The regular meeting of the Denton Planning and Zoning Commission was
held on October 15, 1980 at 5:00 p.m. in the Council Chambers of the
Municipal Building.
PRESEAT: Bob Woodin, Carole Busby, Marilyn Gilchrist, Jack Miller,
and Linnie McAdams. Staff present were Jeff Meyer, Charles
Watkins, Rick Svehla, Greg Edwards, and Susan Wigand.
ABSENT: Robert LaForte and Andy Sidor.
Carole Busby called the meeting to order,
1. Approve the minutes of the October 1, 1980 meeting.
The minutes were amended as follows: I. A. - change AAuust
to Auger srt, 11. A. 9th paragraph delete "which is a, u
street, and add instead "and across from another office."
Motion was made by Wcodin and seconded by Gilchrist to
adopt the minutes as amended. Motion carried unanimously.
Carole Busby explained the procedural policy for the meeting.
The order of the agenda was changed so that Z-1472 would be heard
first.
11. E. Z-1472. This is the ppetition of Mr. J. V. Strange requesting
a char?e of zoning from office (0) classification to planned
development (PD) for one family detached housing on a minimum
lot size of 41 X 113 feet. The propertyy in this request is
located along the north side of polpyhil1 Street and is more
par.icularly described as block 2, lots 4, 5, b, 8, and 9 of
pouthridge A.ddition.'
Carole Busby described the case.
Charles Watkins described the surrounding land use and stated
that public facilities are available for extension to tho site.
Tom Jester, representing Virgil Strange, spoke in favor of
the request.
Linnie McAdams arrived at this time,
Virgil Strange, petitioner, spoke in favor of the request,
stating that he felt a responsibility to the current residents
of Southridge and also to the people interested in purchasing
his homes. He stated the minimum value of each home would be
$1000000 - $135,000. The aids would have sprinkler systems
and would be landscaped. iach hove would have a rear entry garage.

Mr. Strange added that all fences would be of masonry or wood
construction. Each would be a single family dwelling. Mr.
Strange presented photographs of typical patio homes in Dallas.
He stated that he would not sell the lots but would develop
the lots himself,
Fred Vaughan, resident of 306 Hollyhill, spoke in favor of
the request as a prospective buyer of one of the patio homes,
Joe Skiles, owner of 1407 Ridgecrest, spoke in opposition
to the request,
John Kokalis, owner of 1803 Concord Lane; spoke in opposition
to the request.
Dwight Gailey, owner of 1722 and 1724 Stonegate, spoke in
opposition to the request,
Ronald Smith, owner of 1800 Concord, spoke in opposition to
the request.
Charlie Watkins presented the staff recommendation, which w4# I '
approval.
Marilyn Gilchrist asked Charles Watkins if the green eppaci {
would be leas with a patio home opposed to a duplex, since',
some of the residents in the area were concerned that there

might be less green space.
Charles Watkins stated that the green space would be the same.
Virgil Strange spoke in rebuttal, stating that after the hone
was built there would be the same amount of land or more land
left as compared to a duplex, and that he would add trees in #
the front.

The Commission discussed the case.
Marilyn Gilchrist stated that she was strongly in favor of
the request because the houses are high quality, and feats
Denton needs to'offer people homes that are not attached
but yet have lesa of a yard to take care of compared to a
home built on a 7,000 square foot lot,

Linnie McAdams felt that planned development was better for
the residents than office zoning because with a planned
development restrictions can be placed on the property,
Bob Woodin pointed out that patio homes are less dense than
dupplexes, and under the current zoning duplexes would be
allowed,
Jack Miller moved to approve 2-1471; Marilyn Gilchrist seconded

A, Z-1467. This is the petition of Mr. Grant Jacobson
j requesting an amendment to a portion of planned development
(PD-25), and a change of zoning from single family (SF -7)
to planned development. The amendment of the planned .
development and zoning change from SF-7 to planned develog-
ment would permit development of a maximum of 42 one family
attached units on a tract tota]ing a proximately 4.1 acres.
The parcel is located along the south side of Windsor Drive
beginning approximately 450 feet west of Stuart Road.
Carole Busby described the case,
Charles Watkins further described the case.
Grant Jacobson spoke in favor of his petition, stating that
the current density requested is 42 units but would codsider
lowering the density to 35 units if the Commission wished.
No one spoke in opposition.
Charles Watkins presented the staff report.
Jack Miller moved to approve Z-1467 with the amendment that
the density be lessened to 35 units and with the following
conditions:
1. A 6 foot solid masonry fence shall be constructed along the
southern boundary of this portion of PD-25 before any building
permits will be issued for this development,
2. Plat approval shall constitute site plan approval.
Marilyn Gilchrist seconded the motion and it carried unanimo" ly.
B. Z-1464. This is the petition of Mar; Lou Collins requesting
a Changge of zoning from single family (SF•7) to office (0)
classification at 1614 Underwood Street. The parcel is more
particularly described as lot 6, block 3 of the replat of
Chapman Addition.

