The Council considered the presentation of Ed Staplet^n relative to the extension of hours of operation From 12:00 a.m. to 2:00 a.m, for establishments serving alcoholic beverages, poll halls and dance halls. Stapleton reviewed comments of persons who previously addressed the Council. lie pointed out that one of the main comments was loss of revenue. He said there was a massive support of the 2 a.m. closing time and advised that a petition with 2,000 signatures had been very easy to obtain. Several citizens spoke regarding the 2 a.m. closing time. One citizen named the Mulberry Club as an offender. The Mayor stated that he had never voted fer the clubs. Ile added that loud speakers should not be installed outside a club building, and if a customer is unruly when he leaves the club he should be picked up by Police. hlxyor Pro Tom Stephens said that he had three concerns: (A) Noise k (B) Litter (C) Cost for police protection. t lie asked the Manager for costs to patrol the areas after 12 midnight. u k The City Manager stated that figures he might give cannot be based on ~ facts, since no studies of this type of thing have been made. i Vela-- { A) There are clubs because people drink. 1 ~R) People have this right. (C If people demand 2 a.m. closings, then the owner has the right to stay open, but disturbing have life is another thing. I Mayor Nash asked Mr. Stapleton if he thought the club owners would pay 1 an off-duty policeman? Stapleton--There could ba some contribution for a patrol, if necessary. Vol Judson Moore, Prosident of the North Texas Student Body, made the following statement; "I am concerned about students staying in a club until. 2 , in the morning. This could endanger the grades of students and dull their alert- noss in the classroom." i Motion was made by Stephens to deny the request. The Council received a report on the Denton Housing Study, , John Laurette revieti~ed the background of meetings and puns that led to the eventual housing study, lie said that a special Committee was appointed and the Committee recommended hiring a consultant to prepare a study. ~ 1 } May 8, 1979 Continued 153 After a lenghty and detailed presentation John Lavretta commended the Committee and Comprehensive Planning Institute, Moore Diversified Services, Inc. in cooperation with Farrington and Asser.ates, Inc. Dick Halton, realtor who was an the Cuumtttee, thmiked the Committee and the consultants for a very fine job. The Council agreed, as did the City Manager that the City must move forward with a housing program. 3. The Council considered extending the Animal Quarantine Contract between the City of Denton and Denton County for a period of one year. The Meager recommended extension of the contract for a period of one year beginning the day the new contract is approved by both the City and County. Motion was made by Stephens, seconded by Vela that an extended Animal Quarantine Contract be approved for a one year period. Motion carried. 4. The Council considered a report on presentation by Philip Larrimore. Larrimore stated that he was still paying 2S% interest on his unpaid t utility balance. W Sity Manager Hartung stated that we are all concerned about high bills. Q The single largest cost is the cost of fuel, not poor management. We have lowered payment of late payment from 108 to S1 on past due bills. Vela--If we are going to make changes we should see what affect we have on over all utilities. Stephens--Lato penalty is a necessity; collections must be considered. Motion was made by Hensle, to table the matter for further study. The Council considered a report on Elderly Homestead Exemption. Mayor Nash--r have been thinking about an $;1,000 exemption rather than a $6,000 exemption. 1 The City Manager said that the impact of the homestead tax exemption I for the year 1978 involves $8,920,590.00 evaluation of exempt homesteads. This is 31 of the total valuation. The tax arwwtt on the exempted homesteads is 110,615.32 and the number of exempted hoaaiesteads is 1,588. i Motion was made by Hensley, seconded by Vela to direct the City Attorney to prepare an Ordinance for an $8,000 homestead exemption on property tax for the j elderly to replace the present $6,000 homestead exemption. Motion carried. 6. The Council considered amending the Sewer Use Ordinance. The City Manager recommended amending the rate to be the same as the i residential rates. } r Bob Nelson, Utilities Director, stated that loss of revenue with this m=dment as applied to churches is estimated to be not more than $5,000 per y6or. The only difference between thu church rate and the residential raw is that the propoaed church rate would not have a 20,000 gallon maximum. Bob Nelson reconsnended that the progress payment be made, and that ` Denton Mali Company has presented a progress payment invoice. This progress payment is in the amount of $147,554.19. Motion was made by Nash, seconded by Hensley to approve the progress paynnent of Participation Agreement wit;u Denton Mall Company for a 30" water line in the amount of $147,554.19. The Council considered update on the status of the following construction projects: (A) Peterbilt: Rick Svehla advised that due to a change in Peterbilt's plans, we anticipate another $5,000 cost increase for a storm sewer crossing that the City has agreed to build, and we want to advise the Council, and we need the Council's concurrence for inclusion in a bid document. Motion was made by Hensley, seconded by Nash to approve this change and to include