required in the opinion of the Board/Commission with regard to any
watter considered in such executive meeting or consultation with the

A. Z-1543. This is the petition of Dewey Fields, representing Capital
Consultants, requesting an amendment to Planned Development (PD-34)
which is approximately a thirty (30) acre tract. located on the west
side of Mockingbird Lane, beginning approximately 1180 feet south of
the intersection of Audra Lane and Mockingbird Lane. The Planned
Development (PD-34) currently permits single family detached
residential development (typical lot size 60' x 1001); the
petitio►,er is requesting an amendment to permit the following land
uses:
Single family detached residential (typical lot size 60' x 1001)
on 12.97 acres.
Multi-family residential on 16.24 acres.

City of Denton, Texas Utility System
Revenue Refunding Bonds, Series 1982
In accord with our agreement with you, we have developed and present for
your information and consideration preliminary plans to refund City's out-
standing Electric and Water and Sewer System Revenue Bonds and, through the
refunding process, combine the systems to create a single operating
utility. Two plans have been developed and follow herewith.
CASE 1 contemplates refunding all outstanding revenue bonds and restruct-
uring the debt so as to approximately parallel existing net debt service.
Under this plan all existing balances in debt service reserves and sinking
funds would be utilized to establish a new debt service reserve fund and to
purchase open market securities for the Escrow Account, CASE 2 is
structured to provide funds necessary to establish a new debt service
reserve fund, to purchase a lesser amount of open market securities for the
Escrow Account and to make available $2,000,000 of funds for construction
or other system purposes.
The refunding program contemplated herein would result in the defeasance
of all outstanding Electric and Water and Sewer System Revenue Bonds and a
concurrent release of the existing ordinances which would permit the
adoption of a new ordinance containing security provisions more in keeping
+ith present market conditions, and also would allow removal of onerous and
r strictive coverage requirements which do not permit the flexibility
desired to accommodate future funding programs. Further, it is our
,judgment that the combined utility system revenue bonds would command
wider acceptance in the marketplace which, in turn, soould result in lower
borrowing costs on future bond sales.

SUMMARY: This bid is for the purchase of a previously owned
9 row passenger bus. This bus will be utilized by
the Parks and Recreation Department in an expansion
of recreational programs. Field trips to Dallas or
Ft. Worth for concerts, museums, Six Flags, etc. will
be made available for school children, teen groups
and Senior Citizens. Denton Teen Clubs will be
visiting other Teen Clubs in the Metroplex area. We
will expand and enhance our city wide events by
transporting participants to Easter Egg Hunts,
Christmas Programs, Spring Fling, Summer playground
sites, water carnival, etc. and develop an after
school program by transporting children from elemen-
tary schools to the recreation centers. The bus
would have the potential of almost daily usage and
be some what self supporting thru ticket sales to
passengers for specific uses.
ACTION REQUIRED: Approval by council and award of bid.
SOURCE OF FUNDS: This purchase will be funded from two sources.
1. The Senior Citizen Organization will donate
$2,100.?0 toward this purchase.
2. The balance of $2,750.00 will come from the
Parks 6 Recreation Dept. special Recreation
fund account A 261-003-0062-9106.
Total purchase price is $4,850.00.
RECOMMENDATION: We recommend this bid be awarded to the only bidder,
Bolain Equipment in the amount of $4,850.00 for a
1971 Chevrolet passenger bus. bolain Equipment has
offered a 50/50 Warranty for 90 days or 4,000 miles.
This bus has been used by the City of Denton on a lease
type agreement in the past a:.d has been inspected by
the Vehicle Maintenance Dept. and found to be in very
good mechanical and appearance condition.

SUBJECT:, Emergency purchase order 955037 to Stewart 6 Stevenson
SUMARY: This purchase order is for the emergency repair on
an emergency generator serial 06A149342 at the Electric
Steam Turbine Generating Plant. The repairs were on
the General Motors series 6-71 Diesel engine. This unft
must be in operating condition at all times and ready
to be put in service immediately. We also asked that
the Westinghouse Generator be checked completely and
to test run in order that everything could be checked.
ACTION REQUIRED: Approval by council.
SOURCE OF FUNDS: Budget account 610-008-0251-8339, repair and maintenance
machinery and equipment.
RECOMMENDATION. We recommend this emergency purchase order to Stewart

Summarv: The Denton Shopping Center Addition is

Mall on the northeast side of Loop 288.
This property is zoned Planned Develop-
ment (PD 28 and PD 28.1) for commercial
uses, and development of a Wal-Mart store,
and a retail office complex is already
underway. The intent of the replat is
to divide a large lot formerly designated
as lot 3, into three (3) smaller lots.
Changes have also been made in the plans
for utility services. The Development
Review Committee has reviewed the revised
replat and necessary engineering plans,
and found them to be satisfactory.

that development of general retail and office area to

department requirements as well as water, sewer and
electrical have been satisfied and Development Review
Committee recommends approval.

