Use Plan. It is the overall policy of this plan that apartments be dim-
-parsed throughout the city with limited areas of high concentration.

standard, however, if this area-is developed as currently zoned total trip
generation will be approximately 13,500 vehicle trips per day which will
exceed standard by about 3,000 trips.

There is an existing four-plex located behind the church and an apartment
complex consisting of 64 units northeast of the site, a 24 unit complex at
the southwest corner of Eagle and Welch for a total of 92 units. in addi-
tic" the block bounded by Eagle, Fannin, Beatty, and Bernard Streets is
zoned multi family (MF-1), the existing.land use on this block is single
family but if it were redeveloped according to MF-1 zoning approximately 120
units could be built. If this occured then there would be one continuous
cluster of apartments in excess of 500 units.
Under the heAding of "Spot Apartment Development in Older Single Family Areas`
the Land Use Plan states that "some older neighborhoods have been opened up
to apartment development and there are some unique parcels that are uorealisti
for further single family development." HoVever, the interior area of the
neighborhood (Eagle, Bernard, Greenlee area) has not been opened up by past
zoning. It is felt that this parcel is not unique in that it can be replotted
into two (2) single fancily lots, duplex, or other similar land use could be
considered, The Land Use Plan goes on to say that "if it is determined that
single family preservation is not totally preferable for the neighborhood and
higher density housing is to 6e allowed, then, it is the policy.of this guide '
that existing single family still will po ea pare for for that preservation.

the deveiopmeent proposal only appears to meet 2.of 8 criteria for riulti-famrily
development in a low intensity area, and is highly questionable in regard to othw
specific policies In spot apartment zoning and special protection for older

Yvonne Jenkins, Chairperson of the Denton County Historical
Commission and ex-officio member of the City of Denton Historic
Landmark Commission spoke in opposition to the amendment.
G. R. Hadley spoke in opposition to the amendment.
i Ranndyy Boyd, a member of the City of Denton Historic Landmark
e Commiasion, spoke in opposition to the amendment.
Aullitt Lowry spoke again in opposition. ,
Bob Woodin asked Mr. Lowry how the Department of interior j
would respond to this change in the ordinance. I
Mr. Lowry replisd that if they followed their past to
~j of using the National Register as a modal it would be likely
i that the Department of interior would not accept the ordinance.
He stated that the Department now lets on uneonsenting property
owner file an "Owner Objection",however this excludes the
property ownex from the tax breaks and the regulations '
which go along with having 04ir propercy zonad.as,a historic
landmark still apply.
David Lllison'stated that he spoke with Ms. Grovner of the
Department of Interior, and that it wr.i her opinion that
this amendment would threaten certification of the ordinance.
Mr. Pearce spoke in rebuttal, stating that the City of Austin's
i ordinance concerning historic landmarks was amended because it
was found unconstitutional.
Robert LaPorte.stated that he felt opposed to any amendment
which may threaten tax breaks and therefore moved to deny
J , the amendment. Linnis McAdams seconded and the motion carried
i unanimously.

Summary:
Mr, and Hrs. Michael Thompson originally submitted a petition for a specific `
y
use permit to the Planning and Zoning Commission and the City Council on
March 31, 1981. The Planning and Zoning Commission held a public hearing to
consider the request at its April 150 1981 meeting, and based on information !
before it, recommended denial. The Thompsons then appeared before the City
Council with new information related to the parking and driveway arrangement I
which had been a major factor in the Planning and Zoning Commission's
recommendation of denial. Largely as a result of significant information
different from that originally presented, the City Council referred the ;
request for the specific use permit (5-156) back to the Planning and toning
Commission for its review. The Thompsons consulted staff in the Planning
{ and Community Development Department and the Building Official's Division
in an effort to come up with an adequate plan for parking and traffic flow.
The present plan (see attachment 03) is acceptable and it does meet City
of Denton standards. The Planning and Zoning Commission reviewed the new
site plan, and upon tonsidering this information along with other factors,
took no action on this request at its May 20, 1981 meeting for lack of a
maJority ruling. The Planning Commission vote was 3 in favor of the request,
2 opposed, and 1 abstention. ,
Recommendation:
Although the Planning and Community Development Department feels that the
parking and traffic flow plan has improved significantly, we also feel that
this is not an ideal location for the day care center when considering traffic
flow during peak hours and the close proximity of this site to the Avenue A -
,rile Drive Intersection.
The '-and Use Plan states in its Housing and Neighborhood Preservation
section (p. 26) that it is the overall policy of the guide to preserve
neighborhoods and existing housing stock whenever possible. The specific
policies in support of these issues are as follows:
1. Modify codes to encourage remodeling of housing and
redevelopment of neighborhoods by providing bonus in
regulation, taxes, and codes.
2. The following general policies are suggested for all current
neighborhoods, but particularly older neighborhoods:
a. Code enforcement will have a priority for older neighborhoods.

