:
There is an urgent, proven need for a sheltered workshop to be
located in Denton.
Considerable State and Federal funds are available for cormmun-
sties that exhibit strong local support to have such a program,
There is sufficient leadership, organization, expertise and resour-
ces in Denton to make this proposal into a model sheltered work-
shop, given the opportunity.
Answering a question of Mayor Pro Tem Gay+s, Reese stated that a 5
year lease wuuld be adequate,
The City Manager said that this project is important to the City, but
that the old Post Office Building needs much rehabilitation,, Ile asked Me, Reese
if they had evaluated a more appropriate place without the expense of modification.
The answer was no. i
Mayc,, tdtchell stated that he still thought that the City should sell
the old Post Office Building,
The City Manager advised that the City had asked for an appraisal of
the building,

Council Member Hu?hes stated that she thought that the City should
keep this building since it s near other City buildings and might be needed for
City operation space later.
Motion was made by Stewart, seconded by Gay to defer the Community
Council's request for study, Motion carried,
5. The Council considered the request of the Denton High School principal
to approve the landing of a U,S, Marine helicopter in an open space near the
Denton Nigh School on January 27, 1979,
Sergeant Strain of the High School ROTC stated that the helicopter
would land on the practice field across from the High School and remain for
1 1/2 hours, No danger would be involved and no passengers would be flown.
Motion was made by Stewart, seconded by Hughes to approve the request
of Denton High School to land a U.S. Marine helicopter in an open space near the
High School on January 27, 1979, Motion carried 4 to 1,
b. The Council considered site plan and location of a proposed police
firing range,
Assistant City Manager King Cole briefed the Council, stating that if
the Council approves the request for the firing range, the following 3 things
must be done:
(A) Refer the proposed property use and location to the Planning
and Zoning Commission for recommendation on the use of this
City property,
(8) Instruct the City Manager to determine if funds are available.

(C) Instruct the City Attorney to preoare an ordinance amending
j j Sec, 14-4 of the City Charter to a11ow discharging of a
firearm within the City limits,
` Police Chief Mills pointed out that the Highway Patrol, Sheriff's
Department and the Police Departments from TWU and NTSU will use the range for
hand eun training purposes. He reviewed the proposed plans.
Motion was made by Gay, seconded by Stewart to approve the Police
firing range construction and that the Staff arrange for financing, Motion
carried,
j 11 The Council considered an Ordinance granting a franchise for cable
t i television to Golden Triangle Communications,
City Attorney Paul Isham briefed the Council, stating that the CATV
Advisory Board had met and unanimously recommended that the ordinance be passed,
He reviewed the proposed ordinance section by section and added that ordinance
78-21 should be noted,
Council Member Stewart said that since one group will own two medics,
Golden Triangle must have a strong committment to this City,

Motion was made by Mitchell, seconded by Gay that the ordinance be
passed on its first reading, On roll call vote Nash 'nay", Stewart "aye",
Hughes "aye", Gay "aye" and Mitchell "aye", Motion carried 4 to 1.

81 The Council considered Q-19, the requested quit claim of the dedicated
portion of Coit Street from Sunset Street south to the drainageway.
John h vretta advised that the Planning and Zoning Commission consid-
ered this request on December 6, 1978 and recommended the City quit claim the
dedicated portion of Coit Street from its intersection with Sunset south to the
,.a drainageway to adjacent property owners McGill and Barker, The Planning and
Zoning Commission also recommended retention of an easement on the entire area.
Motion was made by Nash, seconded by Hughes to approve quit claim of
the dedicated portion of Coit Street from Sunset Street south to the drainageway
and that an easement on the entire area be retained and that the quit claimed
land cannot be sold, Motion carried,
9. The Council considered participation agreement for oversizing sewer
line in Kingston Trace residential development,
Utilities Director Bob Nelson stated that the Water and Sewer Depart-
ment requires an 18" sanitary sewer line be installed and will participate in
the difference between the 10" and the 18" line,
M The City's cost will be $22,214.72, this amount to come from sewer
M bond fund,
Nelson added that the Utilities Board had approved this participation,
Q Council Member Nash stated that the City should handle bids, not
developers,
Motion was made by Gay, seconded by Mitchell to participate in the
{ cost of oversize sewer line in the Kingston Trace subdivision. Motion carried.
10. The Council considered participation in overwidth paving of Kings Row,
Kingston Trace subdivision,
Jack Owen stated that construction cost would be $18,031,30 and tnis
{ appropriation is standard procedure to achieving proper width and quality of
major collector streets. He added that the Staff recommends approval of
1 tonstruction of the overwidth and extra depth of paving and payment thereof.
Motion was made by Gay, seconded by Hughes to participate in the over-
width paving of Kings Row with Kingston Trace subdivision. Motion carried.