SPECIAL INFORMATION
Physical Characteristics: Topography is basically flat and
vegetation consists of trees, grass
and weeds. This development will
increase the runoff in the area, thus,
contributing to an existing drainage
problem. The Development Review Com-
mittee has suggested that the devel-
oper look at ways to relieve the sit-
uation and submit plans during the
final platting stage.
Public Utilities: Adequate water and sewer and electri-
cal services are available for exten-
sion to this site.
Transportation: It is strongly recommended that high
density residential developments have
access to collector streets or larger.
Mockingbird Lane is shown as a col-
lector street on the approved thor-
oughfare plan, but it is presently an
unimproved street. The developers
will be required to dedicate adequate
right-of-way and pave, curb and gutter
one half of Mockingbird Lane wherever
their property has frontage along the
street when subdividing occurs. The
proposed development would generate
2,217.6 vehicle trips per day if ap-
proved as shown on the amended site
plan. If single family development
occurred on the originally planned 147
single family lots, 1,455.3 vehicle
trips per day would be generated by
the development. The proposed amended
plan which combines single family and
multi-family uses would generate 762.3
more vehicle trips per day than the
original plan involving total single
family development.

ZONING HISTORY
The thirty (30) acres in this request was the subject of zoning
change petition submitted by Joseph Burris in July, 1981. The
request for a change from agricultural (A) to Planned Develop-
ment (PO-34) for single family detached development on lots
typically 6,000 square feet in size, was approved by the Plan-
ning and loving Commission and the City Council in August, 1981
with the following condition;
The proposal for detached single family homes on lots
totalling 6,000 square feet in size shall observe minimum
requirements specified for single family (SF-1) development.
No development has occurred at this site since the zoning change
was approved.
ANALYSIS
The site in this request is located in an area designated as low
intensity by the Denton Development Guide. Low intensity areas
represent the primary housing areas with an emphasis on low den-
sity residential; however, housing diversity is encouraged so as
to provide for housing types that respond to the differing eco-
nomic and individual lifestyles of Denton's citizens. It is
important that any proposed diversified housing be well planned
to insure that; (1) neighborhood integrity is maintained, (2)
there is no one type of housing heavily concentrated in one
area, (3) good site transition between housing types and density
is provided (buffers greenbelts, e.g.) and (4) transportation
circulation is designed so that higher density housing can be
served without flowing through low density residential streets.
It is a general policy of the Development Guide, that apartments
be dispersed throughout the City with limited areas of high con-
centration in any one area. In low intensity areas, apartment
complexes in the 200 unit range are considered acceptable and
the maximum acceptable number of units in one development is 500
units. Proposed multi-family developments in low intensity
areas should have major street access that provides adequate and
safe capa:ity for all modes of transportation, specific site
plan control, density and intensity ratings within the area
standards, access to flood plains, greenspace or large open
space that can be utilized to provide recreational amenities for
tenants, access to pedestrian, bike-scooter and public transpor-i
tation and locations that buffer other higher intensity uses

