This is the petition of Mr. J. V. Strange requesting a changge of
zoning from office (0) classification to planned development ;PD)
for one family detached housing on lots ranging in size frog 41 X
114 feet to 58 X 128 feet. The property in this request is located
along the north side of Hollyhill Street and is more patticulariy. r•
described as block 2, lots 4, 5, 6, 8, and 9 of Southridg,% Addition. l
Reports
The'site& in this request are vacant. Surrounding land use includes
singgle family housing to the south, Southridge Park to the east,
duplexes north of lot 4, and a duplex at the northeast corhar of
Woodbrook and Hollyhill and Moore Business Forms wait of Woodbrook.
Public facilities are available for extension to the site and there
is adequate capacity,
The ppro arty in this request is zoned office (0 classification,
The Dan~an Zoning Ordinance is a cumulati4a ordinance, which means
that anyo more restrictive use, is permitted in the: zone such as
detaehcd single family housing, attached single family housing on
j 20 X 1J0 foot lots, two-family, and multi family including high rise
apartments.
Given the variety of uses permitted in an office zone, the length
of time the property has been zoned for office use, and the
restrictive nature of the request,the Planning and Zoning Commission
unanimously recommends approval of A-1472 with the following
conditional
1. The minimum square footage shall be 1650 square feet
excluding garages, porches, and breezeways,
2. Rear entry arages and driveways shall be required for
all of the "pat o homes",
3, A minimum 75% masonry shall be required on all exterior
walls excluding windows, doors, and porch areas.
4. A minimum front yard setback of 25 feet shall be required,
5, A minimum side yard setback of 5 feet shall be required,
6. A minimum 10 foot rear yard setback shall be required.

The regular meeting of the Denton Planning and Zoning Commission was
held on October 15, 1980 at 5=00 p.m, in the Council Chambers of the
Municipal Building,
PRESENTi Bob Woodin, Carole Busby, Marilyn Gilchrist, Jack Miller,
and Linuie McAdams. Staff present were Jeff Me are Charles
Watkins, Rick Svehla, Greg Edwards, and Susan Wigand,
ABSENTS Robert LaForta and Andy Sidor.
Carole Busby called the meeting to order,
1. Approve the minutes of the October 1, 1980 meeting.
The minutes were amended as follows: I. A. change uust
to Au_gu r, It A. 9th paragraph - delete "which is a ustrut. and add instead "and across from another office.Motion was made by Woodin and seconded
by Gilchrist to
adopt the minutes as rmended, Motion carried unanimously.
Carole Busby explained the procedural policy for the meeting. j
The order of the agenda was changed so that Z-1472 would be heard
first.
II. E. Z-1472. This is the petition of Mr. J. V. Strange requesting
a change of zoning from office (0) classification to planned
development (PD) for one family detached housing on a minimum
lot size of 41 K 113 feet. The ropperty in ths request is
located along the north side ofollyhiil 3trsit and is more
particularly described as block 2, iota 4, 5, 61 81 and 9 of
pouthridge Addition,
Carole Busby described the case.
Charles Watkins described the surrounding land use and stated
that public facilities are available for extension to the site.
Tom Jester, representing Virgil Strange, spoke in favor of
the request,
Linnie McAdams arrived at this time,
Virgil Strange, etitionar, spoke in favor of the request,
stating that he Mt A responsibility to the current residents
of Southridge,and also to the people interested in purchasing
his hoaxes. He stated the minimum value of each home would be

Marilyn Gilchrist asked Charles Watkins if the.treen space
would be lass with a patio hose opposed to a duplex, since
some of the residents in the area were concerned thkt there

Charles Watkins stated that the green space would be the same.
Virgil Strange spoke in rebuttal, stating that after the home
was built there would be the same amount of land or more land
left as compared to a duplex, and that he would add tress in
the front. `
The Commission discussed the case.
Marilyn Gilchrist stated that she wet stronggly.in favor of
the request because the houses art high quality, and feels
Denton needs to'offsr people homes that are not attached
k but yet hove loss of a yard to take care of compared to a
home built on a 7,000 square foot lot.
Linnis McAdams felt that planned development was better for ,
the residents than office zoning becaus` with a planned
development restrictions can be placed on the property. ;
Bob Woodin pointed out that patio homes are less dense than
duplexes, and under the current zoning duplexes would be
allowed,

Grant Jacobson spoke in favor of his petition, stating that
the current density requested is 42 units but would consider
lowering the density to 35 units if the Commission wished.

Jack Miller moved to approve Z-1467 with the amendment that
I~ the density be lessened to 35 units and with the following
conditions: }
1. A 6 foot solid masonry fence shall be constructed clong the I

It was agreed that "if any" on the fifth line of paragraph N.
would be deleted. Linnie McAdams moved to approve and Jack
Miller seconded the motion. Motion carried unanimously. (4-0)
3 #2 Xn ordinance amending Article 17 of the Zoning Ordinance
of the City of Denton, Texas, by adding a new subsection M
regulating special civic event temporary signs located on
residential property; and declaring an effective date.

