ordinance, appendix B, of the Code of Ordinances
of the City of Denton, Texas, by adding a new
section, article 26C, providing for filing fees
ti to accompany zoning petitions and declaring an
effective date. The ordinance would require `a
$200.00 filing fee for zoning petitions
consisting of less than 5 acres and a $250, b0
filing fee for zoning petitions consisting of a
more than 5 acres, (The Planning and Zoning

property in this request consists of approximately 79 407 square feet.
theoreticallyy this amount of land could yield 4.96 SP-16 lots or 7,94
SF-10 lots which amounts to a difference of three lots. In fact, some
of this land will no doubt have to be dedicated to the City for right-
of-way for streets which will reduce the total amount of land avail-
able for building sites. Because of the minimal difference in the
current zoning and.the zoning proposal it is not felt that density/
intensity is a significant consideration and it is felt that the loca-
tion of the site will insure suitable access.
j RECOMMENDATION
Because of the limited scale, compatibility of the request with the
adjacent 20 acre tract, adequate access, and consistency with the Land
use Plan, the Planning and Zoning Commission unanimously recommends
approval. (Vote 7-0)

discussed with staff explaining that if area is zoned "A",
only one residence allowed per one acre of gground, anything
else would have to cove through planning and Zoning and
City Council.
Ms. Gilchrist said when live this close to City only matter
of-time before annexed to City but she feels the question
is whether now is right time,
} Mr. Sidor said City needs control over development of area.
Dr. LaPorte asked what evidence exists there is going to be .

Mr. Sidor said there.is 118 acres south of Spencer that has a
for sale sign which indicates that some kind of development
could occur. He said he feels main concern is small helter
skelter development in area.

Lane and adjacent and south of Longridge Street to permit
the following land uses.
1. Single family (SF-10) on approximately 19.2 acres.
2, Duplexes (2-F) attached and split for individuc.l sale
on 1,6 acres,
3. Office (0) on 1.2 acres.
David Ellison explained request, stating that 55 property
owners were notified, 2 reply forms were received in favor, t

No one else spoke in favor.
David White, speaking for 45 residents within 200 feet,
s presented petition in opposition and 7 reply forms in
opposition. He stated he is also speaking for people who
are here in Council Chamber as well as 303 residents not
within 200 feet, presented petition, He asked what areas
are in flood plain.
Charles Watkins stated along north side of tract along
Longridgge and along west side of tract along Teasley is in
flood plain, interior portion is not.
He asked if any time when Teasley might be widened,
Mr, Woodin answered that capital improvements presented
nothing, City Engineer Greg Edwards answered that widen- rr
ing of Teasley was considered by city but it was decided
a ainst because of desiggn problems. He said it was not in
City plans within next five years. However it is on farm
to market road and poisibly.Highway Dept, might come up
with something.
Mr. White stated they are opposed to request because
1) feel value of property will be hurt, 2) when bought
homes they didn't anticipate duplex or multi-family units
would be built in area, 3) greatest concern is increased
traffic by placing duplex and offices on Teasley as it is
high traffic artery at present time: They do not feel these
uses are within character of surrounding neighborhood.
Mr. White asked about proposed Ridgeway Street intersection
with Teasley stating that he felt that location would be
developed commercially. He further stated that one zoning I
change cannot be considered without considering future
requests. This proposed zoning would be nothing but spot
zoning. He repeated they are mainly concerned with duplex
and office zoning change,
Mr. Woodin asked if any part of this property was covered
by deed restrictions.
Mr, White answered he didn't think so.
Hoyt Watson spoke in opposition stating that he doesn't live
within 200 feet but does live within two blocks. He repeated
that the people only want what is there now. On question, he
said he would buy a home backing up to Teasley.

