1. Consider the minutes of the Regular Meeting of February 5,
1980 and the Special Called Meeting of February 12, 1980.
2. Public Hearings:
A, Z-1408. This is the petition of Texas Instruments
and the Planning and Zoning Commission requesting
annexation of a tract which is approximately 314.9
acres In size, The property is located on the north
aide of Highway 77, adiacent and east of Bonnie Brae
Road. This tract has approximately 4,434 feet of
Highway 77 frontage, extending westward from the
Riney Road - Highway 77 intersection and Is
f contiguous with the centerline of Riney Road from the
f intersection of Riney Road and Highway 77 extending j
eastward for a distance of approximately 344 feet.

8. Consider disposition of approximately 1/2 acre of City
property located approximately 200 feot west of Willow
Springs Drive along the TPaL easement. (The Planning and
Zoning Commission recommends approval.)
9. Consider the final plat of North Lake Park Addition. (The

districts e+d to consider adopting an Ordinance creating the single member districts
under the Charter of the City of Denton.

City. He also asked that the Council not approve is plan designed by special
interests.

go with the City Attorney to tho Civil Defense Room to try to work out ma equitable
and fair districting map. Motion carried 1 to 1.

City Attorney Taylor-Besides the original rap, six other plans were
drawn.
Bill Midgett•-The original plan is not the best for a black citizen to {
win a Council seat.

why weren't all the people here tonight present at the o*IS nal meting last week.

McKinney Street and many are similar to the southow Denton area in income and

the map to the Justice Department?
City Attorney Taylor-The Charter, as adapted, state; one (1) at large j

the Tax Roll as submitted by the Tux Department. Notion carried.

g. The Council considered 714PA-Denton memorandum of Intent for an Economic
Dispatch Agreement.
Utilities Director Bob Nelson advised that the City of Denton is partici•
psting with other member cities of TWA in a program lmown as Econonia Dispatch.
In this operational mode, the fou.• cities dedicate their gererators to a camnott
enr..rating poo1. A computer program Web is based in Garland and adnSniatered
the Dispatcher in Crrland reviews the total electrical requirements of the four
ties and then puts the maxLmm amount of IoM on the most efficient unit in the
system, and the next increment of load on the second most efficient unit and so on
down to the less efficient milts. This program has been saving the City of Denton
between $10,000 and $30,000 per month.

9. The Council considered participation in oversize of a 12" water line an

Utilities Director Bob Nelson advised that Financial CornsultVig, Inc.,
is developing a site on the west side of Stuart Road and the north side of Hercules.
The City is requirln9 the water line to be a U1 main and will participate in the
difference between a 12" and an B" line required to serve Financial Consulting, Inc,
The City's cost is $3,929.

Utilities Director Bob Nelson advised that the Denton Baptist 04tociation
is decaloping a site on the south aide of Hobson lone and east aide of Carmel Street.

iated right-of-way from Brazos Electric Power Cooperative.

Utilities Director Bob Nelson reported that the City of Denton has been
negotiating with Brazos Electric Cooperative for some time to ppuurrchase their old
69 kV lira that rues (ran the Stem Plant to the Dental, North SUbatstion. They
have agreed to sell the 30,500' line for S12,00. Pods will come (ran the 109•su
eperat.on budget.

69 RV line from Brazos Electric Cooperative. Motion carried,

1. The Council considered an atppppeearance by Ms. Ruth Sweeney relative to
her request for a variance from the Aniral Control Ordinance prohibiting the
keep:ag of goats within the City limits.
City Attorney C. J. Taylor advised that on January 28, 1980 Animal
Control Officers issued a letter of warning to hrs. Ruth Sweeney of 7120 Emerson
allge¢ing a violation of Article I, Section 4-5 of the Animal Control Ordinance
%hirh prohibits keeping certain animals in the city within 200 feet of an
oc vpied building. Mr. Taylor added that Ms. Sweeney had contacted his office
seeking a variance froa the Animal Control Ordinance and that he had discussed

