have the permit for water rights, adding that Aubrey water will not rated to be
pumped but will flow by gravity to Denton. Y

At this point mayor Nash reed a proclamation proclaiming "Aubrey Reservoir
Day In Denton". He said that this is an expression of gratitude of former CoL=il
Members, fanner Utilities Board Members ud Denton citizens who have and will
continue to support the Aubrey project.

8. The Council considered the disposition of property adjoining the right
of way proposed for the Mingo Road extension.
City Planner John levretta briefed the Council advising that in 1977 the
City acquired t parcel of property denoted as Tract 1 a;~ Tract I on the enclosed
map. These tracts are located between &I1 Avenue and the Wr Railroad tracks and
are just south of Vine Street. The property was acquired to permit the extension
of Mingo Road co &11 Avenue, We haw had a request fray an adjoining property owner
to pwaasa Tract 1. The Planning and twine Crnmission reviewed this request at
their cast meeting Tract 1 will not be needed for the extension of Mingm Road and
there are no utilities located on the property. The Staff cannot forsee a potential
Cityy use for the property and the Pluming and ZmIng Connission recommended disposition
of Tr.nct 1. The Staff believes the property is independently developable.

Intersection.
' Rick Svehda briefed the Council, stating that the Traffic Safety S+~pott
Coimission reviewed this inter,,ection in relation to signal needs at its Octoobbeerr
nesting. A new traffic tratt was made and accident histories were reviewed. The
intersection does not meet tenants or requirements to establish a signal at this
intersection. Comanity Davelgernt is working through its demolition prooggrrn to
see if it is possible to roaove the building on the south west corner of this
intersection which would improve sight distance. The Highway Department bas been
contacted as to the status of a request made by former Councils for a sigrulissd
tall crossdns just most of the intersection. As of this date, we have not received

SUBJECTt Single Member District Plan
When we added the figure for District l as proposed by the
N,A,A.C.P. we discovered that the district would have
approximately 15,000 population. This would make the other
three districts have approximately 11,500 each. They did not
include in their calculations the dorm residents (students) at
North Texas State University.
I met with Rev. Mark Chew, Jr. Thursday morning and he took our
information and a map for a meeting in his area Thursday eight.
He informed tae that they would have their recommendations in my
office by 9130 A.M. on Friday. Until then we cannot complete
the District plan for submission to the Council.
We will deliver to you the completed plan and ordinance late
Friday afternoon.

PRESENT: Mayor Nash, Mayor Pro Tom Stephens, Members Hensley and Vale;
City Manager Chris Hartung, City Attorney C, J, Taylor and
City Secretary Brooks Holt.
ABSENT: Council 4ember Stewart.
1. The Council considered a Publi: Hearing on the creation of
the single member districts and adoption of an ordinance creating the
single member districts under the :barter of the City of Denton,
City Attorney C. J. Taylor briefed the Council relative to
the drawing of the J districts.
Council Member Volt asked if he thought the plan would be
accepted by the Justice Department.
Taylor answered that he did not know at this time, but that
input by the citizens tonight will have an impact,
Mayor Nash opened the public hearing,
Revetend M. R. Chew, Chairman of the Political Action Comm•
ittoe of the NAACP, who lives is District 1 of the City of Denton, ask-
ad the Council to consider an alternate plan that is in the frame work
f the one devised by the City of Denton Staff. His alternate pplan
he added that there the two still would be approximwould be ately 12,000 popular ion In
each of the four Districts.
Poyyo Gonzales local businessman, stated that he was not
j opposed to eh1 districting, but that he would like for the Mexican
Americans to have their own district, but that he knew that there was
not enough of them to have their own district.
Carl %illiams, President of the Denton chapter of the 'MCP,
{ advised that the Closing of Dreamland caused the dispersing of FOOT
II black residents :a the low rent college site housing, He said "the
black ma)ority desires to have a council member who sometimes laves
into our district, sometimes attends church with us, sometimes e.ts
barbeque with us and sometimes comes to our park to play basketball
with us". He added that the map should be drawn on a socio-economic
basis.
Council Member Volt answered that the map was drawn on a
socio-economic basis, according to the City Attorney,
Carl Millfamt stated that precincts 1C and IM have the
poorer minorities. He said, "we are proud that we can come before
the City Council to present at. alternate plan and It makes us proud
to be Americans
Local Attorney Ed Stapleton spoke on the request of the
NAACP. He advised that many old time black residents had moved to
the Stella Street area because the cost was more reasonable. He
added that it would be difficult to elect a minorityy unless that
population concentration iris just mentioned be lntluded.
Mayor Nash stated that people Just aren't votin in Denton,
He added that it the blacks in their district vote then w~11 elect
a Council Member,