Claudia Conner asked about building restrictions for duplexes.
Answer. was given that lots would be 10,000 square fee, that
city has no control over size of building.
Cliff Black said he moved from Arlington, that duplexes were
brought in and did hurt value of his property. He doesn't
want this to happen here. He expressed concern about office
uses.
Barnett Greenberg said he would like area to continue as
' residential; that there has been residential development 41
along Teasley during the last three years and these houses
have sold.
Mrs. Lo isti, Pembrook, requested that development continue
as single family residences only.
Robert Zant asked about lot widths, stating that some are
90 or more feet and he is opposed to less than that.
Ms. McAdams answered that SF-10 area only requires 70 foot
width.
Marty Remer, Longridge, objected to three lots'being changed
from 16 to 10.
David Ellison gave staff report stating residential character
is maintained, primary difference is duplex and office us•.s.
lie said that 58 single family homes would"generate•551''irips
per `day, six duplexes would generate additional 126 tripe
office development 94, total of 765.8 trips per
per daY day.
Charles Watkins stated that staff recommends appproval'with
conditions stating that as currently zoned would be approxi-
mately 50 trips less per day than proposal.
David Ellison spoke again pointing out that proposal would
be acceptable for intensity standards but he feels that in
the future Plan Commission will have to be concerned with

Mr. Jacobsen continued stating that costs of developing land
have quadrupled since original 5outhridge development, cost
per lot to develop is now $15,000. He stated he is not

There will be a paved bicycle path where Pennsylvania will

Stanley Sawyer asked about office uses. Question was
answered for security systems.
L. Borgman asked if this approved if other owners could come
in and request Duplex zoning.
This was answered that individual would have to come in and y;
make request.
Mr. Jacobsen continued stating that he would withdraw request c
for office and for duplex if Plan Commission and people would
go along with SF-10 on entire tract.
Ms. McAdams stated that someday Teasl'eq is going to be
widened and suggested that people think about what they
i want in the future for their area.
Mr. Woodin stated in view of expressed intent of developer
to modify his plan and in view of expressed wishes of witnesses
not to have, proposal as presented, 1 move that proposal be
I tabled until another time when developer can bring pproposal
which will suit needs of area and his pocketbook, Seconded
by Ms. Gilchrist.
Mr..Sidor explained that if Commission agrees to his changed

from 16 to 10.

C. Z-1506. This is the petition of Richard Shoffitt re-
questing a change of zoning from single family (SF-7) to
planned development (PD) zoning classification on a parcel
24,000 square feet in size located on the southwest corner
of Sherman Drive and Greenwood Street; adjacent and west of

has traffic congestion problems. The
increased activity proposed in this
case which feeds into University Drive
will increase traffic congestion on
University Drive. An intensity study
of the Universityy corridor quantifiably
confirmed that the corridor exceeds
crrrent intensity standards for
University as a moderate intensity,
area. This points out the interrela-
tionship of all the intensity areas.,
However, this problem will be mitigated
somewhat by future construction of
Windsor Drive. Other possible mitira-
tion actions include aignalization of
the Hinkle-University intersection,
study of curb cuts in Denton Center
area to determine which curb cuts can
be eliminated and/or realigned to im-
pprove circulation, permit no additional
hi h intensity zoning in this areal of
University, and down zoning of existing
undeveloped retail and commercial zoning
in this area of University Drive.

ANALYSIS
The development proposal consists of 32 two-family units and 240
r multi-family units for a grAnd total of 272 dwelling units.
A total of four (4) driveways are provided, two of the driveways
i are located along Hinkle Drive, one at the extreme northern end
of the property and the other at the southern end of the parcel.
The other two driveways provide access to Denton Center near the
Scars building. Two tennis courts grid two pools are provided as
! well as a landscaped berm and generous setback along Hi Drive.
The land use plan designates low intensity areas as our primary
housing areas, encourages diversified land uses, discourages con
centration except for low density residential, and permits scattered
apartment sites which are usually less than 200 units but no more
than 500 units if (1) there is strict site plan control within one

block of existing low density residential so that the character of
the area can be maintained; (2) traffic planning insures access by
a collector street or larger and traffic does not flow through loca
streets; (3) the overa2egnatrecYeationalsfacilities are provided,

form of, continuous strip commercial is strongly discouraged in or
backing up to low intensity areas.

