Through the effort of our Safety Director, John Maxwell, the
Department Heads, and supervisory personnel, we were able to hold
accidents down to where we only received a 5% increase to our
Workmen's Compensation Premium last year.

Identity and Location:
This is the petition of Mr. Joe Belew requesting annexation of a 6.2 acre
tract located approximately 350 feet west of Interstate 3561, beginning
approximately 1,010 feet south of Zimmer Motor Vans.
Report;
The site in this request is surrounded by vacant land, and is designated for
light industrial use by the comprehensive plan.
To serve the site with public facilities will require the installation of a
lift station and extension of an 80 sewer line and 16" water line. There will
be adequate capacity in the lines.
j The site will be served by the Interstate 35H service road which is generally
an ideal location insofar as access is concerned however in this particular
case there is only one way to and from the site in that the service road ter-
minates just south of this site. However, the Planning and Zoning Commission
felt that this was not an insurmountable problem.
Because of the surrounding vacant land, and the compatibility of the petition
i with the comprehensive plan, the Planning and Zoning Commission recommends
approval of Z-1432.

This is the petition of Mr: John Tysseland and Mr. Laurence Halsey requesting
a change of zoning from agricultural (A) to light industrial (LI) classifica-
tion on a tract totaling approximately 6 acres. The parcel is located on the
west side of Mayhill Road beginning approximately 487 feet north of the inter-
section of Mayhill Road and East McKinney Street.
Background:
In May, 1979 a petition for tight industrial (LO zoning on an eight acre tract
located at the northwest corner of East McKinney and Mayhill Road was approved
by the Planning and Zoning Commission. The City Council approved the request in
modified form as follows: the requested change in zoning from agricultural (A)
to liu4t industrial (LI) classificstion was approved on that sourthern portion
of the eight acre tract measuring 466.9 feet in depth, located north of fast
McKinney Street.
the current petition includes the balance of the property which was not approved
for light industrial zoning in 1979 plus one additional acre on the north.
? Report,
Surrounding land use includes single family housing on large lots to the north,
a single family house and a n4oile home outside the city limits to the east,
vacant land to the west, and Jai r.onstruction company to the south. Dr. Pepper
j and Frito Lay industrial uses are located to the southeast just outside the
city limits.
The comprehensive plan specifies this area for single family residential use.

Public facilities are available for extension to the site.
An industrial corridor is developing between, Loop 288 and Mayhill Road. Con-
siderable 11ght industrial development is PO O located along the east side of
Loop 288 north of McKinney Street. The three light industrial zones on the
north side of McKinney Street between the Loop and Mayhill Road extend no more
than 600 feet deep which is consistent with the Dr. Pepper and Frito Lay
industrial uses just outsido the city limit.
This petition proposes the extension of light industrial zoning along Mayhill
Road north of McKinney Street. The Planning and Zoning Commission considered
the effect of this case setting a precedent for simillar re uests along Mayhill
Road, north of McKinney Streets and considered the impact of the request upon
future residential o'evelopment {particularly on the interior between Loop 289
and Mayhill Road) Is delineated by the compreht:nsive plan.

The Planningg and Zoning Commission felt that the north boundary of this property
would be a 1c ical stopping point for tight industrial toning north of McKinney
Street and felt that this zoning would not have a detrimental effect on future
residential development in the area. These reasons along with a lack of opposition
inclined the Planning and Zoning Commission to recommend approval of Z-1448 by a
4 - 2 vote.

May 7, 1980 at 5:00 p.m. in the Council Chambers of the K.nicipal Building.
PRESENT: Mart/ jn Gilchrist, Llnnie McAdams, Robert La Forte, Andy Sidor,
Bill Brady, Carol Busby. Staff members were: John Lavretta,
Charles Watkins, Jeff Meyer and Sue Wigand.

Linnie McAdams called the meeting to order.

A. Approve the minutes of the April 16, 1980 meeting.
The Commission amended the minutes as follows: Phil Smith's name
was changed to Phil Philips. Motion was made by Marilyn Gilchrist
and seconded by Robert La Forte to approve the minutes as amended.
Motion carried unanimously.

classification on a one (1) acre tract located along the north side of
University Drive approximately 1,015 feet west of Old North Road.

that he wanted the Commission to deny the request,

Approval of an amendment to a site plan for a portion of planned development
(PD-2).
Summary:
I
Planned Development (PD) zoning classification normally has a two stage review
procedure including first, approval of the basic land use plan and secondly,
review and approval by the City Council of a detailed site plan. Planned
Development zoning for multi family use and limited retail use was approved
on a 34 acre tract located on both sides of Coronado Drive, west of Bell Ave..
In 1973.