A. Consider final plat approval of Denton South Addition and
site plan approval for a portion of PD-6.
Motion was made by Linnie McAdams, and seconded by Marilyn
Gilchrist to approve the final plat of Denton South Addition.
Motion carried unanimously.
David Dunning spoke in favor of the site plan for a portion s
of PD-6, statingg that he had met with the property owners
and was agreedbla to some changes. These changes are:

1. The building will face the highway so noise will funnel
out onto the highway.
2. A brick fence in the rear will separate the single family
homes from the commercial property.
3. Pole sign height will be reduced.
4. The rear door of the building will be used as a fire door
the main entrance and exit for customers will face the highway.
Herbert Jockey, Vice President of Homeowners Association, ^a. f
spoke concerning the site plan for PD-6. The main concern
was noise.
Greg Edwards, City Engineer, expressed concern about, the access
to the property. He stated that he had met with the Highway ;
Deppartment but that a solution has not been arrived'at., He
asked the Commission to table this item until a decision was
arrived at.
The Commission discussed the matter with Mr. Dunning.
Linnie McAdams moved to table the approval of the site plan
for PD-6. Jack Miller seconded the motion and it carried
unanimously. (4-0)

` This is the petition of Mr. Victor R. Alvarez requesting a change of
a zoning from single family (SF-7) to planned development (PD) classifi-
cation for office use. The property is located at".the northwest
1 corner of Malone and Broadway Streets. The parcel is a part of the
W.W. Wright Addit.'on and is approximately .6 acres in size.
Report:
The lot is vacant, with single family abutting to the north and
west bordering Broadway on the South;iand fronting Malone'on the east.
Public facilities are available for extension to the site and there j
is adequate capacity.
Major considerations in this case are:
1. The need for the use in the neighborhood.
2. The impact on abutting property owners. ,
3. The amount of similar higher intensity development in the
neighborhood area and the precedent for future requests.
4. The character of the proposed development as to its scale
and appearance with the surrounding neighborhood.
1. The need for this zoning or use at this location is highly questionable
when considering all of the currently vacant zoning in this general
an interior location
quadrant of the city. Normally such a use at
on a collector type street like this is reserved for local neighborhood
service. This use, however, is intended to serve clients on more of a
city-wide basis and therefore should normally be located in a more
city-wide office/commercial center, such as on University or towards
Scripture.
2. The impact on abutting property owners could be negative if not
properly screened and the setback and the scale and operation of
the building' controlled. 'therefore, if approved, it is recommended
the PD site plan stipulation include such things aas
a) A solid 6 foot masonry screening fence of equal architectural
appearance of the main building running along the west and
noith property line of the subject site,
b) All buildings set back from all property lines at least 251.

Identity and Locations Z-1471
This is the petition of Mr. Fred W Vaughan requesting a change of
zoning from agricultural (A) classification to Commercial (4).
The parcel begins on the north side of the corner of FM 1173 and the
Interstate. 35 service road and is approximately 1,8 acres in size.
Ravort:
The parcel in this request is vacant, A single family house is
located to the north with a retail store and truck stop further northi g;
vacant land is on the south and west and I-35 to the east.
The 1974 comprehensive plan designates this site for office use and
the land Just north of this site for light industrial use; while the
proposed consensus plan designates this general area for high in-
tensity use.
Given surrounding land use, the proximity of the Tixaoln'otruments
property, the iodation alon a major transportation borridor, and
the foot that north Loop 281 will connect with 2-35 in this vieielitq,
higher intensity uses seem reasonable to the planning and Zoning
Conmaittee.
The Petitioner originally requested light industrial (Li) zoning
on this parcel and expressed or desired to sell portobie'buildings And
horse trailers at this location. Inasmuch as the proposed use'cah be
accomadated with a commercial (C) classification, the petitioner
corsonted to modify the request to commercial. ,
(The Planning and Zoning Committee recommeds approval of Z-1471 by a
4-0 vote).

CAIRESVILLE, COOKE COUNTY, TEXAS AND THE CITY OF DENTON, DEVTON
COUNTY, TEXAS.

SUMMARY:
In early 1980, the Utility Department made preliminary
investigations of the feasibility of installing hydroelectric
unite on Lewisville Lake and Ray Roberts-Reservoira, but did
"j not take any action because of the contract negotiations
underway with Dallas and the Corps of Engineers regarding R&
Roberts and Lewisville Reservoirs. The City' of Denton's
electrical system consulting engineers, Black and Veatch,
assisted Denton in these preliminary investigations.
On August 25, 1980, Continental Hydro Corporation of Boston,
Mass., filed an application for a preliminary permit with ,the
Federal Energy Regulatory Commission to study the feasibility
of installing a hydroelectric generator at the outlet of
Lewisville Lake. Governmental entities, such as the City of
Denton, have priority over privately owned companies for-such
projects. Denton has until December 4, 1980, to file 'a
notice of intent for a competing application on Lewisville.
K Denton then would have until February 2, 1980, to submit the
complete application.
The hydroelectric facility being proposed by Continental
Hydro is 8 4.100 KW unit. Annual energy production would, be
11,700,000 KWH, Sales would be to TPSL. continental, Hydro
estimated that studies performed under the-preiminary permit
would cost $52000. However, the figure was probably
partially arrived at by the fact that Department of 6nelgy
grants up to $50,000 are available for such studies.
A preliminary investigation by the Corps of Engineers j
indicated that the capability of Lewisville was 2,780 KW with
estimated annual energy of 6,')50,000 KWH at a coat of 4.7?D
per KWH.
Preliminary investigations indicate that a hydroelectric unit
for Ray Roberts Lake would be approximately 70% as large as
the unit for Lewisville Lake.

The developer seeks to subdivide a tract totaling approximately
23 acres in planned development (PD-6) located along the north side
of Dallas Drive and along the northwest side of San Jacinto Blvd. ^
The parcel is designated for commercial (0) use. Inasmuch is thi>a
