ELECTION TO BE HELD ON JANUARY 15, 1983 FOR THE PURPOSE OF
I, SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY THE QUESTION OF
WHETHER OR NOT AN ORDINANCE PERTAINING TO LEGALIZING BINGO GAMES
FOR CHARITABLE PURPOSES, AS AUTHORIZED BY THE BINGO ENABLING
ACT, SHOULD BE ADOPTED BY THE QUALIFIED VOTERS OF THE CITY OF
DENT(Wt TEXA61 DESIGNATING THE POLLING PLACES AND THE HOURS OF
VOTINOI PROVIDING FOR THE APPOINTMENT OF ELECTION OFFICIALS=
! PROVIDING FOR ONE VOTING PLACHI PROVIDING FOR THE USE OF PAPER

Pursuant, to the terms and provisions of Article 179d

4 ordered held in the City of Denton, Texas on Saturday, the 15th
dAy of January, 1983 for the purpose of submitting to the
qualified voters of the City of Denton, Texas, for adoption or
rejection, the following proposed propositions

PURPOSES AS AUTHORIZED BY THE BINGO
ENABLING ACT IN THE CITY OF DEN1`0N0 TEXAS,
AGAINST LEGALIZING BINGO GAMES FOR CHARITABLE
PURPOSES AS AUTHORIZED BY THE BINGO
ENABLING ACT IN THE CITY OF DENTON, TEXAS.
SECTION II.
Said election shall be held between the hours of 700

1.(a) Don Pickens shall be the Presiding Judge at the
Denton Civic Center Voting Place.
2. Charlotte Allen, City Secretary shall conduot
' absentee voting under the Texas Election Cone.
The Presiding Judge of the Denton Civic Center shall be
authorized to appoint a sufficient number of Clerks as they may
deem necessary to assist then in said election, Including
bilingual assistants as required by law.

SECTION III.
Absentee voting shall be conducted by the Office of the City j
Secretary in the Municipal Building on East McKinney Street in ~
the City of Denton, Texas, and the polls for absentee voting
shall be open or voting in person between the hours of 800
f o'clock A.M. and 500 o'clock P.M. Monday through Friday during `
1 the tunes allowed for absentee voting.
SECTION IV. '
Said election shall be held in accordance with the Election
Code of the State of Texas, and all duly qualified resident
{I electors of the City of Denton, Texas shall be qualified to vote
j in said election.
SECTION V. !
That paper ballots shall be used in such election both for
the polling places and for absentee voting in conformance with
the provisions of the Election Code of the State of Texas.

amended, and the language to be printed and the form of the

SECTION VII.
That notice of said election shall be given by the posting i
of true copies of this ordinance, Signed by the Mayor and
attested by the City Secretary, in three public places of the

for thirty (30) consecutive days prior to the date of such
election and this ordinance shall be published in full one time
in the Denton Record-Chronicle at least thirty (30) days prior
to said election.

SECTION VIII.
The City Secretary shall make up the official ballot in j

such election printed and delivered to the presiding judge of
said election and to perform all other acts required of election
officials for such election.

That immediately after the counting of the votes the

AN ACT
2 relating to the regulation and taxation of bingo games; providing
3 penalties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. SHORT TITLE. This Act may be cited as the Bingo,
5 ;
Z Enabling Act.
SECTION 2. DEFINITIONS. In this Act:
8 (1) "Governing body" means the commissioners court with
• ~r g. regara.to a county or 'justice precinct or the city council or other
10 !chief legislative body with regard to an incorporated city or town.
11 (2) "Bingo" or "game" means a specific game of chance,
12 commonly known as bingo or lotto, in which prizes are awarded on
,
13 the basis of designated n'umbners or symbols on a cord conforming to
t` 34 numbers or symbols selected at random.
is (3) "Nonprofit organization".- means an unincorporated ~I
~
16 association or society or a corporation that is incorporated or
11 holds a certificate of authority under the Texas Non-Profit
18 Corporation Act, as amended (Article 1396.1.01 et seq., Vernon 's
19 Texas Civil Statutes), that:
20 (A) does not distribute any of its income to its members,
21 officers, or governing body, other than as reasonable compensation
22 for services;
23 for at least three years:- -
24 (1) has had a governing body or officers elected by a vote 1
25 of members•or by a vote of delegates elected by the members; or

1 (ii) has been affiliated with a state or national
2 organization organized to perform the same purposes; and
3 (C) has obtained a 501(c) exemption from the Internal
4 Revenue Service.
5 (4) .tFiaternal organization" means a nonprofit'orgini'zation

6 that is 'organized to perform and engages primarily in performing;
7 charitable, benevolent; patriotic, employment-related, or
a educational functions and that:
(A) h'as been organized for at least three years;
110 (8) has not authorized any person on behalf of its.
.11 membership, governing body, or officers to support or-oppose"a.
12 particular candidate for public office by making political
-13 speeches, passing out cards or other political literature, writing
I
14 letters, signing or circulating petitions, making campaign
15 contributions, or soliciting votes; and
16 (C) is not a veterans organization.
`17 (5) "Religious society" means a church, synagogue, or other
is organization or association that is organized primarily for
19 religious purposes and that has been in existence for at least 10
20 years. ~I
21 (6)• "Veterans organization" means a nonprofit organization
22 whose members are veterans or dependents of veterans of the armed
23 services of the United States and that is chartered by the United
24 States Congress and organized to advance the interests of veterans,
25 or active duty personnel of the armed forces of the United States y
26 and their dependents.
27 (7) "Person" means an individual, partnership, corporation,
28 or other group, however organized.