City Attorney Taylor--"I do not have knowledge of the number
of mi.+ority who reside in the 4G precinct.
Larry Bailey, Vice Chairman of the Charter Revision Committee,
asked if it is correct that due to population residency changes that
districts can be changed.
City Attorney Taylor answered that districts can be changed
when there occurs a loss or a gain of populatiun or could remair the
same. The 1952 population figures could cause this.
Bailey stated that the alternate plan could be unfair to
some citizens, but that he was not at all in opposition to districting.
He said, "Denton needs to get moving, and I am pleased that the minor-
ities edn be heard".
Ms. Charlie Ha¢an, Southeast Denton resident, said, "it
appears that Mr. Bailey is in opposition to our alternate plan".
Randall Biddy stated that the cititens want this districting
to go through so that everyone will have equal representation.
Mrs. McAdams, Southeast Denton resident, stated that she
felt that some prejudice had developed because of the alternate plan.
/ Mayer Nash ssked City Planner John Lavretta what figures
were used in the population distribution of the districts.
Lavretta-•"Council of Government figures were used, snd I
think it is roughly right."
City Attorney Taylor--"We do nred a bit more tine to check
I out tie population figures."
Council Member Vela and Larry Bailey had some differences
of opinion and both indicated that their remarks were misunderstood.
Both men spologited for their remarks.
Mayor Nish--"We want it to be made clear that the Council
is not trying to cram anything down the cititen's throats."
Mayor Pro Tom Stephens-•"I feel these people are sincere,
and the Council has a very ferious responsibility".
Council Member Volt-•"I am recommending that we eliminate
the original districting plan as prepared by the Cit± Attorney and
Staff and to accept the NAACP alternate plan,
City Attorney Taylor stated that the Council needs to have
a special meetin next Friday or Monday because there Is a time element
in sending material to the Attorney General.
The Council concurred to most on Ftbruary S, 1980 to vote
on plant submitted.
Motion Vol made by Vels, seconded by Stephens to accept i
for further hearing the recommendation of the NAACP, or others, to
make ch■nga on the districting map, and to consider an Ordinance on
Tuesday, February S, 1980. Motion carried.

for temporary water service outside the City limits.
Mayor Nasu abstained because of engineering work, Mayor
Pro 1'em Stephens took the chair,
Utilities Director Bob Nelson advised that Mr. Below has
requested a 2" water lime to service a Mvelopment on'I.3SN South
of the Denton City limits, and that he ii in the process of annextr;
the property, and that he and Bob Jones, adjoinint land owner are to
install the necessary utllity lines to the property. He addeI that
there would be no cost to the City for the tine.

for the Energy Conservation Office.
City 4anaget Chris Hartung advised that this is a lease
agreement for an office for the Energy Conservation Department at 124
Ea~1It Drive. This building contains 630 square feet at a cost of

Identity: Z-1419
This is the petition of Mr. H. S. Osborne requesting annexation and
Agricultural (A) zoning classification on a 31.5 acre tract.
Location:
The property begins approximately 1800 feet south of the intersection of
Hobson and Country Club Road (FM 1830) and has approximately 40 feet of
frontage along the east side of FM 1830.

This petition for annexation and Agricultural (A) zoning classification
received favorable consideration from the City Council at the public hearing
of November 6, 1919. However, an error was discovered in the property
description furnished by the petitioner, which necessitated a new survey of
the property. Inasmuch as 20 days elapsed following the public hearing
without the institution of annexation proceedings the public hearing must
k be repeated in -rder to conform with state Law.
f Veaort: i
The petitioner seeks annexation and Agricultural (A) zoning classification
on this property. The reason he has given for the proposal is to obtain
City Fire Protection for his home. Several Single Family residences are
located along Country Club Road (FM 1830) to the north and south of this
property, and the eastern boundary of this site abuts the City Limit and
tht proposed Forrestridge Section II development, The land west of this
property is currently undeveloped. The Comprehansive Plan indicates the
site in this request for Single Family use.

j 1 Utilities are not currently available to the property, howt,er, utilities
will become available as development occurs on adjacent land (and the
developer extends utilities to his development). According to the Fire
Chief, this property can be furnished with City Fire protection upon
completion of the annexation process.
No major planning issues are involved in this request. It is felt that this
request would have a reasonable revenue impact and a reasonable land use
Impact.
The Planning and Zoning Commission unanimously recommends apprkoal of Z-1419.

