Regular Meeting of the City Council of the City of Denton at
700 P.M., Tuesday, September 2, 1980 in the Council Chambers of
the Municipal Building at which the following items of business
will be considered.
1. Adoption of an ordinance regarding the petition of Mr. Joe
Belew requesting annexation of approximately 6.2 acres of
land located approximately 1,260 feet west of Interstate
35W about 1,101 feet south of Zimmer Motor vans. 2-1451.
(The Planning and Zoning Commission recommends approval.)
2. Public Hearings

A. This is the petition of Mr. Joe 8elew requesting
light industrial (LI) zoning classification on a
tract totaling approximately 6.2 acres located/;.
approximately 1260 feet west of Interstate 35W about
1,101 feet south of Zimmer Motor Vans. The f
petitioner Is also requesting a specific use permit ri
to operate a concrete batch plant on the property.
Z-14510 (The Planning and zoning Commission '
recommends approval.)
B. This is the petition of the Denton Historic Landmark
Commission requesting historic landmark (H) zoning
designation at 123 N. Elm Street. The property is
owned by Mr. Randall Boyd and is more particularly
described as City lot 21 block 301. (The Planning
and Zoninc, Commission and Historic Landmark
Commission recommend approval.)
3. Appearance by representatives of the Golden Triangle Mall
relative to the Mall's Grand Opening.

4. Appearance by Lester Horstmann representing Lone Star Gas
relative to their request for interim rate relief. ;
5. Approval of a site plan for a portion of planned
development (PD-6). This property is located between
Colorado Blvd. and the MK&T Railroad immediately northwest
of Loop 288. (The Planning and Zoning Commission
recommends approval.)

This is the petition of Mr.
Joe 8elew requesting annexation, tight industrial
(LI) zoning classification, and a specific use permit for a concrete batch plant
on a tract totaling approximately 6.2 acres, The tract is located approximately
1,260 feet west of Interstate 35 West about 1,010 feet south of Zimmer Mo*.or Yans, t
8ac~kground:
On August 5, 1980 the City Council approve the follows; petition
of Mr, Joe Belew, as
1. A change of zoning from agricultural (A) to light industrial (LI)
+ classification on a 2,4 acre parcel located along the west side of
I.35W.
2, Annexation and light industrial (LI) zoning on a 6.2 acre tract
located approximately 350 feet west of 1.35W contiguous and west of 4
no. 1 above.
The 6.2 acre tract in this request is :ontiguous and west of no. 2 above.
( Re „rt:
This site is surrounded by vacant ]and, and is designated for light industrial
use by the comprehensive plan.
To serve the site with public facilities will require the installation of a
lift station and extension of an 8" sewer line and 16" water line. Electrical
service is also available for extension to the site and there will be adequate
capacity in the lines.
The site will have access to the 1.35W service road which terminates south of
the entry point to this property, thus affording only one way to and from the
site.
The petitioner is also seeking specific use permit approval for a concrete batch
plant on this property.
The Planning and Zoning Commission felt that the limited access and the batch plant
do not ppresent significant problems because of the surrounding vacant land and
compatibility of the request with the comprehensive plan.
t The Planning and Zoning Commission recommends approval of Z-1451 with 3 in favor
and 2 abstentions.

The regular Teeting of the Denton Plannir3 and Zoning Commission met or. June 4,
1:80 at 5;00 p,m. n the Council Chambers of the Municipal Building.
PRESLNI: Marilyn Gilchrist, Robert Ld Forte, Carole Busby, Bill Brady, and
Linnie McAdams.
ABSENT: Andy Sidor.

Chairperson McAdams called the meeting to order and explained the procedure for

A, Approve the minutes of the May 21, 1980 meeting,
Motion was made by Gilchrist and seconded by Busby to approve the
minutes of the May 27, 1980 meeting. Motion carried unanimously. 4

John Lavretta presented the staff recommendation. $
The Commission discussed thc. batch plant. There were questlons concerning
how the batch plant would affect surrounding development. The Commission
asked if Mr. Belew intended to keep the batch plant at this location.
Charles Watkins stated that he talked to the petitioner end the it alas the
petitioner's desire to keep the batch plant there permanantly.
Pick Svehla spoke concerning problems associated with batch plants. Re
explained that dust is created and gets ca4ght up in the wind. The degree i
of dust in the air depends upon the cleanliness of the batch plant.

John Lavretta stated that the Comnission could grant a renewable specific
use permit subject to periodic reviews.
The Comnission discussed this issue.
Bill Brady arrived at this time.
Motion was made by Gilchrist and seconded by LaForte to approve Z-1451
as requested. Motion carried by a vote of 3; Linnie McAdams and Bill
' Brady abstained.
0. Z-1452. This is the petition of Mr. Lindon H. Nilson requesting s
change of zoning from multi family (MF-2) to neighborhood service (NS)
' classification on 5 lots located between Collier Street r,nd Avenue B,
beginning immediately north of Underwood Street and tooling approximately
1.1 acres.
Dr. Kent Noell spoke in favor of the request.

