20, 1979 and the Special Called Meeting of November 270

A, z-1423. This is the petition of Mr. Tom Jester
requesting a change of zoning from General Retail !
(GR) and Single Family (SF-7) to Light industrial
(LI) zoning classification on a tract approximately
13.9 acres in size. The property begins at the
northwest corner of the intersection of Woodrow Lane F'
and Morse Street, and extends to the west along Morse
street for approximately 800 feet, and extends north
along Woodrow Lane for a distance of approximately
! 970 feet. (Planning and zoning Commission recommends

the Special Called meeting of November S, 1919; the Reluln Meeting of November 6,
1979; and the Special Called Meeting of November 13, 1979 be approved. %lotion

2. The Council considered a final report on the 19,9 Sormr Playground
Program with STS 1.
In excellent slide reesentatlon rats shown of the Denton su:mer play
scene of 1979 which was a cooperative effort of the City Parks arnd Recreation
Department and NTSI1.
Farks and Recreation Director Dick Huck pointed out that the program
was held at Denton Civic, Matte Shultz and fred Mfours Parks.
Dr. David Compton of Recreation and Uisun Studies of YfSU loaded the
prekrsn. i
3. The Council considered in sprearance by Danny L. Smith relative to 1
i vandalism in the City and the need for a Pol.cs Officer Recruitinq Program.

s. The Council considered an appearance by Deborah Shelton of the Denton

7. The Council considered the petition of the V. D. Burch Estate, request-
ing demu:exation of approximately 63.6 acres of land located along either side
of Highway 377 in southwest Denton County,
Motion was made by Stephens, seconded by Vela that the petition be
approved and to instruct the City Attorney to prepare an appropriate ordinance.
Motion carried.
3. The Council considered the request of North Teems State University for
quit claim of a right-or-way for Wilshire Street located between Avenue D and
Avenue B.
City Planner John LaNvotu briefed the Council advising that North
Texu State University has been pure?using land in block 3003 and now owns all
of the lard adjoining the Wilshire Right-of Way. North Texas State University
his na immediate plans for the property, but the last YM master pplan designated
the area to be developed as a major entrance to the campus from IJS. No street
exists at this locntion and no street is planned for th;s right-of-way. There
is a sewer line in the right-of-way but it no longer erves any property. The
Planning, Enginterin and Utility Departments have each reviewed this request
and can forsee no p hic use for the eight-ef-way. fie existing sewer line
j would be abandoned along 'Ath the right-of-wsy. The Planning and Zoning Camnisi-
ion recommended approval.

9. The Council considered a report on the status of the wood shingle roof
ordinance.
The City ?major advised that the Building Code Board has been studying
this matter sari t6t the Code Board will meet on November 19.
Motion was made by Vela, seconded by Stewart to table the matter.

10. The Crtmil considered a recomrendation from the Building Code Board on
mobile hares and their use within the City.
City Reneger Hartung advised as fol7a At its October meeting, the
Buildin Code Board Board revtewed all the information given to them by mfr Staff
on mobile hones. Currently soma mobile homes meet or can be modified to nett all
of the pertinent ccnstruction codes of the city of Denton. The board diseuseed
this item at two different meetings and finally d+c!ded to recommend to the Council
that no regulations be put on the use of mobile ?roes. It wad the feeling of tho
Board that their use in :ones like commercial or general retail would not haw
any III effects on the ceeemnlty arxi that their use in residential areas would
in all likelihood be prohibited by deed restrictiore or other covenants. The
basic recommendation was that since there appear to be no problems at this point,
no action should be taken.
Mootion was made by Stephens, socerdad by Stewart to accept the recomm-
endation of the Building Code Board. Motion carried.
11. rho Council considered disposition of excess right-of-way along Sherman
Drive at Denison Street.
City Planner John tavretta ga%et the followir'g report: in order to
extend Sherw Drive froa Denison Street to Carroll Mt. it was necessan' for
the city to adccdre portions of Noril lob. The design of the street left
excess ?rcpetty remaining on the south ride of .4;hemrian Drive. Ns, Bonnie '4xwall
of the .prat]- sllller Company has requested scquisition cf the 1651 square foot
-steel.