Ths regular meetita of the Denton Planning and Zoning Commission was
held on `.ctober 17, 1979 a: 5:00 p.m. in the Council Chambers of the
Municipal Building.
PRESENT: Linnie McAdamr, Bill Brady, Robert LaForte, R.-chard Taltaferro,
and Don Ryan. Staff members: John Lavretta, 0arles Watkins,
Rick Svehla, Steve Fanning, Greg Edwards, and Sec:etary, Sue
Wigand.
ABSENT: Andy Sidor and Marilyn Gilchrlst.
Chairperson Linnie McAdams called the meeting to order.

It. Public Hearings.
A. Z-1419. This is the petition of Mr. H. S. Osborne requesting
j annexation snit Agricultural (A) toning classification on an
approximately 38.7 acre tract.
{ Mr. Dick Kelsey, representing Mr. Osborn%$ spoke in favor of the
! request stating that Mr. and Hrs. Osborne live on the :bovs property.
li Mrs. Osborne is an invalid and the requo.t is to obtr.in fire and
j police protection.
No one spoke in opposition to the request.
f John Lavretts stated that out of 11 property owners notified no
reply forms were returned in favor, none were returned in opposition,
and two were returned undecided.

j E. 2-1422. This is the petition of the City of Denton to consider
annexation and Agricultural (A) toning on an approximately 1436 acre
area beginning at the present city limits and extending 600 fast
north of the centerline of proposed North Loop 288.

Floyd McDaniel, owner of 2315 Hestated
z Acres in request and presented a petition in favor3Ofpthe requests ot
that there is rapid growth in North East Denton and he felt that
annexation would give the Council the power to control development.
Mr. Ralph Leach spoke in favor of the request stating that he is a
member of the North East Homeowners Association,
Mr. G. Selling, owner of 924 Kings Row, also a member of the North
East Homeowners Association spoke in favor,
Mr. Snyder, representing North Texas Savings and Loan, spoke in
favor of the annexation.
Chairperson McAdams asked those who were in favor of annexing the
entire area to stand. Sixteen people stood in favor of annexation.
Mr. A. F. Calahau, representing Mr. E
opposed to the request. Mr. Calshan felt that since, in hive as
opinion, the extension of Loop 288 would not be completed in lose
than 10 years, annexation is a premature move on the part of the
City.
Ms. M. MacIntyre asked if it would be a number of years until city
services were supplied to the annexed area. (She owns 40 aerse).
City Planner, John Lavvotta, stated that water and fewer for
significant development would be extended at the developer's expense.
Fire and police protection would be given immediately,

City Planner, John Lavrette stated that the City has the right to
review subdivision plats, The City then has an indication of how
land will be used, and the developer is obligated to go by the
subdivision plat submitted to the City,
Chairperson McAdams asked all in opposition of the anr:.-Ation of the
entire Area to stand. Six people stood in opposition,
John Lavretta stated that of 185 property owners notified, 16 were
returned in favor and 13 were returned In opposition, One was
returned undecided. John Lavratta also described the services to
be provided (Utilities, Fire and Police Protection, Public Works,
and Parks), John Lavretta also went over fiscal issues and pltaning
issues in dSteil.

Tom Jester,spoke in favor of the request stating that there are 2
or 3 duplexes and houses presently on the tract. At out time the
property was zoned for a day care center, however, no day care
center was aver developed.

John Lavtetta stated that of the 42 property owners notified, one
was returned in favor and 20 were returned in opposition.
Tom Jester spoke in rebuttal saying that he felt it was unfair to
say that the quality of life would go down because apartment dwellers
would be living in the area.

petition and expressed her concerns about the traffic impact of
the proposed development. Mrs. Knack then read a statement o ending
the zoning change which had been signed b 72 property
presented the petition to the Planning and Zoning Commission.
Mr. Dacca Nolan spoke for himself and other Froeptty owners in
opposition to this request. Mr. Nolan stated that the proposed
change of zoning to SF-13 would downgrade the area.
His George Olson spoke in opposition cc the request stating that the
smallest lot in Hontecito is 33,000 square feet.
Mrs. Gualock who lives adjacent to the proposed development spoke
in opposition.

Charles Watkins advised the Planning and Zoning Commission that
corrected plans were not submitted and the staff therefore recom-
mended denial.
Motion was made by Commissioner Brady and seconded by Commissioner
Talleferro to deny the final plat of the Summit Addition. Motion
carried unanimously.