11, The Council considered a report on progress of Step Ill Grant Appli-
cation for wastewater treatment pant addition,
Bob Nelson stated that the Step Ill Grant Application provides for ;
the building and erection of plant and related facilities.
The Federal share of the entire project would be $6,929,168.00,` with
f the City's share to be ;2,309,722.00, and that bonds must be sold before a
construction contract can be awarded.
He added that the Utilities Board has approved the application,
Motion was made by Stewart, seconded by Gay to submit an application
to the Texas Department of Water Resources as recommended by the Utilities Board
tt and the Utilities Director. Motion carried,
12, The Council considered change order number one to the sidewalk contract
with Denton Construction Company,
Jack Owen stated that this addition was authorized by the Council at
their November 28 meeting and that it calls for approximately 160 ramps of
various types and an additional 250 feet of walk, He added that the Staff feels
that an additional 100 working days should be added to the contract to facilitate
the construction, Construction cost will be $63,350.
Motion was made by Nash, seconded by Mitchell to approve change order
number one to the sidewalk contract with Denton Construction Company in the
amount of $63,350. Motion carried,

The Council considered change order number one and two to the McCormick
Street drainage project with Denton Construction Company,
Rich, Svehla stated that the change orders were necessary through an
error in calculation for the Rip-Rap by condition of the settlement for a retain-
ing wall. The construction cost for Rip-Rap would be approximately $16,000, and
for the retaining wall and fence, approximately $2,900. T6e funds will come
from the Capital Improvements Bond Funds, It is also requested that an additional
0 75 working days be added to the contract.
Motion was made by Mitchell, seconded by Hughes to approve change e
order number one and change order number two as recommended. Motion carried.
14, ORDINANCES:
(A) Ordinarce No. 78-77
AN ORDINANCE AUTHORIZING THE DIRECTOR OF ENGINEERING AND DEVELOPMENT TO TEMPOR-
ARILY PROHIBIT OR RESTRICT PARKING ON CITY STREETS AND THUROUGHFARESs PROVIDING
A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND DECLARING AN EFFECTIVE DATE.
Motion was made by Gay, seconded Stewart that the Ordinance be
passed. On roll call vote Nash "ayeHughes 4 aye", Stewart "aye"1 Gay "ay e"
and Mitchell "aye", Motion carried.
(B) Ordinance No. 78-78 (Oak Ridge Company)
AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS
I ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS,
1 BY ORDINANCE NO. 69.10 AND AS SAID MAP APPLIES TO 8.6 AND 9.9 ACRES OF LAND OUT
OF LOT 61 BLOCK 2856 AS SHOWN THIS DATE ON THE OFFICIAL TAX MAP OF THE CITY OF
DENTON TEXAS, AND MORE PARTICULARLY DESCRIBED THEREIN; AND DECLARING AN EFFEC-
TIVEDATE.