Identity and lccation: Z-1408:
This is the petition of the Planning and Zoning Commission requesting
annexation of a tract which is approximately 314.9 acres in size. The
property is located on the north sides of Highway 77, adjacent and east of
Bonnie Brae Road. This tract has approximately 41434 feet of Highway 77
frontage, extending westward from the Riney Road - Highway 77 intersection
and is conti,uous with the city limits approximately in the centerline of
Riney Road. This property is owned by Texas Instruments.
Background:
Some time ago Mr. Dale Cunningham, representing Texas Instruments, petitioned
the City of Denton for annexation and Light Industrial (LI) zoning
classification on this property. After the annexation and zoning process
was apparently completed, an error in the property description was discovered
which rendered the entire annexation and zonin invalid. Moreover, the
City Attorney has now promulgated a procedure for annexation and permanent
zoning which deviates somewhat from previous practice.
The only issue before the City Council is whether or not to annex this
314.9 acre tract. A public hearing on the permanent zoning of this
property will be scheduled for a later date.
Report and Planning Commission Recommendation:
This tract is located in an area which is predominantley undeveloped, There
f is a drive-in theater located on the south side of Highway 77 across from
this property, and there are several homes located near the southeast
corner of the tract. The remainder of the area surrounding this property
is typically in agricultural or very low density single family use,
The property itself is bisected by the proposed corridor for Loop 288,
and there are two major easements for electrical service on the property.
{ Water and sewer utilities can be extended to the property and there appears
to be adequate capacity for most uses.
The Planning and Zoning Commission unanimously recommends this property f
for annexation. ;

As a result of the City Council meeting of January 22,
1)80, we are writing on behalf of Scott Instruments Corporation
(the "Company") to address certain of the concerns expressed
by the City Council in connection with the Company's proposed
industrial development bonds (the "Bonds")t '
1. Public funds. No public funds would be involved in o
the propose nano ng. The Bonds would be sold exclusively to
bank purchasers. As required by statute, neither the City nor
the proposed City of Denton Industrial Development Corporation a
(the "Corporation") would be liable for any interest or principal
of the Bonds nor would the Bonds constitute any charge against the
general credit or taxing powers of the City or the credit of r
the Corporation. In addition, the Company would[ at the time of
closing, reimburse the City and the Corporation for any out-of-
pocket expenses incurred in the transaction.
2. Bond rating. The proposed transaction would be
unlikely to`-`eve ay n effect on the City's bond rating, because
(a) the Bonds would be directly placed to a few banks and would
never reach the public market and (b) the investment community c.
recognizes that the only credit determination is with respect to
the Company and Et V, Scott, the proposed guarantor of the Bonds.;
The enclosed item from The Wall Street Journal, which does not
even indicate the names o t e mun c pa issuers, is instructive
' in this regard.

3. City "lender of last resort." The prospective bank
purchasers are genera y rn eren a ween lendit,g to the
Company at a 11% taxable rate or an 8.56 tax-exempt rate. The
Company would obviously prefer the latter alternative, which,
according to statute, requires the vehicle of an industrial
development corporation. in other words, the Company is not
seeking to bolster its credit position by using the City; it is
only attempting to follow a statutorily mandated structure for
such tax-exempt financing.
4. Absence of securi~y. The Bonds will be secured by a
pledge of t He can payments made by the Company and by a lien
on the land, building and equipment acquired with the proceeds
of the Bonds. The guaranty of E. V. Scott serves as additional
security. The various bank purchasers - the only persons who
will commit funds - presumably would be satisfied with the
security or would not decide to purchase the Bonds.
5. Creation of car oration. Creation of the City of
Denton Indust' rialbeve opment Corporation is a riskloss act for
the City. The Corporation is created at no expense to the City
and would be available to be utilized for projects in addition
to, or in lieu of, the Company's proposed financing. The City t
Council could decide subsequently to dissolve the Corporation,
if it so desired. Creation of the Corporation would not imply
that the City agreed to the proposed financing or even endorsed
the concept of tax-exempt financing. Under the statute, the
j authorization and approval of the City Council is requested at
two subsequent dates; (1) passage of an inducement resolution
authorizing the Company to proceed with the project and (2) after
E approval by the Texas Industrial Commission, passage of rosolu- j
tions authorizing the actual issuance of Bonds. ;
As indicated during the January 221 1980 meeting, the
Company would be pleased to submit any additional information
which the City Council or Firs L• Southwest Company deems necessary.
! Having received no such requests to date, we have assumed that
i the City Council would be willing to consider a proposed resolution
to create the Corroration at its next meeting, which we understand
will be held on February 12, 1980, Tho form of such resolution
has previously been submitted to you and to the City Council.