12, The Council considered a preliminary report on the strait condition
inventory and the proposed Street tmorovement Program,
The City or introduced Greg Edwards, a new employee in the
Ccrsmxraty Detialonment Denartment, who advised that there is approximately 9.6
miles of streets with curb and gutter and 9.35 miles of street without curb and
T..itter to be reconstructed, an additioal 45.9 miles of streets with curb and
gutter and 3.7 miles of streets without curb and gutter that need an overlay or
repaving. Usingg current costs from oor last major project and also existing costs
of asohalt and indications from other cities an the cost of repaving, we have
i come up with the following cost for the far categories:
h Reconstruction of streets with curb 6 Gutter 53,900,000.
Reconstruction of streets without curb 6 gutter 52,000,000,
Repaving or overlaying with curb and gutter 52,500,000.
Repaving our overlayinp without curb and putter s 200.000,

The Cltv manager reco6randed referral to the Planning and toning Comm-
ission for such matters u priorities, schedulingp areas where capacity is inadeq-
+nte. He added that major commitment of funds will be required. He also mom-
ended to give careful study before presenting to the voters, with the Council
W as unanimous support, and that next Aorii will be the earliest for street
ovement plans to be submitted to the electorate. The Staff has completed a
revtew of the cost estimate on 3411 Aaanme. He advised that w4 t re not sure of
the figures used by the Universiry but we have computed the cost based bids that
were received on our last major project which was Windsor Drive, Our estLsute
included not only the construction of a new road from Mingo to LhIverlity but
also a new far lane facility from Wingo south to the proposed unction with
Bell Avenue, the estimate included a 49 foot strest, adoum Iminage for the
street and the inclusion of a double 6' x 6e box culvert for vodastrian traffic
movements to the trt:k facilities. this totals approximately 5600,00. If we add
in an additional ls5 for engineering Arid a 305 increase in teflatiort (assuming 16
months to 2 yeses for Constrnxtion) a total cost of the project would be approx-
imately 5900,000,
Council Flember MS. stated that he wood Like to its option for voters
on three levels of cost so that voters can vote a yes our no choice.
Mayor Nash asked that the City Manager check with the City's Financial
advisors.

Identity: Z-1423
This is the petition of Mr. Tom Jester requesting a change of zoning
f from General Retail (GR) and Single Family (SF-7) to Light Industrial
(LI) zoning classification on a tract approximately 13.9 acres in size.
Location:
The property begins at the northwest corner of the intersection of Woodrow
Lane and Morse Street, and extends to the west along Morse Street for
approximately 800 feet and extends north along Woodrow Lane for a distance
of approximately 970 feet.
Report:
Surrounding land uses include undeveloped land immediately north of the
site with City Park land further north which provides a buffer between this site
and the proposed city animal shelter north of the park land. Single family
1 housing is located across Morse Street to the south, and new singe family
housing is under construction along Baldwin Street to the southwest. A Planned
Development zone (PD-17) permitting development of a light Industrial park on
a largge 122 acre tract is located to the east and undeveloped land is found
immediately west of this site with single family housing further to the west.
The Comprehensive Plan provides no guidance with respect to this property.
The proximity of the lodustrial park to the east tends to support this roquest.
The Planning Commission considered the issue of a light industrial use being
incompatible with the exis'.Iag single family housing alonngg the south side of
Morse Street and its possible negative impact on the construction of additional
housing along Baldwin Street. The Planning Commission felt that development
of single family housing on this tract proposed for industrial zoning would.
be unlikely because of the size of the flood plain and also proximity of light
industrial uses. Moreover, a number of adjacent property owners spoke in favor
of the request.
The Planning Commission recommeiids appruval of Z-1423. (Motion carried 5 to
1.)