ANALYSIS CONTINUED
This proposal is well within intensity/density standards and is
not in close proximity to any other significant multi-family
developments. Current planned development (PD) zoning permits
single family residential detached development on 6,000 square
foot lots. The proposed amendment would permit multi-family
development on 16.24 acres of this 30 acre tract. The remaining
12.97 acres are reserved for single family development as pro-
posed in the original planned development. 4 total of 198
apartment units are planned at a density of 12.1 units per acre.
Access will be from Mockingbird Lane (collector), and a series
of internal residential streets, cul-de-sacs and private drives.
The developer will be responsible for maintaining the private
drives and will dedicate and build the public streets in accor-
dance with City of Denton subdivision regulations. Mockingbird
Lane will also be improved in accordance with the perimeter
street paving ordinance (curb, gutter and pave 17 feet across
front of property).
Six inch water and sewer lines will be extended to serve this
site and electrical service is available. Any development in
this area will contribute to existing flooding problems in this
area if approved. The developer has agreed to submit drainage
plans designed to help alleviate any problems created by this
development when the property is subdivided.
The Planning and Zoning Commission expressed some concern over
the issues of adequate drainage plans for the area, and the con-
dition of Mockingbird Lane, respectively. Mockingbird Lane is
designated as a collector street in the Denton Development Guide
and the Denton Thoroughfare Plan; however, it is not an improved
street. Characteristics of a typical improved collector street
would include dedication of 60' of right-of-way, 41' of paving
from back-of-curb to back-of-curb, and stand up curb and gutter.
When subdivision and development of any type occurs, the devel-
oper will be responsible for dedicating 30' of right-of-way and
making the above improvements to the street wherever it abuts
their property boundaries. Mockingbird will have 11' of pave-
ment, curb and gutter along the portion which fronts the pro-
posed development. Drainage plans will be reviewed and evalu-
ated during the final platting stage, and the developers have
revealed preliminary plans for dealing with the drainage ques-
tion to the engineering department.

RECOMMENDATION
This proposal is consistent with Development Guide policies re-
garding multi-family development in low intensity areas. The
Planning and Zoning Commission recommends approval by a vote of
5-0 with the following conditions:
1. The single family detached areas shall be developed in
accordance with building code and zoning ordinance
requirements specified for single family (SF-7) development.
2. Adequate screening consisting of a living screen or a'six
(6) foot wooden fence shall be erected along any property
line where multi-family development abuts single family
residential housing, when the single family area is
developed.

The regular meeting of the Planning and Zoning Commission of the
City of Denton, Texas was held on Wednesday, October 20, 19821, at
5:00 p.m., in the Council Chambers of the Municipal Building.
Present: Bill Claiborne, R. B. Escue, Jr., Gary Juren,

Chairman Robert LaForte called the meeting to order.

1. Approval of the minutes of the special called meeting of
September 29, 1982.
Mr. Escue moved to approve minutes of the special called
meeting of September 29, 1982. Mr. Claiborne seconded
motion with following amendment: Page 3 - "On further
question, he said that he did not know at this time whether
right-of-way exists to allow expansion of McKinney to four
lanes." Vote was called dnd iuution unanimously carried.
IT. Public Hearings
A. fz-15430 This is the petition of Dewey Fields requesting
an amendment to planned development (PD-34) which is an
approximately thirty (30) acre tract located on the west
side of Mockingbird Lane, beginning approximately 1180
feet south of the intersection of Audra Lane and
Mockingbird Lane. Planned Development (PD-34) currently
permits single family detached residential development
(typical lot size 601 x 1001); the petitioner is re-
questing an amendment to permit the following land uses:
single family detached residential
(typical lot size 601 x 1001) 12.97 acres
Multi-family residential 16.24 acres
Mr. Ellison explained the request stating that 12
notices were mailed to property owners; four reply
forms were received in favor, none were received in
opposition.

Dewey Fields, surveyor, stated that approximately 200
multi-family units are planned, there will be 60 foot
general usage easement through the property with head-in
parking on both sides of the easement. He said the six-
plexes will be two story, the fourplexes will be one
story.
Ed Boudreau stated he is one of the owner-developers of
the project, they have owned the property 10 years and
would like to see some use of it.
No one was present in opposition to the request.
Mr. Ellison continued stating that PD-34 currently per-
mits single family detached dwellings; proposal is for
single family and multi family development. He said
that area is designated as low intensity by the Develop-
ment Guide which basically encourages single family
housing; however, Guide does have policies for mixture
of uses with site plan control and protection of single
family areas. He said that proposal is for 198 units,
12.1 units per acre, which is acceptable. Mockingbird
is designated as a collector street, however it is un-
improved as a collector street. Petitioners would be
responsible for paving and curb and gutter of one half
of Mockingbird where it fronts on their property. He
referred to matrix summary, with an overall rating of
acceptable, and stated that staff recommends approval.

could include screening as a condition of approval.
Mr. Boudreau said that would be acceptable to developers
but asked that it be delayed, for maintenance purposes,
until such time as single family area is developed.
The roadway north of Casey Drive was discussed and
Mr. Ellison explained that it would be dedicated as an
all purpose easement, that it would not be developed in
accordance with street system. He said dedication was
required because of utilities and fire access. on ques-
tion, he said that either home owner's association or
owner of property would maintain street, the city would
not. on question about head in parking on each side of
easement, he said he did not feel there would be any
problem as this has been done in other parts of the city.