SUMMARY: }
In the 1977 Bond Issue, the citizens of Denton authorized the
expEnditure of $772,000 to build an addition to the Emily
Fowler Public Library. The Library Director and the Library {
i Board have been working closely over the past several months
with the Architect, Dwayne Landry, to develop the plans and
specifications for that addition to the Library. The
architect will have those plane and specifications to us on
Monday, February 18, and we will hand-deliver them to the 6
Co>ancil on that day so they will have an opportunity to see
them prior to the Council Meeting. The Library Board will be
in attendance at the council Meeting in Tuesday, February 19th
to give their recommendation to the City Council.
FISCA% SUMMARY:
The City Council was given a briefing at their meeting of
January 151 1980 on the fiscal cor,dition of the Library Bond {
Issues It was pointed out at that meeting by the architect
that the effects of Inflation had raised the estimated cost of
the building to $960,460. This amount exceeds the $972#000
authorized by $188,460, At that meeting, we discussed with
the Council the possibilityp of issuing certificates of
Obligation to make up the additional cost necessary to build
the building as originally proposed to the voters, j

STAFF RECOMMENDATION:
The Library Staff and the Library Board have previously
recommended to the City Council that, if at all possible, the
building be built as proposed by the architect and that steps
3 be taken by the City Council to raise the additional funds
necessary to complete the building. The schedule of events if
the City Council approves the plans and specifications and
accepts the recommendation of the Library Board will be as ;

Re: Recommendations on naming of Parkside Drive and its possible
connection with Windsor.
At the Development Review Committee meeting of February 6, 1980
the staff reviewed this subdivision and found almost all things to
be in order. The Fire Department recommended that the furthest
Street west in the subdivision have the same name throughout. The
Development Review Committee recommended this approach unanimousla.
The developer has submitted a letter asking for the street in his
subdivision and part of the existing street at University Drive (Gay
Street) to be permanantly named Parkside Drive. The developer's
letter is attached. The City Council needs to rename the Existing Gay
Street and approve Parkside Drive in the subdivision, or it it takes no
action in renaming Gay Street we will advise the developer that his
street must be named Gay Street.
As the City Council may recall at prior meetings of zoning in this area,
one main opposition of residents in the Georgetown area was that
Georgetown would become a new route to the park. If the developer
i develops this first part and connects Parkside Drive with Windsor,
Georgetown may be used by some residents to get to either Auburn or
Bowling Green, and then Parkside Drive to get to the park. The
Engineering staff feels strongly that the connection with Windsor
should be made. We would suggest two alternatives to the City Council.
i We have discussed both of these requests with the developer; he has
indicated a strong desire to accomplish the first alternative and has
reluctantly agreed to the second.
The first alternative would be to go ahead and make the connection between
Parkside Drive and Windsor. The developer feels that this will make a
better selling point for his development and he also feels this will
¢ provide an alternate access to the development. He stated that he will
make a diligent effort to ask all of his contractors to access development
from Windsor Drive.
3 If the City Council moves to make the connection and if traffic
i Increasesdrastcally, the street could always be barricaded and in
effect become a dead end street until Parkside Drive is connected to
Gay Street.
The second alterantive and one that the developer has reluctnatly agreed
+ to would be to construct Parkside Drive only part of the way toward
Windsor, and then the City could build a small section of street to
connect with Windsor when Parkside Drive is connected to Gay Street.