in the bid. Motion carried. (B) Welch: Rick Svehla gave information on possibility of repairing Welch Street, adding that he would obtain more information by the next meeting so that the Council can give the Staff some direction. The grant regulations specify a wide range of eligible profac~s including street i and utility improvement, housing programs, park improvements, drainage im provements, etc. Cities over 50,000 in population are "entitled" to a certain grant amount and have a wide latitude in the expenditure of their CD8G grant funds. Cities in Denton's class. are referred to as "discretionary" cities and must compete with other cities in Texas fora C03G grant and our program is somewhat limited by this fact. Last year Denton received preliminary •spproval for a1,500,000 grant to be funded over a two year period. We have received f nai approval of.the 1978-79 installment of this grant ($750,CD0) and .ire operating the progqrams authorized. The final application for the second year installment, 1;79.80, is due on June 1. If they are not satisfied with the plan or our compliance they can disapprove our CDBG grant. In this second year of our program we do not have to compieteiy rewrite the plan, but only must revise the Annual Housing Goal page, The Planning staff, together with the Housing Authority Director, will submit a proposal to the Grant Advisory Committee and their recommendation will be available to the Council Tuesday night. We do not anticipate any problems with HUD concerning the housing assistance plr.i. The next step in the PD procedure requires the developer to submit a de- tailed site pla, for consideration by the Planning Commission and City Council, The Health Center Complex, as well as a four story resident apartment facility, is already located on the site, The property owner wishes to continue development by adding another wing of apartments to the south of the existing structure (50 additional units) a row of } duplexes along the south side of Headlee'Lane, and a triplex near the east I and west property lines. I SUWMRY; 1 As indicated on page 1131 (enclosed), the Zoning Ordinance provides a process whereby requests for new and unlisted land uses are submitted to the n- ning Commission and City Council for determination of the appropriate zoning classification in which the use should be permitted. The Planning and Zoning Commission at its May 2 meeting considered the request of Mr. Basil Murphy concerning the operction of limited automotive car wash facilities as an accessory use within apartment co7ipiexes.' (Mr. Murphy's letter is enclosed P.A he will be present at the City Council meeting on Nay 15.) Technical concerns to be investigated for each individual site ~ include drainage, uisposal of run off into the city's storm sewer Systems certification by the State Department of Water Resources regarding bio- degradable detergent; compliance with existing zoning and parkingg requirements for apartments; and compliance with building, plumbing, mechanical, and electrical codes, It was the consensus of the Planning Cortunission that limited car wash machines, as suggested by Mr. Murphy, + are accessory uses to an apartment complex--much like laundry facilities-- and should be permissible to serve tenants if these technical concerns can be satisfactorily addressed. At the Planning Commission meeting in May g, the planning Commission recom- mended the following land use interpretation regarding limited car wash facilities, "Limited car wash facilities ate hereby determined to be an accessory use in conjunction with multi family dwelliiig'units and shail.be permitted when ril city, county, states and federal requim,ents are met. This i,~cludes, but is not limited to, provision of the Zoning Ordinance:riciuding setbac.5 for an accessory use and re- quired parking for multi family dwelling units; ;adopted city ~J building, electrical, mechanical, a .id p1Urobing codes; er,gi.neering standards for provision of adequate drainage; compliance with EPA guidelines and obtainment of appropriate permit for disposal of run off into the city's storm sewer system." This interpretation, if approved by the City Council by resolution, wculd permit the petitioner to initiate his proposal after a detailed review of site conditions and obtainment of the appropriate state permit. Addition- ally, the Planning Commission recommends a Zoning Ordinance amendment which would more clearly define limited car wash facilities as a permis- sible acs-assory use within apartment complexes, and est?blish a review process whereby the Building Official would determine satisfactory com- pliance with applicable standards. r i i~ i1 ALTERNATIVES: r.y A) "he Council may adopt the land use interpretation recommended by the Planning commission. The project consists 1 of paving a 60' wide road between Bell Avenue and Stuart Road along with drainage improvements including one box culvert on Windsor Drive and a second box culvert on Stuart Road approximately 160' north of the Windsor/Stuart intersection. This i second culvert on Stuart Road will be funded jointly with a $20,OOD.00 contribution from the developer who is making improvements on the west side of Stuart Road. This project was to be funded in the Capital Improvement Program and bonds have been sold to facilitate this construction. We estimate the City's cost of this project to be approximately $240,000.00. This is an increase from the prior Capital Improve- as 7,aappproximately $20,OOOe00 of