1 (8) "Volunteer fire dcp,artment" means an association that:
2 (A) operates fire-fighting equipment;
3 (B) 'is organized primarily to provide and actively' provides
4 fire-fighting services; and
5 (C) :does not pay its members compensation other than nominal
6 compbnsatJ'n.
7 (9) "Charitable purposes" means one or more of the following
$ causes, deeds, or activities to which the net proceeds derived from

the playing of bingo are dedicated:

10 (A) those that ;.cnefit needy or deserving persons in `this
it state, indefinite in number, by enhancing their opportunity for
12 religious or educational advancement, by relieving them ftom
13 disease, suffering, or distress, or by contributing to their
14 physical ,well-beinn.. by assisting them in establishing themselves`
15 in'life as worthy and useful citizens, or by increasing their
16 comprehension of and devotion to the principles on which this
17 nation was founded and enhancing their loyalty to their government,
18 (B) those that initiate, perform, or foster`', worthy public
19 'works in this state or enable or further the erection or
20- maintenance of public structures in this state;
21 (10), "Net proceeds" means:
22 (A) in relation to the gross receipts from one or more
23 occasions of bingo, the amount that remains after deducting the `
24 reasonable sums necessarily and actually expended for advertising,
25 security, repairs to premises and equipment, bingo supplies and
26 equipment, prizes, stated rental, or mortgage and insurance
27 expenses, if any, bookkeeping or accounting services according to a
28 schedule of compensation authorized by the governing body, fees for

this Act, food, beverages, janitorial
] personnel as permitted by
2 services and utility supplies and services, if any, license fees,
3 gross receipts tax, and the cost of bus taiansportation, if
Q authorized by the governing body; and
an
5 (B) in relation to the gross rent received by
6 organization licensed to conduct bingo for tt;e use of its premises
7 by`'another licensee, the amount that remains after deducting the
g reasonable sums necessarily and actually expended for janitorial
9 services and utility supplies directly attributable to the use of
t 10 the premises, if any.
11- (11) "Authorized organization" means a relicilout, society, a
12 nonprofit organization (other than an organization w}{ose membership
13 is predominantly veterans or their dependents organized to advance
14 the' interests of veterans, active duty personn'il, or' their"
]5 dependents) whose predominant activities are for th1+ support of
,
16: medical research or treatment programs, a fraternal or veterans
17 `organization, or a volunteer fire department. "i
18 (12) "Authorized commercial lessor" means a person, other I
19 than a licensee permitted to conduct bingo under this Act, who owns
~
20 or is a lessee of premises that he offers for }easing to an
21 authorized organization for the purpose of conducting bingo. The
22 term does not include:
23 (A) a person convicted of a felony, criminal fraud, or a j
24 crime of moral turpitude;

i 26 or indirect, as owner or lessor of premises offered for the purpose
{ 27 of conducting bingo; or {

1 Paragraph (A) or (B) of this subdivision or a person' married or
2 related in the first degree to much a person has greater than a 10'
3` percent proprietary, equitable, or credit interest or in which such

112 (13) "Gross receipts" means the total amount received -from

13 he'sale, rental, transfer, or use of bingo cards, the sale of food {
14 and beverages, and entrance fees charged at locations in which
is bingo is conducted.
16 (14) "Municipal secretary" means the officer of a
17 municipality who performs the duties of city secretary, regardless '
of the officer's title.
lg (IS) "Municipality" means an incorporated city or town. t
20 (16) "Political subdivision" means a county, justice
21 precinct, or municipality.
SECTION 3. AUTHORIZATION FOR GROSS RECEIPTS TAX. (a) The
22
23 commissioners court of a county that has voted to legalize bingo or
24 in which a justice precinct has voted to legalize bingo by order i
25 may impose a two percent gross receipts tax on the conduct of bingo
26 games within the county.
kk 27 (b) The governing body of a municipality that has voted to
t 28 legalize bingo by ordinance may impose a two percent gross receipts

2' (c) Any municipality within which one or more justice
3 precincts have voted to legalize bingo and which municipality has'
' 4 not voted to prohibit bingo may impose a two percent gross receipts
5 tax on the conduct of bingo games within the municipality.