General Recommendation on Proposed Lend Use planning program
The Planning and Zoning Commission recommend to the City council
that they initiate a citywide land use planning program similar to
the full state citizen participation approach presented in the
joint Planning and Zoning/City Council meeting of September ZS, 1919.
Further recommendations include that the committee structure should
generally follow the example presented oxcepti

Identity and Location:
This is the petition of Mrs. Tom Floyd requesting a change of zoning from
Single Family (SF-7) to Commercial (C) zoning classification on a parcel
approximately 1.2 acres in size. The tract is located along the north side of
Dallas Drive between Simmons and Chambers Streets.
Background:
At the public hearing before the Planning and Zoning Commission on January 2,
1980s an error was made in the staff presentation concerning the zoning
classification of a tract just north of the site in this request. The adjacent
property was described accurately in the written staff report (as Commercial
and Office), but was described as being zoned Single Family (SF-7) in the staff
f presentation and on the viewgraph.
i A consideration concerning this case was placed on the Planning lnd Zoning
Commission Agenda on January 16, 1980. The Planning and Zoning Commission
discussed the error and a motion was made to re-hear the case. The motion
failed by a 2 - 2 vote with 2 abstentions.
Re rt:
A commercial center is located along the west side of Dallas Drive across the
street from the site in this request. The site also abuts two single family
houses on the east, and single family housing and a church to tho north. A
i trucking firm is located to the northwest across Simmons Street dnd part of this
property is zoned Office and Commercial.
The property is located in the Dallas Drive corridor which is predominately s
zoned Commercial (C) and developed with Commercial uses. However, the proposed
i Commercial zone does not allow for a transition into the single family residential
Ifff area to the north and east. Most of the housing surrounding this tract is well
maintained. The Planning and Zoning Commission felt that a commercial use would
be incompatible with the existing housing and would have an adverse impact on
neighborhood maintenance, particularly on those homes abutting this property,
Public facilities are available for extension to the site and there is adequate
capacity in the lines,

The Planning and Zoning Commission recommends denial of Z-1432 because of the
nsgative influence on the adjoining neighborhood by a vote of 4 to 1.

The regular meeting of the Denton Planning and Zoning Commission was held
on January 2, 1980 at 5:00 p.m. in the Council Chambers of the Municipal
Building.
PRESENT: Robert LaForte, Linnie McAdams, Don Ryan, Andy Sidor, and
Richard Taliaferro. Staff members were John Lavretta, Charles
Watkins, Rick Svehla, Greg Edwards, Steve Fanning and Secretary,
Sue Wigand.
ABSENT: Marilyn Gilchrist and Bill Brady.
Chairperson Linnie McAdams called the meeting to order.
1. Approve the minutes of the December 19, 1979 meeting.
Mution was made by Richard Taliaferro and seconded by Andy
Sidor to approve the minutes of December 19, 1979. Motion
carried unanimously.
II. Public Hearings:
A. Z-1429. This is the petition of Mr. Bennie Snider (North
j Texas Savings and Loan) requesting a change of zoning from
Agricultural (A) and Multi Family Restricted (MF-R) to Multi
Family (MF-1) zoning classification on a tract approximately 17.3
acres in size. The property is immediately east of the Denton North
Apartments and on the north side of Sanger Road (U.S. 77) north of
the Optimist Club property.
Bennie Snider, representing North Texas Savings and Loan, spoke in
favor of the request, stating that 3 acres of the property are not
served with sewer, therefore, if the request is granted the 3 acres
would be donated to the City for a park.

sell her property unless it was zoned Commercial.

Identity and Location:
This is the petition of Mr. Steve 8atey requesting a specific use permit to
operate a day nursery at 1008 Sherman Drive.
Report:
The Zoning Ordinance permits property owners to seek specific use permit
approval for day care facilities in residentially zoned districts. The under-
lying philosophy of this provision is that under certain conditions a day nursery
can operate without adversely affecting surrounding residential property. In
order to accomplish this goal, the day nursery should be a small scale operation
or there should be an adequate buffer between the nursery and residential
property

The house at 1008 Sherman Drive is located on a 2.3 acre tract which hats a
circular driveway of gravel construction, and a chain-link fence is located
at the rear of the house as shown on the attached diagram. The Plannin5 and
Zoning Commission felt that the existing circular drive would be inadequate
and would need to be expanded if the case was approved.
The Department of Human Resources has set the maximum number of children for
the facility at 59. 1he Planning and Zoning Commission felt that the residential
1 character of properties in the area of Sherman Drive should be maintained and
1 that a day nursery of this size, with the expected noise and traffic, would be
j n intrusion into the area.
I , Additionally, the Commission was concerned that ingress and egress would be
awkward particularly since the peek traffic periods on Sherman Drive are the
j times when the children would be delivered and picked up.
The Planning and Zoning Commission recommends denial of S-145 by a vote of 5 -
0 with one abstention. The staff recomended denial.