Setback requirements were discussed and Mr. Ellison
advised that setbacks would be observed in accordance
with SF-7 requirements.
No rebuttal was offered.
Chair declared public hearing closed.
Mr. Juren moved to approve Z-1543 subject to the follow-
ing conditions:
1) The single family detached areas shall be developed
in accordance with building code and zoning ordi-
nance requirements specified for single family
(SF-7) development.
2) Adequate screening consisting of a living screen or
a six (b) foot wooden fence shall be erected to pro-

where abutting sixplexes, and lot 1, block 1, where

B. Z-1545. This is the petition of Phillip M. Smith
requesting a change of zoning from two family (2-F)
to the general retail (GR) classification at 519 and
529 Bolivar Street (First Church of the Nazarene).
Mr. Ellison explained that some major changes have
been made since information was sent to the Planning
and Zoning Commission. He said that request has now
been amended from straight general retail zoning to a
planned development for a funeral home. He said no
physical changes are anticiated except removal of the
dwelling unit. Mr. Ellison further stated that 17
notices were mailed to property owners; five reply
forms were received in favor, none were received ii
opposition. He said that two of the reply forms
originally received as being in opposition have been
changed to a favorable response after parties learned
of proposed use.
Phillip Smith, pastor of First Church of the Nazarene,
stated they have outgrown their property and want to
sell facilities and move elsewhere; the purpose of re-
quested rezoning is to make property more marketable.
He said that church has a proposal which they are happy
with and requested that request be amended to PD.

The Zoning Map of the City of Denton, Texas, adopted the
14th day of January, 1969, as an Appendix to the Code of

SECTION It
That the City Council of the City of Denton, Texas, hereby
finds that such change is in accordance with a comprehensive
plan for the purpose of promoting the general welfare of the
City of Denton, Texas, and with reasonable consideration, among
other things for the character of the district and for its
peculiar suitability or particular uses, and with a view to
conserving the value of the buildings, protecting human lives,
and encouraging the most appropriate uses of land for the
maximum benefit to the City of Denton, Texas, and its citizens.
SECTION III.
That this ordinance shall be in full force and effect
immediately after its passage and approval, the required oublic
hearings having heretofore been hold by the Planning and Zoning
Commission and the City Council of the City of Denton, Texas,
after giving due notice thereof.

GENERAL INFORMATION
Applicant: Phillip Smith

Requested Action: Change of zoning from two-family (2-F)
to Planned Development (PD) classifi-
cation.
Purpose: To pzrmit redevelopment of property as
a funeral home.
Location and Size: 519 and 529 Bolivar begins at the,
southwest corner of Bolivar and Con-
gress. The property is approximately
24,320 square feet in size.
Existing Land Use: Church and single family residential.
Surrounding Land Use
and Zoning: North - Single family residential,
two-family residential, Town
and Country Home Improvement

cial
South - Commercial mail service, sin-
gle family; two-family, Com-
mercial.

SPECIAL INFORMATION
Physical Characteristics: This tract is approximately one-half
acre in size, and is presently devel-
oped as a church on the cast portign
and a single family residence on the
west portiors. The topography is
basically flat and the vegetation
consists of grass and trees.
Public Utilities: All water, sewer and electrical ser-
vices are in place,
Transportation: This site has immediate access to Con-
ress (collector street) and Bolivar
residential street), Carroll Boule-

vard and North Elm are arterial
streets located 450 feet east and west
of this site. Parkway is located ap-
proximately 210 ff:et south of this
property.
ANALYSIS
The property at 519 and 529 Bolivar is located on the fringe of
the Original Downtown special purpose high intensity center. It
is the policy of the Development Guide that development or rede-
velopment on the fringe of high activity centers adjacent to low
density residential areas he protected by such measures as in-
tensity gradation (buffering), strict site design requirements,
transportation and land use balance and traffic planning that
insures that no local residential streets are utilized for gen-
eral circulation to the centers and specific development sites.
A mixture of land uses including single family and two-family
residential, office, commercial car sales and general retail,
surround this site, and the area beginning adjacent and north of
Congress is designated as low intensity. Although very little
or no control of intensity is proposed in high intensity cen-
ters, it is strongly rctcommended that existing housing be pre-
served and protected from adjacent proposed high intensity uses. `
This policy is emphasized throughout the Development Guide, and
it has been strongly considered, and frequently applied in cases
involving older neighborhoods.