The Council considered tax adjustments for the month of November, 1978,
Motion was made by Nash, seconded by Hughes that the tax adjustments
be approved. The motion was then withdrawn by Nash and Hughes after Council
Member Stewart stated that he saw names of a lot of people that could be contacted.
{ Motion was then made by Stewart, seconded by Nash to table the matter,

16. The Council considered bid 085821 for restrooms and concession stands i
at various City parks.

SUBJECT: Q-21. Requested quitclaim of a utility easement on five lots
located on the west side of Stuart Road, in the %icinity of
Manhattan and Sierra.
SUMMARY: At your meeting on February 13, 1978, the City Council approved
Planned Development (PD) zoning classification, permitting zero
lot line development, on 3.7 acres along the west side of Stuart
Road. When this property was platted into 40' x 100' lots, a
utility easement was obtained at the rear of the properties for
electric 'service. In Octobe, of last year, the property owner
rezoned a small portion of this tract--five lots--to Sirgle
Family ($F-7) classification. The larger lots required by SF-7
zoning are provided in the proposed replat--Generally 80' x 1251.
However, the existing utility easement should be qquitclaimed
since the easement mould appear near the center of the proposed
t lots, There is no necessity to retain this easements no utilities
are located there and it has been determined that electric service
to these lots will be provided by a line along Stuart Road.
ACTION REQUIRED: City Council'approval of the requested quitclaim.
I ALTERNATIVES: Retention of an unnecessary utility easement located near
the center of five residential lots.
RECOMMENDATION: The Planning Commission considered this quitclaim request
and unanimously recommended the City quitclaim thus utility

Land Acquisition for Neighborhood Park
The City's Community Development Block Grant contains money for acquisi
tton and construction of a neighborhood park, and for drainage improvements
in southeast Denton. Apprximately $65,000 has been set aside for the park
project and $35,000 for droainage Improvements. A site for the park, which
the park board has reviewed, is immediately west of the Dreamland apartments.
This site is also adjacent to that section of Pecan Creek which is selected
for drainage improvements.
The environmental reports that are required for federally funded projects
has been submitted and final project clearance has been obtained. Followinq
council action, the land acquisition process would begin and the engineering
and park staff would begin the design work.
r'' ! ACTION REQUIRED:
The City Council should approve a motion to acquire the property indicated
on the attached map using Community Development Funds and instruct the
staff to hire an appraiser,

APPLIES TO 6.2 ACRES OF LAND OUT OF LOT 7, BLOCK 187-2, AS SHOWN
THIS DATE ON THE OFFICIAL TAX MAP OF THE CITY OF DENTON, TEXAS,
AND HORE PARTICULARLI DESCRIBED THEREIN; AND DECLARING AN EFFECTIVE

THE COUNCIL OF THE CITY OF DENTONI TEXAS, HEREBY ORDAINS!
SECTION I.
That the Zoning Map of the City of Denton, Texas, adopted the
14th day of January, 1969, as an Appendix to the Code of Ordinances
of the City of Denton, Texas, under provisions of ordinance No. 69-11

E ' All the hereinafter described property is hereby removed j
from the Agricultural "A" District as shown on said Zon-
ing Map, and all provisions of Ordinance No. 69-1, adopted

7 in the same manner as other property located in the Light
Industrial "LI" District;
I i All that certain lot, tract or parcel of land lying and
be- ing situated in the City and County of Denton, State of
Texas, and being 6.2 acres of land out of Lot 70 Block 187-
2 and being located on East McKinney Street beginning 1100
feet east of Loop 288. The tract is typically 400 feet
deep and has 677 feet of frontage along East McKinney in
the City of Denton, Texas.

That the City Council of the City of Denton, ~'sxas hereby
finds that such change is in accordance with a comprehi5nsive plan
for the purpose of promoting the general welfare of the City of
j Denton, Texas, and with reasonable consideration, among other thinge
for the character of the district and for its peculiar suitability
or particular uses and with a view.to conserving the value of the
buildings, protecting human lives, and encouraging the moot appro-
priate uses of land for the maximum benefit to the City of Denton,
Texas, and its citizens.

SECTION III.
That this ordinance shall be in full force and effect immedi=
ately after its passage and approval, the required public hearings
having heretofore been held by the Planning and Zoning Commission

In accordance with the charter, this proposed site was sent to tht hlonning
zoning commission for site approval At their meeting of January 30 1979. The
Planning i Zoning Commission approved the site and passed a motion without ex-
caption authorizing the firing range a+. t1jis location.
I would recommend that the Ordinance be approved.

