1. Consider a resolution nominating a representative from
the City of Denton to the Board of Directors of the
Denton County Single Appraisal District.
2. Consider the acquisition of property for drainage im-
provements along Pecan Creek and its tributary in the
vicinity of East Prairie Street.
3. Consider discussion on the application of penalties on
utility bills.
4. Consider a progress report on speed and load limits on
Sherman Drive,

the State of Texas passed Senate Bill 671. relating to ad valorem
taxation of property,- snd

WHEREAS, Senate Bill S71 estoblishes a single apDprataal
district in each Ccumty of the State of Texas whtah to
responsible for appraising property in the district[ and
WHEREAS, the said appraisal district 11 to be governed by a
Board of Diroctorsl and
WHEPEAS, each taxing unit in the County may nominate one

Agenda Item
Consider the acquisition cf property for drainage improvements along +
Pecan Creek and its tributary in the vicinity of East Prairie Street.
Summary j
This represents the last parcel of land to be acquired in order to
commence construction on the Pecan Creek and Tributary "C" of the creek
channelization and realignment project. The purpose of the project is +
to improve drainage conditions in the general around Project Phoenix
(Dreamland) and fir the Southeast Denton Community Development Area.
Fiscal Summary
' Our real estate appraiser ha% completed his appraisal and is recommending
the following as just compensation for this tract.

This project, including property acquisition, will be funded entirely by
our Community Development Grant. The cost of ac uisition reflected i '
in the appraisal does seem to fit within the project budget.

Recommendation {
The staff W reviewed the appraisal and feels that it is reasonable.
The fair mar;.-,t value placed on the .:act which the City is interested
j in acquiring may appear high, but the tract in consideration, because of
numerous trees along the creek, represents approximately 6D% of the total
value of the property. The amount recommended by the appraiser would
F have been less if the City was simply obtaining an easement. However,
{ according to Engineering they could not guarantee that the visual amenities
3 involved with this tract could be saved during the construction phase.

Alternatives
r
The City Council, in considering other alternatives, could decide to:
1. Have another appraiser conduct a real estate appraisal of this
tract, but this would take additional time and money, and this
second appraisal could possibly reflect a similar Fair Market
Value.
2. Shift the new portion of the channel over further east of the
existing creek, however, the creek bed in this area is approximately
30 feet deep and additional excavation costs would be economically
unfavorable,
3. Delete the chinneiiration project from our approved community
Development Program, but this would affect our Grant rating, which
HUD could possibly require the City to refund a portion or all of the
funds for this grant.
~ Action Required
f The Council should consider establishment of Just compensation the
amount reflected in the appraisal and authorize the City Manager to
negotiate for acquisition of this tract.

The purpose of this real estate appraisal report is to
estimate the fair market values as described heroin. This
report is based on all availatle pertinent data that could be,
acquired, confirmed, and analyzed within the reasonable period
of its preparation.
Primary evidence of value stems from recent sales, r6ntals, I
and current construction costs of properties substantially E
similar to the subject property. This Is the most reliable
typo of data and is accorded the most weight in arriving at

final value estimates. ;
Secondary evidence from such sources as development,

buildera, and the City of Denton's Engineering, Utility, and 1
Community Development Departments, and the USDA Soil Conser-
vation Service was utilized in estimating present costs and i
j feasibility of economically feasible alternative highest and
best uses such as, assimilation, or subdivision anA development
or cost to cure approach to any existing problems of an s`
inhibitory nature.
The Cost Appraoeh indication was $4,000. The Income Approach
indication was $3,200. The Market A

to $4,100 with a 28;6 range; a moan of $3,720; and a
median of $3,766. Since the Income Approach was considered s 1
the. least reliable, more wAight was given to the Cost

value for the subject property of $4,000. i

The same factors of value and approaches to value estimates
of the whole property was utilizod in estimation of the value
of the partial taking. Based on these facts and data the
fair market value of the partial taking is estimated to be
$2,250.00.
ESTIMATE OF VALUE OF THE REMAINDER
DtLu to the shape of the whole property and the location of
the partial taking in relation to the whole property and
existing improvements, the remainder's highest and best use,
and utility is relatively unaffected after the taking there-
fore, the value of the remainder before and after the taking
is estimated to be $19750.00.

Billing for service hereunder will be at the net
monthly rate, payment of which is due on or before
the due date shown on the statement, A penalty for
nonpayment of the bill will be assessed and charged,

the due date will be considered overdue. The penalty

SUBJECT: Airport Grant for Radio Control of Runway
Lighting System
The Federal Aviation Administration and the Texas Aeronautics
Commission have developed a grant program to jointly fund for
Texas airports a new radio controlled runway ighting system.
This sytem will be a control system added to our existing
lights which will enable them to be turned on by a pilot with
his own radio controls. What this allows us to do is not keep
our runway lights burning all night long. They would only be
activated at a pilot's discretion when he wanted to make a
night lcoding. This will have a good energy-saving consequence {
on our utility bills at the airport.
The funding for this project will come from the Federal Aviation
Administration and the Texas Aeronautics Commission. There will
be no cost to the City of Denton, and it would be my recommendation
that the City Council approve this resolution accepting the grant.