Gentlemen:
'h I understand that the property (S-145) at 1CC8 Sherman Drive
is being considered for a specific use perait to operate a
day nursery.
I am opposed to this change from residential use.
'$hen I built my hone at 629 Sherman Drive in 1P41 (having first
had fc ur acres of my property of four-and-one-half acres voted
into the City)) I built it for a residence in a residential area,
and I am oppoised to spot changing for any other use,
Each time that the property at 808 Sherman Drive (8_IDRTE KOW )
has been considered for a change from residential, I have gone
on record as opposing it. Sherman Drive is too busy a thorough-
fare for one day nursery, let alone twot Sher.'an Drive was
widened to four-lane at great expense to open up and provide
access to the growing northeastern section of Denton. The extra
cars bringing and coming for children at the day nursery causes
a traffic bottleneck and hazard at the very busiest times of day,
8100 A,M. and 6s00 P,H (many times with cars attem ting to exit
or enter the nursery taking up hnlf of the outside lane of the
street.) Furthermore$ a day nursery is a noise hazard end very
undesirable in a residential area, Neither is such a location
j safe for children on as busy an artery as Sherman Drive which
carries so much traffic all of the time and especially at peak
times of dcy as mentioned above.
If the ex^eiience of living neor the play school at 808 Sharjan
Drive is any indication, a change of use from residential at
f 1008 Shercian rrive would be a creeping paralysis which grows and
a grows end grows, M%reas the school at 808 Sherman Drive bagen
as a very small and innocent operation (to which I voiced aq
} opposition,) it has grown by leaps and bounds until now I see
that even classes for adults are being advertised there! (cee
enclosed clipping from a on Record-Chronicle of January 4 `IPSO,)
I would appreciate your serious considerr,ticn in o;pjsing t change

Planning and Zoring Commission
January 16, 1980
The regular meeting of the Denton Planning and Zoning Commission was
held at 5:00 p.m. in tra Council Chambers of the Municipal Building.
PRESENT: linnie McAdams, Richard Taliaferro, Robert La Forte, Marilyn
Gilchrist, Andy Sidor, and Bill Brady, Staff members were:
John lavretta, Charles Watkins, and Secretary, Sue Wigand.
ABSENT: None.
Chairperson Linnie McAdams called the meeting to order.
1. Approve the minutes of the January 2, 1980 meeting.
Motion was made by Commissioner La Forte and seconded by .
Commissioner Taliaferro to approve the minutes as written.
Motion carried unanimously.
11. Public Hearing:
A. S-145, This is the petition of Mr, Steve Batey requesting
a specific use permit to operate a day nursery at 1008 Sherman
Drive.
John lavretta described the proposed nursery.
Stave Batey, petitioner, spoke in favor of the request.

favor of the request,

Richard Styles, representing his Aunt Carpenter (owner of 926
Sherman Drive), spoke In opposition to the request.
Ms. Garton, resident of 816 Sherman Drive, spoke in opposition.

in opposition to the request.
John Lavretta gave the staff recommendation, recommending denial.
Steve Batey and Margaret Batey spoke in rebuttal.
Andy Sidor abstained since his property was within 200 feet.
The Commission discussed the case.
Motion was made by Bill Brady and seconded by Marilyn Gilchrist
to deny S-145. Motion carried 5 - 0 with one (1) abstention.
111. Considerations:
A. Consider Z-1432.
John Lavretta explained that there was an error rt the public
hearing of Z-1432.
Motion was made by Andy Sidor to reopen the case as a public
I hearing. Motion was seconded by Richard Tallaferro. Bill
Brady and Marilyn Gilchrist abstained, The vote tied 2 - 29
therefore the motion failed.
B. Consider the final replat of City Lots 12 and 13, Block 404.
i Charles Watkins stated that the only correction of the plat was
i that it was a plat and not a replat, and this correction has
iii already been made, therefore the staff recommended approval.
I Motion was made y Bill Brady and seconded by Richard Tallaferro
to approve the fibnal plat of Lots 12 and 13, Block 404. Motion
carried unanimously.
C. Consider disposition of Lot 2A, Block 3, Heritage Oaks
Subdivision,
Andy Sidor moved that the City retain property. Motion carried

SUBJECT: Maintenance of Grounds at Athletic Facilities
With the problem in finding workers in the past to strictly pick
up trash, etc. and perform other clean up jobs and the age res-
triction makes this maintenance task very difficult for me to
provide. j
In 1979 we were able to find several boys and Mr. C'idpman to
provide these services. This was paid by check requisition and
the time was documented by time cards.