The apartment areas have been completed, with the exception of one tract. The
Planning and Zoning Commission and City Council approved a site plan for the
limited retail area at the corner of Bell and Coronado in August, 1979. The
approved site plan proposed a 6,750 square foot building located on the west side

conditions:
1. A building setback of ID feet shall be observed from the
western property lino.
2. The trees shall be planted as indicated by the plans. The
area indicated as green space will be planted with grass. Alsos,
a low hedge shall be planted immediately in front of the parking
area on the east side of the property and at the end of the
parking lot on the west side of the property.
¢ 3. The dumpster shall be located as indicated on the site plans
and a 6' X 6' wall enclosure shall be built on three sides of
the dumpster. A plan for the enclosure will be submitted to
the Building Official to ensure the proposal is compatible with
the dumpster vehicles.
4. The building walls indicated on the elevation plan will be
of masonry construction. There will be no detached signs per-
mitted.

The proposed amendment to the site plan reduces the size of the building from
6,750 square feet to 4,000 square feet and reduces the parking from 30 spaces
to 25. The proposed site plan adds a gasoline pump island with a 12' 7" X 20'
canopy.
A building permit was issued for the installation of two underground gasoline
storage tanks at the site. The permit was issued based upon the fifth condition
cited above, but the issuance of the permit was contrary to the approved site
plan in that no gasoline pumps were indicated on the approved site plan.
Alternatives:
Approve, deny, or modify the amendment to the site plan.
Recommendation:
When the site plan was originally approved in 1979 the Planning and Zoning
Commission felt that it was important for this site to be integrated as much
as possible into the surrounding residential environment, This particular
site plan was more strict than the norm to insure its integration with
surrounding land use. The Planning and Zoning Commission felt that the
addition of the gasoline pumps and canopy was incompatible with the surrounding
residential environment and recommends denial of the site plan by a vote of
5 1.

In accord with your telephone request of this date, I reviewed the above
referenced appraisal and particularly those sections of the appraisal
which dealt with the subject Tract 2, a rectangular shaped 6,165.65
i square foot site which is located at the northeast corner of Vast Hickory
Street and Avenue
the purpose of my appraisal review was to formulate an opinion of the
most probable range of fee simple market value for Tract 2, under market
conditions which existed as of May 20, 1980.

was quite limited; that its most probable purchaser would desire a discount

Included on the Agenda for City Council approval on June 3 is a
Request for Proposal to assist the City in reviewing their data
processing financial applications. This request has been developed
in response to the need for making extensive revisions in the
! accounting and utility billing systems within the City.

The staff has worked with the Data Processing Citizen's Advisory
Board to formulate the approach, and they have recommended this
Request for Proposal to the City Council for their consideration. A
member of the Advisory Board will participate in the evaluation of
the firms, and the Board as a whole will recommend a firm to the
City Council.
It is anticipated that the Board's recommendation will be brought to
the City Council on July 8. The review will be accomplished by
September 1. This time table is extremely critical in order to
incorporate the results within the context of the budget formulation.
The Request for Proposal discusses what is required from the firm
assisting the City and the objectives of the project. I will be
happy to answer any questions that may arise about the approach or
the Request for Proposal.

Denton in a review of data processing for financial applications. The

t During the last financial audit for the City, Alexander Grant
and Co. addressed what they felt was a material weakness in the financial
{ systems by stating in their advisory comments, "The City should coisider
an extensive revision of their utility accounts receivable system." The
City believes that substantial ch,r es are necessary in the other
financial areas as well because of growth of the organization and
tremendous demands for additional financial information and disclosure.
11. Objective of the Pro ect
The object of reviewing the financial applications is to develop
li a plan for implementing new systems or system modifications that w
eliminate current weaknesses and will provide for additional user
requirements. The City has chosen to address all these needed changes
with a comprehensive review that will provide for the City the most
economical alternatives and at the same time avoid the inconsistencies
developed by a piecemeal approach.

