Regular Meeting of the City of Denton City Council, Tuesday,
January S, 1980 at 7t00 P.M. in the Council Chambers of the
Municipal Building.
1. Consider the minutes of the Regular Meeting of December
18, 1979.
2. Public Hearings:
A. Z-1426. This is the petition of Mr. Harry Friedman
requesting a change of zoning from Single Family
(SF-7) to Multi Family Restricted (MF-R) zoning }
classification on a tract approximately 9.75 acres in
size. The property begins approximately 750 feet
east of the intersection of Mack Place and East
McKinney Street and has approximately 654 feet of a.
frontage along the north side of East McKinney St.
(The Planning and Zoning Commission recommends
approval.) {
B. Z-1430. This is the petition of !*rs. Opal Brown
requesting a change of zoning from Single Family y
(SF-7) to Commercial (C) zoning classification on a
tract approximately 5 acres in size. The property is
located along the east side of Frame Street between
the Texas and Pacific railroad tracks and Paisley
Street. The parcel is more particularly described as
City lots 1, 10, and 11 of fllock 171. (The Planning
and zoning Commission recommends approval.)
~ C. Z-1431. This is the petition of Mr. Weldon H. Miller
requesting a change of zoning from Single Family

(SF-7) to Planned Development for Light industrial
use (PD) on a tract which is approximately 4.2 acres
in size. The address of the property it 1600 Wilson
Street and is the present location of aensley Packing
Company, Inc. Planned Develon-ant (PD) zoning Is
proposed for the continuation and expansion of the
product distribution operation. (The Planning and
Zoning Commission recommends approval.)

additional 70 days, that it might be that we can negotiate with the low bidder,

Shelter,
Assistant City Manager King Cole advised that new bids on the Shelter vase
received on Decomb er 11, 1919 from Devil Duffield Construction Cceepshq of Denton
at a bid of 1198,756, adding that this amount Is considerably above the 1100,000
budgeted.
The Architect, James Kirkpatrick, briefed the Council, go advised that
the Shelter could be built by phases and would to Phase 1,2 a 7.
City Attorney C. J. Taylor stated that be would doubt if the City can
legally negotiate with a low bidder. '

This is the petition of Mr. Harry Friedman requesting a change of zoning
from Single Family (SF-7) o Multi Family Restricted (MF-R) on a tract
approximately 9.75 acres in size,

The property begins approximately 750 feet east of the intersection of
Mack Place and East McKinney Street and has approximately 654 feet of
frontage along the north side of East McKinney Street,

few single family residences to the east and west, and across East
McKinney Street to the south.
The Comprehensive Plan indicates this area for Single Family development,
Multi Family development could have a negative impact upon the existing
Single Family homes in the area, however, these impacts are mitigated to
some extent in that this will be a low density apartment complex. The
apartment development will front along East McKinney Street, Locating the
higher density development along arterial streets is beneficial in that
the traffic generated by the apartment complex can be easily accomodated,
and will not have a significant impact upon the Interior streets of the
overall development. In addition, this location will offer excellent
access to the Central Business District and Loop 288.
Public Facilities are available for extension to the site and there is
adequate capaclty in the lines. The developer will have to extend the
sewer line approximately 4,400 feet from Loop 298.
The Planning and Zoning Commission recommends approval of Z-1426.

This is the petition of Mrs. Opal Brown requesting a change of zoning
from Single Family (SF-1) to Commercial (C) zoning classification on a
parcel approximately 5 acres in size.
Location:
The property is located along the east side of Frame Street between the
Texas and Pacific Railroad Tracks and Paisley Street and is more particu-
larly described as Lots 11 10, and 11 of Block 171.
Background:
The petitioner originally submitted a request for Light Industrial (LI)
zoning on this property which was denied by the Planning and Zoning
Commission on November 21, 1979.
Report: '
The Texas and Pacific Railroad tracks and Mingo Road are located north
of this site with Single Family housing to the south and east, and the
railroad to the west. The City Service Center is located about 400 feet
northeast of this tract along the south side of the railroad, and the
City Animal Shelter is currently located near the corner of Rose and Texas
Streets.
The Comprehensive Plan provides no guidance with respect to this property.
The proximity of the Railroad and the City Service Center tend to support
this request. The Railroad and Mingo Road form a buffer between this tract
and the housing north of Mingo Road, The Planning and Zoning Commission
considered the issue of a commercial use being incompatible with the existing
housing along Rose, Paisley, and Frame Streets. The site in this request
abuts approximately 9 homes along Rose Street, The Planning and Zoning
Commission considered the fact that some f the houses in the area ware
deteriorating and the apparent support i~ the nearby property owners for
the change. The Planning and Zoning Commission felt that this zoning
request would not significantly affect the deterioration of housing in
this area.
Regarding public facilities, utilities are available for extension to
serve the site and there is adequate capacity in the tines.
The Planning and Zoning Commission reconmends approval of Z-1430 by a vote
of 4 to 2.
(The Plaoning and Community Development Department recommended denial of Z-1430.)