RECOMNDATION
Because of the unlikelihood of single family or two family develop-
ment occuring at this location due to the proximity of Denton Cents
and the Fair Grounds and compliance with all the criteria set forth
in the Land Use Plan except the nearest major arterial, the Plan-

III. Public Hearings
A. Z-1508. This is the petition of Gerald Henigsman rep-
resenting Folsom Investments, Inc, requesting a change of
zoning from single family (SF-10) to planned development (PD)
classification for two family (2-F) and multi family use.
The parcel totals approximately 19.8 acres in size and is j
located along the east side of Hinkle Drive and Denton "enter
and Good Samaritan Village.
Charles Watkins explained request, stating that 23 property #
owners were notified; no reply forms were received in favor,
8 were received in opposition. ,
Wayne Miller, attorney representing petitioners, stated that
since proposal was turned down petitioner has met with neigh-
bore to determine their objections; has plans for a reduction
of flood lain b concrete channel. He further
in a

stated they do not believe zoning is proper now, that this
proposal would buffer the single family area. After meeting
with the neighbors they have proposed single story duplexes
with a residential character, set back 70 feet from Hinkle Drive,
and have lowered the overall density to 15 units per acre.
Mr. Henigsman, petitioner, stated the firm owns and opperates
many units in the metroplex, that theirs are quality built and .
quality managed. This complex will consist of 240 one bedroom
units, renting from $275 to $420; and 32 two bedroom units,,
renting from $450 to $565; they have strict lease regulations
which prohibit multi roommates and would therefore'not attract
the college crowd. Their ppeople are "peace anA quiet" oriented
mainly married professions 1, some singles and a few families.
They, will provide rtnnis courts and two swimming pools but do
not provide a party type recreation room. He, showed slides
of other apartment complexes pointing out extensive landscaping
and small signs. He further stated that as a result of meetingga
with home owners the units were redeaigried to do away with patios
and fences on Hinkle Drive, only windows and chimneys will show, E
all parking to be inside complex. There will be a berm to soften
and enhance the area. The drives from project to Hinkle`Drive
will not line up with streets across Hinkle Drive, discouraging
traffic through the residential area.
Mr. Miller spolte again pointing out that sidewalks along Hinkle
} will be maintained as if residential; that there is concern
about property values but he feels that a well run project can !
enhance value. He said they talked with people at Good Samari-
tan Village, that their main concern would be met by providing
a living screening fence along northern boundary of property.
They also added a second exit on southern boundary of property,
and will try to funnel some traffic out through the shoppping
center, which they own, between Piggly Wiggly and the old Sears
store, On question about width of that drive, he said it could
be increaseto 24 feet if desired. On question about drainage
channel, Mr. Miller replied that it would be landscaped and
maintained,

Mr. Henigsman said it will be a concrete drainage area through
the project, that it will help move water. On question, t

M;, Edwards explained that they are Tanning to box culvert
underneath the parking lot through the shopping center to
i University which has good capacity. He stated they have not
submitted final engineering plans, that _f additional box
culvert is nee can b regained. Mr. Miller stated they
would be No one spoke in favor of the request.
Mfs. Ogden, 1317 Amherst, stated the traffic on hinkle is -
heavy now, that ccrs now come from Malone to Amherst to shopping
center and this project will bring about 400 more cans into area.
Mrs. Morris, 1212 Bryn Mawr, stated she feels the area should
be limited to single family or at most duplexes. She suggested
that area be developped ith duplexes on cul-de-sacs or possibly
an office, residential w mix like near Newton Raznor School on
Crescent.
Horace Trietach, 1200 Bryynn Mawr, str-id he objected to the
increased traffic, that he felt cul=__-sac development would
be ideal.
Mrs. Shook, 1220 Tulane, stated she objects to that many apart-
ments, that Malone is only through street and tars will come
through on residential streets to get to Malone.
Mrs. Coleman stated she objects to the approximately, 400 auto- '
mobiles, that she feels.the one bedroum units will attract
college students who do not have pride in their residences.
Mts. Charles Borth, Northridge, stated she is concerned about j
increased traffic on Hinkle, that youngsters living in North-
ridge use bike trail going to and from schoil.
1204 Amherst, stated the people bought their
homesein area Riders because it was Dingle family, a quiet peaceful
area, that they do not want 272 apartments across street even
k though some concessions have been made.
Lowell Hennen, 1426 Amherst, stated he objects because of
traffic problem, that Hinkle and University can't handle the ,
traffic in peak hours now; that the drive into shopping center 2
will make it more hazardous.
Dr. Mrotek, 1320 Dartmouth, stated he bought his home with
understanding he would be living in quiet neighborhood; that
there is trash on streets now with 3 convenience stores and 5

