SEVERASILITY CLAUSEI AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the Laws of the State of Texas and the City
Charter of the City of Denton, Texas, outhorlse and empower the
City Council of sold City to promulgate and establish rules and {
procedures to govern and conduct meetings of all boards and
commissions of the City of Denton; and
WHIMS, the City Council has determined that such rules
and procedures would more effectively and efficiently serve the
public; nowo therefore, i

Chapter 1 of tie Code of the City of Denton, Texas, Is

amended by adding to Chapter 1 a new Article III "Rules and ;

RULES AND PROCEDURES BEFORE BOARDS AND COW4TSSION9
Sesllon 1.42, DEFINITIONS
The word "board, boards, commission, or commissions" as
used in this Ordinance shall be construed to mean any
msnagerlal, administrative, or quasi-judicial body of potions
which has the character of in advisory or deliherative
character and whose members are appolnted by or serve at the
` pleasure of the City Council of the City of Denton, Texas.

Section 1.43. APPLICABILITY:
The provisions of this ordinance $bU1 govern and control
the rules, procedures, and operation of all boards, end the
removal of members thereof; provided, however, wh+rever any
provision of the State Constitution, a State Statute, the City
Charter, or City ordinance conflicts or Is inconsistent with
j ! any provision of this Ordinance, the conflicting or
a Inconsistent provision of this Ordinance %bill not be
applicable.

r, Mr. Doug Blackburn has agreed to a 3/4 inch water,
main under old Highway 77 to serve you with Denton water through
Corinth lines to your property. When and If Denton builds water
dines they will serve you, and the lines will be disconnected
from Corinth.
The Town of Corinth Commission has met and agreed to run the
water line -to your property at the'agrsed point by'you last
veeko at no cost to you in exchange for a signed easement by
you. and your daughters to cross'your, property with a sewer line
on thenorth side of your property along the fence line and five
or six feet inside, with twenty five foot working eaeement and a
ton foot permanent easement for work in case of a brook.
The water line is to be built within 30 days-for this exchange.

SUMMARYI
The proposed transmission line and associated facilities
are for the purpose of furnishing a 100 MVA
interconnection between the City and TMPA for electric
service from future power supplies to be furnished by
TMPA and/or economic dispatch power from other members of
the Power Pool.
The City has obtained the right of way with the
expectatyon that, at some future dater the city will
j purchase the 130XV transmission line when the City load
! requirements are such that a ?.38KV loop system will-be
required around the Citys At this time, all right of way

• has been obtained except the last two parcels adjacent to
the ARCO site.
FISCAL SUMMRYt
The total cost is expected to be approximately $93,000.
The total spent to date is $87,000.
ACTION REQUIREDt
Execution or disapproval by the City Council of tae" 7rf

RECOMMENDATIONt
1 The Public Utilities Board at their meeting of July 6,
1981, recommended to the City Council that the Agreement
be executed so that the 1381 . V transmission line may be
constructed as soon as possiblo, Lack of this facility
being in service has reduced the Cityy of Denton's
capability to fully utilize the economic dispatch program
due to existing transmission line limitations.

SUMMARYe
By Charter, the Utility Board is required to submit to
the Planning and Zoning commission annually an updated
Five (5) Year Capital Improvement Plan, From previous
citizen input to the Utility Department and Planning
Department on future capital improvement needs and from
7 Staff awareness of capital improvement requirements, a
proposed Five Year Capital improvement Plan has been
developed for the Electric and Water/Sewer Departments.
The Planning and zoning Commission reviewed the plan at a
public hearing on June 10, 1981, "
The Five Year Capital improvement Plan is httached for
your approval.