Novinber 7, 1979
The regular meeting of the Denton Planning and Zoning Commission was held
on November 7, 1979 at 5:00 p.m. In the Council Chambers of the kuuicipal
Building.
PRESENT: Bill 3ra9y, Marilyn Gilchrist, Robert LaForte, Linnia McAdams,
Andy Sidor and Richard,Taliaferro. Staff Members: John Lavretta,
Charles Watkins, Steve Fanning,
ABSENT: Don Ryan
Chairperson Linnie McAdams called the meeting to order.
1. Approve the minutes of uctober 17, 1979 meeting.
Motion was made by Commissioner Brady and seconded by Commissioner
f LaForte to approve the minutes of October 17, 1979.. Motion
carried unanimously.
Ii. Public Hearings:
A. Z-1423. This is the petition of Mr. Tom Jester requesting a
change of zoning from General Retail (GR) and Single Family (SY-7)
to Light Industrial (LI) zoning classification on a tract approxi-
mately 13.9 acres in size.

Tom Jester, petitioner, stated that he was representing the owner
and the hopeful purchaser of the land, stating that there are
warehouses already on the property and that the purchaser hopes
to put a print shop and other small shops on the property. He
asked all in favor of the request to stand. Six people stood
in favor of the request.
E i Archie Kelley, current owner of the property, spoke in favor of
the request, stating that he owned the property since 1946. He
stated that he felt it would be impractical for any contractor to
develop the area for Single Family since it is located in a flood
plain.

Commissioner Sidor asked Mr. Kelley what would be dond with the
warehouses.
Mr. Kelley replied that they would stay on the property.
Commissioner Brady asked Mr. Kelley if he was aware that he
could put a print shnp and other small shops under Commercial
p zoning classification.
Mr. Kelley replied that he was not aware of this at the time
he made his request for a change of zoning. -=,€c•:
Commissioner McAdams clarified thot if the aria wag zoned Light -
Industrial, even though shops were planned now, in the future
Light Industrial development would be xlLowed on th,t property.

Commissioner Taliaferro asked Mr. Kelley if the sale of the
property was contingent on the zoning.
Mr. Kelley replied that it was not.
Tom Jester stated that be would like the area zoned as Light
Industrial, but would take Commercial zoning classification as
a second choice.
Commissioner McAdams clarified that the Commission was required
to vote on the petition as it w..s originally requested.'
;e Commission discussed the request.
Motion was made by Commissioner Sidor and seconded by Commissioner
Gilchrist to approve Z-1423. Motion carried 5 to 1.
B. Z-1425. This is the petition of Mr. James Dentico requesting a
change of zoning from Agricultural (A) to single Family (SF-.6)
zoning classification on a tract approximately 9.5 acres in size.
Mr. John Nar3utis representing Mr. James Dentico spoke in favor of
the request, statking that the lots would be very large and in to
way harm the adjacent area along Montecito.

Commissioner LaPorte asked Mr. Narsutis if it was possible that Mr.
Dentico was planning to develop the entire area of his first request.
Mr. Narsutis stated that he could only speculate about Mr. Dentico's
t plans and that he did not know for sure.

Robert Estes, principle of a nearby school, spoke in apposition to
the request.
Mr. Spurlock, owner of 3300 Carmel spoke in opposition to the
request stating that he felt that he felt Dentico was still planaing
! to develop all 40 acres of his first request and that Dentico's
! planning of streets was poor.
Paul Scheuler spoke in opposition to the request and asked all who
were opposed to the request to stand. Twenty-taro people stood
opposed to the request.
Lee Knack, owner of 3011 Carmel, spoke in opposition to the request,
stating that Hontecito would have to bear the,burden of the additional
traffic.
r Mrs. Dwayne Stevens of Forrestridge and E1 Paseo spoke in opposition
to the request, stating the streets would not ba ready to, handle the
'additional traffic.
Commissioner McAdams stated that the Commission was considering only
the requait for rezoning the property, and that the consideration of
ntrepts could later when they were platt:d.

Richard Holstrom of 3110 Carmel stated that he was opposed to the
request.
Mr. Narsutis spoke in rebuttal stating that he felt the nearby
residents were using traffic as an excuse, that the streets would
not be developed unless the property was developed, and that he
saw no reason for the request to be denied. '
Commissioner Brady asked tta Director of Publi: Works, Rick Svehla
about the safety of the streets. „ r '
Ritk Svehla stated that in a residential area, in a 24-hour period,
71000 vehicles is capacity - more tl•an that is dangerous. 11e
stated that with 40 more vehicles on the streets, in his opinion,
there would not be a hazard. He stated that if all 40 of the acres
were developed, and there were 3 cars to each home, and they all
left at the same time then the streets would be at full capacity,
however it would still not be a traffic hazard.
Motion was made by Commissioner Sidor and seconded by Commissioner
McAdams to approve Z-1425. Motion carried unanimously.