From these past records we were able to identify the extra amount of
time that it tak9s to provide this service.
I recommend that a formal contract for service be approved for the
1980 season. We cannot hire, supervise, and provide transportation
at a lesser cost to the City for this same service.

Consider bids for drainage work on Pecan Creek.
Summary.,
We have two items in our Comnunity Development Block Grants for
drainage improvements on Pecai Creek. The 1978 Grant included
$60,000.00 for improvements to the south fork of the channel
leading from Bradshaw Street continuing to the main channel. The
1978 Community Development Grant included $35,000.00 to improve
the main Pecan Creek Channel.
Property acquisition has been underway for sometime and we have
closed on all the property needed except for one parcel. the channel
projects were let for bids together. The quantities in the bid
package were based on a realignment of the south fork and creating a
one hundred year channel, The design for the main channel was to
improve it as a twenty five year channel. The purpose of the channel
work is, first, to improve the drainage and second,to improvc the
area aesthetically. The main channel adjoinsfa park that is being
developed with grant funds and the realignment of the south fork will
enable us to fill in a section of the old south fork that has been
used as a dump for many years.
Bids and Fiscal issues:
! The channel projects were let for bids originally in November and we
! received no bids at that time. The project was let for bids again
in December and we received one bid at the opening on January 15. The i
bid from Craig Olden, Inc. is $148,126.10 (the quantities prices are
listed on the attached sheet).
i The Engineering staff has reviewed the prices for the bid quantity
and feels that they are reasonable in terms of today's prices. The
Grant budget for the project is $95,000,00 and the bid together with
f the property acquisition required for the wort is approximately $160,000.00.
f We recognized when the project was deslyned and let that the bids would
probably come in over budget so we included a contingency in the
bid package that we could reduce the quantities by half and still
retain the quantity prices,
Recommendation:
The staff is recommending that we accept the bid but that we reduce
the excavation quantities by 25,010 cubic yards, the seeding by 2300
square years, and that we accept an alternate to the concrete proposed
being 6 inch gabron revetment.

The reductions affect the section of the main channel between Sycamore
Street and the point at which the south fork enters the main channel,
This section would be widened only slightly by reworking the bottom of
the channel and the north bank of the channel wall to a more gradual
slope so it can be maintained. This improvement will enable the
channel to carry a 15 to 20 year flood. The work will improve the
area aesthetically and drainage problems in this section are less
critical since it is next. to the park that is being developed.
The reductions recommended reduce the bid b $52,150.00. As a result
of that reduction the overall project will be approximately $13,000.00
over budget. This is the approximate cost overrun that was anticipated
and the budget amendment for the Community Development Program approved
last week will be sufficient to cover it.
Action Required:
The Council should accept the bid of Craig Olden Inc., contingent on
HUD approval of the contractor, with the following reductions:
i 1) Reduction of excavation of 25,010 cubic yards.
f 2) Reduction of 2,300 square yards of seeding.

Consider Memorandum of Intent to Enter into an Economic
Dispatch Agreement with the Cities of Garland, Bryan,
Greenville and the TMPA.
SUMMARYt
The City of Denton is participating with other merbes cities
of TMPA in a program known as Economic Dispatch in this
operational mode, the four cities dedicate their generators
to a common generating pool. A computer program which is
based in Garland and administered by the Dispatcher in
Garland reviews the total electrical requirements of the four
cities and then puts the maximum amount of load on the most
efficient unit in the system, and the next increment of load
on the second most efficient unit and so on down to the less
efficient units. This program hAS been saving the City of
Denton between $100000 and $30,000 per month.
j To date, this program has been conducted under the
contractural arrangements provided between the four cities
within the framework of the Texas Municipal Power Pool
's Agreement, The Power Supply Contract that the cities have
with TMPA states that TMPA will administer such a program for
the benefit of the cities, TMPA has entered into an Economic
Dispatching Agreement with the City of Garland, whereby the
City of Garland is designated as the operating agent to
administer and dispatch the units for the four cities for
TMPA, To date, the program has been entirely voluntary for
the four cities.
The long range pro forma statements prepared by TMPA's
consulting engineers for the Financial Feasibility for TMPA
bonds are predicated upon a mandatory economic dispatch
progrent for the four cities. In past TMPA financings, the
bound prospectus has made reference to an Economic Dispatch
Agreement and has noted that such an Agreement is
forthcoming. Since TMPA is planning another financing in
1980, it is necessary to consumnate or, at least, to agree to
develop auch an Economic Dispatca Agreement. Attached Is a
Memorandum of intent for an Economic Dispatch Agreement that
TMPA has requested the four cities to enter into, The actual
Economic Dispatch Agreement will be developed at a later date
and presented to the Council for approval.

