F ' f MCI C2'Y MR1TMY ~i • I a f } S' n Planning and Zoning Commission Recommendation to the City Council l Z-1468 October 21, 1980 ~ i Identity and Locations 2-1468_ This is the petition of Mr. Robert H. Parham requesting a change of zoning from neighborhood service (NS) to general retail (GR) at 628 through 636 Londonderry Street. The property is more particularly > described as all of Lot 3, Block A of the replat of part of Teasley Mall subdivision, Report; This is a request to change the existing Teasley Mall strip; center on Londonderry from neighborhood service zoning (NS) to general retail type zone (GR). The major purpose of the request appears to be a need to broaden the scope of potential tenants for the center, J In review of our zoning ordinance you will see the major' difference. between NS zoning and h zoning is 1) the size of the retail permitted and 2) some additional uses permitted in GR. The zoning ordinance size limitation is 40000 square feet of retail space for NS zoning while GR can be of any size, Since this request is for an existing building this is not a major question, _however there is a major question about the precedent this might met for W additional zoning requests south of Londonderry on Teasley There is currently an extensive amount of more intense.typa Ovalopment' in the area such as multi family and general retail as well as numerous additional vacant acreage for more multi family and retail. Thus _a policy determination on future requests in this area will be a bye I product 'of this request, If the existing zoning line just south of III Londondel (which includes this request) can be maintained as the 4 limit of this area's contiguous concentration of more intenre develop- ment then the subject request would present no major impact. However, if this case is judged as an extension of the current high intensity zoning in the area then some question of the request would be in order. As to the use questions, GR zoning allows limited uses not allowed in NS, For example the following is a sample list of additional uses that would be aliowedi I 1 auto parts sales & repairs (indoor) 2 retail plant nursery 3 auto laundry 4 service stations S onipremise sale of beer and wine b prvate clubs 7 household appliance repair 8 retaurant i 3 i yF i f I u• v yy,e ri ~4~9''~r aa.; :Gre.y _ra, .-r, , AZr.. . „ - ~ . , . _ C Z-1468 Page Two precedent for further The Planningg and zoning Commis sion felt that this was a reasonable request, and should development down Teasley i contiguous striping of higher intensity Lane. Three persons raised their hands in opposition. The Commission discussed the petition, Some Commissioners felt the proposal was not a spot zone and was consistent with the existing zoning, and felt that single family housing was unlikely to develop along Malone whibh is a busy street. ' Other Commissioners felt the proposal was spot zoning; that there is a need to protect the neigghborhood from this typa of use and that adequate land is zoned appropriately for thhiie` type of use elsewhere, They felt that permitting the office use across the street from this parcel was a poor decision and should not be expanded, Motion was made by Woodin and seconded by Gilchrist to approve Z-1466, Motion failed by a vote of 3 to 3 (Bob Woodin, Marilyn Gilchrist and Andy Sidor voted to approve, Robert LaPorte, Jack Miller, and Carole Busby voted to deny.)