b. Neighborhood committees, especially multi-neighborhood
councils (community unit) w111 be encouraged to interface
with Planning and Zoning, Parks and Recreation, or other
pertinent boards as well as City departments and the
City Council.
3. In review of zoning, subdivision, City budget Capital 1
Improvement Program Planning, and other similar decision points, }
priority will be given to older existing neighborhoods to insure
and put the neighborhood on notice that zoning stability will be
maintained, subdivision and housing redevelopment will be encouraged,
and public funds will have a priority to these areas over newly
expanding areas.
Staff does not feel that this proposal would constitute a major,deviation from
the intent of the Land Use Plan if approved. However, If the City Council is '
Inclined to recommend approval of this request, we recommend that it Is done
so with the following conditions:
1. The number of children to be accomodated is limited to a maxim=
of 34 children.
2. Adequate off-street parking shall be provided, and design be
consistent with submitted site plan.
3. A six foot solid wood fence be erected along the sides and rear
of the property.
4. No parking or standing siggns be placed on both sides of the street
in a location where the site will be specifically impactedi with
strict enforcement strongly encouraged.

the way the parking lot vat drawn on t e site plan was not I
a good idea since care would have to back out onto Avenue A,

Marilyn Gilchrist stated that, in view of the traffic, and
11 also 3n view of the fact that the root of the immediate area
is, zoned single family (SP-7), she felt opposed and moved
to deny S-156. Linnia McAdams seconded the motion and it
carried unanimously (5.0).

As you may know, the City of Denton his proposed a slight modification
of the existing contract with the Denton City-County Health Department and
District. However, under Section II of Art. 4447•A (the statutory authority s"
for the creation of coordinated health programs such as we have In Denton '
County), the law requires that there be the consent of all of the governing
bodies which were parties to the original agreement,
This whole Issue was discussed by the Commissioners Court on Monday,
May iI, 1981, We decided as a body that we have been remiss in our dutles
by not hiving amended this contract before now because since this contract
originally was signed and betAme effective in May of 1969, manly cities have
grown in size. Their contributions, however) have not increased at All since
1969, In other Instances there are some cities which exist now which had
not been incorporated In 1969 and are not contributing any money to the
I
health district. These cities do receive the services of the health district
without paying for them on the same formula basis (see below) which the I
City of Denton has negotiated with the County.
In 1069 the cities of Denton, Pilot Point, Sanger) Flower Mounds'Shady
Shores, Highland Village, Argyle, Justin, Roanokel Lake Dallas) Krum,
Aubrey, Little Elm and Hickory Creek Joined in the Compact.
The City of Lewisville began a limited participation in the district in
1972 by making small quarterly cash contributions and more ilnpartantiy by
providing free office space for various clinics of the Health Dapartment for 99
residents of Lewisville and the surrounding areas, Lewisville though his Its
own health department which handles restaurant inspections, health compliance
i and complaints,` weed control, inspectlon of day care Centers, and upon +
1 receipt of complaints the Inspection of nursing homes. 1

At this time I would invite your attention to Article 4425, which requires
every Incorporated city and town to elect a quafifled person to the office of
City Health Officer. In connection with this I would further draw your
attention to the fact that all the county is required by law to have Is one
county health officer. Instead, we have a viable and active City County
Health Department which has under its umbrella the following services:
(1) Well Child Clinics.
(2) Immunization Clinics. '
k (3) Healtn cards for food service employees.
(4) VD Clinics. 10
(5) Food Establishment Inspections.
(6) Prenatal Clinics (which requires financial screening by Jackie
Webster),
(7) Adult Health Clinics (blood pressure checks, etc.).
(8) Swimming Pool Inspectlon (sanitation).
(9) Allergy and other non•immunizelon Injections.
(10) international Immunization (passports).
(11) Check for lice and scabies.
(12) Information on vector control (fleas, ticks, mosquitoes,
etc, i
1 (13) inspection of foster homes for licensing after being requested
to do so by State.
(14) Inspection of Day Care Centers for licensing after being
requeested to do so by State.
I (15) Private water system analysis for VA or FHA loans.