that she understands there is problem of traffic but doesn't
feel it will be as bad as people think,

Mr. Sidor said he feels traffic is primary concern but doesn't

David Ellison explained the request stating that 13 notices

Mr. Hoenig, petitioner, stated he is an electrical contractor
with a need for this facility, that he thought the property
would be ideal for his needs, that hg could take existing
structure and use for office space and provide additional park-
ing as needed, He said. he has very little traffic in his.

E David Ellison gave staff report and recommendation stating {
this would not violate overall intensitqq standards due to
large amount of vacant land; however, this use is not ton-
sidered a neighborhood commercial use and is-incompatible with
surrounding area. He pointed out there are other areas nearby
i which,are already zoned commercial and which would be more
j suitable for this type use. Approval of this request would
leave McKinney Street open for strip zoning. Whereas this
might be an immediate improvement it could affect future single
family development and would have a negative-impact on area;
therefore, staff recommends denial.

near an area which has managed to maintain a somewhat stable resi-
dential character despite being near several higgh intensity uses
The Land Use Plan has several policies which relate to this request
for office zoning in a low intensity area. Most significant is the
Policy which encourages strict site design control when high inters- '
aity development is being propposed within one block of, existing logo
density residential areas. This is A request',for planned developments
therefore, the capability for strict site design exists,' A site plan
has been submitted which limits access through local low density reei'
dential streets, provides adequate parking, and pprovides a screening
device along abutting residential property, It is felt that this pro-

Christ, 411 Simmons, stated they would like the area to
remain residential and are opposed to change in zoning
because of increased traffic, possibility of burglary and
vandalism. They are also concerned about caliber of office
building. He also pointed out there is another piece of
property to east which might also request rezoning if this
is granted.
David Ellison gave staff report and recommendation, stating

submit as Planned Development (PD). Seconded by Me. McAdams
and unanimously carried.
FApproval of an ordinance amending the code of ordinances
of the City of Denton, Texas exempting portable signs of
certain dimensions from sign permit for requirements
Charles Watkins explained that this ordinance would exempt
portable signs (trailer type) less than 25 square feet from
ppemit requirements; those over 25 square feet would still
be required to obtain permit,
Mr. Woodin moved that ordinance be adopted, Seconded by
Me. Busby and unanimously carried,
(3, Approval of an ordinance amending the zoning ordinanca of
the City of Denton, Texas by adding subsection (59.1) defin-
ing portable advertising signs.
Charles Watkins explained that this ordinance will define
portable advertising signs.
Ms. McAdams moved that adoption of ordinance be recommended.