January 8, 1980
Agenda Item:
Consider the deannexation request of Mr. William M. Johnson regarding
approximately 23.8 acres located east and north of the Montecito Del
Sur subdivision.
Summary:
The petitioner seeks to deannex this 23.8 acre tract which was part of a
250.28 acre parcel which was annexed and zoned Agricultural (A) on October
10 1975 (Ordinance 075-31). The annexation and zoning wa; initiated by
the Community Development Department.
The petitioner contends that the City has precluded reasonable development
of his property based upon the City Council's denial of Z-1425 (this was
the request of Mr. James Dentico seeking a change of zoning from Agricul-
tural (A) to Single Family (SF-16) on 9.5 acres which abuts this 23.8
acre site on th3 north).
` If deannexation of this parcel is permitted, an enclave without zoning
would be established. The City would surrender control over the type of
development which may take place and would retain subdivision review
authority only. Approval of this request would in all probability open the
door for similar requests whenever a property owner disagreed with zoning
decisions.
Fiscal %mmary:
The City would lose roughtly $600 to $800 per year as a result of deannexation.
Alternatives:

Recommendation:
The Planning and Zoning Commission unanimously recommends denial of this
deannexation request because the City should retain full development review
authority on land within the City,

WHEREAS, the Texas Legislature has enacted legislation
stating that it is the policy of the State of Texas to provide
rehabilitation and related services to eligible handicapped
persons to that they may prepare for and engage in gain ul

authorize programs to promote and expend employment oppor-
tmiities in the public and private sectors for handicapped
persons and to place such persons in employment; and

I have reviewed the information which was provided to the City
Council regarding various police reports associated with the
Denton Area Crisis Center. In the process of investigating
these incidents further, I have had conversations with Mr. Ted
Karpf and Mr. Dean Lamont, the President-Elect and current
President of the Board of Directors of the Denton Area Crisis
Center, They have allowed me to review their files, including I
various reports made to the appropriate funding agencies
{ regarding a number of these incidents. I have determined that
all of the reports relate to juveniles at the Juvenile Shelter.
None of the reports relate to activities involving the battered
wives program. However, because of the fact that both programs
are managed by the same agency, I do feel that an explanation is
required to explain the position of the Crisis Center with
respect to these incidents.
A large number of the incidents reported to the Police concerned
run-sways. It should be pointed out that residents at the
Shelter by juveniles is voluntary) they are under no requirement
j to remain at the shelter. Additionally, it should be noted that
f th funding agencies, the Department of Health, Education and
We.fare, and thv Texas Youth Council, require that, should a
youth leave the shelter without permission of the parent, a
run-away report must be filed with the Police Department. I am
i including for the Council's information the summary of these
incidents, and some written comments from the Crisis Center.
According to their statistics, the run-away rate for the Denton
Area Crisis Center Youth Services Center is significantly less
than either the Regional or National rate.
I reviewed a number of reports filed by the Crisis Center staff
with the Texas Department of Human Resources concerning other
incidents which occured at the Youth Shelter. I was also able
to review the monthly report filed after each regular inspection -
visit by the Department of Human Resources, I find that

generally the operation of the Youth Serviceas at h in
compliance with various State and Federal regulti
in those casns where non-compliance has been reported, steps
have been taken to bring about compliance.
I am also including for the Council's information a report
prepared by the Crisis Center which indicates the breakdown of
activities at the Service Center and includes a breakdown of the
C dispositions of the various individuals. Also included are
copies of the budgets for the various activities at the crisis
Center for the period of January 10 1980 through January 1, 1981.
In analyzing the various activities at the Youth Shelter, I
think it is important to keep in mind the fact that, without
exception, the juveniles that reside in this shelter from time
to time are individuals with serious problems.
They broken homes where they may have been subject to abuse, either
verbal of physical. By and large they are not to the point
where the criminal justice system needs to be involved) however,
this does mean that the potential exists for problems of the
sort which has been experienced at the Denton Center. With this
in mind, and recognizing that again none of the problems whielj
wore discussed with the Council relate to the shelter at all, I would respectfully recommend that battered wCity
Counoil consider approving the previously authorized funds for
disbursement to the Denton Area Crisis Center.
I have asked Reverand Karpf and Dean Lamont to attend the
Council Meeting on Tuesday to discuss with the members of tSre
Council any further concerns which you might have regarding
either of these programs. r have additionally requested
confirmation from them regarding the current status of their
reporting to the various other funding agencies from which the
{ Center obtains money. Additionally, I have requested that, in
the future, any requests for funds from the Crisis Center ought
to be submitted prior to
the formal
annual budget so that we might evaluate their request, Calong
{ with others that are received for City funds, We have also
discussed with the Roard Members the desirability of obtaining a
more adequate location for these activities in the future. As
this program continues as an on-going program, we ho that
funds can be obtained for this purpose.