t Please be advised we wish to retain the name Parkside
j Drive for the most westerly street in our North Lake Park

i Parkside Drive extends south from Windsor approximately
2,700 ft. at which point it joins with Gay Street, which runs
another 300 ft. to University Drive.
We understand the Fire Department would like to see same
continuity of name, therefore we would request that you change
the name of Gay Street to Parkside Drive.
We wish no disrespect to former councilor Gay, but 6e do
have to recognize that society has foisted upon us a certain
I connotation that is associated with the word Gay. Therefore,
i the name Parkside Drive is much preferable as the street runs
parallel with North Lakes Park and the name Parkside Drive is
i entirely consistent with the location of our subdivision. We
also feel future homeowners would prefer to live on Parkside
Drive ratter than on a street named Gay Street.
Therefore, may we respectfully request that (1) the name i j
Parkside Drive be recorded on our final subdivision plat, and {

Construction Company, the apparent low bidder on the
project. Howerer, the Missouri-Pacific Railroad Company

which the compp.ny maintains specialized crews. The
Railroad Company's portion of the construction needs to
be completed prior to the commencement of Kidwell
Construction Company activities. It is estimated that
the Missouri-Pacific Railroad Company could begin construc-
tion within forty-five {45) to sixty (60) days from
Notice to Proceed.

CONTRACT FOR CR?DE SEPARATION
THIS CONTRACT, made and entered into this day of , 19
by and between the CITY OF DENTON, TEXAS, a municipal corporation of the State of 'texas,
hereinafter called "City", and MISSOURI PACIFIC RAILROAD COMPANY, a Delaware corporation,
hereinafter -.tilled the "Railroad", covering the construction and maintenance of an
underpass grade separation structure, replacing an existing underpass structure, located
at Robertson Street in Denton, Denton County, Texas, and also known as Railroad Chain-
age Station 11062+33.06 on Railroad's Red River Division, Whitesboro Subdivision, to
accommodate two vehicular traffic lanes and two pedestrian walkways beneath same.
WITNESSETH:
ARTICLE I - GENERAL
1. The separation of grades on said highway and said track shall be effected by:
(a), the preparation of all plans for roadway and grade separation
structures;
j (b) the construction and removal of temporary falsework for the pro-
tection of railroad traffic during the construction period{
(c) the construction of a new underpass structure to carry Railroad's
track over and across proposed roadway and the subsequent removal
of the existing underpass structure;
(d) the construction of new roadway and drainage facilities therefor
and of all incidentals thereto including, but not limited to, walk-
ways and retaining walls;
(a) the temporary removal and restoration of Railroad's or Railroad's
lesseea' or licensees' facilities made necessary to permit the con- i
strjction of the proposed roadway improvements and the resdoval of
the existing underpass structure; and .
j
(f) the acquisition of all needed right of way for the work outlined above.
i All of the above is hereinafter collectively referred to as the "Project".
The underpass structure carrying the railroad track over and across, Robertson
S Street shall be constructed generally in accordance with plan marked Exhibit "A", con-
I sisting of three sheets, attached hereto and made a part hereof.
3. Detail plans, specifications, and construction procedure, or any changes
therein, of any work involved in the Project shall be subject to the approval-of the
City's Engineer and the Railroad's Chief Engineer.

4. Railroad has determined that purchase of insurance coverage in the amount of
$1,000,000, combined single limit per occurrence, is required to provide tdequate pro-
tection against risks incident to the employment of labor engaged in making changes in
Railroad's facilities required by construction of the Project. The rate to be paid for
said liability insurance is ,10.50 per $100 of labor payroll.
ARTICLE II - RAILROAD WORK
Railroad agrees to furnish, or cause to be furnished, all material and labor and
to do the following work as the progress on the construction of the Project requires,
and in accordance with the plans specifications and construction procedures should it
be necessary to perform any of the following work by contractor, the Railroad may so
arrange, subject to prior approval by the City:

1. Railroad hereby conveys to the City, its successors and assigns, without pay-
ment of separate or additional compensation, solely to the extent of its right and
authority to do so, without any warranty, express or implied, the right, license and
permission to establish, construct and maintain that portion of the roadway and drainage
facilities shown on Exhibit "A" - detail plans - which involves Railroad right of way i
` as indicated by heavy dark line on Exhibit "B", attached hereto as part hereof; reserving,

