Tho staff is punting a list of necessary items together that would need to be included in the design of any such park. We are also going to request that the City Attorno y contact the attorney for the State School to Cind out any legal restrictions. Various restrictions will also be highlighted in this proposal which concern the impact this area will have on m r budget and on our matnte.nnace abilities. There will be impacts not only on this yentts budget but also items which w11 have to be purchased in the next budget year as well to get the park area in shape, We hope to liave both the park design and costs as well as legal and budgetary restrictions worked out and a proposal developed by our park board meeting of March 7.8, 1983, 1 r.. This does not include a small pond in the area, The neighborhood representatives propose a play area to be established with playground equipment, a small back stop for informal baseball gameu and a small picnic area. A small parking area would be established off State School Road and an entrance for pedestrians would be established off Brighton Road, At this time, discussions with the State School Administrator are favorable and the possibility exists through the inter-local act of state law. The Parks Division will estimate construction and maintenance costs to estau lish this proposed park as requested by the parks and Recreation Board. .--b , SCULDULE 'FOUR OF PARKS: Steve will schedule this tour to be utt June 18, 1983. We will probably maintain various programs of this year carrying thew over through next year. There will also be supplemental programs, such as the Briarcliff request. The Council and Commissioners heard a presentation First 'texas medical, Incorporated relating to the sale of Flow aemorial Hospital, Me, Dean Davis, Lawyer for First Texas Medical, lncorp~srated, reported that 'T'exas had experienced tremendous growth and it was imperative to plan for future health care in the 1980'a and beyond. First Texas Medical, Incorporated would present a proposal regarding health care for Denton County which would address the issues of. future liabilities, equipment needs, and indigent care. Dr. H. Darrell Lvmr.vs, President of First 'Vexes Medical, Incorporated, presented a booklet outlining a yease proposal to the City the County. The proposal included buying the assets and paying County bond payment. Proposed was an immediate infusion of working capital for nse equipment to be used at the existing facility for 5 ~ears while a now hospital was bein constructed, Mr. Lummus stated ',,it hospital charges would remain competitive and prssenteo a comparison cf charges for Lewisville Memorial Hospital and Berea facilities, LummUe stated the City and County could continue with the system as it now exists or could lease the facility to first Texas Medical, Incorporated, the three peoposala included in the proposal were an exchange agreement, a lease agreement, an.S an indigent care agreement, Council Member Kiddlesperger asked Fir. Cox if any hospital in U,llas was in compliance with the Texas Health Uapartmont codes, Mr. Cox replied that he did not know. Kiddlesperger askeo it the cost to patients would be reduced is the City did not tax, Mr. Lummus stated this aid not show to be true. Kiddlesperger asked who paid for indigent care. Mr. Lummus replied that traditionally the County has paid. Council Member Chew asked who decided which persons quaLified for indigent care. Dr. burgess answered that this was a very sensitive area. Guidelines exist in the ;octal service area, such as tiedlcare. Council Member Stephens asked who selected the membera of the citizens advisory board for Flow hospital. and what would be the criteria for selection, Mr. Lummus answered that the existing board would be used an. the criteria for selection would be developed over the next 5 years. II, Capital Improvement Program (CIP) The CIP of the City consists of a five year plan that is up- dated yearly, The Plan is prioritized by such policy 6uide- lines as; (1) Demand for services as compared to other areas based partly on density of population, magnitude of problems compared to other areas, established technical standards and professional studies, and natural or technical restraints or opportunities, (2) Impact on the balanced growth policy of the city, (3) Impact on overall city economics, The annexed area will be considered for CIP planning in the upcoming CIP plan, which will be no longer than one year from the date of annexation, In this new CIP planning year the annexation area will be judged accordingly to the same established criteria as all other areas of the city. During the pr,,IOot's first year of operation, 14B% of the projected goals were reached. This represents a considerable amount of effort on the part of the people involve: in the unit, Ono of the most notable projects is our neighborhood watch program. We projected that 45 neighborhood watch groups would be implementej during the year. Actually, 97 groups were formed and are now active. The second year continuation grant has boon awarded and will begin Marcia 1, 19S!, This resolution is for thQ third year continuation which would begin March 1984. Taylor - City Attorney RESOLUTION A RESOLUTION by the City Council of the City of Denton, Texas, relating "o the issuance of Bonds by the North Texas Higher Education Authority, Inc.; approving the' issuance of one or more series of Bonds) and making certain findings in connection therewith, WHEREAS, this