III. Considerations:
A. Consider the request of the v. D. Burch Estate for deannexation
t of approximately 63.6 acres of land.
Motion made by Commissioner Brady and seconded by Commissioner Sidor
to approve the request. Motion approved by 31 voted against by
one, and Commissioner LaPorte abstained.
B. Consider the final plat of the Summit.
Motion was made by Connaissioner Taliaferro, seconded by Commissioner
LaPorte to approve the final palt of the Summit. Motion carried
unanimously.
¢ C. Consider the final plat of Bethel Temple Church Addition.

Motion was made by Commissioner LaPorte, seconded by Commissioner
Brady to approve the final plat of Bethel Temple Church Addition.
Motion carried unanimously.
! D. Consider the final replat of Willowereek Addition Section 11.
Motion was made by Commissioner Taliaferro and seconded by Commissioner
Sidor. Commissioner Brady abstained, Motion carried unanimously.

Gentlemen:
It has come to my attentio: that there are several questions on the
Denton Good Samaritan financing on which you might like some
1 further elaboration.
f 1) The Ev. Lutheran Good Samaritan Society Is s, sound financial corpora-
tion and is not now nor has it been involved in any of the financial
problems associated with some of the nursing homes and retirement centers
recently headlined in the financial press.
The financial viability of The Ev. Lutheran Good Samaritan Society is
rl evidenced by the A rating given to its bond iss-see by Fitch Investors
Services which specializes in hospital and nursing home financings.
2) The viability of this particular project is assured by the fact that
the apartments and the nursing center are fully occupied and there is {
` a waiting list. This obviates any need fora feasibility study. 1
~i 3) Proceeds from this bond issues will be used exclusively to retire the {
outstanding debt of this facility in Denton. In addition, all revenues
j from this facility will stay in Denton. The Society operates its centers
on a decentralized basis. Each center has a local advisory board and j
funds are kept in local banks, The only funds paid by the Denton facility
to The Society is 2% to 2 112% for management, which includes all its data
processing, accounting, training, purchasing services, etc, which are
centrally managed to effectuate economy of scale.

Estimated Issuance Costs include some $43,500 for fees for band counsel,

printing, title insurance, other attorneys fees, trustee fees, etc. All
these are normal fees in any bond financing for public sale. The rest
of the Issuance Costs are the 4% underwriters discounts which include
all their expenses in preparing documents and structuring tha financing,
and of this 4% approximately 2 1/2% is paid to the salesmen who retail
the bonds. Piper, Jaffrey has done soma 27 bond issues with this
tiscount since 1945. The Society has concluded that it obtains better
coupon rates on its bonds by ceiling the bonds to individuals and
numerous financial institutions then by privately placing the financing.

WE, THE UNDERSIGNED, natural persons of the age of
eighteen (18) years or more, citizens of the State of Texas
and residents of the City of Denton, Texas (the "City"),
acting as incorporators of a public instrumentality and
non-profit corporation (the "Corporation") under the Texas
Housing Finance Corporations Act, having been granted auth-
ority by the governing body of the City as evidenced by the
resolution attached hereto as Exhibit "A", do hereby adopt
- the following Articles of Incorporation for the Corporations

of the Texas Housing Finance Corporations Act, i.e.,
exclusively for the purpose of benefiting and accomplishing
a public purpose of, and on behalf of, the City, by financing
the cost of residential development that will provide decent,
safe and sanitary housing for residents o' the City at
prices they can afford. It hasbeen determined and declared
by the Legislature of the State of Texas that such residential
development will (a) provide for and promote the public
health, safety, morals, and welfare; (b) relieve conditions
of unemployment and encourage the increase of industry and

commercial activity and economic development so as to reduce
the evils attendant upon unemployment; (c) provide for
efficient and well-planned urban growth and development
including the elimination and prevention of potential urban
blight and the proper coordination of industrial facil.cies
with public services, mass transportation and residential
development; (d) assist persons of low and moderate income
in ac;sir+,nq and owning decent, safe and sanitary housing
which they can afford) and (e) preserve and increase ad
l ! valorem tax bases of local governmental units; and the