REs Construction of a Pedestrian Walk on the South side of Willowwood
from McCormick to Kendolph i
I
At their December 12th meeting, the Citizens Traffic Safety Support Commission
discussed the possibility of providing some sort of pedestrian lane along
Willowwood. The Staff presented them with some figures indicating what they
felt would be the minimum cost. Since the Staff felt there would be some
question about property ownership, the cost included approximateey $1,000.00
dollars for surveying work and approximately $1,500.00 to $2,000.00 for asphalt,
making the total cost of the project about $2,500.00 minimum. These costs did
not include any labor charges since the labor will be done by the Street Depart-
ment if asphalt is used.
A more permanent walk could be constructed from concrete but the coat would 1n-
crease substantially. Currently, the sidewalk cost a minimum of $21.00 per
yard, and the total cost of the walk would be approximately $12,000.00 We
would probably also incur some right-of-way costs since we would want this per-
manent construction to remain when Willowwood was rebuilt.
In either case, the Staff has advised the Commission there are currently no s
funds for the project and although we feel that it is s good project, we would
have to recommend that it be considered for next years budget. j

consideration on the alignment of Bell Avenue that TWU has recommended,
At their December 12th meeting, the Commission at the request of one of its
members asked the Staff to review in a very preliminary manner the coat of
realigning Bell Avenue as shown on the proposed sheet, The Staff made a very
j rough estimate of the coat involved to realign Bell Avenue essentially north
of University to Sherman Drive. We have estimated the cost to be approximately
j $160,000.00 for actual street construction and a minimum of $400,000.00 for
right-of-way.
The Commission felt that this was a reasonable cost. They felt that this '
option was a viable alternative and certainly should be considered by the
Council.

1. Motion was made by Wilson TO APPROVE THE MINUTES OF OCTOBER 171 19791
Terry seconded the motion and it carried unanimously,
2. Removal of parking on the south side of Mulberry in front of the
teachers credit union was discussed. Motion was made by Tarry and
seconded by Hartney to recommend to the Council REMOVAL OF PARKING
ON THE SOUTH SIDE OF MULBERRY IN FRONT OF THE TEACHERS CREDIT UNION.
Motion carried unanimously.
3. Mr. Norman Sisk appeared before the Commission to request enlargement
of loading zones for school bus pickup at Ginnings and Davis schools.
After a brief discussion, a motion was made by Hughes and seconded by
Wilson to recommend to the Council that THE LOADING ZONE IN FRONT OF
1 GINNINGS ELEMENTARY SCHOOL BE ENLARGED TO A MAXIMUM OF 200'. Motion
carried unanimously.
Terry made a motion that was seconded by Hartney to recommend to the
Council that JEFFERSON DAVIS ELEMENTARY SCHOOLS LOADING ZONE BE EN-
LARGED TO A MAXIMIN OF 1011, Motion carried unanimously,
4. The Traffic Safety Supervisor spoke on the removal of parking on Coronado
between Locust and Bell Avenue. Motion was made by Wilson to recommend
i to the Council TO REMOVE PARKING FROM BELL TO LOCUST ON CORONADO ON THE
NORTH SIDE. Hartney seconded the motion, Motion passed with a majority
of the vote and one opposed.
5. Mrs, Susan Stein requested a loading zone for her business, Hairehitects,
at 105 Avenue A. Hartney made a motion to recommend to the Council that
the REQUEST FOR A LOADING ZONE FOR HAIRCHITECTIS AT 105 AVENUE A BE DENIED.
Terry seconded the motion and it carried unanimously,
6. Mr, Jim Carter requested that the speed limit be redu-ed on Bell Avenue.
After a brief discussion, motion was made by Wilson and seconded by Terry
to recommend to the Council THAT A REQUEST FOR LOWERING THE SPEED LIMIT
ON BELL AVENUE BE DENIED, Motion carried unanimously.
7. A pedestrian lane on Willowwood was discussed by the Commission and the
Traffic Safety Supervisor, After a lengthly discussion, a motion was 1
made by Terry and seconded by Hartney to recommend to the Council THAT