t howeve+•, to Railroad the right to maintain, operate and renew any existing telephone,
telegraph, power and signal lines and poles, tracks, roadways, pipe lines and facilities
of similar character now located on said premises and the right to hereafter construct
and install additional facilities of the aforesaid types or necessary appurtenances
thereto, provided such changes do not materially interfere with the use and maintenance
of the roadway or drainage facilities set out above.
2. Railroad shall provide inspection, flagmen and protective services and devices
from time to time as, in the opinion of Railroad, may be required for protection of
Railroad's traffic and operations and for prcper inspection of work. Cost for flagging
and other protective services attributable to work by City's contractor as provided in
Article III hereunder shall be billed monthly to the City.
3. Except as otherwise provided in this contract, relocate or rearrange any of
its or its lessees' or licensees' facilities made necessary to permit the construction
j of the Project, but only insofar as it has legal authority to do so.
4. Place existing signal and communication lines underground and make other neces-
sary adjustments to signal and communication facilities.
5. Vnload ballast and raise the main track and Track No. 4 a maximum of 0.9 foot
between Railroad's Chainage Stations 11059+00 and 11068+00.
6. Construct, or cause to be constructed, and maintain falsework to conform to
"Stage r Falsework" as shown on detailed plans.

7. Subsequently temporarily remove section of main track and part of (alsework
as required to permit installation of the new underpass superstructure.
8. Upon completion of the installation of the new underpass superstructure restore
the main track to service and alter falsework to conform to "Stage II Falsework" as shown
on detailed plans.
9. Restore signal and communication lines to permanent poles to conform co the
Project.
10. Furnish to City three seta of plans and detailed estimate of costs which shall "
set out separately the cost of insurance as provided in Paragraph 4, Article I, and the
work outlined in Paragraphs 2 through 9 above, including costs of plans and preliminary
engineering.
11. The estimated cost of carrying out Railroad's work is ~ w 0, 470.O 0.
12. Maintain the superstructure of said underpass structure and all Railroad
facilities involved in the Project, except that City shall assume the repair costs on
damage to beams and deck caused by highway traffic. In the event of damage to beams
and/or deck by highway traffic, the extent and method of repairing shall be agreed upon
by the City and the Railroad.
13. Reimbursement to the Railroad will be made for work performed and materials
furnished, including, but not limited to, insurance premiums and Poverage at the rate
and amount set forth in the approved coat estimate, in accordance with the provisions
of Federal Highway Program Manual, Volume 1, Chapter 4, Section 30 dated October 25,
1974, issued by the Federal Highway Administration, and amendments thereto, which by
reference are made a part of this agreement.
14. The Railroad may submit monthly bills prepared in Patisfactory form for work I
performed in compliance with this agreement provided the coat to be billed exceeds $500.
Upon receipt of said monthly bills, the City will make a payment to the Railroad. The
amount of such payment may be up to 90% of the cost of the w1)rk performed and as covered
by said bill. Subsequent to the final audit the City will make final payment to the
Railroad for work performed and materials furnished in accordance with this agreement.
ARTICLE III - CL1f WORK
City agrees to furnish or cause to be furnished ail materials and labor and to do
the following work as required by the progress on the construction of the Project std
in accordance with plans, specifications and construction procedures
1. Secure all needed right of way for the Project, except as otherwise provided
in Paragraph 11 Article it hereof. j
2. Prepare detail plans of the proposed roadways, grade separation structure, i
drainage facilities, including all incidentals therefor.