bavid Ellison reviewed the petition stating that Mr. Cawthoa
had submitted a site plan. He discussed with Mr. Cawthon
his concerns about plan as well as Greg Edwards, Cityy.Engineer.
r The staff has prepared an alternate plan which clearly'definea
ingress and egress, changes parking, requires a 10 foot build-
ing setback on east boundary which abuts residential property,
and requires a b foot fence along that property line.
4 Chairman asked if Mr. Cawthon was agreeable to alternate plan,
Mr. Cawthon was present and indicated his appproval. Dr. LaForte
asked if adjoining property owner knew how close building would
be to his propperty and Mr. Pruitt answered he didn't know but,
they wanted.the office building,
Dr. LaPorte stated he didn't like curb cute on Dallas Drive
as it is an extremely busy street, Mr. Edwards stated if
didn't allow curb cute on Dallas Drive office traffic would
be forced onto Simmons Street which primarily serves resi-
dential area.
Mr. Laker, 414 Simmons, appeared in favor of the office build-
in g stating,that he represents himself as well as others in
neighborhood.
It was moved by Mr, Woodin seconded by Mr. Escus, and unani-
mously carried to bring M509 off table.
Mr. Woodin then moved to approve planned development (PD) for
office use and to approve alternate site plan as prepared by
staff. Seconded by Me. Gilchrist and unanimously carried. '
Mr. Woodin left meeting at 8t40 p.m,
B. Approval of the preliminary plat of Jones-Collins Addition.
Mr. Watkins explained that this property is zoned commercial,
that staff recommends approval subject to conditions.
Ms. Gilchrist moved approval subject to the following conditions:
1. Add four feet to the north side of existing 12 foot utility
easement to form a 16 foot easement;
2. Dedicate an additional 10 feet of right of way for Myrtle
Street and submit plans for construction of 17 feet.of
paving and one side of curb.and gutter.

on San Jacinto Street which will provide bettor circulation.
Staff recimmends approval subject to conditions,
Dr. LaPorte moved that modified site plan be approved subject to
the following conditions.
1. Signs to be setback 25 feet from right of way;
2. Maximum height of signs shall be 30 feet;

The appropriationa ordinance implements the budget as submitted
to the Cii Council by the City Manager with the exception of a
reduction in revenues in the {general Fund because of the ad
valorem tax shortfall, The eneral Fund revenues have been r
reduced from $11,962,820 to 11 84+5,301, As has been
indicated this shortfall will G recovered by reduting
t appropriations among the various departments after the
beginning of the fiscal year.
The apppropriations ordinance takes exactly the same form as in
the prior fiscal year, It there are any questions concerning

which sets the tax rate for collectitember on 15, of 1991, property ty an taxes ordinance the

General Fund and the Debt Service Fund. The tax rate included
in the ordinance is $0.774 per $100 of valuation.
This tax rate will provide s tax, rate of $0.309 per $100 of
valuation for collection of property taxes for the Interest and ti
sinking Fund and $0.465 for collection of property taxes for
the General Fund. This tax rate is applied to the assessed
values provided to the City Council by the Board of
Equalization which have been valued at.1001 of market in
accordance with state law.
The City Council has complied with the "Truth in Taxation"
legislative requirements to conduct public hearings advertising
the tax rate and may at its prerogative reduce the tax rate
from $0.774; but the Council may not increase the tax rate
without going through the advertisement process again.
If there are any questions concerning the tax rate or the
process of establishing the tax rate, 'I will be happy to answer
them.

SUBJECTS Amendment of the Solid Waste Ordinance to provide for
New Fees
Attached is the ordinance which will provide for a fee of $5.50
to be charged' to all Residential Custamers. The amendments
of Section 12 9-C which eliminates all
also include elimination
the free bags. We have not increased', any of the fees for
independent haulers hauling to the Landfill. We would expect
to do that later on in the year; once the operation of
additional facilities at the Landfill have been resolved.
We will be available at the meeting to make any changes that
the 'Council may with to make, if they choose to change either
the rates or distribution of free bags. If you have any
further questions, please call.

SUBJECT: ADOPTION OF A RESOLUTION APPROVING THE DEPOSITORY
AGREEMENT
On the agenda for September 15, 1981, is a resolution approving
the depository agreement with the First State Bank, Copies of
the application for depository of City funds were distributed
{ to the five banking institutions within'ahe City, and First
State Bank was the only bank to submit a bid.
? The agreement, provided is essentially the same as has been in,
effect for the prior two years. After review of our depository
agreement with Arthur Young and Company, some improvements were
made in reporting requirements and the ability to invest in
i overnight repurchase agreements.
The term of this agreement is from October i, 10810 to
September 300 1983. If there are any questions concerning the

FUNDS FOR THE TWO YEARS BEGINNING

1. We will act as paying agent for all outstanding and future bonds
without charge. ~
2. No charge will be made for overdrafts.
3. We will furnish all City checks printed in accordance with the
City's specifications without charge. The City writes
approximately 25,000 checks a year.
+ 4. We will provide one safe deposit box without charge.