The full effect of such an Economic Dispatch Agreement, of
course, will not be fully realized until after Commanche Peak
and Gibbons Creek generating units become fully operational.

This memorandum of intent is made by the Cities of Bryan,
Denton, Garland, and Greenville, Texas, hereinafter called jointly r
Cities and separately City, and the Texas Municipal Power Agency,
hereinafter called Agency, all hereinafter called a participant or
participants along with the other parties who execute thq. economic
dispatch agreement herein provided with the approval of the Cities
and the Agency.
WITNESSETHs
x WHEREAS, economic dispatch is the joint coordination of start-
up, operation, and shut-down of each and every participant's electrical 1
, generation, transmission, and other related facilities by and among
the participants in order to minimize their total system-wide fuel
requirements, thereby resulting in a monetary savings to all the

WHEREAS, tLe Cities and the Agency desire to express their
intent to provide for economic dispatch among themselves;
NOW, THEREFORE, the parties agree as follows:
1 1. The Cities and the Agency hereby agree to dispatch and
expeditiously to develop and enter into the necessary economic
dispatch agreements with each other and any other participant that
is acceptable to the Cities and the Agency.
2. The agreement shall provide for the costs and administration
of the economic dispatch program by the Agency on a mutually agreeable j

basis, either through its awn personnel or by contracting with
others.
3. No provision of the economic dispatch agreement shall
require the Cities or the Agency to breach the terms of 'any valid,
prior contract.
4. The economic dispatch program will be developed to realize
monetary savings for each participant.
5. It is contemplated that under the proposed agreement any
participant will be able to withdraw from the economic dispatch
agreement, wherever it determines that it bears an unfair burden
upon providing one-year's written notice to all the other partici-'

DISPATCIIING SERVICE AGREEMENT
This Dispatching Service Agreement, dated as of Jung 1,
1979, is by and between the Texas Municipal Power Agency
(TUPA} and the City of Garland, Texas (Garland), each of
which is a municipal corporation and a political subdivision
of the State of Texas; each of which has executed this
agreement with the approval of its governing body;
WI THE S SETH:
WHEREAS, the TMPA is in the process of constructing the
Gibbons Creek Steam Electric Station (formerly known as the
Bryan Lignite Project) and is in the process of acquiring an
ownership interest in the Comanche Peak Steam Electric
Station and it is necessary for the Agency to provide a
procedure for the coordination of the dispatching of electric
power and energy from the said electric venerating stations;
and
WHEREAS, it appears that Garland now has a portion of
the facilities which will be required to provide for the
F dispatching of the electric power and energy and that it .
would be to the best interest of TMPA and the inhabitants of
{ the Cities in:luded within its boundaries for Garland to
• k dispatch such electric power and energy; now, therefore,
BE IT MUTUALLY AGREED AND CONTRACTED AS FOLLOWS:

SECTION 1; The term of this contract is thirty-five
r (35) years rom its date, but may be cancelled without
penalty by one party giving written notice to the other that
the same is to a cancelled after a period set forth in the
notice, which period shal?. not be less than eighteen (18)
months.
SECTION 2;
(a) The Power Pool and Interchange
Agreement (dated as of September 23, 1963, and amended in
1969, approved by R.E.A. on July 30, 1969, and hereinafter
called Pooling Agreement) by and between the Cities of
Bryan, Greenville, Garland and Denton (collectively called
the Cities) and the Brazos Electric Power Cooperative, Inc,
(BEPC), is recognized as an existing agreement involving
torrepealigalter, abridge, abrogate, cortmodify sthetprintended