g SECTION 4. ORDERING ELECTION. (a) The governing body of a
justice precinct, or municipality shall order and hold an
10 county,
ll election under this Act in the appropriate political subdivision if
12 the governing body is presented with a petition for an election
13 that meets the requiremkrnts of this Act.
14 (b) The governing body of a political subdivision may not
15 order an olection under this Act for a political subdivision
16 earlier that two years after another election on the same ballot
17 proposition was held for the same political subdivision. If a
18 petition for an election is submitted and it.is not possible to
19, order an election under this Act as req»eated by the petition
20 without violating this subsection, the petition hae~ no legal E
21 effect.
22 SECTION 5. PETITION. (a) A petition for a legalization
23 election riust have a statement substantially as follows preceding ;
24 the space reserved for signatures on each page: "This petition is
25 to require that an election be held ire (narte of political
26 subdivision) to legalize bingo games authorized under the Eingo
27 Enabling Act." A petition for a prohibitory election must have a
28 statement substantially as follows preceding the space reserved for

l0 SECTION 11. RESTRICTIONS ON BINGO CAMS. (a) The conduct
it of bingo games authorized under this Act is subject to the
12 restrictions prescribed by this section regardless of whether the
13 restrictions are contained in a local ordinance.
14 (b) A person, other than a licensee under this Act, may not
l5 lease or otherwise make available for conducting bingo,a hall or
t
16 other premises for any consideration, direct or indirect.
17 (c) A bingo game may not be conducted on or within tiny
18, leased premises if rental under the lease is to be paid, in whole
{
19 or part, on the basis of a percentage of the receipts or net j
i ~
20 proceeds derived from the operation of the game. E
71 (d) The net
proceeds of any game of bingo and of any rLntal
22 of premises for bingo shall be exclusively devoted to the
23 charitable purposes of the organization permitted
to conduct the
24 game. The proceeds of any game of bingo or of any rental may not
25 be used to support or oppose a particular candidate or a slate of
26 candidates for public office or in favor of or in opposition to any

27 measure submitted to a vote of the people.
28 (e) A prize may not exceed the sum or value of $500 in any

1 single game of bingo.
2 (f) A series of prizes on any one bingo occasion may not
3 aggregate more than $2,500.
4 (g) A person other than a member of a licensed authorized
5 organization may not conduct, promote, or administer a bingo game.
6 t (h) A person may not be denied admisol'on to a game or the
7, opportunity to participate in a game because of race, color, creed,
8 religion, national origin, sex, or handicap.
9 (1) Bingo games may not be conducted at more than one
10 location on property owned or leased by a licensed authorized
11 organization.'
12 SECTION 12. APPLICATION FOR LICENSE. (a) To conduct bingo,
13 an applicant fora license must file with the comptroller of public
14 accounts a written application in a form prescribed by the
15 comptroller, duly executed and verified, which must include:
16 (1) the name and address of the applicant and sufficient
17 facts relating to its incorporation and organization to enable the
18 comptroller of public accounts to determine whether it is an
19 authorized organization;

20 (2) the names and addresses of its officers and the plate

21 where and ,the time when the applicant intends to conduct bingo

S (5) all other items of expense intended to be incurred or

g persons 'to whom, and.. the purposes for which, they ara to be paid;

g (6) the specific purposes to which the ret'proceF:ds of 'the
10 games are to be devoted and in what manner and a'statement that the FS
]l net, proceeds will go to pane or more of the authorized charitable
12 purposes under this Act;
13 (7) e; designation of an active member or members of the
14 applicant organization under whom the game or games of bingo will
15 be conducted, accompanied by a statement executed by the member or
16 members so designated that he or they v,i11 be responsible for the
17 conduct of bingo games in accordance with the termo of the license
18 and this Act; and M
19 (B) a statement that a copy of the application has been sent
20 to the appropriate governing body and the attorney gen.ral.
21 (b) An applicant for a license to act as an authorized
22 commercial lessor must file with Cio comptroller of public accounts
23 a verified written application on a form prescribed by the
ig comptroller, which must include:
25 (1) the name and address of the Applicant;
26 (2) a designation and address of the premises intent?ed to be
,
try covered by the license Eouyht;
28 (3) the lawful capacity for public assembly purposeel

„ 1 (4) a statement that a copy of the application has been sent
2 to the appropriate governing body and the attorney general; and
3 (5) a statement that the applicant complies with the
4 specifications prescribed by Section 2(12) of this Act.
5 (c) At any time the comptroller of public accounts, the
6 governing body, or the attorney general may make a written reg"est
7 of a' commercial lessor to disclose any of the following

9 (1) the cost of the premises and appraised value for

P p Y purposes or annual net. lease refit, whichever • `is
11 applicable;
12 (2) gross rentals received and itemized expenses for the
13 Immediately p.-,zceding calendar or fiscal year, if any;
14 (3) gross rentals, if any, derived from bingo during the
15• last preceding calendar or fiscal year;
,16. (4) the computation by which the proposed rental schedule
17 gas determined;
18 (5) the number of occasions on which the applicant
I 19 anticipates receiving rent i'
for bingo during the ensuing year or
20 shorter period if applicable and proposed rent for each such

21 occaaion;

22 (6) estimated gross rental income from all other sources
23 during the ensuing year; and

{ (7) estimated expenses itemized for the ensuing year and the ,
' 25 amount of each item allocated to bingo rentals,
26 (d) An authorized organization may receive a ~ temporary

f 27 li:ense for the conduct of bingo games on filing with the
1 28 comptroller of public accounts an application, on a form prescribed