#kk SUMMARYs The Denton Police Department currently leases property
for a firing range east of town on a year-to-year basis with a thirty
day cancellation clause. Because of the lack of ownership, the Depart-
ment is reluctant to make those permanent improvements necessary for
a first rate range. The City of Denton owns property in a sparsely pop-
ulateil area in the western portion of Denton and the Police Department
is requesting the City Council's permission to utilize that property as
a firing range.

FISCAL SU..kVARYs Our current lease for the property east of town is $400.00
per year. The major costs to develop the new range would be approximately
$6#500 for dirt work on the backstop and parking lot. There would be some
other costs for gravel and hot mix for parking lots and walkways. No funds
kre currently budgeted in tho City budget for these proposed improvements.
ACTION REQUIREDs Refer the proposed property use and location to the
Planning and Zoning Commission for their recommendation on the use of this
City property. Instruct the City Manager to determine if funds are avail-
able, Instruct the City Attorney to prepare an ordinance amending sec. 14-4
of the City Charter to allow discharging of a firearm within the City limits
l at the specified location of the
firing range.

At the present time we are leasing land from the American Legion
for a firing range. This land is in the county off of Trinity
Road, east of Denton. Our least costs $400.00 per year with a
30 day cancelations therefore, it is not practical to-improve this
range to any great degree. This range consists mostly of a space
100 feet wide and 2S0 teat long with a creek, bank for a backstop. I
After it has rained we cannot use the range until the road has
dried enough to travel.

The City was givers a parcel of land on Airport, Road in 1944 by
the late J. Newton Razor. There were no specific use conditions
on this deed: (see Attachment) A portion of this land would be
ideal for the construction of a firing'range. (See Attachment)
The location marked on the map would be approximately two acres
l of land. There would have to be approximately 6000 yards of I
dirt moved to make the land level and to build a 12 foot backstop.
The cost to do the dirt work and rough out the parking lot would ;
cost about $6,500.00 and would be the largest cost. The perking
,lot would need to be 'graveled and some hot mix walkways would be
put in place on the firing range.
This range would be used for handgun training purposes by the Denton
Police Officers, NTSU# TWU and Sheriff's Office Officers, and the
Highway Patrols Once each year in the Fall we would sponsor a
supervised program for area hunters to fire and tiro in their hunting
rifles, We'have sponsored theme programs in the ,,last and they have
proved to be very sucessful. The rifles would be fired in a
~C direction that would be almost down range of the city property.
There are not any residenced that would be endangered should a bullet
gat over the backstop, and thare are no residences that are so close
that noise from the range would be a problem. This land Is inside the
city limits,' therefore, an ordinance would be necessary to establish
a firearms training range, as we presently have an ordinance prohi-
biting the firing of a firearm inside the city limits.

THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINSi
PART I.
That Chapter 14.'Offenses and Miscellaneous Provisions",
Article I of the Code of Ordinances for the City of Denton is
hereby amended by amending Section 14-4 "Discharging Firearms"
which shall hereafter read as follows
"section 14-4. Discharging Firearms
A. Discharging Firearms Prohibited. It shall be unlaw-
ful for any person to fire or discharge a firearm, rifle, shot-
gun, automatic rifle, revolver, pistol, or other weapon designed

. for the purpose of firing or discharging a shell or cartridge,
i
whether the shell or cartridge is blank or live ammunition,
€ within the corporate limits of the City.
i B. Exceptions.
I
(1) When the firing is done by a law enforcement
peace officer acting in the performance of his official duties/
(2) When the firing is done at a shooting or firing
range operated by an agency of the United States Government,
i
State of Texas, the County of Denton or City of Denton, or which
is privately operated if approved by the Chief of Police.
(3) When the firing is done using blank cartridges
for a show or theatrical production, or for signal or ceremonial
purposes in athletics or sports, or by a military or5tnization.
(4) When the firing is done in a shooting gallery or
gunsmith's establishment and when such shooting gallery or gun-
smith's establishment is properly fitted and arrangal for the
purpose so that no danger arisoa therefromt provided, however,
that no shotgun of any character, nor any pistol or rifle larger