governing body, requested certain individuals to proceed to re-organize and re-establish a non-profit, corporation pursuant to the Texas Non-Profit Corporation Act, for the purpose of furthering educational opportunities of students by providing funds for the acquisition of student loans; that such has been accomplished, the corporation being known as the "North Texas Higher Education Authority, Inc,"; and WHEREAS, the North Texas Higher Education Authority, Inc,, has proceeded in the development of a plan of doing business and it is now appropriate for this governing body to approve the actions taken; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS: SECTION I, This governing body has been advised by the North Texas Higher Education Authority, Inc., (the "Corporation"), that such Corporation upon approval thereof by the governing bodies of the Cities of Denton and Arlington, Texas, proposes to issue revenue bonds; that such bonds would be initially issued as one or more series of Bonds (col- lectively, the "Bonds") in the aggregate principal amount of up to $50,000,000, and that such bonds would be payable from and be secured by a pledge of revenues derived from or by reason of the ownership of student loan notes and investment income after deduction of such expenses for operating the loan program as may be specified by the bond resolution or trust indenture authorizing or securing such Bonds and the payment thereof. The Bonds (up to the aggregate principal amount of $50,000,000) ar% issued to obtain funds with which to purchase Student Loan Notes which are guaranteed under the provisions of the Higher Education Act of 1965, as amended, to establish certain reserves and for the purpose of paying certain expanses, SECTION II. This governing body hereby approves the issuance and delivery of such Bonds for the purposes aforesaid, and in this connection requests that the said corporation exercise the powers enumerated and provided in Section 53.47 of the Texas Education code, that such non-profit corporation shall, in this connection, exercise such powers for end on behalf of the City and the State of Texas, as contemplated by Section 53.47(e) of the Texas Education Code. SECTION III. The City does not agree to assume any responsibility in connection with the administration of this student loan program; it being understood this responsibility is being • assumed by the Corporation. SECTION Iv. It is recognized by this governing body that the instruments which authorize the issuance of bonds by the Corporation will specifically state that this City is not obligated to pay the principal, of or interest on the Bonds proposed to be issued by the corporation. Nothing in this resolution shall be construed as an indication by this City that it will pay or provide for the payment of airy obliga- tions of the said Corporation whether heretofore or hereafter ineurr-:d, and in this connection, attention is callod to tLe Constitution of Texas wherein it is provided that a city may incur no indebtedness without having made provisions for its payment, and this City Council hereby specifically refuses to set aside any present or future funds, assets or money for the payment of any indebtedness or obligation of the Corporation. Chris Hartung, City Manager FROM= Hugh Lynch, Chief of Police SUBJECTr Video Equipment Needs DAM September 21, 1982 In response to your request for the Police Department'" video equipment needs, we have checked with various manufacturers. Panasonic has what we think would be the best type equipment for our needs at a cost of $7,125, Purchase of this system would allow videotaping of D.W.I. cases and major crime scenes, and it could be adapted to servo as a Department training air:. Until approximately a year ago, the Department of Public Safety maintained a breathalyzer instrument in our facility which was very convenient for our user however, with the change-over to the new intoxilyzor unit, the space we have available can no longer accommodate the larger unit. Conseq+rently, the intoxilyzer had to be placed in the Sheriff's office, and this arrange- ment has not worked very well for convenient usage. With this situation ill mind, we have allotted space in our now facility and have obtained approval from the D.P,S. Chemical. Testing Supervisor for the placement of the intox- ilyzer unit in this area. The addition of videotape capabilities would be well received by officers and prosecutors for obvious reasons. Currently, 15 to 20 D.W.I. cases are being filed per week with the D.A.'s Office, which includes all other Denton County law enforcement agencios' cases, These statistics Vould indicate that use of a video instrument could be invaluable in many court proceedings. Introduction of this equipment, coupled with the change in location of the intoxilyzer, may also increase tho enforcement actions by ofricers on D.W.T. cases. While it would be extremely difficult to project usage of videotape on ma or crime scenes, I would think that 10 to 15 filmings would not be out of the ordinary in a 12-month period. Hopefully, this will give you some idea of the usefulness of the equipment and costs involved, which are necessary for your recommendations. If I can be of further assistance, please let me know. Last May, when the contract was entered into, the scope of work and the estimates for the cost were $3,000 for the preliminary study with an additional $25,000 for the preparation of the fina draft copy of the application. As you may recall. for the initial, or the preliminary study cost approximately $500 over the $3,000 Limit-, this latest bill makes the total contracts c .at $30,471.44. At. this point, repr.esentati-,-es from HDR, do not forsee any further costs, except for appearance at the public hearings and/or any other further engineering work -hat the Texas Department of Health may want. It wiLi Lake about one month for these to be sent: out with the utility bills. There have been several additions to the program. There will be three sports .:amps, and we will try to add one or two per year in the future. We have gone to one-hale day programs at each location. They will be from 9:00 A.,M. until. 