was held on October 1, 1980 at 5:00 p.m. in the Council Chambers
of the Municipal Building, 1
Present: Bob Woodin, Marilyn Gilchrist Robert LaForte, Carole
Busby, Andy Sidor, and Jack Miller. Staff present were: j{

A. Approve the minutes of the Aguust 27, 1980 study session,

Motion was made by Woodin"and seconded by Busby to approve the

the minutes; motion carried unanimously,

11, Public Hearinga.
A. Z-1466, This is the petition of.Mr. Victor R. Alvarez
requesting a change of zoning from single family (SY;7) to
planned development (PD) classification for office use, The {
property is located at the northwest corner of Malone and
Broadway Streets The parcel is a part of the W. W. Wright
Addition and is approximately .6 acres in size,
Attorney Richard Kelsey spoke in favor of the petition }
stating that the petitioner was willing to agree to all the {
conditions suggested by the staff,
Mr, Will Wagers spoke in opposition.
Mrs. Jones spoke in opposition.
Charles Watkins presented the staff report, concluding that the
staff saw no significant adverse impact on the surrounding
neighborhood if all suggested conditions were met,
Mr. Kelsey spoke in rebuttal.

Andy Sidor asked all those in the audience who were in
opposition to raise their hands. Three persons raised their
hands in opposition.
The Commission discussed the petition,
Some Commissioners felt the proposal was not a spot zone and
was consistent with the existing zoning, and felt that single
family housing was unlikely to develop along Malone whibh is
a busy street.
' Other Commissioners felt the proposal was spot zoning; that
there is a need to protect the neigghborhood from this typa of
use and that adequate land is zoned appropriately for thhiie`
type of use elsewhere, They felt that permitting the office
use across the street from this parcel was a poor decision
and should not be expanded,
Motion was made by Woodin and seconded by Gilchrist to approve
Z-1466, Motion failed by a vote of 3 to 3 (Bob Woodin, Marilyn
Gilchrist and Andy Sidor voted to approve, Robert LaPorte,
Jack Miller, and Carole Busby voted to deny.)
B. Z-1468, This is the petition of Mr. Robert M. Parham
requesting a change of zoning from neighborhood service (NS)
to general retail (CR) at 628 through 636 Londonderry Street,
l The property is more particularly described as all of lot 3,
block A of tha replat of part of Teasley Mall subdivision,

Woodin moved to deny the petition, motion died for a lack of a

_ WHEREAS, the City Council of the Ctty of Denton, Texas, has
been raquested by the owners of certain property to vacate, and