Gilchrist to approve Z-1471. Motion failed by a vote of J
3 - 1 (Miller, Busby, and Gilchrist voted to approve, McAdams
voted to deny).
Jack Miller moved to approve the zoning request from
agricultural (A) to commercial (C) classification. Motion
was seconded by Marilyn Gilchrist and carried unanimously.
F. Z-1473. This is the petition of Mr. Robert Justice
requesting a change of zoning from two family (2-F) to
multi family restricted (MF-R) classification on a parcel
located along the west side of Bernard Street beginning
approximately 195 feet north of the intersection of Garvin
and Bernard Streets. The property is more particularly
described as Block E, lots 8, 9, 10, and 11, Southpark

! City of Denton, Texas, effective January 1, 1986; and prohibiting
portable signs effective January 1, 1986. Motion carried
unanimously.

zoned property; and declaring an effective date.
It was agreed that "if any" on the fifth lineof paragraph N.
would be deleted. Linnie McAdams moved to approve and Jack
Miller seconded the motion. Motion carried unanimously. (4-0)
#2 An ordinance amending Article 17 of the Zoning Ordinance
of the City of Denton, Texas, by adding a new subsection M
regulating special civic event temporary signs located on
residential property; and declaring an effective date.

David D%nning spoke in favor of the site plan for a portion
of PD-C, stating that he had met with the property owners
and was agreeable to some changes. These changes are:

1. The building will face the highway so noise will funnel
out onto the highway.
2. A brick fence in the rear will separate the single family
homes from the commercial property.
3. Pole sign height will be reduced.
4. The rear door of the building will be used as a fire door

Herbert Jockey, Vice President of Homeowners Association,
spoke concerning the site plan for PD-6. The main concern
was noise.
Greg Edwards, City Engineer, expressed concern about the access
to the property. He stated that he had met with the High%4y
Department but that a solution has not beer) arrived at. He }
asked the Commission to table this item until a decision was
arrived at.
The Commission discussed the matter with Mr. Dunning.
Linnie McAdams moved to table the approval of the site plan
for PD-6. Jack Miller seconded the motion and it carried j
unanimously. (4-0)

This is the petition of Mr. Victor R. Alverez requesting a change of
zoning from single family (SF-7) to planned development OD) classifi-
cation for office use. The property is located'at the northwest
corner of Malone and Broadway Streets. ` The parcel is a part of the
W.W. Wright Addition and is approximately .6 acres in size.
Report:
The lot is vacant, with single family abutting to the north and
west bordering Broadway ca the South;:and fronting Malone on the east.
Public facilities are available for extension to the site and there '
is adequate capacity.
Major considerations in this case are:
1. The need for the use in the neighborhood.
2. The impact on abutting property owners.
3. The amount of similar higher intensity development'in the
neighborhood area and the precedent for future requests.
4. The character of the pproposed development as to'its acale
and appearance with t1le surrounding neighborhood.
1. The need for this zoning or use at this location is highly.questionabl
when considering all of the currently vacant zoning in this general
quadrant of the city. Normally such a use at an interior location
on a collector type street like this is reserved for rcai neighborhood j
service, This use, however, is intended to serve clientl on more of a
city-wide basis and therefore should normally be located it's. more
city-wide office/commercial center, such as on University or towards
Scripture.
2, The impact on abutting property owners could be negative if not
properly screened and tha, setback and the scale and operation of
the uilding controlled.' Therefore, if approved, it is recommended
the i) site plan stipulation include such things as:
a) A solid 6 foot masonry screening fence of equal architectural
appearance of the main building running along the west and
mith property line of the subject site.
b) All buildings set back from all property lines at least 25'.

architectural character as the main building and not located
in any'iequired yard and not to exceed 5 feet in height or

The regular meeting of the Denton Planning and Zoning Commission
was held on October 10 1980 at 5:00 p.m, in the Council Chambers
of the Municipal Building,
Present: Bob Woodin, Marilyn Gilchrist, Robert LaPorte, Carole
Busby, Andy Sidor, and Jack Miller. Staff present were:
Jeff Meyer, Charles Watkins, and Greg Edwards.
Absent: Linnie McAdams.
1, Approval of minutes:
' A. Approve the minutes of the Aupust 27, 1980 study session.
Motion was made by. Woodin and seconded by Busby to approve the
minutes; motion carried unanimously.
B. Approve the minutes of the September 10, 1980 study session.
Motion was made by Miller and seconded by Woodin to approve
the minutas; motion carried unanimously.
G. Approve the minutes of the September 17, 1980 regular
meeting.
Motion was made by Gilchrist and seconded by Busby to approve 1