Consider a report concerning the development of districts for the single
manber district election plan,
Summary:
One of the proposed charter changes that will be decided in the January 19,
1980 election is the adoption of a single member district plan. The staff
has been researching the alternatives available for developing the four
districts.
Report_.
{ The first step necessary in developing alternative districting proposals
is to decide on a data source for population. In our case, the plan is to
use the existing precincts to avoid cumbersome administration of the
election and registration and so we need the population data aggregated
by precinct.
The first thought was to use the 1970 census data. Census data is available
for Denton for the City as a whole and also available in sub-geographic units
called census tracts. The census tracts are larger than the precints so the
first goal was to try to aggregate the precincts by census tract. Unfortunately,
there were significant descrepancies in the boundaries of the two units.
Census data is avialable to larger cities by a very small unit called blocks.
If this were available, the blocks could be aggregated by precinct, We
have learned, however, that the block data was not gathered for cities of
Denton 's size.
Since we are not able to utilize census data we have begun to look for
alternatives, There is a private company, Polk, that gathers data similar
to census data. However it is. the opinion of several people knowledgeable
in this field that polk data is not reliable enough to be useful in this
study.
The only real option the staff can forsee is the development of population
estimates by doing a housing unit count. This could, be accomplished
in several ways. We could drive the city and actually count the units; we
could count the units from aerial photos; and we could use water meter connections$

Receive report concerning the progress in forming the land-Use
Planning Committee.
Summary;
On December 17, 1979 the at large selection meeting was held at the
Civic Center, There was very good attendance of over 115 people.
Representatives selected that night are summarized on the attached
list. As a side note, the Planning Commission has selected as their
representatives Dr. Robert IaForte, Me. Lennie McAdams,
Mr. Andy Sidor, and Ms. Marilyn Gilchrist.
The Northwest sector and the Civic Group at large categories' repr6-
I sentatives were not fully resolved at this meeting. The Northwest
sector had poor attendance and, therefore, could only select one
representative. The Civic Group at large category was not finalized
in order to better define eligibility requirements.
The staff is preparing to; '
1) readvertise for a small meeting of interested people in the
Northwest sector of the City in order that we might get
three representatives from that area,
2) readvertise for a meeting to select the Civic Group at large
• representative. Selection criteria would be self selection
from the groups in attendance with each group provided one
vote. Groups eligible would be any group not otherwise
specifically designated on the Committee. Representatives.
of a Civic Group would need verification by letter from the
Civic Group that they are authorized by the membership to
represent the particular Civic Group.
We anticipate that the planning workshops will begin in the last week of
January,

The Council should appoint a Technical Review Committee to oversee staff

Over the last month the .Land-Use Planning Committee has been In the
organizational process. On December 21, 1979 letters went out to
established agencies to name their representative. These groups ~

In addition on December 17, the at large category of Developer Interest
and the at large category for City Residents ware selected. The work of
the Committee is to begin in late January or early February, and then
will be followed by two workshops in February, two in March, and then
will finalize the Committee work in April or May with the final two or
more workshops.
Action Recommended:
Appointment of three City Council Members to serve on the Land-Use
Planning Committee. Tu keep on the current schedule, appointment
needs to be made by January 21, 1980.

{ The first three methods are self explanatory, but the mail-in
registration should be elaborated on. When n
animal vaccinated, the voternarian gives the owner nar has
card to be forwarded to the City along with the registration
fee. The City, in turn, mails the registration card back to the
owner. If the owner fails to register the animal with the City
and the animal is found at-large, the owner is given a citation.

The responses on the efficiency of City registration were
generally good. Since it is not feasible to go door to door,
the cities admitted having Ies:i than 1008 registration.
However, they indicated that each year their registration
numbers increased,
'Fhe cities that have discontinr,ed the practice of registration
are Grand Prairie, Hurst and Irving. Approximately one year ago
the Animal Control Board of the City of Grand Prairie decided to
eliminate City registration. The Board wanted to place emphasis
on rabies vaccination, It was the Board's opinion that the
focal point of registration was rabies control and that the area
veternarian's records were sufficient. The procedure that was
implemented was a coupon system. If an animal is found at-large
without any rabies tags the owner is notified and must purchase
the rabies coupons from animal control In order to have the
animal released. The coupons are then taken by the owner to
area veternatians for redemption. The veternarians in Grand
Prairie cooperate fully with this procedure.
The City of Hurst had a number of problems with City
registration. Most of the problems that Hurst had were with
administration of the registration. The City had an elaborate
system of color coding tags by the twelve months of the year.
It was felt that this would enable an animal control officer to
spot an animal that had an expired registration tag. However,
they were confronted with problems in getting twelve
identifiable colors. Also, Hurst had problems with the issuance
of registration tags. Therefore, the City decided to abandon
registration.
The City of Irving eliminated their registration procedure six
years ago. In a survey, Irving found that each of the six area
veternarians vaccinated approximately 12,000 animals per year.
F The city issued only 1,800 tags per year. Irving therefore
concluded that citizens were having animals vaccinated, but not
registered. The City also felt that the procedure was difficult
to man. Since the veternarians were closer to the animal
vaccinations, the City felt that they were more effectively
handling the situation. In a cooperative agreement between the
City and area veternarians, it was decided that the City would
euthanize all animals and the veternarians would aid the City
with other problems, such as space.