than twenty two (.22) caliber shall be used in a shooting gallery,
-1 and that no shooting gallery shall be lawful in a gunsmith's
establishment except in connection with the necessary repair of ,
the firearm,used.
(5) When the firing is done in the necessary and lawful
protection of person, premises or property, or a justifiable c•r
excusable homicide situation.
PART II.
Any person who violates any provision of this ordinance shall
be deemed guilty of a misdemeanor, and, upon conviction, shall be
punished by a fine not to Exceed Two Hundred Dollars ($200.00).
Each day such a violation shall continue or be permitted, shall
be treated as a separate offense.
PART III.
That if any seotion, subsection, paragraph, sentence, clause,

phrase or word in this ordinance, or application thereof to any
person or circumstances is held invalid by any court of competent
jurisdiction, such holding shall not'ciffeot the validity of the

I remaining portions of this ordinance, and the City Council of the 1
City of Denton, Texas, hereby declare,j it would have enacted such
remaining portions despite any such invalidity.
IV,
PART
That this ordinance shall become effective fourteen days
from the date of its passage, and the City Seorotary is hereby
directed to cause the caption of this ordinance to be published I
twice in the Denton Record-Chronicle, the official newt-paper of

Attached for the Council's consideration is an Ordinance granting a cable
television franchise to Golden Triangle Communications for purposes of opera-
ting a :able television system within the City of Denton. In conformance
T~ with our City Charter, this Ordinance must be passed at two regular meetings
I of the Council by a majority vote of the entire City Council. The first
reading of this Ordinance took place on December 19, 1978.
f If the Council passes this Ordinance on January 16th, it will not take effect
r, until 71 days after that date. The Charter further states that during that
21-day period, the full text of the Ordinance shall be published once each
-ti week for 2 consecutive weeks in the official newspaper of the City of Denton.
During this time period, our Utilities Department Fill be negotiating with
Golden Triangle communications on a contract proviLinq for the use of the
i City's utility poles. we hope to have this contract ready fo1' the Council's
consideration at the first meeting in February. Once this contract has been
approved by the Utilities Board and the City Council and the 21 days required
by the Charter have lapsed, the Company would, at that point, be allowed to

Donton, Texas, hereinafter called "City" horoby grants to Golden
Triangle Corununicati.ons, a partnership of subsidiaries of Denton
publishing Company and Cox Cable Communications, Inc. of Atlanta,
Georgia, hereinafter called "Golden Triangle", its succ4ssors,
lessees and assigns, consent to use the present and future streets,
alloys, highways, bridges, public places, public thoroughfares and
grounds of the City for the purpose of erecting, laying, maintaining,
and operating therein and thereon polos, towers, anchors, wires,
k cables, electronic conductors, conduits, manholes, and all other
purtonant equipment needed and necessary for the maintenance and

j transmission and distribution of television programs and other

II SECTION 2.
Company agrees to pay and City agrees to accept, on or before

succeeding year during the life of this franchise, up to and in-
oluding the year 1990, a sum'of money to be known as a street and
publio way rental charge which shall be equivalent to throe (31)
percont of the gross annual revenues from all sources attributable
to tho operations of the grantee within the City and the Service
Area, which annual payment shall be for, the rights and.privileges

Secretary a sworn report showing the gross annual revenues from all
sources attributable to the operations within said City limits for
the calendar year preceding the date of payments. City may, if it
sees f.it, have the books and records of Golden Triangle examined by
a representative of said City or independent public auditor employed
by the City to audit the same to ascertain the correctness of the
sworn reports agreed to be filed herein.
That the City agrees that the consideration sot forth in the
preceding section hereof shall be paid and received in lieu of any
tax, license, charge, V of street or alley rental or any other
character of charge for use and occupancy of the streets, alleys,