Legislature of the State of Texas to lessen the burden of

The Corporation shall not have the power to make or acquire

These articles of incorporation may at any time and from
time to time be amended so as to make any changes therein
and add any provisions thereto which might have been included

such amendment shall be effected in either of the following
manners: M the members of the board of directors of the
Corporation shall file with the governing body of the city an
application in writing seeking permission to amend the articles
o3' incorporation, specifying in such application the amendment
proposed to be made, such governing body shall consider such
application and, if it shall by appropriate resolution duly
find and determine that it is wise, expedient, necessary or
advisable that the proposed amendment be made and shall
authorize the same to be made
and shall approve the form

the Corporation may amend the articles of incorporation by

of persons appointed by the governing body of the City. The

the costs of construction and design, The City will be
responsible for maintenance of the signals after they have
been completed. This maintenance will include such things
as the cost of power and any replacement parts. The

The Planning Commission reviewed this program at their meeting of October
17 and made the following recommendation to the City Council at their
November 6, 1979 meeting.
1) Plan Scooe and Planning Process

initiate a city wide land use planning program rather than just
the neighborhood study funded by our HUD grant. They further recommended
that we utilize the full scale citizen participation approach illustrated
by tho slide presentation presented at the joint meeting. The major steps

41 Type of Plan and Implementation. The Planning Commission considered pre-
sentation from the staff on the type of format of the plan and also con-
sidered some implementation strategies. They decided to discuss this issue
further and their recommendation will probably be presented to the Council
in December or early January prior to the first workshop.
a. Counril Action at the November 6. 1979 Meeting..
1) Budget.
` At the November 6, 1979 meeting, the Council approved the planning
program (including the subdivision update) budget of 47,900 which
will be funded from the current planning department budget and plan-
ning budget in the C.D.B.G. federal grant.
2) Planning Program Format and Schedule.
The planning program general format and schedule as recommended by
the Planning and Zoning Commission was approved as presented.
3) Decision on Committee Structure deferred until the December 4, 1979
meeting.
4) Decision on plan type and implementation policies defeered until later
Council meeting in December or early January prior to the first workshop.
II, Current Action Step
{ After approval of the Planning Program and budget, the naxt step in the
j Land Use Planning Program is the official establishment of the city wide
Land Use Planning Committee. The general makeup of the Committee was
established at the November 6, 1979 Council meeting in order to procaad
with advertising for the selection of the citizens at large category.
This selection meeting has been scheduled for December 17, 1979 and is
now being advertised through the utility billing,
Prior to this Ating, the Council must finalize the citizen at large
slots and se)..tion procedures. In addition, the other category of
participants 'the established agencies" must also be finalized in order
that invite ions can go out at least thirty days prior to the first
scheduled jrkshop which is scheduled in late January of 1980.

A, General Guidelines
U. The committee should be a general cross section of community development
interest.
2. There should be major participation by the Council and Planning Commission.
3. The committee size should be limited to 35 to 50 peopld so that everyone
will be able to participate fully and so that the staff can handle logistics.
The strategy for selecting the actual people on the committee is by self selec-
tion. That ia, a letter is sent to the organizations or boards inviting them
to send a representative to serve on the Planning Committee. The city resi-
dents at largo, developer intetest,and civic groups at large are selected by
advertising and holding a citywide meeting at which those who attend are grouped i
by the category and/or sector of the city in which they live,and theme groups
select their own representative.