A. Z-1466. This is the petition of Mr, Victor R. Alvarez t ;

Attorney Richard Kelsey spoke in favor of the petition
stating that the petitioner was drilling to agree to all tEe
conditions suggested by the staff.
Mr, Wili Wagers spoke in opposition.
Mrs. Jones spoke in opposition.
Charles Watkins ppresented the staff repor, concluding that the
staff saw no sigbifiesnt adverse impact t.& the surrounding
{ neighborhood if all aMeited conditions were met.

Andy Sidor asked all those in the audience who were in
opposition to raise their hands. Three persons raised their
hands in opposition.
The Commission discussed the petition.
Some Commissioners felt the proposal was not a spot zone and
was consistent with the existing zoning, and felt that single
family housing was unlikely to develop along Malone and across
from another office,
Other Commissioners felt the proposal was spot zoning; that
f there is a need to protect the neighborhood from this t ppe of
use and that adequate land is zoned appropriately fortis
type of use elsewhere. They felt that permitting the office
use across the street from this parcel was a poor decision
and should not be expanded.
Motion was made by Woodin and seconded by Gilchrist to approve
Z-1466. Motion failed by a vote of 3 to 3 (Bob Woodin, Marilyn
Gilchrist and Andy Sidor voted to approve; Robert LaForte,
Jack Miller, and Carole Busby voted to deny.)
B. Z-1468, This is the petition of Mr. Robert `H, Parham
requesting a change of zoning from neighborhood service (NS)
to general retail (GR) at 628 through 636 Londonderry Street. }
The property is more particularly described as all of lot 3, #
block A of the replat of part of Teasley Mall subdivision, y
f Mr, Robert Parham spoke in favor.
f No one spoke in opposition.
Charles Watkins presented a favorable staff report.
Woodin moved to deny the petition, motion died for a`lack of a
second.
Gilchrist moved to approve Z-1468, Miller seconded the motion;
the motion carried by a vote of S to 1 (Woodin voted to deny).

Greg Edwards ppresented a favorable staff report and recommended
that when additional development was proposed on Contiguous
property owned by the church that the church would need to
plat and extend public facilities to serve the future building
sites and pay pro-rata for existing lines.
Motion was made by Robert LaForte and seconded by Busby to
approve as per staff recommendation. Motion carried unanimously,

I The purpose of this letter is to outline t,WFW's approach and
costs for selecting new computer equipment and "core" software
for the City of'Denton as part of Phase II of the Data Processing
study. This effort entails three (3) major tasksl
j,
1. Development of a detailed Request foi Proposal (RPP) to be
sent to qualified vendors for a "turnkey" computer system {
including computer equipment and the "core" applications I
software outlined in our Phase I report.
2. Selection of qualified vendors to receive the RFP `nd the
evaluation of these vendors' proposals, The evaluation
process will include the definition of evaluation 'orite'ria
and the narrowing of the responses to the top two or three
proposals.

3. The selection of the beet vendor's proposal considering !
Denton's needs and the development of a detailed +
implementation plan and schedule based on this selection.
The selection process is planned to include up to three site
visits to observe the top vendors' software in operation at {
an existing user site.
We project that this process can be completed by raid to late
January given a mid-November start date. As we have discussed,
the City of Bryan, Texas is considering authorizing LWEV.to
initiate a Computer Systems Selection process very similar to the I
one outlined In the letter. We have recently completed an
Information Systems Needs Analysis for the City of Bryan and,, as j
you might expect, their information systems needs are comparable i.
to Denton's. As I've discussed with you and Ernie Clark, LM
could conduct this work for both cities in concert at a cost
savings to both Denton and Bryan. Wo feel we could do this in
the Same "time frame with the special needs of each city fully
considered, On the following pa e, I've summarized the cost of
the selection project done indoependently for Denton and its
concert with Bryan. I suggest you ask your council to authorize
the larger amount with the understanding that if we receive

Several months ago the developer and railroad reached an
agreement on a storm sewer and sanitary sewer crossing for the t'

for the storm sewer crossing was signed. HHowevet the
railroad elected to write a separate permit for the sanitary
$Ewar, This agreement would conclude all of the negotiations
done by the developer, City and railroad.

SUMMARYs This bid is for the purchase of three tandem
axle, diesel powered, 10 to 12 yard dump
trucks for use by the Stt.at Department.
These three large trucks will replace six (6) "
of the smeller 1974 6 yard - dumptrucks that '