SECTION 6.
LIABILITY OF CITY. That during the period this ordinance is in
existence and enjoyed by Golden Triangle, Golden Triangle shall in-
demnify and hold harmless the City from any and all claims for losses, J
damages and injuries occasioned to or sustained by any persons, firms,

or corporations, or their property by reason of the existence, main i

of all rights herein contracted for, except as herein otherwise pro- j

DELEGATION Or AUTHORITY. That the City may delegate to a desig-
nated official or officials the exercise of any and all of the powers
conferred upon the city hereby or by applicable State statutes and
law which relate to the supervision and regulation of a cable tole-
vie+on company; in its exercise of the rights and frnchisag herein
conferred, but the governing body of the City shall reserve to itself
j exclusively and to the full extent possessed, all powers, if any, to
fix and regulate chargos and rates of Golde.l Triangle given the City

the regulation of rates to be charged by Golden Triangle to the in-
habitants of the City is pursuant to Section 27-52 of ordinance No,
78-21 of the City of Denton. The initial rates to be charged by
Golden Triangle are attached to this ordinance as rxhibit "A" and are
incorporated heroin and made a part of this ordinance. Such rates
shall remain in effect and not be changed for a minimum period of two
(2) years after the award of the franchise.
It is also mutually understood and agreed that the City of Denton
{ may, when considering a revised rate schedule submitted by Golden Tri-
angle, consider the fair return on invested capital by using calcu-
lations for the cost of capital for Cox Communications, Inc. of Atlanta,
{ Georgia rather than the cost of capital for Go]don Triangle Communi-
cations.
SECTION 9.
CONSTRRUC ION TIMETABLE, Although Section 2744 of Ordinance No,
78-21 sets out the construction timetables for servicing the City of
Denton with cable television service, it is mutually understood and

tire City within fourteen (14) months from the date of this ordinance,

satory to the system. A low lease tariff that does not re-

Service Area
The City of Denton entered into a contract with- Denton County November 15,
1978, to serve the northwest portion of Denton County with ambulance ser-
vice. Since that time, John Maxwell and Paul Isham have been negotiating
with the Cities of Sanger, Krum, Ponder, Argyle, Shady Shores, Corinth,
Lake Dallas and Hickory Creek to develop a contract between those cities
j and the City of Denton.

Article 8, Bylaws of the Texas Municipal *.eague Workmen's Compensation Joint
Insurance Fund, stipulates that "All Board member positions after the original
appointments shall be subject to election by the members of the Fund." The cur-
rent three-year terms of Alfred H. Koeb;g (Mayor, Seguin), Ed Wagoner (City
Manager, Tyler), and R. Marvin Townsend (City Manager, Corpus Christi) expire
December 310 1978; alt are standing for reelection to the nine-member Board of
Trustees that, administers the $25 million TML Joint self-insurance program.

Mayor Kopbig has served as Mayor of Seguin for 12 years. He is past president
of the Texas Municipal League. active In insurance, real estate and ranching .

i interests. His involvement with the TML Fund dates back to the Initial organl-
zation efforts In 1973-74.
Ed Wagoner brings li Years of municipal management experlence to the Board. He

has served with the cities of Lubbock, Abilene,' Fort Worth, Greenville saA. Tyler. 1
He was appointed to flit an unexpired term on the Board during 1978 and Is making
his initial standing for election.
Marvin Townsend, like Mayor Koeblg, was Instrumental in the initial development
and organization of the TML Fund. His 22 years of city management experience
with the City of Corpus Christi provides a strong finanulal perspective to the over- `
sight of Fund operations. 1

Grader. The unit was sent to Darr Equipment Dallas
to repair engine as necessary. After breaking the #

engine down Darr Equipment advised us a major engine 1
overhaul and some other minor repairs were necessary
to put the unit back in good condition.
They were instructed to proceed. The repairs
cost a total of $4164.27 including labor.
We recommend this order be approved for payment.