The City of Denton reserves the right to make an award in the best
interest of the City of Denton, all factors considered. The technical
portion of the proposals submitted will be the most important
consideration in awarding and should therefore be complete and specific.
Although cost may not be a controlling factor in the evaluation process,
it will nevertheless be considered in the negotiation and awarding of the
study. In addition, the City reserves the right to reject all proposals
and resoiicit in the event no adequate and solely responsive proposals
are received and negotiations fail to provide mutually satisfactory
results.
The proposals will be reviewed by i committee composed member of the Data Processing Citizens Advisory Board, the City Manager,
the Assistant City Manager, the Director of Utilities, the Director of
Finance and the Director of Data Processing, They will select three
pi,eloposalcteds firms further l be orasked to al presentation. a Representatives from these
committee on June 25 at the City Hall, Each rconsultant will be allowed
20 minutes to present their proposal with an additional 15 minutes for
questions and answers.

each firm responding is asked to declare:
all software it is currently marketing for local government

any software vendors with which the firm has any connections
for local government; and

SUBJECT: ASSESSEMENT OF AUTOMOBILES
Because of legislation passed last year, cities which continue to
' tax automobiles must make an affirmative action to do so every
year. Consequently, if the Council chooses to continue assessing
automobiles, it should direct the City Attorney to prepare the
appropriate documents to enact the program.
For the 1978 tr.x year, the City of Denton had an assessed value on
automobiles of $18,9990060. This assessed value will generate
$141,353 in revenue to the City. To generate an equivalent amount
of revenue on property taxes, an additional $0.05 would have to be
levied to the current tax rate of $1.24.
The staff has brought this matter to the attention of the City
Council so that the tax roil may be completed in time for submission
to the Board of Equalization. I will be available to answer any
questions that might concern the asses,ment of automobiles.

SUMMARYs
In February of 19801 the City of Denton made a Participation
Agreement wich Denton Baptist Association to pay fog the
oversize of a water line from 8" to 16". The estimated
length of the line was 978' anC estimated cost to the City
was $15,306.75.
Due to a change in location, it became necessary to bore and '
encase 44' of the highway and to uye 80' extra of 16" line at
the crossing. The length of the line paralleling the highway
was 9811. The total cost to the City is $18,589.50.
ACTION REQUIREDs
Approval by the City Council of final payment in the amount
of $188389.50.
STAFF RECOMMENDATIONS
The Public Utility Board has approved the change in location
and recommends to the City Council that final payment be i
! made. The Utility Staff conclrs with this recommendation
! that final payment be made in the amount of $180589.50.

The participation costs have increased since the line relocation also
caused changes in the num'oer of type of fittings usad. The major
items contributing to the added participation costs were the adapter
changing from a Ductile iron to concrete pipe the cancellation and
modification as per'enolosed invoice, the 16.1nch by 12 inch to ping
sleeve and valve. These items alone accounted for an extra $2078.

Approval of the final plat of Montecito Village Unit 2,
Summ3r :
The developer seeks approval of a one lot subdivision along the Interstate 35E
(service road) near Fort Worth Drive for the purpose of constructing a service
station.
Water and sewer service is not available from the service road and for this
reason will be provided from Acme Street through an off-site private utility
easement. Meters will be located at the north end of existing 16 foot utility
easement.
f k Electrical service will either be provided from the service road or through the
utility easements shown on the plat.
Recommendation:
The Planning and Zoning Commission unanimously recommends approval of the final
plat of Montecito Village Unit 2.
The Planning, Engineering, and Utility Departments have each reviewed the plat
and recommend approval.

Approval of the final replat of lots 1 and 2, Myrtle Addition.
Summary:
The owner of lots 1 and 2 of the Myrtle Addition has built most of an addition
to his house on lot 1. It was discovered that the addition was being constructed
on the lot line dividing lot 1 and lot 2. This replat is for the ppurpose of
moving the lot line southward so that the addition to the house will not rest
upon the lot line.
After moving the lot line as far south as possible, the addition to the house
on lot 1 is only five (5) feet away from the lot line. The Board of Adjustment
granted a one (1) foot side yard setback variance in that a 6 foot minimum
side yard setback is required by the zoning ordinance,
Recommendation:
The Planning and Zoning Commission unanimously recommends approval of the final
i replat of lots 1 and 2 of Myrtle Addition.

Action Required:

Service in the amount of $4,193.31.
SUMMARY:
This purchase order is for the complete overhaul and recondition of an
Elgin Whirlwind Sweeper. Environmental Sales and Service is the only factory
authorized sales and service facility in this area making this a single source
purchase. This sweeper is the only street sweeper currently in the motor pool r
fleet. Due to the extremely high cost of replacement and long delivery schedule
we felt that reconditioning was best for the City of Denton.
FISCAL SUMMARY:
The funds for this repair will come from the motor pool vehicle main-
tenance account 05-98-87-10 and charged to the Street department budget.

We recommend this purchase order be approved and the invoice for