(b) The Pooling Agreement mal:cs p°ovisions for Supplemental,
Emergency and Maintenance Energy (as such terms are defined
and utilized therein) and provides a procedure whereby such
energy may be dispatched subject to certain conditions and
controls by the Pool Committee established thereunder.
(c) The parties hereto recognize that with respect to
j Economy Energy from the units of the Cities, i,arland, as
I4 between the Cities and upon request, has undertaken to
provide for the dispatching of such energy based upon loads,
generation, ability to interchange power, fuel, heat rates,
system limitations and other factors (including those specified
in paragraph (b) hereof) in order to provide the most economical
power to all of the Cities. This arrangement with Garland
is subject to cancellation or revision at any time.
' d So long as the Cities continue to supply information
to Garland and request that Garland continue to act in the
ca acity in which it has been acting (as specified in paragraph
(c~ of this Section), Garland represents to 1'MPA that it
will continue to exercise such responsibilities and in that +
connection will coordinate such responsibilities with those
x assumed by it under Section 3 of this Agreement.

SECTION 3: With respect to the Comanche Peak Steam
S Electric at on, the Gibbons Creek Steam Electric Station
r) and other generating projects of nIPA hereafter approved
(MA's Units), Garland will, in conformity to criteria
J established from time to time by TMPA:
(a) coordinate the startupi operation and shutdown of
ttt the electrical generaton, transmission and
related facilities;
(b) coordinate the operation of generation facilities
in order to minimize the total fuel expenses;
l (c) monitor, coordinate and control the interconnected
j operation of electric facilities;
The criteria to be established by Tt4PA will consider:
(i) the capability of generation units,
(ii) the capability of related transmission facilities, t

(iii) the security and reserve requirements of
the TMPA electric system;
f'` (iv) the security and reserve of the Texas
Interconnected System, or its successor;
(v) the interchange of energy between each and
all of the Cities and TMPA;
(vi) the interchange of energy between WA,
the Cities, and systems to which they are
interconnected to the extent permitted
by law and other contracts;
(vii) the maintenance of records with respect to
frequency, power flow, energy, kilowatt hour
exchange, power factor, voltage and other
similar matters bearing upon the satisfactory
interconnection and syncb.onous operation
of the systems over which it has control
or information.
Garland shall consult with personnel of TMPA concerning
the dispatching of the TMPA units.
SECTION 4: The duties assumed by Garland with
respect to A's units (as set forth in Section 3) shall ba
administered by Garland with the view of providing the

lowest cost power to the Cities in accordance with Prudent
Utility Practices. The THPA Units shall be diapatched in a
[ manner that fulfills TMPA's obligations under the Power
Sales Contracts between TMPA and each of the Cities.

Garland represents that so long as Economy Energy is
exchan ed between the Cities (as set forth in Section 2(c)
hereof, , it will continue to follow Prudent Utility Practices
in the exercise of the duties it has assumed,
Prudent Utility Practices is defined as any of the
practices, methods, and acts engaged in or acc=pted by a
significant proportion of the electrical utility industry at
the time the decision was made, or any of the practices, i
methods, and 'acts that, in the exercise of reasonable judgment
in light of the facts known at the time the decision was
made' could have beer expected to accomplish the desired
result at the lowest reasonable costs consistent with reliability,
safety, and expedition, Prudent Utility Practice is not
intended to be limited to the optimum practice, method or
act to the exclusion of all others, but rather to be a
spectrum of possible practices, methods, or acts.

SECTION 5; Garland shall acquire the equipment,
utilizing appropriate bid rocedures, which is described in
Exhibit A (attached hereto , as amended from time to time by
the parties. TMPA shall approve all plans and specifications
upon which bids are taken. Title to such property shall be
in TMPA.
Garland shall be reimbursed for its labor costs and
expenses in connection with the acquisition and installation
of such equipment. The total cost of sucb labor and equipment
shall not exceed $250,000 without prior consent of the
parties.
SECTION 6: The annual payment to Garland hereunder
shall not exceed the actual cost incurred. The initial
annual budget is set forth in Exhibit B which is made a part
' hereof for all purposes.
The parties hereto shall have the right to assume that
no change is to be made in the annual budget for opcrat'ng
and maintenance expenses hereunder (from that set fort), :z

This bid is for the purchase of the annual supply of plastic refuse
bags used by the City of Denton. These bags are distributed and sold for specific
use in the repidential soild waste collection system. The bags are 2 mil., black
polyethylenes packaged 52 bags per roll.
< FISCAL SUMMARY:
These items are purchased as Warehouse inventory. Funds are taken from
the working capital account 05-98-87-03 and charged to the using department as they
are disbursed. Approximately 20,000 rolls are distributed in March and again in
September. The balance of the contract are sold across the counter or to other
cities, counties and school districts.