No one spoke in opposition.
John Lavretta presented the staff recommendation. f
i Dr. Noell spoke in rebuttal.
s The Commission discussed the case.
Motion was made by Gilchrist to approve neighborhood service zoning classi-
fication for lots 17.1, 19.1 19, and 18, and deny neighborhood service
zoning classification for lot lot 17. Motion was seconded by Brady and '
f carried by a rote of 3 to 2. Linnie McAdams' comment on the vote was that
I she voted to deny the request because she would have approved neighborhood
zoning classification for lot 17 also.
E 111. Considerations:
A. Consider the final plat of Metro Industrial Park.
Charles Watkins stated that the staff recommended approval with three
conditions:
1. That site grading will be accomplished to facilitate drainage as shown
on the plans;
2. Only a 50' R.O.W. will be required for Metro Street but no on street
will b emitted.
3. Three (3) pro rata street lights are requi:td.

motion And it carried unanimously.
B. Consider the final replat of Denworth Addition.
Charles Watkins explained the location and stated that the staff
recommended approval.

and Jack Miller. Staff members present were: Jeff Meyer, Charles
Watkins, Greg Edwards, and Susan Wigand.

Chairperson Andy Sidor called the meeting to order.
1. Minutes:
A. Approval of the minutes for the July 2, 1980 meeting.
Motion was made by Linnie McAdams and seconded by Bob Woodin to approve
the minutes for the July 2, 1980 meeting. Motion carried unanimously.
B. Approv..l of the minutes for the July 16, 1980 meeting.
Motion was made by Linnie McAdams and seconded by Carole Busby to

11. Proclamation.
Chairperson Andy Sidor presented the Resolution in Appreciation of
Linnie McAdams. Motion was made by Bob Woodin and seconded by

Charles Watkins explained the revision.
Robert Horn spoke in favor of the amendment to the planned development, 1
and assured the Commission that the sidewalk would be put in right away. ]
Motion was made by Robert LaPorte and seconded by Linnie McAdams to
approve the revised site plan for a portion of planned development (PD-24)
with conditions as written in the staff recommendation to the Plan n ng
Co„x,ission. Motion cirr,ed unanimously.
B. Consider a revised site plan for John Knox Village, PD-22.
Charles Watkins presented the staff recommendation.
Greg Edwards discussed the construction of the infrastructure with the
Commission.
Motion was made by Bob Woodin and seconded by Robert LaPorte to approve
the revised site plan for John KnLx Village, PO-22 with conditions as
written in the staff recomnendation to the Planning Commission. Motion
carried unanimously.
j C. Consider the request of Mr, W. T. Smith for deannexation,
Charles Watkins explained the case, '
Mr. Smith spoke with the Commission regarding his request. He stated
that he would be able to sell it at a reasonable price if it was deannexed,
Robert LaForte stated he felt it was only fair to grant deannexation to
Mr. Smith since the Birch's property, which is closer to town, is deannexed
also.
Motion was made by Bob Woodin and seconded by Jack Miller to deannex
Mr. Smith's property, Motion carried by a vote of 6 - l (Bob Woodin,
Robert LaForte, Carole Busby, Andy Sidor, and Jack Miller voted in
favor; and Linnie McAdams voted in opposition).
j 0. Consider renaming Green Oak Street.
Charles Watkins stated that Green Oak Street has been confused with
Green Oaks Street, and therefore the staff recommends that the street
be renamed. He suggested "Black Oak Street".
Motion was made by Robert LaForte and seconded by Bob Woodi6 to
rensmo Green Oak Street to Black Oak Street. Motion carried unanimously.

Lone Star Gas is posting a bond of $37,000 to apply against the
difference in the current rate schedule and the proposed rate
schedule during the period in which the rates have been suspended,
Lone Star Gas has not yet flied their bond, The Council will be i
advised about the status of the bond during the Council meeting.

NOW, COMES, Lone Star Gas Company, a division of ENSERCH

CORPORATION, a Texas Corporation, and would show the Ho•,orable City i

1. On the 6t.1,0 day of Au::u:t , 1980 Lone Star Gas Company,
a division of ENSERCH CORPORATION, filed a Statement of Intent to change I
the residential and commercial rates in the City of pentoe
Said rates are proposed to become effective thirty-five days after the
date of filing.
2. Section 43(d) of Article 1446c (Public Utility Regulatory Act I
of 1915) provides that a regulatory authority, such as the City Council,
pending a hearing and decision, may suspend the operation of the State- I
ment of intent for a period not to exceed 120 days beyond the date on
which the scheduled rates would otherwise go into effect. If the regu-
latory authorit;, finds that a longer time is needed for a final determin-
ation, the regulatory authority may further extend the period of suspension
for an additional 30 days.
3. Section 43(d) further provides that the regulatory authority at
its discretion may fix temporary rates for any period of suspension.
During the period of suspension by a regulatory authority, the rates in
force when the Statement of Intent was filed shall continue in force 4
unless the regulatory authority establishes temporary rates. j
4. If this regulatory authority finds it necessary to suspend the
ii Statement of Intent previously filed with it, Lone Star Gas Company, a
f division of ENSERCH CORPORATION, respectfully requests that the regula-
tory authority establish temporary rates for the period of suspension,
which will operate in lieu of the present rates now in force until such I
time as final rates are deteemined,
5. By this request, Lone Star Gas Company, a division of ENSERCH
f CORPORATION, does not waive its rights under Section 43(c) of Article
1446r to put changed rates not to exceed the proposed rates into effect I
under bond It the regulatory authority fails to make its final determin-
ation of rates within 90 days from the date that the proposed change