3. Construct said proposed Grade Separation, Robertson S,:rtet underpass and
remove existing underpass structure. Construction and removal work shall conform to
Railroad's standards for both materials and workmanship.
4. Construct retaining walls, roadway and walkways, Robertson Street.
5. Backfill Railroad embankment behind abutments and'retaining walls in accordance
with Railroad's standards for material and workmanship.
6. Require its contractor to notify the Railroad and arrange for protective
services required by Railroad for the protection of its property and operations under
the situations anc conditions as set forth in Exhibit "C" attached hereto and made a
part hereof. Costs to be paid by the City shall be determined on the basis of rates of
pay and other related costs actually in existence at the time protective services are
furnished. The schedule of present rates of pay and other costs and information related
thereto is included in the aforementioned Exhibit "C".
I 7. Require its contractor, in respect to its work performed upon, over, under or
about Railroad's right of way, to provide Railroad Protective Liability Insurance in the
1 form as set forth in Federal Highway Program Manual, Volume 6, Chapter 69 Section 21
Subsection 2, dated October 25, 1974, issued by the Federal Highway Administration, as
amended, on behalf of Railroad as the Insured, in the amount of $2,000,000 combined single
limit per occurrence during the policy perioA.
8. Require any of its contractors, in respect to his work performed upon, over,
or under Railroad right of way and tracks, to provide Workmen's Compensation and
Employers' Liability Insurance in statutory limits, and Public Liability insurance
providing for (1) a limit of not leas than $500,000 for all. damages arising out of
bodily injury to or death of one person and (2) subject to that limit for each person,
a total limit of $1,0000000 for all damages arising out of bodily injuries to or death
e of two or more persons in any one occurrence; and Property Damage Liability insurance .
providing for a limit of not less tian $500,000 for all damages arising out of injury
to or destruction of property in an., one occurrence and, subject to that limit per
occurrence, a total or aggregate lit,it of $1,0000000 for all damages arising out of
injury to or destruction of property during the policy period. Said property damage
_J coverage must by endorsement also be rendered applicable to any property damage which may
result from collapse, explosion or underground property damage hazards as defined in
such insurance policy which may occur in the performance of said contractor's work as
described herein.

9. Reimbura,, Railroad for the actual cost of the work performed by it or its can-
tractor, as outlined in Paragraphs 2 through 90 inclusive, of Article II and insurance
costs as provided in Paragraph 4, Article I. The City agrees to reimburse Railroad
monthly pursuant to Pzragraph 14 of Article It and upon receipt of its final itemized
i statement 90 percent of the bill, subject to final audit by the City. Upon completion
of final audit, the City shall reimburse the Railroad for tt.a retained percentage of
i expense less ..n.y amount found through audit to be ineligible for reimbursement. If the
t audit re%oaals that Railroad has been overpaid, Railroad will immediately refund to Llty

10- Upon completion of the work, remove from within the limi,s of the Railroad's
right of way all machinery, equipment, surplus materials, rubbish or temporary buildings
and leave, the right of way in a neat condition satisfactory to the Chief Engineer of the
Railroad or his authorized representative.
11. Maintain the substructure of the underpass and all highway facilities involved
in the Project.
ARTICLE IV
1. The cost of all work herein agreed to be performed by the City and the Railroad,
respectively, shall be included in the total cost of the Project, and said total actual
4 cost shall be assumed, borne and paid by the City.
2, The City assumes the entire responsibility for the construction, improvement,
maintenance and use of said underpass structure, approaches, pavement and drainage
facilities, located upon the Railroad's property and right of way; and nothing herein
shall ever be construed to place upon the Railroad any manner of liability for injury to
or death of persons or for damage to or loss of property arising from or in any manner
connected with the construction, improvement, maintenanco or use of said underpass struc-
ture, approaches, pavement and drainage facilities, located upon the Railroad's property
and right of way; provided, however, except as otherwise hereinabove provided with
regard to damage resulting from highway traffic, the Railroad accepts responsibility for
the maintenance of the aforementioned superstructure.
3. Thu undertakings herein are solely between and for the benefit of the parties
hereto and shall not affect any agreements or arrangements between either party hereto
and any other person, firm or corporation.
4. The City, when returning this agreement to the Railroad (duly signed), shell
a cause same to be accompanied by such order, resolution or ordinance bf the City's governing''
t body, passed and approved as required by law, and duly certified, evidencing the authority
of the person executing this agreement on behalf of the City, and further certifying that
funds have been appropriated and are available for the payment of the total cost of the
Project, herein agreed to be paid by the City.

