SUBJECT: Election Recount
DATE: April 109 1979
Mr. "Robby" Robinson, candidate in Place 12, has made
a written request for a recount, stating there was an 18
vote difference between him and Mr. Schneider for a run-off
• spot in Place 12. ,
I
If the ground of the application for a recount is
that the difference of votes is less than 51, a recount of
all ballots must be made, including absentee ballots. In {
this case the difference As loss than St.
The Council must appoint a committee of three dis-
interested citizens to make the recount. The Council sets
the date when the. recount will begin. Both candidates
involved will also be notified, The committee will select
its chairperson. Persons who served in the Council election
on April 7th cannot be appointed. .
The recount will be held in a private place 'and the City
Secretary, who has custody of the voted ballots, will be
entitled to be present or have his designated representative
{ present while recount is in progress..
The Council shall advise the City Secretary of the
persons selected on the recount committee and issue an
order directing him to deliver to the chairperson of the
recount committee the boA or boxes containing the ballots.
Members of the committee shall be paid the same wage
as those working-iq the election ($3,00 per hour). The {
person requesting the recount must pay $10 per'procinct,
or in the amount of $50.00, whichever is greatest,

THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:
SECTION I.
1
That the City Council otficially finds and determines that an
election was duly ordered 'to be held in the City of Denton, Texas,
on the 7th day of April', 1979, for the purpose of electing three
(3) members to said Council, three members to be elected to Places
One (1)j Two (2), and Three (3) for two (2) year terms; that proper
notice of said election was duly given; that pr,-per election officers
were duly appointed prior to said election; that said election was
duly held; that due returns of the result of said election have been
I -made and delivered$ and that the City Council has duly canvassed

SECTION 11.
That the City Council officially finds and determines that only

LAY OF APRIL, 1979, THE SUIE BEING THE FOURTEENTH DAY AFTER THE PRE-
CFa)INO ELECTION FOR THE PURPOSF OF ELECTING ONE (1) COUNCILPERSON TO
PLACE TWO (2), AND ONE (1) COUNCILPERSON TO PLACE THREE (3) FOR THE ~

WHEREAS, it is necessary to hold a special run-off election to
fill Place Two (2) and Place Three (3) by electing one (1) Council-
person to each place for the City of Denton, Texas, now,. therefore,
THE COUNCIL OF THE CITY OF DENTON, TEXAS,'HEREBY ORDAINS
SECTION I.
' That a special election shall be hold in the Community Building
in the Civic Center on WcKinney Street, in the City of Denton, Texas,
between the hours of seven o'clock (7:00) A.M. and seven o'clock
(7:00) P.W. on the 21st day of April, A. D. 1979, the same being the
{ fourteenth day following the preceding election, for the purpose of
electing Ono (1) Councilperson to fill Place Two (2) and One (1)
'Couaoilperson to fill Place Three (3) for the City of Denton, in
accordance with the provisions of Article 111, Section 3.04 (b) of
j ( the Charter of the City of Denton, Texas.
1 # SECTION It.
E That One (1) Couneilperson shall be elected for a term of two
(2) years to fill Place Two (2), and the candidate who receives the
majority of the votes cast for such place shall bo,deelared elected
to that pace on the City Council of the City of Denton, Texas, and
One (1) Councilporson shall be elected for a term of two (2) years
to fill Place Three (3), and the candidate who receives the,majority
of the votes east for such place shall be deolared elected to that a
place on the City Council of the City of Denton, Texas. In the
event of a tie vote at the special election, the candidates who tie

shall cast lots in the presence of the City Secretary to determine
which one shall be declared elected, and said lots shall be cast
within five (b) days of the election.
SECTION III,
That Lee 0. Knox is hereby appointed presiding fudge of said
election, and Robert A, Miller is hereby appointed as his alternate,
and the said presiding judge shall appoint such assistants me may
be necessary to propbrly conduct said election, as provided by the

election code,
SECTION. IV.
That the City Secretary shall prepare an official ballot for
such special election bearing the names of the two (2) candidates
who reoetved the highest number of votes cast for Place Two (2)

and the names of the two (2) candidates who received the highost
number of votes cast for mace Three (3) at the regular election,

SECTION Y,
That Immediately after the counting of the votes the presiding

3udCe and/or alternate judge shall deliver the official returns of
the election to the City Secretary.

SECTION VI.
That on the Tuesday next followiap the election, tho City Council
shall canvass the returns and declare the results which shall be re-
corded in the Minutes of the City Council.
i SECTION VII.
That immediately after the election results have been declared
the Msyor shall deliver a certificate of election to the successful
candidates. The Counollpersons so elected she'll take the oath of
office as soon thereafter as practicable at which time his term of
office shall begin,

DENTON CITIZEN SURVEY
Purpose
The Applied Policy Research Program of North Texas State
University proposes to contract with the City of Denton for the
purposes of designing and administering a citiaer, survey,
analyzing and rep)rting the results of the survey, and doveloping
a citizen survey model for use by the city on an annual basis.
Objectives
There sze two primary,objeotives associated with this projeot.
The first is to provide the city manager and city staff with
oitizen input that Is relevant to budgetary deoisions. The second
j is to provide the city with a citizen survey model that can be
implemented by the city staff on an annual basis with only limited
i
assistance form the Applied Policy Research Program or other outside
' agencies,
Project Deaoription
Sampling Procei,re--The survey project will seek to obtain
interviews from approximately 400 adult residents of Denton. A
sample of 700 households will be drawn however,
, The three hundred

additional households will be included to take into account refusals,
` vaoanoies, and other reasons for non-response, The random sample of
j 700 households will be drawn fron Cole's Kris-Kross DirocLo-r-v.

Instrument Design--The survey instrument will be developed by i
,Applied Policy Research in consultation with the city staff. This ;
procedure will be followed in order to ensure that the data produced
will be useful to the city staff. The instrument will be designed to
that it may be administered in 10-15 minutes.
Data Colleotion--Telephone interviews will be used to collect.

the data. Approximately twenty interviewers will be employed to

conduct the interviews. Since tblephone interviews normally yield {
a lower response rate than do personal interviewsp the choice of
this method of data collection contributes to the large site of the
initial sample. '
Report--The report compiled'by.Applied Policy Research will J
consist of two partsi 1) an analysis of the data collected, and 2)
a citizen survey model.