approximatel heiadditiongof the00 nrtor several estimate factors some $ is due box culvert on Stuart Road, a delay in awarding of the bids due to the bond election 1 and sale and inflation since the first estimate which was made in late 1976. We have discussed this increase with the Finance Department and they feel that the project can be funded and the increases can be absorbed because of the way the bonds have been ~ sold and invested. During those meetings, complaints from citizens on the east side of Stuart near i Windsor were presented. At several of those meetings, the developer indicated that he would be willing to participate in some kind of drainage crossing on 1 Stuart Road. Consequently, the Planning and Zoning Commission and the Council determined that the developer would participate in the amount of $20,000.00. In discussions with the University, 1 they have indicated that thev would certainly be willing to commit their contract amount for the mount has not been tied d own lbut t it is contract approximatelyt$30 000. ton$35,000.Tdollars. a + We have also been able to gather further information on what we consider to be some major problems. The University had indicated that they do not have final plans com- pleted on the storm sewer project for Welch. This would present a major problem to install lateral lines across the paved areas at the proper location and elevation. The University has also indicated that they are not completely sure that this con- tract will be let. Therefore, some of these laterals might not ever be used. For , this reason the University is reluctant to install these itorm sewer crossings across the pavement. They have indicated a preference for waiting to see if this contract is let and installing the sewer crossings once the contract is let. f The Staff has also reviewed the time that would be required to advertise this project' and begin construction. Bid advertising and preparing if plans and specifications f would take a minimum of three to four weeks. As we indicated at the last meeting, i the prices that were quoted by a local firm were very good. However, we currently have this local contractor under contract and it is doubtful that he would be able to move in on Welch Street for at least several weeks after the bids were let. In , essence the Staff believes that there would be a tag of at least six to eight weeks before Welch could be paved. Obviously once the City indicates to the University { that we would like to complete this project by repaving, their liability and main- tnnspdifficult i problem d for the anCity d become the City's. We believe this would be a rather accept. Finally at the meeting last Tuesday, rte indicated to you that there are currently no funds available to do this paving except for Capital Improvement Program bond funds. If these funds were used, something in the Capital Improvement Program would have to be eliminated. Chris Hartung FROM: Rick Svehla DATE: May 4, 1979 i RE: Update on Welch Street Paving We have had several conversations s;ith the University on repaving Welch Street from Highland to Hickory. At the present, University is planning to patch a waterline ditch and a sanitary sewer ditch and sometime late fall or early next year, a storm sewer ditch. Both staffs have discussed the possibility of completely repaving this area rather than having the University dust patch its utility ditches. The University has indicated j that they have thirty to thirty-five thousand ($30-35,000.) dollars avail- able for repaving, however, they indicated that they would like to gait until the storm sewer has been completed this fall. We have suggested paving one-half at a time which would eliminate having Welch Street tore up all summer long. Their staff has indicated this would probably be agreeable. We have contacted a local firm who indicated that they would pave Welch Street with five (5") inches of asphalt for approximately sixty ($60,000.) ; thousand dollars. This price does not include any excavation and removal 1 of old street materials or any base work to the section under consideration. We have estimated that liming the base would cost an addition fifteen ($15,000.) thousand dollars. The total cost to the City would be approximately forty ($40,000.) thousand dollars. The only source of funds that I am aware of at this time would be Capital Improvement funds. The two new engines were replaced one-year r ago and we are in good shape as to the regisired number of engines for s Insurance Key Rate Credit. Also, we are r aestin that an automobile be be used in the re Department as a replacemeniufor~thisftrruuckhe sale to The Fire Department is very short on automobiles os}secially since we started sending three firemen to paramedic School in Dallas last August, three more in February of this year, and three more It. August of this year, We will be sending others in the 1979-80 budget year. There are times when two vehicles are going to Dallas every day, and i other times when one goes each day. This simply leaves our department stripped of automobiles to carry on r the day to day operations, such as fire department business and cmorgency + calls. `r The truck in question was ordered in 1964, mounted on a Ford F600 Com- mercial Masses. It has served us well for 15 years on county fires,, grass fires, and structure fires. This truck was replaced with it Chev- rolot C60 Coinnercial Chasscs and a larger Dnanp, larger carrying capacity, and larger compartment space. I 1 CITY OF Wrrm !