Install approximately 2,925 feet of 6" and 8" water
main lines along Fort Worth Drive and down Mission

lines have been pressure tested and disinfected to the
satisfaction of the City's inspector and the Water and
Sewer Department. A one year Maintenance Bond has
been received from Turner Construction Company to

The City Council approved in thn 1979-80 Budget funds for
a manager of Denton Municipal Airport. The Airport Board has
reviewed several options for airport management and they are
recommending to the City Council that we contract with Aviation }
and Transportation Consultants to provide that management,
Aviation & Transportation Consultants is a consulting firm
composed of five individuals currently working in the aviation i i
industry. Under the terms of the proposed contract, one of
those five individuals will quit his
Denton to become a full-time airport manesent job mo to

individuals would serve in reserve to insure that the City of
Denton had twenty-four hour coverage. the City of Denton will pay to ATCg$16,500rper ryearr or 33% of ice,

FISCAL SUMMARY:

As mentioned in the previous paragraph, the City's obligga-
tion to ATC under the terms of this contract is $16,500 or 35y.
of the gross revenues (excluding taxes) to the City from airport
operations, The Airport would have to generate approximately
$50,000 in annual gross revenues before the 35% rule would go
into effect. Currently the Airport is pro acted to generate
approximately $20,000 in the 1979-80 fiscal year.
The proposed contract with ATC also has provisions requiring
expenditures by the City of Denton. The two expenses that are
most significant to our budget are the requirement for a full-time
maintenance man and the requirement for a vehicle, such as a pickup
truck, for the maintenance man and airport manager to utilize at the
airport. I have taken expenses required under the proposed contract

and combined them with the standard expenses that were budgeted
in the 1979-80 Airport Budget. Under the terms of the proposed
ATC contract, the cost for airport operations for the 9 months
of 1979-80 would be al-droximately $43,630. In the 1979-80 Budget
we have $34,984 budgeted for airport operations, which is $81646
short of the anticipated cost under the ATC contract. It should
also be pointed out that under the proposed ATC contract, based
on a full 12 months of funding, the proposed expenditures would be
approximately $51,328 per year. These projections are shown in
detail on the attached report entitled 'Cost Analysis of ATC
Airport Management Proposal".
ACTION REQUIRED: s
The City of Denton Airport Advisory Board met on Tuesday,
November 20th to consider the proposed contract with ATC for
management services at Denton Municipal Airport. It was their
recommendation that the City of Denton City Council enter into
n agreement with ATC to act as Airport Manager at Denton Municipal

The Airport Advisory Board and the City Staff recommend that

that the initial term of this contract is for one year to give
the City of Denton an opportunity to observe this management
concept in action and make a determination after one year i
whether or not we desire to continue with Aviation & Trans-

ATC proposes a full time Airport Manager, experienced both in FBO a

Denton and be on call 24 hours.

Since Orville Wright left the ground from the sand dunes of

has become essential in the economic growth of our society.' Air
commerce is the most vital link in providing a community with a
sound economic posture. Air transportation consists of Aerospace

the sites and all of the maters appear to be quite old, I have researched the

Consider the final plat of the Stratford Addition.
Summary:
The property owner seeks to subdivide a parcel of land containing approximately
5.9 acres for the purpose of constructing duplexes, triplexes, and four-plea
apartments.
Appropriate utility, drainage, and street improvement requirements have been
met.
j Recommendation:
1 The Planning and Zoning Commission unanimously recommended approval of this
plat at its meeting of November 21, 1979. The Planning, Engineering, and
Utility Departments have each reviewed the plat and recommended approval.
Action Required:
The City Council should move to approve the final subdivision plat of the
Stratford Addition.

1. Consider the minutes of the Regular Meeting of November
20, 1979 and the Special Called Meeting of November 27, '
1979.
2. Public Hearings:

A. Z-1423. This is the petition of Mr. Tom Jester
requesting a change of zoning from General Retail
(GR) and Single Family (SF-7) to Light Industrial
(LI) zoning classification on a tract approximately
13.9 acres in size. The property begins at the
northwest corner of the intersection of Woodrow Lane
I and Morse Street, and extends to the west along Morse
t 1 Street for approximately 800 feet, and extends north
along Woodrow Lane for a distance of approximately
970 feet. (Planning and Zoning Commission recommends
approval.)
B. Z-1425. This is the
petition of Mr. James bentico
requesting a change of zoning from Agricultural (A)
to Single Family (SF-16) zoning classification on a
tract which is approximately 9.5 acres in size. The i
property is adjacent to and east of the Montecito
subdivision with the western edge of the property {