6. We will furnish coin wrappers without charge. The City uses
approximately one hundred (100) wrappers a year.
We will furnish depository bags to the City without charge. The

accrue to the City.
9. The City will be furnished wire transfer service to any bank in

Statute's Article 2560 to cover all funds deposited with us by
the City, as determined and requested by said City.

13. The City will have the right to invest up to a maximum amount of
$100,000.00 in each savings and loan institution whose home
office is within the City.
14. We agree to comply with all statutory provisions contained
within the terms of Article 2559 et seq. Y.C.S. as amended
concerning City depositories.
15. The rate of interest to be charged by the bark for warrants
issued by the City and not to exceed two (2) years shall '
be 8_ percent, not to exceed $500,000. over $500,000., subject
to negotiation.
16. Loans will be made by the bank to the City within the limits
prescribed by law, such loans shall be at the interest rate
of 8 percent for loans up to $500,060.00; over
the rate of interest shall be subject to
negotiation. Loans are to be direct indebtedness of the City to
be made within each fiscal year of the City. This is not
intended for long-term indebtedness.
17. With the exception noted in #13, the City shall have the right
to negotiate certificates of deposits with any bank located
within the City limits, and we will be given first and last
refusal. It is the intent of the City'to purchase certificates
of deposit rather than purchase government securities when for
a desired maturity date, the C. D. interest rate is equivalent
or higgher than the market yield for the proposed security.
Should the City foresee some potential for early liquidation of
a specific certificate of deposit prior to purchasing the
investment,' the bank will agree to provide a loan if required at
an interest rate nit to exceed the rate of the C.D. for a term
not to exceed the time from required liquidation to the maturity
'date of,the C.D. If this liqu4dity cannot be assured, the City,
at its option, may purchase the Government security,
18. The City shall have the right to negotiate repurchase agreements
for investments less than 30 days. We will be given first and
last refusal.

19. We will act as purchasing agent fnr all Treasury Notes, Bills,
and Bonds and all Federal Agency 'erurities at no cost,

s As you know, the City's contract with Baking Building
Maintenance for janitorial services for the Municipal Building
expires on September In 1981. This contract which was
originally executed in February, 1981, allows for a one year
extension under the some

bfaintenance have requested Oat the City exercise it's option
to extend the contract for a one year time period.
In the eight months that Baking has been performing
janitorial services, there has been a noticeable improvement in
the over-all cleanliness of the building at a reduced cost to
the city., In respect to performance, Baking has met every
obligation under the contract and has performed some services
not covered by the contract at no charge to the City. The.cost
savings to the City during this oight month time period tinder
the contract has been approximately $50000.00
Given tho quality of service we have received from
Baking over the last eight months, I would recommend that the
City Council appprove the extension of this contract for a one
year time period.

The successful bidder will agree toy
A. Carry employer's liability insurance, workman's compensation insurance and,
combined single limit bodily injury and property damage insurance. The amount
of insurance caverage will be reviewed by the City as a factor in awarding the
bid.

charges and taxes.
C. Withhold from payroll such amounts for insurance and'taxas as may be required
by federal, state or local governments with respect to all persons employed by

facility.
D. Promptly furnish the eartifeite of insurance upon request.

fidelity bond in the amount os $75,000.00.
III. Length and Termination of Contract
A. The City shall have the right to cancel this contract at any time on thirty (30)
days written notice.
B. The successful bidder shall have the right to cancel this contract at any time
on thirty (30) days written notice.
C. If this contract is not cancelled as herein provided, it shall begin so of
February 1, 19810 and terminate o:t September 30, 1981. If agreeable to both
parties, the contract may be extended for an additional one year period.