amongst its other duties WIC conducts programs on nutrition for women,
Infants, and children.
(19) Homo Health (which we believe will soon be moved to Flow
Memorial Hospital and then expanded).
All of :nose programs have been well received by the various cities and ;
those citizens of Denton County who have avalled themselves of the services
offered, E
As you can Imagine, the budget has Increased drastically since the
inception of this joint project, and it will be approximately $206,000 for 1981. l
We have been exceptionally lucky in keeping the administrative costs of this
program low. Dr. Gerald Flanagan of Denton is generously giving his services ?
to the County as the official County Health officer for free. We are all
grateful to him for the loving service he has given on behalf of the public.
Only the City of Denton amongst the municipalities and signatories to
the original agreement has kept up on its share of the overall budget.
This, however, has been the fault of the County Judge and County Commissioners
for not moving for renegotiation of the contract at an earlier date. The
amount which the City of Denton will owe for the upcoming year will be
approx'mately $60,000. This amount was reached through a joint committee
cts
which was established to determine the level of funding on all joint, whoich
between the City of Denton and the County of Denton. The formula,
was reached by a fine committee chaired by former State Representative
Alonzo Jamison is based upon a combination of population and usage of the
health department. This was considered fair by both the City Council of
Denton and the Commissioners Court.
At this time the Health Department is under instructions to tabulate
figures showing the yeographlc origin of the Individuals who are using the
various programs and offices of the Health Department. We believe that
after a period of close to a year that we will have accurate enough figures
upon which to make a proposal to each municipality In the County so that It
may pay its fair share of the expenses of the Health Department, and thus
become a member of the District. The formula referred to above is as follows.
Take the total amount of funds necessary --for exempla, $100,000; then take
the usage per municipality and figure that as a percentage. If City "X"
uses the facility 20% of the time its initial share (prior to further calculations)
would be $20,000. Assuming that City "X" and the County (total county
population being 100,000) are the only participants in the District, then the
County's share as per usage would be $80,000. Next, divide the $80,000 by
the 100 000 population, getting $.80 per capita share. Then multiply the per
capita share of the County times the City's population and substract this
sum from the initial usage figure of the City. Assume the City has 10,000 i
People $.80 x 10 000 equals $8000, substract $ 000 from $200000 (Intel
figure for the City) and this will be the City's share (I.e. $120000).

This is basically the formula which the Commissioners Court would like
p to propose to all of the municipalities in Denton County probably beginning
fiscal ear 1983) as it is too late at this point to get all of the municipalities
w to work this item Into their respective budgets for 1982.
Section 2 of Article 4447•A states in part: "as used in this Act, 'city' ~
means any Incorporated city, town or village In this state, and 'member' y
means a county or city which Is a party to an agreement for formulation of a l
health district." My Interpretation is that those cities which do not join the
health district are then relegated to Article 4425 for health services or their f,
citizens and they may not then obtain the services offered by the health i ,
district. a
All of the above raises yet another issue which needs as speedy a
resolution by your city as possible, and that is the population figures which
we are going to use for the health district, and more importantly for our tE
upcoming budget, the funding for the ambulance services within the County, ;
The three rational choices it seems are to use the population figures provided
by N&COG, the official Census figures, or. the average of the two. We are i ;
open to shy suggestlom on this, but do need your help as soon as possible
so that we may work out our budget for this item, ` Please bring this let!

between Sherman Drive and University Drive. -
SUMMARY: !
Truck traffic for the new Safeway store will use this driveway A.
to enter the Denton Center shopping area, It will be a_
difficult movement for trucks to negotiate this turn if the w
driveway is left at its smaller required width. Traffic Safety
has reviewed this request and recommends approval as long as
the center line of the drivoway is distinctly striped.
FISCAL SUMMARY:
There will be no cost to the City.

mid-block between Sherman and university on the West side of
Carroll. With the new construction of the Safeway store, tru k

turn and entering the Denton' CenterShopping Center at. this
mid-block driveway, The movement appears to be rather
difficult for tractor-trailer trucks, ` Therefore, at their May
mestingr the Traffic Safety COMISitcn recommendedr to allow a
fifty foot driveway out to be builtr with the stipulation that
buttons be used to distinctly define the center line of the
driveway.

SUMMARYI E
On September 2, 19800 the City of Denton entered into
contract with Gilbert Associates of Readingf Pc., to conduct
a 1981 Electric Power Supply Study with the primary purpose
being to analyze Denton's participation in a TMPA proposed
second unit at Gibbons Creek. The study has been completed
and final payment is due.
The contract amount was $21,000 for professional services and
$4,000 for expenses, Periodic monthly payments have been
made in the amount of $16,570 36 $141260 for services, rs`
and $2,31006 for expenses. DuriXg the course of the stud
Al Herman of Gilbert Associates was r+queated' by the Coifth
and Board to do work beyond the scope that was originally'
established in the contract. Although Al Merman pefsonally
spent some 40-60 hours of his own time, without pa~r j~ to
complete the assignment, the cost of professional services