This purchase order is for two wisconsin gasoline powered
engines complete with adapters and mounting brackets. These
f engines power the packing system for the EMCO side loading
refuse trucks. The City of Denton has four of these side
loading refuse truck in service.
When the packer engine on truck 02000 became uneconomical
to repair the vehicle maintenance requested a complete new
style engine as a replacement. This engine coat the City
of Denton 2366.00.
{ Due to the fact that these trucks are critical to our solid
waste collection system and delibe.iy time for replacement
packer body engines was increasing when unit number 2010
developed packer engine problems we immediatly authorized
'a second engine. The engine for unit 2010 was 2366.00

also,' bringing the purchase order total to 4712.00.

SUMMARYt Two bids have been received )n manhole forms (see exhibit I)
In which one comjeny bid a fiberglass form while the other
company bid an aluminum fcr. It is the desire of the sewage
collection department to Accept the bid for the alloy, aluminum
form although it is tiro higher bid. The reasons for accepting
the alloy aluminum form aret
1) interchangeability of parts with the existing steel
I manhole form.
I 2) The department has a trailer it can use to transport the
form from job to job. The fibernlass form would necessitate
the purchase of another trailer for transportation purposes.
I 3) More manholes can be poured with the alloy aluminum form.

f This bid is for a set of "Cast in place" concrete manhole
forms. This-set will replace 3 simular set of forms the
n City of Denton Water and Sewer Department has had for a
j numbit of years. Form of this type allow us to set up
and pour a manhole in place rather than purchase a pre
cast manhole or build one of brick and morter.
We recommend the low bid meeting specification of Action
Products in the amount of $4858.03.

I Hanson Co. has offered a lower price however their
forms are made of fiberglass, not alloy aluminum as
specified. We feel the alloy aluminum will have n

i longer life expectancy, be easier to repair and there-
fore worth the additional $662.23.

15KV power cable. The majority is to be used for service to the
Golden Triangle Mall or main feeder lines around the west and south

During the period between the initial advertising for bids and the
f closing date the staff was informed that equivalent copper silos of
250 MCM and 500 MCM might be more economical and biddere'were advised
that alternate bids were encouraged: Thd bids do reflect that copper
conductor is 6 to 11% cheaper and copper conductor is recommended to be
used because of the lower price as well as the overall size reduction
which will reduce the cost of installation and connections will to more
reliable.
Ethylene Propylene insulation of 220 mils thickness with a polyvinyl
chloride jacket of 110 mils was apeoified., several suppliers submitted
bids utilizing croselink thermosetting polyethylene of 215 mils and a
PVC jacket of 80 mils Which does not meet specifications,
The bid of Temple is not acceptable due to the delivery of 182 days.
The bid of Graybar is recommended as being the lowest bid meeting
specifications. Graybar is recommended to be awarded the bid as follower

Subjectt Bid #8628 Truck Cab and Chassis for Commercial
Sanitation Trucks
This bid is for a cab and chassis to replace motor pool unit
number 2000. This vehicle is the oldest of the four commercial
container trucks in use by the City of Denton. It is our inten-
tion to mount the body off of unit 02000 onto this new cab and
chassis. Replacing the truck cab and chassis only. a
When bids were solicited it was indicated that delivery would
j be a critical factor in our bid evaluation, This due to expect-
ed long lead time and critical requirement of the vehicle.
Six bids were received. Out of the six bids two bidders offered
immbdiate delivery on trucks in stock. The lowest bid on an
"in stock" truck was Lone Star Peterbuilt in the amount of
$40,407.00. We recommend this bid be awarded to Lone Star Peter-
l builh since the low bidder Mahaney International at $34,788.00
offered a 180 to 240 day delivery. The cost to recondition the
old truck and maintain it for a period of 180 to 240 days would
far exceed the $5,619.00 additional cost.
We'also recommend the purchasing department be aurthotised to
order three additional units from Maheney International at the
low bid price of $34,188.00 each. These units would be motor
pool replacements for the commercial sanitation trucks scheduled
for replacement in the last quarter of this year. By awarding
three additional cab and chassis at this time wa could Avoid the
emergency situation we have now. We realize this is a large
sum of money however as delivery schedules approach 6 to 12
months our planning and purchasing must coincide.