ANALYSIS CONTINUED
Upon being informed that unrestricted general retail zoning
would be undesirable at this location, the petitioners produced
a specific development plan, and requested at the meeting, that
the Planning and Zoning Commission modify the originally re-
quested zoning change for retail, to planned development (PD)
for use as a funeral home. The Planning and Zoning Commission
accepted the suggested modification and subsequently, recom-
mended approval of the submitted site plan and the request for
planned development (PD) zoning. The specific proposal for a
funeral home use is considered most desirable because it will
not involve many significant changes in the existing characLer
of this site. A single fa,H ly residence will be removed and a
large portion of the property will be used to provide paved
parking in accordance with City of Denton standards. The pros-
pective funeral home operators have designed a plan which will
maintain practically all of the existing green space or yard
area, and the signage will not create any visibility problems.
The parking scheme is unusual when compared to standard parking
arrangements, but it has been substantiated that funeral homes
have to arrange parking in a unique manner due to the nature of
this business. Traffic will obviously increase during periods
when funerals are underway, however, police escorts are custom-
ary and this site is located within 500 feet of three arterial
type streets (Carroll Boulevard, N. Elm and Parkway). An exist-
ing living screen will be maintained along the western perimeter
of the property. It is felt that this is adequate screening be-
tween the property under consideration and the abutting residen-
tial property. It does not appear that any additional screening
is needed.
RECOMMENDATION
the proposed redevelopment of this property for funeral home use
and the modification to planned development is considered much
more reasonable than the original request for unrestricted gen-
eral retail zoning. The Planning and Zoning Commission recom-
mends approval of Z-1545 with the following conditions:

approved site plan;

Mr. Juren moved to approve 2-1543 subject to the follow-
ing conditions:
1) The single family detached areas shall be developed
in accordance with building code and zoning ordi-
nance requirements specified for single family
(SF-7) development.
2) Adequate screening consisting of a living screen or
a six (6) foot wooden fence shall be erected to pro-
tect rear of lots 2, 31 40 5, 12, 131 14, block 41
where abutting sixplexes, and lot 1, block 11 where
abutting fourplexes, when the single family area is
developed.
Seconded by Mr. Claiborne and unanimously carried. (5-0)
S. 'Z-1545. This is the petition of Phillip M. Smith
requesting a change of zoning from two family (2-F)
to the general retail (GR) classification at 519 and
529 Bolivar Street (First Church of,the Nazarene).
Mr. Ellison explained that some major changes have
been made since information was sent to the Planning
and Zoning Commission. He said that request has now
been amended from straight general retail zoning to a
planned development for a funeral home. He said no
physical chanvas are anticiated except removal of the
dwelling unit. Mr. Ellison further stated that 17
notices were mailed to property owners= five reply
forms were received in favor, none were received in
opposition. He said that two of the reply forms
originally received as being in opposition have been
changed to a favorable response after parties learned
of proposed use.
Phillip Smith, pastor of First Church of the Nazarene,
stated they have outgrown their property and want to
sell facilities and move elsewherer the purpose of re-
quested rezoning is to make property more marketable.

Monte Mason stated they are in process of purchasing
property for development as a funeral home.
Mr. Juren questioned parking plan and it was explained
by Mr. Mason and staff that funeral parking is con-
trolled systematic parking and plan can be approved
under PD.
Wayne Hunt, a trustee of the church, also stated that
church has outgrown property and would like to move.
No one was present in opposition to the request.
Mr. Ellison continued staff report stating that funeral
home is a totally acceptable use and staff is in favor
of planned development. He addressed the parking ques-
tion by stating there is nothing in the zoning ordinance
about parking standards for funeral home, however, it
was his feeling that caner would be allowed to develop
parking plan as shown. On question, he said he had not
checked with building officials. He pointed out that
green space in front of building on Congress would be
maintained; that no definite plans for a sign have been
offered, the existing sign may be retained; that a liv-
ing screen exists between west property line and abut-
ting single family residences that no further curb cuts
would be requested, that the two existing curb cuts
would be widened from 17 to 20 feet. He said site plan
is acceptable and staff recommends approval of planned
development for funeral home use.
Paving of the parking area was suggested.
No rebuttal was offered.
Chair declared public hearing closed.
Mr. Escue moved to recommend approval of planned
development subject to the following conditions:
1) That property be developed in conformance with
approved site plan;
2) That the planned development be limited to funeral
home use onlys
3) That parking areas shall be paved in accordance with
approved site plan and City of Denton specifications.