Summary: This bid is for the purchase of 21 four door sedans to
be used by the Police Department. Eleven units will be
placed in the Patrol Division, eight units will be issued
to Criminal Investigation Division and two units will
be Administrative vehicles. We fo not normally replace
the complete police fleet at ont time, however this year
all vehicles came due at the same time. The Patrol units
are traded every year, the CID and administrative units
every three years,

R E S O L U T I O N
I
WHEREAS, the City of Denton, Texas and Aerosmith Denton
Corporation are patties to a lease agreement, dated August 360
1915 whereby Aerosmith is entitled to the solo use of sufficient
space in the Administration Building (also known as the Airport
Terminal Building) not to exceed fifty percent (SOt) of the
whole areal and
,
WHEREAS, under the provisions of the said lease agreement,
the City of Denton has the right to recapture, at its option, {
the use of the Administration Building under terms and condi-
tions agreed to by the parties and upon written notice to
Aerosmith at least ninety (90) days in advance of the effective
date of recapture; and
WHEREAS, the City Council of the City of Denton, up~on
careful consideration of the matter, has determined to *%arelas
its option under the said provision of the lease agreement to
recapture that Administration Building.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 1-38
r.ITY OF DENTON, TEXAS, THATt
1. The City Council of the City of Denton hereby determines
that the City of Denton should exercise its option to recapture
the use of the Administration Building as allowed by the said
Agreement.
7. The City Manager is hereby authorised to advise
Aerosmith Denton Corporation, by written notice, of the City of
Denton's intent to recapture the use of the Adminiatration
Building as allowed by the said lease agreements

Consider Award of Bid for Water and Sewer Line Improvements
for Cordell Street Sewer nine, University Drive to Cordell
Street Sewerline, and Northlakes Water and Sewer Line.
SUMMARYt
Bids were received and opened on the above subject water and
sewer line improvements, on March 19, 1980. The bids received
were very good (See Exhibit I) and well below the Staff's
estimate. The low bid received was that of Dickerson
Construction Company in the amount of $121,975.00. Mr.
Dickerson qualified his bid by stating that he would only
accept the contract on all sections of the proposed wo►k.
The bid was separated into five (5) sections in order to
allow the City the option of awarding contracts to the low
bidder on each section.
Mr. Dickerson further qualified his bid by adding a rock
excavation provision which calls for the City to pay an
additional $8.00 per cubic yard of rock excavation.
Negotiations with Mr. Dickerson have ret.ulted in a ctiling
amount of rock excavation not to exceed $21,600 (21700 cu.ft.
x $8.00)• (See Exhibits IV and V).
The low bids by section totaled $144,105.40 which is
$22,130.40 higher than the Dickerson bid. (See Exhibit II}. j
The Dickerson bids wore excluded from the low bid by section
determination as per the Dickerson condition to accept all
the projects. With the addition of $21,600 fcr rock
excavation, Dickerson's bid will total $143,575, which is
3 $530.40 below the total bid by section.

:he fifth (5th) section of the project involves the
j installation of approximately 723 feet of 8" sanitary sewer
line along Woodrow Lane to service the proposed dog pound. ,
= Section 5 will be administered by the Water and Sewer
Department but will be paid for with General Govetnment ;
funds. 1

RE: Windsor Drive Project
During construction of this project, it has been observed that there
is a em on the

Stuart Road and Windsor Drive. After a rain, the south gutter will pond
water from a point approximately 60' east of the intersection to a point
approximately 160' east of the intersection. This was probably caused by
water standing in this area during the sidewalk construction project last
s year which weakened the subgrade and caused the curb to sink. The problem
area includes 3 driveways and approximately 60 LF of curb and sidewalk.
I This drainage problem has and will continue to cause maintenance problems
} for our street department. I feel that the best solution to this problem
would be to remove the sunken driveways and curb and install new curb and
driveways at the appropriate grade.