1. Sweep entrances of building
2. Vacuum entrance mate
3. Clean all glass doors
4. Dust mop all hard surface floors with treated dustmops

7. Sweep all steps and landings
8. Empty all waste receptacles and place trash in proper location
9. Empty and clean ashtrays
10. Properly dust all desks, chairs, cabinets, winiow sills, etc.
11. Clean glass top desks, polish wood or plastic top desks
12. Spot clean partition glass
13. Clean, sanitise and polish wateV fcuntains
14. Spray buff entrance areas if required
15. Replace liners in trash cans as needed
16. Keep janitor closets in clean, orderly manner
17. Secure doors and lights after completion of work
H. Nightly Restroom Services:
1. Clean and sanitize lavatory fixtures, toilets, aad urinals
2. Pumice toilets and urinals as needed to remove 'scale
3. Clean and disinfect all toilet seat tops and undersides;
4. Clean walls around sinks, towel dispensers, and urinals
5. Refill soap, towel, tissue, and seat cover dispensers with supplies
furnished by the City of Denton
6. Clean mirroa and polish hardware
7. Empty sanitary napkin containers
8. Empty and clean waste receptacles and dispose of trash
9. Mop floors using approved disinfectants
10. Clean doors and partition walls
11. Notify proper party of any supplies running low
C. Weekly Office Servicesr
1. Perform low dusting of sills, ledges, shelves, rungs, etc.
2. Dust picture frames, hangings, and wail ornaments
3. Clean soil marks from desk and counter tops And partitions
D. Monthly Office Services:
1. Perform all high dusting, i.e., over 7 feet

SUMMARYI
The facility has been completed for about a month and is
currently being occupied by Animal Control. B.F.C. has
corrected all minor problems according to contract and Animal
Control has indicated that the building is in proper order.
Final payment in the amount of $6,275.45 is in order.
FISCAL SUMMARY:
Total amount of the Contract plus Change Orders is $6,275.45.
Funds were allocated and are available in the Capital Budget
for the improvements.

WHEREAS, the Texas Legislative Redistricting Board is now in the
process of defining legislative districts for the Texas House of
Representativea► and
WHEREAS, Denton County must be divided into at least two f.
representative districts because of population fiquresl and ;
WHEREAS, the City Council of the City of Denton has heretofore
gone on record, opposing the division of the City of Denton into more
than one representative districts and
WHEREAS, all of Denton County except census tracts 215,03,
216.01, 216.02, 21703, and 217,04 would leave an ideal
` representative district of 95,035 inhabitants! NOW, THEREFORE,
fi BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXASt
SECTION If
The City Council of the City of. Denton, Texas hereby requests
the Texas Legislative Redistricting Board to designate all of Denton
County, except U, S. Census Tracts 215.03, 216.01, 216, 62$ 217 .03,
and 217.04 as a Legislative District' for the Texas House of
Representatives.
SECTION Ilt.
The Mayor is hereby directed to forward a copy of this
Resolution to the Honorable Hill Hobby, Lieutenant Governors the
i Honorable Hill Clayton, State Representativef the Honorable Sob

HARDWARE ?
included on the agenda tonight is the emergency item to approvo
a lease with Courier, Inc. for eight computer terminals and a
controller. Delivery of this equipment Is anticipated duringg
early October to pprovide necessary equipment for impplementation {
of the utility billing syystem and the training required for
Data Processing personnel. Because of delivery times, Courier r.~
Indicated they could only deliver the equipment to us If a r
lease were approved for the equipment today.

During the month of October a lease/purchase plan fnr these
terminals ss~well as the sixteen IBM terminal!, will be brought

before the City Council for its consideration. use of
Courier equipment will enable the Data Processing Department to
save 401 on the cost of this equipment without any degradation
of quality.
Because of the emergency nature of this item, the Data
Processing Advisory Board was unable to meet in consideration
of it. However, each member was polled by telephone nd has