Planned development zoning classification was approved for This tract n 1969.
The PD was amended in 1973 as shown on the attached general plan. Planined
development zoning classification generally has a two-stage review procedure
including first, approval of the zoning and secondly, review, and acceptance
by the planning and Zoning Commission and City Council of a detailed site plan.
The developer of this parcel has sutomitted a proposed site plan for development
of a Target store and another retail outlet, which is consistent with the land

of the Cities of Denton and Arlington, Texas, pr~posaa to Issue
revenue bondsl that such bonds would be initially issued as
'Series E' Fonds to the aggre;sto principal amount of up to
55,000,000 and 'Serifs CO Bonds in the aggregate principal
amount of up to Mfoco,Ooo and that such bonds would be
payable from and be sacured by a pledge of revenues derived
i from or by reason of th, ownership of student loan notes and 1
investment income after deduction of such expenses for
operating the loan program as may be specified by the bond
resolution or trust indenture authorlaing or securing such

At the April, 191 City Election, the voters will elect one
councilperson from each of four single member districts for the
first time.
It is necessary that the City Council designate new voting
places within each dAstrict and these new voting locations must
be approved by the Justice Department prior to the April, 1901
election,
The Justice Department requires that public notice and a
hearing be held on designating new voting places.
We have asked that this item be placed on the Council Agenda
for September 2, 1990 so that you can call a public hearing and I
give notice of the date you select for the public hearing,

As direct-ad by the City Council on August 51 1480, the Staff
and Public Utilities Board have developed a Contract for a
1981 Electric Utility Power Supply Study. Gilbert and I
Associates have been contacted and contract terms have been
reviewed and negotiated to the satisfaction of both parties.
A copy of the proposed contract for sucn services is attached.
The time frame anticipated is as follows:

BACKGROUND OF TMPA PROJECT

-the City of Denton is presently a member of TMPA, a
i
joint action agency formed in 1975 for the purpose of providing I
wholesale olectrical power and energy for the cities of Bryan,
r
Denton, Garland and Greenville. TMPA is required by contract with
the four Cities to provide future
power and energy for the Cities.
in an effort to meet this commitment, TMPA, is presently studying
several power supply alternatives and have expressed plans to
l
propose a project to the TMPA Board in January 1981 0 if such project
is determined to be feasible. Upon approval by the Hoard, TmPA is
required to submit such project plan to the four Cities for
approval. Each city has 60 days to approve or deny pacticipation in EE1
the project,
in 1979 the Denton City Council i
passed an ordinance
requiring a referendum vote of the Citizens of Denton prior to
i j
approving any such project, By State Statutes such elections can
j occur only on certain designated dates, four times per year, it is
anticipated that such election would take place in April, 1981.

SUMMARY i
included in our EPA Grant for expanding our Wastewater
Treatment facilities is a line item for materials testing, We
have received a proposal from Southwestern Laboratories of
Fort Worth (See Exhibit 1) for materials testing on surface
soils, structural concrete, structural steel and hot-mix
asphaltic concrete. We have reviewed the proposal with our
Consulting Engineers, Freese and Nichols, and have mutually
determined that the costs are reasonable. In addition, Freese
and Nichols have gi%^a Southwestern Laboratories a very
favorable recommendation.

Change Order of Gracon Construction Company for Constructing
a Storage Building,
SUMMARYt
A few weeks ago, Gracon Construction Company Project
Superintendent, Marvin. Beck, advised us that he was going to
build a 40' x 60' .structure for storing his materials and
equipment at the Wastewater Treatment Plant job site. He
indicated at that time that the structure would be temporary,
but asked if we would like to participate in the cost of
building a permanent structure that we could use after he has
moved out. The costa involved would only be for extra
materials since ha would have to spend his labor on the a
construction of the building whether it be temporary or
permanent.

The City Staff as well as the Project Engineer have met with
Gracon Construction Company to discuss details such as
building dimensions and location. The attached change order
(see Exhibit 1) details the building and given -,oat factors. 1
The City Staff will approach the Texas Department of Water
Resources on possible inclusion of the building in our EPA
Construction Grant.

On August 199 1980 the City Council awarded bid 18790 as recommended
by the Staff. 'When the vendor, Priester Supply, was notified of the award for
item 12 we were informed they could not meet our requirements for testi+,g and
certification. The using department feels these requirements are critical. We
recommend the award for bid 18190 item 02 be withdrawn from Priester Supply
and awarded to Temple, Inc.

These transformers vili be paid for from budget funds account number
02-52-92-22, Electric Distribution line transformers.

parts on this unit needed rebuilding and/or replaced. Darr Equirment is the
only authorized repair center for Caterpillar equipment in this ared. We
authorized them to make the repairs is soon as possible and return the unit to
operation.