The Planning and Community Development Department has
served as staff to the City Council appointed committee
on Single Member Districts. The committee consists of
councilmen Joe Alford, Mark Chew, Jim Riddlesperger and
Ray Stephens. The basic charge to the committee was to
design single member voting districts that included
approximately the same number of persons and generally
followed existing neighborhood lines. The committee
decided early that county precinct and census tract lines
could not be followed exactly if the districts were to
have approximately the same number of people. What is
proposed generally meets the charge of the City Council.
The proposal represents a concensus of the committee. An
actual vote was not taken.

AN ORDINANCE PROVIDING FOR THE ABANDONMENT OF A UTILITY EASEMENT
WITHIN THE CITY OF DENTON AND AUTHORIZING THE MAYOR TO EXECUTE A
QUITCLAIM DEED CONVEYING ALL RIGHT, TITLE AND INTEREST OF THE
CITY IN SAID EASEMENT TO THE OWNER OF THE TRACT OF LAND CONVEYED
i BY SAID EASEMENT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Denton, acting
pursuant to law, and upon the request and petition of the
grantee herein, deems it advisable to abandon and convey the
hereinafter described tract of land to grantee and is of the
opinion that said utility easement is not needed for public use,
and that same should be abandoned and quitclatmed to Osborne
Grocery Company, a Corporation as hereinafter provided; and
WHEREAS, the City Council of the City of Denton is of the
opinion that the best interest and welfare of the public will be
served by abandoning and conveying the same to Osborne Grocery
Company, 'forth; for the consideration hereinafter more
fully set forth; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DENTON:
SECTION I.
That the following described tract of land In the City of
Denton be and the same Is hereby abandoned, vacated and closed
insofar as the right, title and easement of the public are
concerned:
BEGINNING at a point in the southeasterly sine of a tract of
land out of the N. H. Meisenheimer Survey, Abstract No. 811 as
conveyed to Joe Nichols and J. L. Ginnines by Edwin Braly and
recorded in Volume 434, Page 294 of the Deed Records of Denton
Coun'y, Texas. Said beginning point also being in the north-
westerly boundary line of State Highway In (Sherman Drivel, and
134 feet north 45040' east of the northeast cosier of a
triangular shaped tract of land owned by the City of Denton upon
which is located a water well;
THENCE north 4704S' west a distance of 35 feet to a point for
a corner;
THENCE north 4201S' east a distance of 10 feet o it point for
a corner;
THENCE south 4704S' east a distance of 15 feet more or less to
a point for a corner in the northwesterly line of said Highway

That portion of the public utiltty easement herein described
being vacated, abandoned, and closed is made suwtect to all

SECTION 1V.
This ordinance shall take effect and be in full force and

SUMMARY:
The Citizen's Traffic Safety Support Commission has recommended
installation of a school zone with reduced speed limits on West
University Drive covering both Selwyn School and Bethel
Christian Academy. These are both private schools and they
have indicated a willingness to participate in the funding of
this school zone.
FISCAL SUMMARY:
Pole bases, wiring and labor for installation can be funded
from the Traffic Control Budget, which would leave
approximately $2,000 for new flashers, time clocks and controls
to come from the Selwyn School and the Bethel Christian Academy.
ACTION REQUIRED:
Council could approve this ordinance if appropriate funding
arrangements could be agreed upon by both private institutions.
ALTERNATIVES:
Leave as is, total funding by the City or total funding by the
private institutions.
STAFF RECOMMENDATION:
Staff recommends approval of the ordinance if funds for

SUBJECT: School Zone along University Drive (U.S. 380)
The Citizen's Traffic Safety Support Commission has recommended
installation of a school zone with reduced speed limits on West
University Drive covering both Selwyn School and Bethel
Christian Academy. Since these are private schools and funds
were not budgeted in this year's budget for this zone, the
Commission recommended that the private schools participate in
the cost of the improvements.
The pole bases, wiring and labor for installation can be funded
from the Traffic Control Budget, without adversely affecting
performance standards set through the budgetary process. New
flashers, time clocks and controls will need to be purchased at
a cost of approximately $2,000 to complete this installation.
If funds for equipment are provided, the staff would recommend
this ordinance and will request the required permits from the
Highway Department.