12;00 noon at.. ' That Section 15-7(c) of the Code of Ordinances of the City of Denton, Texas, 1?611` as amended, is amended by deleting tht present Section 15.7(c) and enacting a now Section 15-7(c) heroin renumbered as Section 1S-6((:) which shall hereafter read as follows: f•.l Bring In or du.np deposit or leave any bottles, broken gttass, ashes, paper, boxes, cans, dirt, rock, rubbish, waste, wood, garbse, refuse or other household or commercial trash, containers, equipment or appliances, No such refuse, trash or other materials shall be placed In any waters in or contiguous to any park or left anywhere on the grounds thereof, but shall he placed lit the proper receptacles where provided, and if not provident, all such rubbish, trash or waste shall he carriad away from the park by the person responsible for its presence and properly deposed of elsewhere. SECTION Vt. That Section 15.7 of the Code of Ordinances of the City of Denton, Texas, 19661, as amended, and heroin rentanhored a.s Section 15-6 is hereby amended by adding thereto a new Sectio,i IS-6(e)) (f), (g), (h), (t) and (j), which shall hereafter read as follows: (e) bring in or d.imp, deposit or leave any noxious, hazardous or flammable materials or substances, either solid or llanid, on park property. (f) Start or maintain a fire In a park except in a firoplaeo or grill at it site deslgaatod by the Parks and Recreation Department; to Leave the park without extinguishing a Ciro started or maintained by that person; to burn wood found In the nark, or to deposit hot coals In trash receptacles. (g) Camp in a park other than an area designated by and with the written permission of the Parks and Recreation Department. (h) Possess, bring Into or discharge in a onrk arty firearm, atr or gas operated guh, how, crosshow or other missile throwing device. (,I) Move or carry away any sod, sand, earth, tree, wood, shrub, flower or other landscaning In .a park, or to trampPle, injure or destroy plant naterlal and park fl.etures or faciI[ties. (yl Hit a golf ball in a park- except In aeons designated by the Parks and Recreation Department. PAGP ? k. No person shall take any fish or other aquatic life from park water areas by any means except a nook and line using natural or artificial bates, All nets and seines are prohibited, SECTION VII, That Section 15-7,5 of the Code of Ordinances of the City of Denton, Texas, 1:66, as amended, and herein renumbered as Section 15-7, is amended to hareafter read as follows: Section 15-7. CONSUMPTION OF ALCOHOLIC BEVERAGES PROHIBITED IN PARKING AREAS, Within the limits of any public park within the City, It shall be unlawful for any person to consume any alcoholic beverage in a parking lot or area when such parking lot or area are adjacent to a reccoation center or facility. Recreation center or facility as used i,erein shall mean a public ouilding, structure or improved area used for any type of rucreationai activity, and shall include but not be limited to swimming pools, basketball courts and tennis centers, SECTION VIII. That Section 15-8 of the Code of Ordinances of the City of Denton, Texas, 1966, as amended, is hereby deleted, SECTION IX. That Section 15-9 of the Code of Ordinances of the City of Denton, To::as, 1966, as amended, is herein renumbered as Section 15-8, and amended to hereafter read as follows: Section 15-8, CITY PARK CLOSED DURING CERTAIN HOURS. The City parks shall be closed to the public between the hours of ton o'clock p.m. and six o'clock a,m. on the following day, and it shall be unlawful for any person to enter or be found in City parks between such hours, except for events approved or, scheduled by the Parks and Recreation Department, SECTION X. That Section 15-10 of the Code of Ordinances of the City of Denton, Texas, 1966, as amended, is herein cenumherad as Section 15-9 and amended to hereafter read as follows: yhe violation of any provision of this chaptor shall be deemed an offensse and be punishable by a fine not to exceed Two Hundred Dollars ($200,00) and each violation thereof shall be and is hereby deemed to be a distinct and separate offense and punishable as such, ~.4C1' SECTION XI, That if any aeotion, uubsection, paragraph, sentence, clause, phrase or word in this ordinanco, or aFplieation thereof to any person or circumstance is held Invalid by any court of eo,opetent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it WOU id have enacted sucn remaining portions despite any such invalidity, 3ECTION X1I, That this ordinance shall become effective fourteen (14) days from the data of ita passage, and the City Sacretary Is Hereby dirented to cause the caption of this ordinance to be published twice in t,.q Denton Record-Chronicle, the official newspa:.er of the City of Denton, Texas, within ten (10) days of the date of Its passage.