This is to advise that Railroad's requirements for flagging, and labor
cost in connection with the project, which may be necessary with rer,pect to work
to be done by City's Contractor, are as followsi
1. The services of one (1) track foreman, or assistant track foreman,
or other Railroad employee qualified to protect Railroad's operation
in accordance with Railroad's rules, will be required during any
construction operations involving direct interference with the
Railroad's tracks or traffic, the fouling of railroad operating
clearances or reasonable probability of accidental hazard to rail-
road traffic. Services of additional Pailroai personnel for flag-
ging protection will be required whenever, in the opinion of the
Railroad's Superintendent, or his authorized representativep such
protection is needed.
2. The rata of pay per hour for each man will be the prevailing
h.,irly rate in effect for an eight-hour day fcr the class of men
-.s3ed during regularly assigned hours and overtime in accordance
with labor Agreements and Schedules in effect at the time the work
f is performed. The current hourly rates of pay area Track foreman
$8.6476, Assistant Track Foreman $8,1563, and Others $7.5398. In
addition to the cost of such labor, the following charges will be
included, computed on the actual payrolls
{
(1) Vacations 6.50% to Direct Labor
(2) Paid Holidays 3.50% to Direct Labor
(3) Railroad Retirement 6 Unemployment 15.25%tDirect Labor Plus

{ (4) Supplemental Sickness 1.00% to Direct Labor Plus
Vacations and Holidays

One and one-half times current hourly rate is paid for overtime.
Saturdays, and Sundays; two and one-half times current hourly rate
for holidays,
Wage rates are subject to change, at any time, by law or by
agreement between the Railroad and its employees, and may be
retroactive as a result of negotiations or a ruling of an'
authorized Governmental Agency. Additional charges on labor s
are also subject to 5hange. If the wage rates or additional
charges are changed,' the Contractor shall pay on the basis of
the new rates and nev charges.
3• A rininum of one hour travel tine per day per man will be required 4
for travel to and from project, plus rental of equipment for a
minimum of one hour per day used to transport such men, a

4. Arrangements for flagging Are to be made at least seventy-two
(72) hours in advance of commencing work on Railroad's property
with Railroad's Superintendent, Mr. R. B. King, whose office
is located at Longview, Texas.
5. Details regarding train schedules and operations, required or
desired by City's Contractor, may be obtained from Railroad's
Superintendent, Mr. R. B. King, 905 East-Pacific, Longview,
Texas 75601. His telephone number is 214-752-6914.
6'. City is obligated to reimburse Railroad for flagging servical
monthly bills will be submitted.
7. Reimbursement to Railroad will be required covering the full
eight hour day during which any flaps is furnished, unless he
f can-be assigned to other railroad work during a portion of such
day, in which event reimbursement will not be required for the
portion of the day during %*ich be is engaged in other work.
Reimbursement will also be required for any day not actually vc,A.ed
by said fla.gmaa following his assignmeat to work on the project
for which Railroad is required to per flagman and which could rr'.
reasonably be avoided by the Railroad Company by assignment of such
1 fleme. to other work, even though the contractor may not be work-

$21,827.76.
This purchase order numbar 42164 to IBE Industries in
Summary: the amount of $216827.76 is for 24,720 gallons of 02
Diesel fuel at 0.883 per gallon. This fuel was purchased
to replace fuel used by the Municipal power plant during
curtailment by tone Star Gas on 1/91/80 end 2/1/80. The
current fuel situation makes bidding an impossible task.
Fiscal Summary: The funds for this purchase have been approved in budget
item 02-51-82-02. The price for this purchase is some
5.7C below last diesel purchase price.
Action Required: Approval by the Council

ground distribution system. The material is warehouse
inventory replacement.
Fiscal Summary: The funds for this purchase will come from the warehouse
inventory replacement account 05-98-87-08 and be charged
to the department as it is used or changed out. The q,tan-
tities purchases are estimated to last six to eight months.

Summary: This purchase order is for an additional computer terminal
and disc controller to be used by the police department in
conjunction with the national crime information center in
Austin and Washington D.C. Currently only one terminal is
available therefore should our Police Department be sending
information they are unable to receive information and of
course the opposite is also true. When this conflict of
information flow occurs which is quite often, our police
department must rely on infcrmation relayed by the telephone
from the Sheriff Department or TWU police. The price of
$4000.00 is for a used terminal, compatible with our exist-
ing system and includes complete installation. The estimated
cost of new equipment is approx. $13,000.0n. +
Fiscal Summary: The funds for this $4000.00 purchase were not included in
the 1979.1980 budget. By re-arranging priorities an inter
departmental budget transfer will place sufficient funds into
account number 01-40-91-07, Police administration misc.