1. Motion was made by Bernstein and seconded by Autrey TO
APPROVE THE REVISED VERSION OF THE MINUTES. Motion passed
unanimously.
2. Discussion was held concerning the request of the Bethel
Christian Academy and the Selwyn School for the marking of
a school zone on U.S. 380.
Dwight Gailey addressed the Commission stating that 174
- -students attend the Bethel Academy and that the average
speed of the cars going down 380 in front of the school is
from 50-60 mph, He requested a reduction in the speed
limit in this area and flashing lights in the morning and
at the close of school. Dr. Gailey requested a cast
estimate as soon as possible to help the City defray the
cost of the signalization, to be shared with the Selwyn
School.
Lynne Ludwig and Richard Sammon spoke representing the
Selwyn School and stated that the gravel trucks travel at a
very high speed. If cars are trying to turn left into the
Selwyn School, the trucks run up right behind the cars or
off the road wher:.3 there is no shoulder and could cause a
severe accident. Mr. Sammon stated that the Selwyn School
is open for classes in the evenings and on Saturdays, so
there is quite a bit of school traffic in the area.
Motion was made by George and seconded by Autrey to
DESIGNATE THIS AREA AS A SCHOOL ZONE WITH 35 MPH SPEED
LIMIT, MARKED WITH SIGNS AND BEACONS AND TO REQUEST THE

SUMMARY:
The major concern in this area is that children who live north
of Kings Row and east of Sherman Drive do not have adequate

Drive as school zones as a temporary solution, until sidewalks
can be built from Kings Row to Windsor Drive along the east
side of Sherman Drive.

Manual on Uniform Traffic Control Devices will require the
purchase of approximately $4,000 worth of school flasher
equipment. Funds have not been budgeted in Traffic Control for
this type equipment expenditure. Cost of materials for a
asphalt sidewalk on the east right-of-way of Sherman from Kings
Row to Stratford would be approximately $300.00.
ALTERNATIVES:
The alternatives are a $4,000 school crossing signalization, a
$10,000 concrete sidewalk from Kings Row to Windsor or a $300
asphalt sidsewalk from Kings Row to Stratford (this was not
considered at the Traffic Safety Meeting).
ACTION REQUIRED:
Council should direct staff to implement an appropriate
alternative.
STAFF RECOMMENDATIONS:
Staff recommends the $300.00 asphalt sidewalk from Kings Row to
Stratford.

As discussed at the October 20, 1982 Citizen's Traffic Safety
Support Commission meeting, the major concern is that children
who live north of Kings Row and east of Sherman Drive do not
have adequate access to Woodrow Wilson School. The Commission
has recommended designating the crossings at Kings Row and
Windsor Drive as school zones as a temporary solution, until
sidewalks can be built from Kings Row to Windsor Drive along
the east side of Sherman Drive.
Marking of the crossings in full accordance with the Manual on
Uniform Traffic Control Devices will require the purchase of
approximately $4,000 worth of school flasher equipment, Funds
have not been budgeted in Traffic Control for this type
equipment expenditure. I feel reduction of the speed limit
without school flashers is not good traffic safety practice and
would not be acceptable to the Highway Department. Besides the
expenses mentioned, having elementary school aged children
cross Sherman Drive twice is not in the best interest of safety.
An alternate solution would be to designate the route along the
east side of Sherman from Kings Row to Stratford then through
the residential area along Stratford, Avon, Heather, Churchill
and Windsor to Woodrow Wilson as the safe school route. The
east right-of-way of Sherman is cleared and mowed. A 4'
asphalt sidewalk could be installed. Cost of :materials for the
sidewalk would be approximately $300.00.
At the Traffic Safety meeting on October 20 , 1982, the asphalt
sidewalk alternative on the east side of Sherman between Kings
Road and Stratford was not discussed. Instead, a much larger
concrete sidewalk project was discussed from Kings Row to
Windsor. The cost of this alternative is greater than the
$4,000 signal alternative. In summary, the staff would
recommend that the $300.00 asphalt sidevalk alternative be
implemented. This could be done much faster than installing
any type of signals or a larger concrete sidewalk project. It
would give the children a safe residential route to school and
the cost could be funded much more easily in this years budgete

3. Mrs. Powell addressed the Commission concerning the parking
situation on Sawyer Street. She stated that the students
park on both sides of Sawyer Street between Locust and
Austin. She said that they park so close to the driveway
that she has trouble backing out and that only one lane of
traffic can get through which could be a problem if
emergency equipment had to get in or out. She stated that
Sawyer Street between Locust and Austin is the only part of
Sawyer that has parking allowed on both sides.
Wayne Autrey removed himself as a votiiig member of the
Commission. As Chief of Police at TWU he stated that
parking had become a problem on the campus due to the large
amount of construction in the area.
Motion was made by K. Robinson and seconded by Kane to
REQUEST STAFF TO CONTACT THE NEIGHBORS IN THE AREA AND
REPORT BACK AT a 1EXT MEETING WITH A RECOMMENDATION.
Motion passed unani.ao,:.ly with Autrey not voting.
4. Jim Martino, President of the Woodrow Wilson Elementary PTA
addressed the Commission concerning the routes for students
walking to school. He stated that sidewalks are on the
west side of the street which means that students must
cross Sherman Drive twice in order to use the sidewalks.
He also stated that there are no other ways for students to
get to school. Motion was made by Pernstein and seconded
by Kane to:
a. MAKE: A 4-WAY STOP AT THE INTERSECTION OF WINDSOR AND
SHERMAN
b. PUT A SIDEWALK ON THE EAST SIDE OF SHERMAN FROM KINGS
ROW TO WINDSOR
c. LOWER THE SPEED LIMIT AND ESTABLISH THE SCHOOL ZONE ON
SHERMAN AS IT WAS BEFORE AT SHERMAN AND WINDSOR AND
SHERMAN AND KINGS ROW.

5. Greg Edwards addressed tht Commission concerning the
intersection of Bell and WithErs. He recommended that this
intersection be put on flash as it meets warrants and would
be a cost savings of $160000 to $32,000 per year to the
citizens. Motion was made by Kane and seconded by K.

Consider placing the intersection of Bell and Withers on a
yellow and red flashing sequence; yellow on Bell and red on
Withers.
SUMMARY:
Since the connection of Mingo Road to Bell Avenue, we have
experienced a significant change in the traffic pattern at the
intersection of Bell and Withers, Traffic counts taken in June
and October indicate that this signal is no longer warranted.
The change in operation will improve operation of the
intersection and reduce City of Denton maintenance cost.

SUBJECT: Operation of Traffic Signal at Bell and Withers
Since the connection of Mingo Road to Bell Avenue, we have
experienced a significant change in the traffic pattern at the
intersection of Bell and 'dithers. Traffic counts taken in June
and October indicate that this signal is no longer warranted.
As you know, the Texas Manual on Uniform Traffic Control
Devices indicates that unwarranted traffic signals tend to
increase the probability of traffic accidents and increase
total driver delays at the location in question. We estimate
that changing the signal from the red/green cycle to a two-way
stop flashing mode, would reduce user costs by approximately
$2S0000 per year. This, coupled with the substantial cost of
maintaining this system, which is probably 40 years old, will
be a big savings to the citizens of Denton.
The Citizen's Traffic Safety Support Commission has also
recommended that accidents at the location be closely monitored
so that immediate reaction to any unanticipated problem can be
accomplished. We try to do this after every change, since
Traffic Control is not an exact science and genuinely
appreciate the Commission's concern for safety.
We feel the change in operation will improve operation of the
intersection and reduce City of Denton maintenance cost, which
is a hard combination to beat. 1 feel that Council acceptance
of the recommendation of the Traffic Safety Commission will be
a big step towards better traffic control in the City of Denton
and therefore strongly recommend approval.

3. Mrs. Powell addressed the Commission concerning the parsing
situation on Sawyer Street. She stated that the students
park on both sides of Sawyer Street between Locust and
Austin. She said that they park so ^,lose to the driveway
that she has trouble backing out and that only one lane of
traffic can get through which could be a problem if
emergency equipment had to get in or out. She stated that
Sawyer Street between Locust and Austin is the only part of
Sawyer that has parking allowed on both sides.
Wayre Autrey removed himself as a voting member of the
Commission. As Chief of Police at TWU he stated that
parking had become a problem on the campus due to the large
amount of construction in the area.
Motion was made by K. Robinson and seconded by Kane to
REQUEST STAFF TO CONTACT THE NEIGHBORS IN THE AREA AND
REPORT BACK AT THE NEXT MEETING WITH A RECOMMENDATION.
Motion passed unanimously with Autrey not voting.
4. Jim Martino? President of the Woodrow Wilson Elementary PTA
addressed the Commission concerning the routes for students
walking to school, He stated that sidewalks are on the
.-west side of the street which means that students must
cross Sherman Drive twice in order to use the sidewalks.
He also stated that there are no other ways for students to
get to school. Motion was made by Bernstein and seconded
by Kane to:
